Gananath review shows nations divided in perception

“I will confess that, as I write this essay, many do see him [Rajapaksa] as someone who “saved” the nation from the brutal LTTE. Surely such a view is not without its truth. But that truth cannot excuse human rights violations that currently afflict the nation as a whole; or for that matter obscure the looming threat of the cultural and political colonisation of the north by the Sinhala Buddhist majority,” writes Gananath Obeyesekere, in reviewing a recent book on Sri Lanka. Commenting, a Tamil academic said Gananath’s reference to ‘nation’ in singular confines to the Sinhala nation, for despite differences of opinion on ways and tactics, many Eezham Tamils see the LTTE as something that was checking brutal genocide by the Sinhala state. The divided perception is sign of nations in plural, justifying their separation even for reconciliation in future, the Tamil academic said.

The divided perception is striking, especially when it comes from a veteran Sinhala scholar like Gananath Obeyesekere, pointing to no way other than separation to the affected nation of Eezham Tamils, even to stop the “cultural and political colonisation of the north by the Sinhala Buddhist majority,” referred to by him.

Conspicuously, Gananath left out the East, where the process was going on for a long time, preceding the current structural genocide in the north.

Professor Gananath Obeyesekere’s book review on “The Sri Lanka Reader: History, Culture, Politics”, edited by John Clifford Holt and published by the Duke University in the USA, appeared in Mumbai-based Economic and Political Weekly, dated 28 January, with the title “Biased and Prejudiced Collection on Sri Lanka.”

The editor of the book, Professor John Clifford Holt is a leading historian of religion in the USA.

Gananath Obeyesekere, now 82-years old, is Emeritus Professor of Anthropology at Princeton University in the USA. Hailing from a village in southern Sri Lanka, he left the island permanently after the JVP insurrection of 1971. Before that he served in the University of Ceylon at Peradeniya in Kandy.

In the review Gananath didn’t fail to make a comparison between the genocidal war and the state’s suppression of the JVP insurrection:

“Violence in recent times is not simply confined to the long war and its suppression, but also relates to the brutal Janatha Vimukthi Peramuna insurrection of Sri Lankan youth in the late 1980s and the equally brutal suppression by the then government of President Premadasa in which it is estimated that about 60,000 people were killed. Even if we reduce this official estimate to 20,000 dead, we are confronted with a searing commentary on violence by Sinhalas against Sinhalas, an issue that Holt does not discuss,” Gananath says.

But the stereotype comparison brought out by many Sinhala and Indian academics, keen in state reformation by keeping state as one in the island, misses the qualitative difference between a protracted genocidal war by a majoritarian state and the state of the Sinhala nation handling an insurrection within its nation.

The comparison makes little justice to the future plight of the nation of Eezham Tamils facing sure annihilation if nothing appropriate to the national question is done right now.

Even in making a comparison, many other Sinhala academics and journalists (not Gananath), have a habit describing the events related to JVP as ‘insurrection,’ but calling the LTTE’s resistance as ‘terrorism’– once again exhibiting the difference in the perceptions in the nations.

This review to the review has nothing to say on the book in question. Many books come nowadays from publishers in the USA and New Delhi, aiming at the orientation of students of South Asian Studies.

But the responses of Gananath, the professor of anthropology known for his psychoanalytical approach, gain particular significance in gauging Sinhala elite opinion – what the most reasonable of them think on accepting Eezham Tamils as a nation needing its own right of self-determination.

Eezham Tamils also carefully watch what Gananath’s Tamil contemporaries like Prof Sivathamby had finally concluded with the ‘Kohomba Kangariya’ model, but in contrast, what the sceptics of the university academics like the creative writer S.Ponnuthurai (Es Po) continue to say on the issue.

Leaving apart the one-nation-outlook, which itself is a colonial legacy, Gananath has come out with many other valuable observations in the review.

The review points out that alongside the brutalities, “Sri Lanka is proud to be the first or the near first in other areas: it has maybe the highest rate of suicides in the world, followed by equally horrendous homicide rates. And if one can rely on official statistics the nation’s Sinhala and Tamil males are among the largest consumers of alcohol in the world, assuming, of course, that most Muslims and women in general abstain from alcohol or are only moderate consumers. Violence against women, sexual abuse of children and multiplying cases of incest (owing to absent women working in west Asia) that have been highlighted in recent times do not merit mention anywhere in this collection.”

Gananath’s review exposes the kind of NGO ‘development’ that are promoted in the West as solutions to the problems in the island:

“The editor has chosen an essay “Sarvodaya in a Buddhist Society” by Ariyaratne, the Sarvodaya chief, who attempts to produce a Buddhist version of socio-economic and political development. Ariyaratne, in his numerous publications, seriously believes that, prior to western contact, Sri Lankan villages expressed Buddhist ideals and lived harmonious lives where inequalities did not prevail. Such an idealised model of village life simply did not and could not exist in Sri Lanka or elsewhere in the world. I doubt that Sarvodaya has made the slightest impact on the issues that I have highlighted, including matters relating to peace and human rights violations following the end of the long war,” the review observed.

“The editor believes that the Vädda hunters or “people like them” had lived here for perhaps “millennia” without offering a scrap of evidence to substantiate this vision of history and without examining whether such groups or so-called tribals, like many other south Indian peoples, continued to migrate into Sri Lanka from the neighbouring subcontinent. All of us after all have been “aborigines” at some point in our unknown pasts,” Gananath said.

Prof. Obeyesekere made a revealing observation on the British historiographical version on the last king of Kandy, Sri Vikrama Rajasinha of Tamil–Telugu origin.

“It is as if the editor has accepted uncritically Davy’s account, including the king ordering the wife of his enemy Ähälepola to pound her infant child on a mortar, a myth that the Sri Lanka historian P E Pieris has effectively deconstructed, pointing out its colonial origins in “The Tragedy of Ehelepola’s Family” (pp 175-85 in Tri Sinhala: The Last Phase).”

“There is no doubt that this was a time when a great deal of brutality prevailed on both sides of the warring divide, but one must remember that the last king built the beautiful “palace of the tooth relic” and the adjacent lake in Kandy and that he was popular with many sections of the Sinhala population,” Gananath observed.

“The story of the English rule in the Kandyan country during 1817 and 1818 cannot be related without shame. In 1819, hardly a member of the leading families, the heads of the people, remained alive; those whom the sword and the gun had spared, cholera and smallpox and ¬privations had slain by hundreds,” Prof. Obeyesekere cited a British judge writing in 1896, to show inadequacies in Holt’s book when it deals with the British colonial period.

