A plea to all the Human Rights organisations by the Tamil Political Prisoners.
We, the Tamil political prisoners hereby make the following requests.
Taking into consideration the present situation, your organisations should work together to transfer our cases to the courts in the North and East and to release us on bail. We request that these organisations should recommend to the government that we too should be released under certain conditions in the same way as those who took part in the war were rehabilitated and released.
Many of us are heads of families and others have the responsibility to carry the family burden. The long periods of time we had been held under detention have severely affected the our children’s education and their mental state. It does not appear that our solicitors are making much effort to bring our cases to a speedy conclusion. Day after day our cases continue to be postponed.
We would like to describe the problems we face and those we faced during enquiries while we were in remand prison.
We are being subjected to torture during questioning. We like to make you aware of the nature of those ill treatments.
Hanging with the thumbs tied behind the back; Twisting the arms at the back after applying hand-cuffs; Hitting hard on the sole of the feet with strong iron bars or poles while being forced to kneel. This is the one that continues to keep many in agony.
Torture by inserting the penis into a table drawer and crushing it by closing the drawer. There are many who are still suffering from the effects of this action.

Adding a few drops of petrol in a polythene bag and tying it round the head covering the face and attacking the prisoner till he becomes senseless. This has affected the eye sight of many.
Implements used for such attacks:
Wire, Hose pipes, Wicket sticks, Cycle chain, Black cloth, Head pins and many other weapons were used and are being used during torture.
Torture using hands, legs and sticks; Turning a brush after inserting into the anus; Hitting on the head using a board with nails; Hanging upside down with the legs tied together. These were some of the methods used during interrogation.
There are many who have been affected by such severe torture. Loss of sight; Spinal injuries; Constant Head ache; Inability to walk due to injury to the feet are some of the ailments we continue to suffer due to lack of medical care.
The Police Commissioner employing his henchmen has used coercion forcing us to sign statements written in Sinhalese. Using people with inadequate knowledge in languages to record statements has resulted in the truth being hidden and the prisoners were subjected to false accusations and thus to suffering.

Torture Continues....
Severe torture has been used against women prisoners too and some of them are mentally affected as a result. During the interrogation they have been subjected to severe humiliation by the use of degradingly foul language which has caused them severe mental distress and are spending their days in a sorry mental and physical state.

They suffer in the courts, unable to follow the procedures because the language used in courts is mainly Sinhalese. There are many children between the ages of 3 and 5 who stay with their mothers, having been robbed of their right to education. This too has caused mental problems among children.
Relatives who come to visit those of us who are suffering in detention centres are compelled to buy their goods in the canteen belonging to the Prisoners Welfare Society. As these goods do not meet their standards of hygiene, quality and measure, they are unwilling to buy these goods thus depriving us of items they wish to supply. This causes great hardship to those coming from distant places from the North and East.
Insults and abuse from the armed forces personnel still continue, who render us naked while doing a search and use degrading foul language against women prisoners. This is prevalent in Welikade Prison in both male and female sections, Colombo Remand prison and Magazine prison.
There are detainees who have been living here for long periods from 5 years to 18 years like the longest detainee Singarasa from Batticaloa. There are no proper facilities in the prison to meet the children and the family. We are prevented from receiving food items brought from distant places. We are ignored during special religious days or celebrations.

There are many in prison today who are here for crimes they have not committed, because of torture. Because of postponement of cases and the lack of facilities to conduct these cases there are many who are compelled to accept guilt. More than that due to the inability to pay for the attorneys (mostly in Colombo courts) we have been detained in insufficient spaces packed like sardines. Because of this many are suffering from infectious diseases.
Many investigating officers have fraudulently extracted large sums of money from the families under the pretext of facilitating the release of their children thereby rendering them destitute who are unable to find the next meal and loss of education of their children.
When transported to the courts along with the suspects from the major community who were involved in serious crimes, these political prisoners suffer mental anxiety and had been targets of sexual misbehavior. They suffer further when they are detained in detention centres along with hardened criminals from the major community who use or smoke banned substances like heroine, weed etc.
Those who have lost the use of legs, hands, sight, paralysed below the waist due to injury to the spine, and those who carry shrapnel in their body having been caught up in cross fire or artillery rounds suffer with various ailments. There are many who continue to suffer in prison due to lack of proper medical treatment or care.