Gananath, admitting his own prejudices against colonialism, says in the review, “The Pax Britannica that followed the rebellion [Kandyan rebellion] was initially erected on a terrifying base in Sri Lanka as it was in other lands that the empire subjugated”.

Even though unsaid, Prof. Obeyesekere brings in here the parallels to be understood on what is taking place in the country of Eezham Tamils, enacted by the agent state of Sri Lanka and by its imperial masters.

Louise Frechette, a Canadian official who chairs the special advisory group (SAG) at the United Nations in New York, said in a statement released at the UN Head Quarters today, that she has advised Major General Shavendra Silva of Sri Lanka, that "his [Silva's] participation is not appropriate or helpful for the purposes of this Group [SAG]. He [Silva] will not participate in its deliberations." Shavendra Silva, who was recently rescued from a civil litigation in a New York court over war-crimes allegations, is the second Sri Lanka Military Commander, after deputy Counsel in Sri Lanka’s embassy in Germany, Jegath Dias, to be barred from high level positions outside SriLanka for alleged complicity in war-crimes against Eezham Tamils.

Frechette is a former UN deputy secretary general and top Canadian diplomat who was named by Ban to chair the committee.

"If Frechette had not acted this panel would just have fallen apart, nobody wanted him on the panel," said one diplomat, speaking on condition of anonymity, AFP said in its coverage of Shavendra Silva's ouster from the UN Advisory Group.

Silva's nomination was strongly condemned by Human Rights Watch and other rights groups. UN human rights chief Navi Pillay also wrote a letter condemning the appointment.

But the UN secretariat had previously said it could do nothing about Silva's appointment as it was decided by member countries.

However, Professor Boyle, an expert in International Law, debunked this excuse in an earlier note to TamilNet, where he said, "Ban to appoint a presumptive war criminal to his Staff would be ultra vires his powers under the terms of article 101(3) and thus a violation of the Charter itself."

Inner City Press (ICP) which mounted a sustained campaign of questioning the evasive UN spokespersons on Silva's appointment, had noted Silva attending the SAG meeting mid-morning and had sent a formal question to the UN Department of Peacekeeping Operations, about where the meeting was and who attended.

Frechette's Press statement announcing the "dismissal" of Mr Silva followed ICP's inquiry.

ICP quoted several paragraphs, including the following, from the UN Expert Panel's report that pointed to alleged complicity of Shavendra Silva in committing war crimes in Sri Lanka:
    In Paragraph 62, Silva appears: "six major battalions were active in the final stages of the war, including... the 58th Division (commanded by Brigadier Shavendra Silva)." 90. Fighting in the area intensified as part of the expressed efforts by the 55th and 58th Divisions to capture PTK by 4 February... in the week between 29 January and 4 February, PTK hospital was hit every day by MBRLs and other artillery, taking at least nine direct hits. A number of patients inside the hospital, most of them already injured, were killed, as were several staff members. Even the operating theatre was hit. Two ICRC international delegates were in the hospital when it was shelled on 4 February 2009. The shelling was coming from SLA positions. 92. The GPS coordinates of PTK hospital were well known to the SLA, and the hospital was clearly marked with emblems easily visible to UAVs. On 1 February 2009, the ICRC issued a public statement emphasizing that "[w]ounded and sick people, medical personnel and medical facilities are all protected by international humanitarian law. Under no circumstance may they be directly attacked."

In a show of solidarity to genocidal Sri Lanka, on the eve of UNHRC sessions in Geneva, military officials of Iran, Russia and Bangladesh visited Jaffna exclusively for meeting the occupying military of Sri Lanka in the peninsula, on Tuesday and Wednesday, news sources in Jaffna said. The visiting military delegates didn't meet the public, but were taken to showcase the ‘rehabilitation’ of ex-LTTE cadres and to see the Nalloor temple and the Buddhist Naga Vihara at Nayinaa-theevu. On 05 February, SL President Mahinda Rajapaksa, secretly inaugurated China-involved power generation project along the northern coast of Jaffna. The inauguration completely hushed to the knowledge of media, took place in a SL naval base at Maathakal, near the KKS harbour.

Meanwhile, SL Defence Secretary and presidential sibling Gotabhaya Rajapaksa, is scheduled to visit Jaffna on Friday to visit the ‘rehabilitation’ facilities of the former LTTE cadres and to open a three-storey building at Mahajana College Thellippazhai (close to KKS), which is claimed by the SL defence secretary as a ‘personal gift’ of him and his ‘friends’. Earlier, there were reports on the personal involvement of Selvarasa Pathmanathan alias KP in the building venture.

The military delegates of Iran, Russia and Bangladesh visited Kayts harbour in the islets off Jaffna, on Tuesday, ostensibly to see the crab farm of the LTTE cadres under ‘rehabilitation’.

Kayts is the traditional port town that had close contacts with the Indian coast on the opposite side of the Palk Bay.

A few days ago, Bangladesh had shown extra-ordinary interest in bailing out Sri Lanka from the Shavendra Silva case at the UN. Bangladesh advised Sri Lanka on its own to withdraw the candidature of Silva to avoid diplomatic embarrassment. News reports said that Pakistan and India were also together along with Bangladesh in advising Sri Lanka on the Silva case.

As a US war hanging in balance with Iran, the Iranian delegation visiting Jaffna along with Russians and China's manoeuvrings in the island gain significance, observers said.

A few days ago, the diaspora of Balochistan accused that SL President Mahinda Rajapaksa held secret talks with Pakistan on Sri Lanka providing military expertise in facing the armed struggle of the Baloch independence movement.

In the meantime, SL High Commissioner in New Delhi, Prasad Kariyawasam, on Thursday, speaking at a function in Gujarat categorically opposed any third-party regional intervention in the Maldives. But, news sources in Colombo indicated that Sri Lanka is thinking of sending a military contingent to Maldives, ostensibly to protect its High Commission there.

சென்னை, பிப்.23: வங்கிக் கொள்ளையர்களை போலீஸார் சுட்டுக் கொன்ற சம்பவம் குறித்து உயர் நீதிமன்ற நீதிபதி தலைமையில் விசாரணை மேற்கொள்ள வேண்டும் என மனித உரிமை ஆர்வலர்கள் வலியுறுத்தியுள்ளனர்.மேலும் இந்தச் சம்பவத்துக்கு அவர்கள் கடும் கண்டனத்தையும் தெரிவித்துள்ளனர்.மனித உரிமை ஆர்வலர் அ. மார்க்ஸ்:வங்கிக் கொள்ளையர்கள் மீது நடத்தப்பட்டுள்ள இந்த என்கவுன்ட்டர் தேவையற்றது. சுட்டுக் கொல்லும் அளவுக்கு அவர்கள் பயங்கரவாதிகள் அல்ல. முடிந்தவரை போலீஸôர் அவர்களைச் சுற்றிவளைத்து கைது செய்ய முயற்சி செய்திருக்கலாம். கைது செய்திருந்தால் அவர்களோடு தொடர்புடைய கூட்டாளிகளையும் கூண்டோடு பிடித்திருக்க முடியும்.ஒருவர் தூக்கு தண்டனை, ஆயுள் தண்டனைகளுக்குரிய தவறுகளை செய்தால் மட்டுமே அவர்களைச் சுடலாம், அதுவும் தற்காப்புக்காக மட்டுமே சுட முடியும் என சட்டம் கூறுகிறது.தற்காப்புக்காக சுட்டோம் என போலீஸôர் கூறினாலும், இந்திய தண்டனைச் சட்டத்தின்படி சம்பவத்தில் தொடர்புடைய போலீஸôர் மீது கொலை வழக்கு பதிவு செய்ய வேண்டும். அவர்கள் நீதிமன்றத்தில் தற்காப்பு நோக்கத்துக்காக மட்டுமே சுட நேர்ந்தது என நிரூபிக்கும்பட்சத்தில் மட்டுமே அவர்கள் விடுவிக்கப்பட வேண்டும்.மேலும் இந்த என்கவுன்ட்டர் சம்பவத்தை விசாரிக்க மாஜிஸ்திரேட்டு விசாரணை போதாது. பணியில் இருக்கும் உயர்நீதிமன்ற நீதிபதியின் தலைமையில் விசாரணை நடத்த வேண்டும்.வழக்குரைஞர் புகழேந்தி: இந்த என்கவுன்ட்டர் சம்பவம் குறித்து போலீஸôர் கூறுவதை நம்ப முடியவில்லை. என்கவுன்ட்டர் நடைபெற்ற இடம் மிகவும் குறுகலான குடியிருப்புக்குள் அமைந்துள்ளது. இந்த இடத்தில் துப்பாக்கிச் சண்டை நடைபெற்றிருந்தால் அதிக எண்ணிக்கையிலான போலீஸôர் காயப்பட்டிருக்கக் கூடும். ஆனால் அவ்வாறு நடக்கவில்லை. தமிழகத்தில் போலி என்கவுன்ட்டர் சம்பவங்கள் நடைபெறுவது அதிகமாகிவிட்டது. குறிப்பாக இந்த என்கவுன்ட்டர் சம்பவத்தின் உண்மை நிலையை அறிய சிபிஐ விசாரணை அமைக்க வேண்டும். மக்கள் கண்காணிப்பகம் இயக்குநர் ஹென்றி டிபென்: "இந்தச் சம்பவம் முழுவதும் காவல்துறையால் திட்டமிட்டு நடத்தப்பட்ட நாடகமாகும். முறையாக விசாரணை செய்து கைது செய்ய வேண்டிய கொள்ளையர்களை, போலீஸôர் சுட்டுக் கொலை செய்திருக்கின்றனர். 5 பேரை 14 போலீஸôர் கைது செய்ய முடியாத அளவுக்கு காவல்துறை பலவீனமாக இருக்கிறது. இதுபோன்ற சம்பவங்கள், ஜனநாயகத்துக்கு நல்லதல்ல.நாட்டின் ஜனநாயகம் நல்ல முறையில் இருக்க, காவல்துறை நல்ல முறையில் இயங்க வேண்டும். இந்த வழக்கு விசாரணையை உயர்நீதிமன்றம் தாமாக முன்வந்து நடத்த வேண்டும்.இச்சம்பவத்துக்கு எதிராக பாதிக்கப்பட்டக் குடும்பம் எடுக்கும் ஒவ்வொரு நடவடிக்கைக்கும் ஆதரவாக அனைத்து மனித உரிமை ஆர்வலர்களும் இருப்போம். இதுபோன்ற சம்பவங்களைத் தடுக்க, புதிய போலீஸ் சட்டம் உருவாக்கப்பட்டு நடைமுறைப்படுத்தப்பட வேண்டும்' என்றார் அவர்.

காவல்துறையைக் குற்றவாளிக் கூண்டில் நிறுத்த வேண்டும்.  வீட்டு உரிமையாளர்  கூறியதாக முதலிலும் பக்கத்துவீட்டுப் பெண் கூறியதாகப் பின்னரும் தெரிவித்துள்ளனர். விவரம்அறிந்து செல்பவர்கள் வீட்டிற்கு  வெளியே மறைவாக இருந்து கொள்ளையர்கள் எனக் குற்றம் சாட்டப்படுபவர்கள் வெளியே வரும் பொழுது கைது செய்து முழு உண்மைகளையும் அறிந்திருக்கலாம். அல்லது மாறு வேடங்களில் வீட்டிற்குச் சென்று தகவல்கள் கேட்பதுபோல்  சந்தித்துஉயிருடன் பிடித்திருக்கலாம். இவர்கள் கொள்ளையடித்த நேரடிச் சான்று இல்லை.  இவர்களில் ஒருவர் படத்தை வெளியிட்டு ஐயம்தான் தெரிவிக்கப்பட்டு இருந்தது. அவர் வடநாட்டு மாணவர்களைப் பொறியியல் கல்லூரிகளில் சேர்த்து த் தரகுத் தொகை பெற்றுப் பிழைப்பு நடத்தி உள்ளார். எவ்வாறு இருப்பினும் உயிருடன் பிடிக்கப் பல வாய்ப்பு இருப்பினும்  ஐவரையும் கொன்றதால் வழக்கை விரைந்து முடித்து நற்பெயர் பெற நாடகம் ஆடி இருப்பார்களோ என்ற ஐயப்பாடு பலருக்கு ஏற்படுகிறது. அன்புடன் இலக்குவனார் திருவள்ளுவன் / தமிழே விழி! தமிழா விழி! எழுத்தைக் காப்போம்! மொழியைக் காப்போம்! இனத்தைக் காப்போம்! /

SL President Mahinda Rajapaksa, during his last trip to Jaffna on 06 February, ceremonially declared open a renovated hospital and a swimming pool, both of which were criticised by local media, especially the diversion of funds intended to reconstruct schools in Vanni to the completion of modern swimming pool in Jaffna. However, Mr. Rajapaksa had also inaugurated a China backed controversial project in Maathakal under the eyes of Sri Lanka Navy, without any public knowledge, informed sources in Jaffna now reveal. The controversial project to install windmills and solar panels along the coastal stretch from Thiruvadi-nilai to KKS and lease the occupied land of Eezham Tamil families, deprived of resettlement, to a Malaysian corporate of Chinese connections for 20 years was the one secretly inaugurated by the SL President together with the SLN.