The practice of imprisoning various anti-social elements together is continuing in many prisons. Due to lack of proper medical care, when one falls ill, it escalates into various other forms of manifestations and makes the suffering worse.
There are in prison now, those who were released at the end of their cases or after rehabilitation who were re-arrested. It is a matter of deep sadness that no action had been taken against such practice, though it was brought to the notice of the courts and to high officials in the government.
Therefore it is very important that the various organisations involved in human welfare and humanitarianism show an interest in our situation. We humbly request that you offer your support to create the conditions to release us from our sufferings and offer us an opportunity to join our families and live with them. All what we have said here is a reflection of our sufferings.
We are spending our life in such dire circumstances. We believe that you will show more interest as it is your field of special responsibility. In addition we request you to speak to the government to resolve this situation in order to transfer our cases to the North and East and to be eligible for bail, (general amnesty).

53 Tamil political prisoners were murdered during an attack in Welikade Prison in 1983.
9 Tamil political prisoners were murdered and 4 were injured during an attack in Boosa Detention centre in 1987.
5 Tamil political prisoners were murdered during an attack in Kalutara Prison in 1997.
Mr Emil Niranjan, who was appointed as the Superintendent of Prisons in charge of Magazine Prison at present, took a very active part in the attack against Tamil political prisoners who were involved in a non-violent action (Fasting) in the same prison in 1997. 10 Tamil political prisoners were injured.
In the attack against Tamil political prisoners in Kalutara prison in the year 2000 2 Tamil political prisoners were killed and 100 were injured.
In 2001, in the attack against the Bindunuwewa rehabilitation camp, the Sinhalese people who were living around it burnt it down, including 27 Tamil detainees.
In the attack against Tamil Political Prisoners in Magazine prison J Section on 13.11.2011 10 Tamil Political Prisoners were severely hurt.
A large number of Tamil political prisoners were attacked in Anuradhapura prisons in 2011
8 Tamil political Prisoners were hurt in the attack in Bogambara prison in 2011.
In 2011 Tamil Political prisoners who went to talk to the Prison officials in Badulla prison about problem with their water supply were severely beaten by the officials. 3 were hurt.
6 Tamil political prisoners were hurt during an attack in the Colombo Remand prison E division 13.09.2011.
On 24.01.2012 during a clash between the Sinhalese prisoners and the Officers in the Colombo Magazine prison 11 Tamil political prisoners were beaten and dragged away. Their whereabouts remained unknown. It later came to be known.
The above incident happened only a few days after Emil Niranjan took charge. The situation in the prison is still volatile.
There are many other murders that have not come to light.
The recorded number of murdered Tamil political prisoners is 96.
The recorded number of Tamil political prisoners severely hurt is 152.

Dear All well wishers
This urgent appeal is addressed to Tamils across the world and those who sympathize with the plight of the Tamil people. Many international human rights organisations highlight the dismal nature of the many thousands of political prisoners held in Sri Lanka, mostly without charge or access to legal representation. In many ways, we feel as if the world has forgotten us and our pleas for help have fallen upon deaf ears. A select few of us have decided to seek help and streamline the collective support that existed at the beginning of 2011. It was this collective cooperation of all interested and sympathetic parties that led to the creation of the Tamil Political Prisoners Welfare Association on Thai Pongal in 2011. Since the date of creation, we have achieved a great deal and here are some highlights of those achievements:
-Legal costs were solicited by the association for over 50 prisoners - prisoners that without any help would have remained in legal limbo for many more years to come. Rs 655,000 was successfully arranged for this purpose in 2011 and in the coming year we expect to incur the costs of even more prisoners, totaling approximately Rs 1,000,000. Legal representation should be afforded to every prisoner, not just those who can afford it.
-We have assisted with the educational costs for over 30 pupils from 14 families of prisoner's since our creation. In the coming year we hope to help over 100 pupils from as many as 50 families at the cost of Rs 1,200,000. Education should be afforded to every child, despite the situation their parents may be in.
-We have also assisted prisoners who do not receive any visits. Numerous prisoners have benefited from this scheme, costing us Rs 39,000. We hope to expand this programme with an estimated cost of Rs 60,000 for the coming year.
-Some of the prisoners families helped with the set up of small home base industries costing approximately Rs 215,000. We have as many as 10 further requests for help requiring approximately 700,000 in the coming year.
We appreciate the time you have taken reading our achievements and we hope you see the immense progress that has been made to date. With the support of the Tamil community and beyond, we can assist many more prisoners and ensure no one is forgotten. We thank you for your support.