In October 2011, the Malaysian corporate, KLS Energy entered into an agreement with China Machinery and Engineering Corporation to 'develop' wind/solar hybrid power project in Jaffna.

The agreement was part of Malaysian Prime Minister's US$ 10 billion economic cooperation initiative with China.

The Malaysian corporate of Chinese connection will be installing windmills and solar panels to produce electricity and 'sell' it to the people of Jaffna, permanently replacing the coastal people and the proud palmyra palms that now stand there.

As reported earlier by TamilNet, the genocidal Colombo not only seals off Eezham Tamils from Tamil Nadu, but also effectively checks Indian ambitions there with proxy Chinese projects.

Yoshitha Rajapaksa, the son of SL president Mahinda Rajapaksa and an officer in the SL Navy and, is also playing a role in maintaining the colonial interests of Colombo, informed sources further said.

Yoshitha was commissioned as an Acting Sub Lieutenant in the Sri Lanka Navy in March 2009.

During the visit, Mr. Mahinda Rajapaksa, stayed in the newly constructed bungalow of the SL colonial military governor in North, Maj. Gen. (retd) G.A. Chandrasiri, the sources further added.

The bungalow was constructed using more than 190 million rupees from the budget of Northern Province.

Renowned journalist Marie Colvin of The Sunday Times (UK), who is familiar to Eezham Tamils for her coverage on the conflict in the island, has been killed in shelling in Syria together with French photographer Remi Olchlik on Wedensday, agency reports said. The courageous journalist lost one of her eyes in 2001 in Sri Lanka Army shelling while working in the island. She was the only journalist to be present in besieged town of Homs in Syria, covering the conflict there, where she was slain. The shocking news of her death comes a few hours after her coverage on “sickening scenes” from Syria.

Marie Colvin was the last journalist the LTTE's Political Head B. Nadesan and the Director of LTTE Peace Secretariat S. Puleedevan were talking to in May 2009 before they were massacred in one of the worst war crimes of modern times.

Jon Snow of Channel 4 came with the following reaction: “Assad's assassination of Marie Colvin: Utterly devastating: the most courageous journalist I ever knew and a wonderful reporter and writer”.

UK's Mirror said of her death" "Witnesses say the American-born journalist was fired on by a rocket as she and Mr Ochlik fled a makeshift media centre that had been shelled in a heavy artillery barrage by Syrian forces.

"As the centre - which is situated next to a hospital - began to collapse journalists and guides fled the scene in the Baba Amr district and were fired upon again by Syrian soldiers.

"Colvin, who was in her fifties, appeared on Channel 4 and ITN’s News at Ten on Tuesday evening reporting on the bombardment of the opposition stronghold," the Mirror added.

Colvin also won the British press award for Best Foreign Correspondent on two occasions, as well as awards from the International Women's Media Foundation, according to UK's Telegraph.

UK Sunday Times's editor, John Witherow, issued a statement in which he spoke of Colvin as "an extraordinary figure in the life of the Sunday Times" who was "driven by a passion to cover wars in the belief that what she did mattered.
    "She believed profoundly that reporting could curtail the excesses of brutal regimes and make the international community take notice... "Throughout her long career she took risks to fulfil this goal, including being badly injured in Sri Lanka. Nothing seemed to deter her. "But she was much more than a war reporter. She was a woman with a tremendous joie de vivre, full of humour and mischief and surrounded by a large circle of friends, all of whom feared the consequences of her bravery."
Rupert Murdoch also paid tribute to Colvin, describing her as "one of the most outstanding foreign correspondents of her generation."

சிறிலங்கா இராணுவத்தின் தொடர்பாடல் சமிக்கை அதிகாரியாகக் கடமையாற்றிய கோத்தாபய ராஜபக்ச போன்றவர்கள் கூட இரகசியத் தொடர்பாடல் முறைமையைப் பேணவில்லை. ஆகவே குறிப்பிட்ட யுத்த மீறல் தொடர்பில் கிடைக்கப் பெற்ற ஒரு தெளிவான யுத்த கால சாட்சியமாகவே கோத்தபாய ராஜபக்சவின் கட்டளை அமைந்துள்ளது. இது நேரடியாக வழங்கப்பட்ட கட்டளையாகும்.

இவ்வாறு கட்டளை வழங்கிய மறுநாள், புலித் தலைவர்களான பாலசிங்கம் நடேசன், சீவரத்னம் புலித்தேவன் மற்றும் ரமேஸ் ஆகியோரதும், அவர்களுடன் சென்ற அவர்களது குடும்பத்தவர்கள் சிலரின் உடலங்கள் போன்றன துப்பாக்கிச் சூட்டுக் காயங்களுடன் அரசாங்கப் படைகளால் கண்டெடுக்கப்பட்டன.
இதனை யுத்த வலயத்தில் இடம்பெற்ற கெட்ட நிகழ்வென சிறிலங்கா அரசாங்கம் அறிவித்துக் கொண்டது.
நாட்டில் 25 ஆண்டுகளாகத் தொடரப்பட்ட யுத்தத்தின் நிறைவாக அதன் கரையோரங்கள், ஆலயங்கள், மலைநாடு போன்றவற்றில் சுற்றுலாப் பிரயாணிகளின் வரவு அதிகரித்துள்ளபோதும், மூன்று ஆண்டுகள் கடந்துவிட்ட நிலையில் யுத்தத்தின் நிறைவில் இடம்பெற்ற குறிப்பிட்ட சம்பவம் தற்போது மீளவும் சிறிலங்கா அதிபர் மகிந்த ராஜபக்சவுக்கு பெரும் தலைவலியை ஏற்படுத்தியுள்ளது.
புலிகள் தோற்கடிக்கப்பட்டு சில மாதங்கள் கடந்த நிலையில், ராஜபக்சவின் இராணுவத் தளபதியாக இருந்து ‘யுத்த வெற்றியைப்’ பெற்றுக் கொடுத்ததாக புகழாரம் வழங்கப்பட்ட சரத் பொன்சேகா அதிபர் தேர்தலில் ராஜபக்சவை எதிர்த்து வேட்பாளராகப் போட்டியிட்டார்.
இக்காலப்பகுதியில், புலித் தலைவர்கள் மூவரும் அவர்களது உறவுகளும் சரணடைய முயற்சித்தமை தொடர்பாக சரத் பொன்சேகா ‘சண்டே லீடர்’ பத்திரிகைக்கு வழங்கிய நேர்காணலில் சிறிது வேறுபட்ட தகவலை வழங்கியிருந்தார்.
இப்புலித் தலைவர்கள் சரணடைவற்காக எடுத்துக் கொண்ட முயற்சிகள் தொடர்பாக ஆராய்ந்த போது உண்மையில் என்ன நடந்ததென்பது தெளிவானது. அதாவது யுத்த காலப்பகுதியில் 58 ஆவது படையணிக்கு பொறுப்பாக இருந்த பிரிகேடியர் சவீந்திர சில்வாவிற்கு சிறிலங்காவின் பாதுகாப்புச் செயலர் கோத்தாபய ராஜபக்ச “சரணடைய முயலும் எந்தவொரு புலித் தலைவர்களையும் ஏற்றுக் கொள்ள வேண்டாம்” என கட்டளை வழங்கியிருந்தார். “அவர்கள் கொல்லப்பட வேண்டும்” என கோத்தாபய ராஜபக்ச கட்டளை வழங்கியிருந்ததாக கூறப்படுகின்றது.
2009ல் இடம்பெற்ற அதிபர் தேர்தலில் பொன்சேகா தோல்வியடைந்தார். அத்துடன் பொன்சேகாவுக்கு எதிராக ஊழல் குற்றச்சாட்டு முன்வைக்கப்பட்டு அவர் சிறையிலடைக்கப்பட்டார். “சாரணர் இயக்கத்தை நிறுவிய பேடின் பவுளின் படத்தைப் பார்த்தவாறு சரத் பொன்சேகா தற்போது காற்சட்டை அணிந்தவாறு சிறை ஒன்றுக்குள் அடைக்கப்பட்டுள்ளார்” என The Economist என்ற ஊடகத்தில் குறிப்பிடப்பட்டுள்ளது.
ஆனால் இவருடன் தொடர்புபட்ட வெள்ளைக் கொடி விவகாரம் இன்னமும் முடிவிற்கு வரவில்லை. அது தற்போதும் தொடர்கின்றது. நிராயுதபாணிகளாக சரணடைந்த புலிகளை கொலை செய்யுமாறு கோத்தபாய ராஜபக்சவால் வழங்கப்பட்ட கட்டளை உண்மையானதெனவும் இதனை தமது புலனாய்வு அறிக்கைகள் உறுதிப்படுத்துவதாகவும் சிறிலங்கா அரசாங்கத்திடம் அமெரிக்கா எடுத்துக் கூறியதாக தகவல்கள் தெரிவிக்கின்றன.
யுத்த மீறல்கள் தொடர்பில் பொறுப்புக் கூறுவதற்கேற்ற தொடர்பாடல் ஆவணத்தைப் பெறுவதென்பது கடினமானதாகும். ஆனால் சிறிலங்கர்களைப் பொறுத்தளவில், உயர் மட்ட அதிகாரிகள் கூட தமது இரகசியத் தகவல்களை வெளிப்படையான செல்லிடத் தொலைபேசிகளின் மூலமே பரிமாறியுள்ளனர். இதனால் இவ்வாறான இரகசியத் தகவல்களைப் பாதுகாப்பதென்பது அவ்வளவு சுலபமான காரியமல்ல.
சிறிலங்கா இராணுவத்தின் தொடர்பாடல் சமிக்கை அதிகாரியாகக் கடமையாற்றிய கோத்தாபய ராஜபக்ச போன்றவர்கள் கூட இரகசியத் தொடர்பாடல் முறைமையைப் பேணவில்லை. ஆகவே குறிப்பிட்ட யுத்த மீறல் தொடர்பில் கிடைக்கப் பெற்ற ஒரு தெளிவான யுத்த கால சாட்சியமாகவே கோத்தபாய ராஜபக்சவின் கட்டளை அமைந்துள்ளது. இது நேரடியாக வழங்கப்பட்ட கட்டளையாகும்.
சிறிலங்காவில் தொடரப்பட்ட யுத்தத்தின் போது நேரடியாக வழங்கப்பட்ட கட்டளைக்கான சிறந்ததோர் சாட்சியமாக இது உள்ளது.
அத்துடன் தனது சகோதரனின் அரசாங்கத்தில் கோத்தாபய ராஜபக்ச அதிவலுமிக்க உயர் மட்ட அதிகாரியாக இருப்பதாலும், சிறிலங்கா இராணுவம் மற்றும் காவற்துறை போன்றவற்றை மட்டுமல்லாது சிறிலங்காவின் நகர அபிவிருத்தியை மேற்பார்வை செய்யும் அமைச்சின் உயர் மட்ட அதிகாரியாக இருப்பதாலும், இவரால் வழங்கப்பட்ட கட்டளையானது உண்மையில் பெறுமதிமிக்க யுத்த சாட்சியமாக உள்ளது.
அமெரிக்க அரசாங்கத்திற்கும் கோத்தாபயவால் வழங்கப்பட்ட கட்டளை தொடர்பான ஆவணமானது வலுமிக்க கருவியாக உள்ளது. தமிழ்ப் புலிகளுடன் மேற்கொண்ட யுத்தத்தின் போது சிறிலங்கா அரசாங்கத் தரப்பால் இழைக்கப்பட்ட யுத்தக் குற்றங்கள் தொடர்பில் விசாரணை செய்வதற்காக மகிந்த ராஜபக்சவால் நியமிக்கப்பட்ட ஆணைக்குழுவின் பரிந்துரைகளை உடனடியாக அமுல்படுத்துமாறு சிறிலங்கா அதிபர் மீது, இந்தியாவுடன் இணைந்து அமெரிக்கா அழுத்தம் கொடுத்து வருகின்றது.
சிறிலங்கா அதிபரால் உருவாக்கப்பட்ட கற்றுக் கொண்ட பாடங்களுக்கான ஆணைக்குழுவானது 18 மாதங்களாக மேற்கொண்ட விசாரணையின்  இறுதி அறிக்கையை கடந்த நவம்பரில் கையளித்திருந்தது. இது தொடர்பில் சிறிலங்கா அரசாங்கத்தால் மேற்கொள்ளப்பட்ட அனைத்தும் ஒரு கண்துடைப்பு நாடகமாகும்.
தமிழ்ப் புலிகள் மனித உயிரினங்களை மதிக்கவில்லை எனவும் சிறிலங்காப் படைகள் பொதுமக்களுக்கு இழப்புக்களை ஏற்படுத்தாதவாறு அவர்களைப் பாதுகாப்பதற்கு முன்னுரிமை அளித்ததாகவும் நல்லிணக்க ஆணைக்குழுவின் அறிக்கையில் குறிப்பிடப்பட்டுள்ளது.
‘யுத்த வலயமற்ற பகுதிகள்’ என அறிவிக்கப்பட்ட வலயங்களில் சிறிலங்கா இராணுவப் படைகள் தாக்குதல்களை மேற்கொள்ளவில்லை எனவும் அதில் குறிப்பிடப்பட்டுள்ளது. இது உண்மையில் ஆச்சரியப்படத்தக்க விடயமல்ல.

Urging Colombo to rebuild railway to north evokes 143-year-old debate

A group of politicians, academics and NGO workers in the South including some Tamils and Muslims of southern orientation, while urging implementation of several LLRC recommendations in consultation with the TNA, and at the same time urging demilitarisation and political solution based on devolution, concluded their signed statement on Friday, wondering it was “hard to understand delay in rebuilding the railway to the north – a one time artery of commerce and people movement.” The perception of the model of ‘integration’ with the Colombo-based system, evokes 143-year-old debate on ‘the tale of two cities’, started by the then British Government Agent in Jaffna, Sir William Twynham, whether the railway makes Jaffna independent or dependent of Colombo. Twynham in his time rather preferred to develop the external trade of the ports in Jaffna and land-link them with the rest of the island.

The railway has come to then British Ceylon in 1864.

The British colonial focus of the railway was linking their latest conquest in the island, Kandy, and the plantations in the hill country to facilitate the export of tea.

The immediate economic victim was Batticaloa, because until then the produce of the tea estates were largely exported through the Batticaloa port in the east of the country of Eezham Tamils.

But the British Government Agent Twynham in Jaffna was thinking in terms of the people of the land he was administering.

In 1869, Twynham built the Punnaalai causeway, linking the Kayts harbour with the rest of the island to improve the local economic independence and external trade that was at that time based on tobacco.

Long caravans of bullock carts starting from the Kayts harbour with commercial items coming in return from as far as Bengal, were taken to the south for trade.

Twynham, who loved the country and people he was administering, strongly argued with the British colonial office against linking Jaffna with Colombo by railway. Twynham retired in 1896, he chose to spend even his retirement life in Jaffna and died in Jaffna.

Twynham was proved right when the railway finally came to Jaffna with commodities coming from Colombo. The ports of Jaffna were closed and became ghost towns. The traders became subordinates by having their shops in the south – to be chased away after every pogrom and then to plead for their return, and not for their national rights. Others who continued with their ancient profession became ‘smugglers’.

The then leading politician of the north, who saw to it that a railway station was built at I’nuvil to facilitate his travels from Colombo, heralded a paradigm of ‘Colombo-Tamils’ deciding the polity of Eezham Tamils.

Now, we see a trend of Sinhala capital coming to the north with military protection and colonial enclaves for further subordination of the nation of Eezham Tamils. The diaspora is not allowed an independent entry to its land for investment. The forces of Colombo-centric thinking are keen in even luring the diaspora into the pattern. The railway, following its long colonial tradition, is now to enhance the agenda of the new colonial masters.

India could have helped the situation by swiftly opening the ports and trade in the north, by developing an appropriate communication through Naakappaddinam, Point Calimere and Athiraam-paddinam and by insisting on Colombo for the development of east coast link of Batticaloa and Trincomalee with Point Pedro. But New Delhi doesn’t want to do it, while its politicians in Tamil Nadu brag about the Thooththukkudi–Colombo ferry.

What is pricking to a Tamil mind is that the signatories of the statement who worry about “people movement” between Colombo and Jaffna have shown no concern at all about people movement within the nation of Eezham Tamils along the eastern and western coasts. Eezham Tamils are long deprived of this ‘people movement’ within their own nation, as Colombo has been deliberately sitting on it.

The formation of a civil society movement based on the grassroot organizations of the north and east has become a pricking problem for some of the Tamil minds seeking space but can’t conceive anything beyond the Colombo-centric life of subjugation, and have been conditioned to remain so, by forces inside and outside of the island. One could see that in the mushrooming Colombo-based Tamil signatories claiming ‘civil society’, but belonging to only certain families and esoteric groups.

Once a section of the elite and affluent of the Eezham Tamil nation bases its property, interests, professional opportunities and orientation of outlook in Colombo, its concern about the liberation of its nation is bound only to the extent of bringing in equilibrium to suit its interests, within the Colombo-centric system preserved at any cost. Eezham Tamils in the island and in the diaspora, as well as grassroot Tamil Nadu should carefully understand where the ultimate problems exist and what to do about them.

While the uprooted Eezham Tamil civilians from Moothoor East of Troncomalee district are languishing in temporary shelters and with their relatives and friends, the colonial Colombo government has sent land surveying teams with a plan to grab the remaining lands in the vicinity of the already seized area for Indian coal power plant in Champoor. Informed sources in Trincomalee told TamilNet Monday that SL presidential sibling Basil Rajapaksa, who is the economic ‘development’ minister in Colombo, has allocated 6,500 acres of the occupied land to a foreign power for the construction of an ‘industrial zone’ surrounding the 1,500 acres of land already allocated to Indian coal power plant. Recently, the SL military was bragging in Jaffna about their ‘diplomacy’ in giving KKS harbour construction to India and giving rest of the northern coast to a Chinese corporate.

Mr. Basil Rajapaksa, had recently told the Sri Lankan parliament that once the land needed for the proposed coal power project is acquired, the uprooted people of Moothoor East would be resettled in their own lands that are left in Champoor.

The Colombo government had earlier demarcated 8,000 acres of lands it seized from the people of Champoor. Later, the SL authorities told people that only 1,500 acres would be taken over for the coal power plant and that the people would be able to resettle in the remaining lands.

However, the people were not allowed to resettle, but were subjected to systematic and continuous harassment by the occupying SL military.

Some of the uprooted families, who earlier owned acres of agricultural land in Moothoor East and were dependent on cultivation, now received only 10 perch land per family in stony area where it is difficult to dig wells or bore tube wells.

Thousands of Tamil families uprooted in 2006 military operation from villages Kadatkaraich-cheanai, Koonith-theevu, Navaratna-puram, and Choodaik-kudaa are currently given temporary shelters in welfare centres located in Manat-cheanai, Ki'liveddi, Kaddai-pa'richchaan and Paddiththidal.

The Colombo government has been engaged in creating new villages for Sinhalese who are being brought down from the south to the Eastern Province. The SL government authorities have set aside around 25,000 acres of land in Vavu'natheevu in Batticaloa district under the pretext of allowing members of the so-called Sri Lanka Civil Defence Force, who are Sinhala home guards trained to colonise Tamil land by the Sri Lankan military, to do cultivation. Hundred percent of the paramilitary home guards in the unit receiving the lands in Batticaloa are Sinhalese.

The Eastern Provincial Council led by a leader of a paramilitary group as its Chief Minister has started fencing the land for the exclusive use of the SL Home Guards, according to Batticaloa district Tamil National Alliance (TNA) parliamentarian Mr.P.Selvarasa.

The TNA MP revealed the hidden agenda of the Colombo government while addressing a meeting at Vellave'li Kalaimaka'l Viththiyaalayam (school) in Poaratheevuppattu education zone of the Batticaloa district.

Mr. Selvarasa further said that the Tamil people are struggling to restore their lost rights and traditional lands. But the Tamil ministers in the Mahinda Rajapakse government are engaged in making speeches to divert the attention of Tamil people from this goal.

“We will not stop our struggle until we reach the goal to fulfill the political aspirations of Tamil people” Mr.Selvarasa declared.

A resolution has been introduced in the US Congress last week, calling upon Pakistan to recognize the right to self-determination of the Baloch people, whose main territory Balochistan, bordering Iran in the west and Afghanistan in the north, is currently a province in Pakistan. It is the US policy to “oppose aggression and the violation of human rights inherent in the subjugation of national groups as currently being shown in Iran and Pakistan against the aspirations of the Baloch people,” the motion said. The resolution also talks on the distribution of the Baloch in Pakistan, Iran and Afghanistan, their long revolts since 1958 and the need for the world to give them an opportunity to choose their own status among the community of nations. Balochistan is rich in oil and minerals with pipeline access to sea besides its strategic importance to US engagements in West Asia and Afghanistan.

The revolts in Baloachistan, in 1958, 1973 and 2005 “indicate continued popular discontent against Islamabad’s rule, and the plunder of its vast natural wealth while the province remains the poorest in the country,” the motion in the US Congress said.

“The Baloch, like other nations of people, have an innate right to self-determination. The political and ethnic discrimination they suffer is tragic and made more so because America is financing and selling arms to their oppressors in Islamabad,” the motion further said.

The resolution was tabled by the US Congressman Dana Rohrabacer, who a few days ago chaired a Congressional hearing on Balochistan.

Meanwhile, there were strong reactions in Pakistan.

On Monday Pakistan foreign ministry summoned the acting US envoy Richard Hoagland to lodge a strong protest.

Hoagland was "told in clear terms that the move in the US Congress was contrary to the spirit of friendly relations and violative of the principles of the United Nations Charter, international law and recognized norms of inter-state conduct", the statement said.

Pakistan’s parliament earlier passed a resolution condemning the hearings of the US Foreign Affairs Sub-Committee.

The provincial assembly of Pakistan’s Punjab, adjacent to Baloachistan, condemned the US bill and wanted the US ambassador to be summoned to its house for an explanation.

Questioning the US silence over the Kashmir issue in contrast, the Pakistan-Punjab assembly also wanted the federal government in Islamabad to take up the Kashmir issue more effectively and to convince to US congress to raise its voice against Indian brutality in the Kashmir valley.

However, many in Pakistan believe that the US Congress bill is not the view of the US Administration and is only a pressure tactic.

But political observers think that the USA and India are likely to take a common stand on Balochistan.

Instead of the Karakoram route to China, shown in the map, China on its own now works on a shorter route through Quetta to Karakoram.


China at the moment builds a deep-water harbour, similar to Hambantota in Sri Lanka, at Gwadar in Balochistan, and is also engaged in building a highway linking the harbour with Balochistan’s capital Quetta close to Afghan border, eventually to link the harbour with China, through the Karakoram Pass of the Himalayas.

China has also invested in oil and minerals in Balochistan.

Apart from oil and gas, Balochistan is rich in gold, copper, zinc and coal.

China’s control of the corridor through Balochistan can "bind India down in South Asia, restricting its capacity to operate elsewhere," a Forbes feature in May 2010 said. In its ventures in Balochistan, China is wiling to play in the bribery culture traditional to the area, the article further said.

Meanwhile, last week, Sri Lanka’s Rajapaksa wanted to assert to his newly found international status as ‘expert’ in handling national questions through military and genocide. The SL president visiting Islamabad had secret talks on providing military expertise to Pakistan in the subjugation of Balochistan, political circles of the Baloch accused.

Rajapaksa’s secret deal with Pakistan sabotages India’s designs in Balochistan, commented a South Asian diplomat.

The International Crisis Group (ICG) sometimes back pointed out the discrepancy in the outlook of the international community regarding national questions: favouring some of them, not favouring some others and watching the rest.

The US Congress and especially the State Department are answerable for their discrimination in recognising neither the genocide committed on Eezham Tamils nor their right to self-determination, Eezham Tamil circles pointed out.

The Tamil Nadu State Assembly, confining only to the war crimes, was not strong enough in defending the national cause of Eezham Tamils, compared to the boldness of Pakistan-Punjab provincial assembly in dealing with foreign affairs of its interest, commented political observers in Chennai.

The Dravidian-speaking Brahui people, having prehistoric relations to Tamils in language and numbering around three million today, are mainly natives of Balochistan. They also are found in the neighbouring Iran and Afghanistan, as part of the Baloch identity.

The occupying Sri Lanka Army in Mannaar has been allocated a vast area of lands in Ezhuththoor GS division of Mannaar Piratheasa Chapai (PS), where uprooted families, most of them who had lost one of their parents in the war and are from Mullaiththeevu, Ki'linochchi, Vavuniyaa and Mannaar districts, have been provided lands to resettle. The families, mostly run by females, have come together and shown their objection to the move to construct SL military cantonment, obstructing the normalcy needed for the families. The resettled women have formed civil groups and urged the civil authorities at all levels to take immediate step to stop the move which would threaten the peace of life in their new village.

To facilitate the resettlement in the dry zone area, the UN aid agency UNDP had constructed a lake to preserve water for civilian use.

However, within a few months, the SL Army has been allocated lands close to the lake and in the middle of the resettlement area.

The main access route to Ezhuththoor runs towards Tharavankoaddai. The militarisation of the road, the residential area and the lake accessed for all basic requirements by the resettled families, would pose serious threats to the civilian life in the GS area, where resettled civilians still lack basic facilities such as own toilets and baths, the female groups have complained in their appeal.

The UN Secretary General is under attack by international legal experts and the media for a seriously bungled war-crimes prosecution in east asia- Cambodia's war tribunal (Extraordinary Chambers in the Courts of Cambodia, ECCC). Two million civilians were killed by Pol Pot's Khmer Rouge, and 35 years later, politics and finance, instead of law and evidence, appear to dictate the course of justice. But, here, now, Tamil political leaders point to the Cambodia model as reflecting the speed of international investigations, and assert that Tamils should not be impatient at the slow progress of international mechanisms. Western States, allegedly complicit in "crime against peace" in Sri Lanka, forward the same argument to avoid their own exposure and to buy the SL Government time so that 30-years into the future, prosecutions become largely irrelevant as is happening in Cambodia.

Legal activists say two aspects of TNA's reference to the Cambodia model for Tamil justice need to be highlighted:
  • The "step by step" approach to prosecution, and the reference to complementarity, while doctrinally relevant, are routinely used by powerful states to advance geo-political interests. Prosecutions are expedited when it is politically advantageous, and prosecutions are delayed to make them irrelevant to save smaller powers or heads of state when needed. US, and India are actively promoting such delays to the advantage of Rajapakses.
  • In Cambodia, 30 years after the mass killings, the victims are no closer to justice. Cambodia's leader has only allowed prosecutions, charges and witnesses he decrees. The UN has been ineffective in enforcing judicial independence. Aging witnesses, fading memory, and deteriorating evidence have hampered investigations.
Tamil circles assert that during the current critical period when States complicit in aiding Tamil genocide are scrambling to assemble pliant Tamils to sidestep Tamil justice by using instruments of reconciliation and development, Tamils need to galvanize momentum for meaningful independent investigations with relentless legal pressure worldwide. Vigilance against being absorbed into conspiracies designed to save Rajapakse, is paramount in sustaining the criminal exposure of the regime, Tamil circles say.

International human rights organizations including Amnesty International and Human Rights Watch have been persistent in their call for immediate International investigations. These actions, together with concerted legal actions from the Tamil diaspora, at some future point, will make untenable Western posturing on delaying investigations, rights activists said.

At this juncture, Tamil National Alliance (TNA) leadership pointing to the Cambodia tribunal as a suitable model for Tamil justice with regards to the conventional function of international relations should be viewed with extreme suspicion. Legal activists point out that while the model may be relevant where the victims are helpless, educationally underprivileged, and the international action proceeds at a pace determined by the whims of the powers with geopolitical interest in the region, the Tamil case is different.

"Tamils, the victims of alleged genocide, have the capacity and are equipped with intellectual and legal know-how to push the justice agenda forward, using the largely independent legal systems of western liberal democracies. In the pursuit of war-crimes prosecution, dependence on political patronage from States that have alleged complicity in the crimes, needs to be minimized. TNA should articulate Tamils' wishes, and not educate them on this matter," Tamils Against Genocide (TAG), an activist group involved in legal action said.

Further, while a pragmatic view of the international law dictates that "state consent plays an important role in maintaining an international legal order," the body of jus cogens, which does not permit derogation, represents a dramatic limitation to sovereign authority. However, international mechanisms, including the UN, with a collection of member states with different political agendas and geopolitical interests, can manipulate the impact of international laws in prosecution of war-criminals.

Also, while the concept of complementarity allows the International Criminal Court (ICC) jurisdiction in situations when the state is unable or unwilling to proceed with an investigation or where the state investigation is conducted in bad faith such as when it is used to shield the person from criminal responsibility, Sri Lanka is not a signatory to ICC's Rome Statute, and ICC prosecution can be only through a vote by the Security Council. However, in terms of the general application of complementarity, which the International community insist on, Wikileaks has revealed the US is aware of Rajapakses complicity in crimes and justice cannot be expected from any internal mechanisms. LLRC, by its failure to investigate war crimes, has clearly demonstrated that complementarity is satisfied and no further demonstration of "unwilling and unable" is likely necessary.

With limited exposure to western legal systems and procedures, TNA is not adequately equipped to "educate" Tamils on international law, and the suitability of other war-crimes prosecution models to seek Tamil justice. Continued reluctance to articulated as due to pressure from States, US, India, and Norway, which are intent on saving Rajapakses, and blunting Tamil aspirations, Tamil circles cautioned.

The United States Department of State, in its response to three Tamil plaintiffs' opposing arguments to the US's suggestion of immunity for Sri Lanka's President Mahinda Rajapakse from alleged war-crimes, said that the plaintiffs have asked the Court to "ignore the substantial and unanimous body of authority recognizing the controlling nature" of US's immunity determination, and that US's earlier submission adequately explained why the Court should recognize Rajapakse's immunity from the suit. Plaintiff's attorney said the US Government has failed to adequately address why the Court should pre-empt judicial review when under TVPA "an individual" has allegedly committed "universally repugnant" crimes, and is insolently insisting on the dispositiveness of US's determination on immunity. A ruling is expected from Judge Kotelly soon.

The Department of Justice reasserts the following three "brief points" in response to plaintiffs' opposition to immunity:
  1. The US President's foreign relations power is constitutionally derived. Also US asserts that there is "no" indication that Congress intended to interfere with Executive authority on the immunity issue when it enacted TVPA;
  2. U.S. contends that creation of statutory right of action does not automatically override "preexisting" immunity rules;and
  3. In view of the above two principles, US says, the Court should join the "unanimous body of authority" recognizing US's "unreviewable" authority to make immunity determinations.
Spokesperson for Tamils Against Genocide (TAG), a US-based activist group that is sponsoring the case on behalf of three Tamil plaintiffs, said: "[t]he Executive Branch's purportedly unreviewable authority to make immunity determinations may not permissibly transgress the boundary between the Executive and the Judiciary, between suggesting and instructing a finding of immunity.

"Under the doctrine of separation of powers, the Court as an independent, neutral, and detached organ of America's constitutional democracy has the authority and capacity to arrive at its own immunity determinations, taking relevant facts such as the body of authority and Executive Branch's position into consideration.

"Special circumstances, such jus cogens norms violations may, in the interests of justice, warrant case-by-case deviations from immunity determinations suggested by the Executive or case law. Such independent judgments constitute the touchstone of American constitutionalism and its common law legal system," TAG spokesperson told TamilNet.

Judge Kotelly of District Court of District of Columbia will rule on the immunity issue, and if she deems there is sufficient merit in the both parties' arguments, Judge Kotelly might also rule if an oral argument is warranted and if the case should go forward.
