Colombo makes mockery of UN endorsed domestic mechanism - Boyle

Noting Sri Lanka Cabinet spokesperson Rajitha Senaratne's statements that there was no deadline to complete the accountability process on the war, that his Government is in talks with the United Nations with regards to the accountability process, and that the process will be a domestic process and not a “hybrid process” as proposed by the UN High Commissioner for Human Rights, Professor Boyle, an expert in International Law, and who teaches at University of Illinois, College of Law, said that by these words "GOSL has publicly stated that it will continue its Crimes against Humanity against the Eelam Tamils. This makes an absolute and total mockery of the so-called “domestic mechanism” that was endorsed by the UN Human Rights Council."

"When the Enforced Disappearances (EDs) of human beings is either widespread or systematic, it becomes a Crime Against Humanity in violation of the Rome Statute for the International Criminal Court and customary international criminal law.

"In the case of the GOSL genocide against the Eelam Tamils, EDs are both widespread and systematic and therefore Crimes against Humanity too. EDs are also ongoing criminal offenses in violation of international criminal law until the fates of the disappeared persons are accounted for.

"So by means of this statement that there is “no deadline” on the accountability process for the EDd persons, the GOSL has defiantly indicated to the entire world that it will continue its ongoing international criminal activity of enforced disappearances of human beings against the Eelam Tamils, which are Crimes against Humanity.

"In other words, the GOSL has publicly stated that it will continue its Crimes against Humanity against the Eelam Tamils. This makes an absolute and total mockery of the so-called “domestic mechanism” that was endorsed by the UN Human Rights Council.

"Any international expert who participates in the genocidal GOSL’s “domestic mechanism” will be aiding and abetting the GOSL’s EDs Crimes against Humanity against the Eelam Tamils.

"Every Tamil in the world must take note of these so-called international experts who get involved in the genocidal GOSL’s “domestic mechanism," Professor Boyle said.

Colombo regime, which came to power claiming ‘good governance’, has failed to address the urgent demands of releasing 200 Tamil political prisoners, reveal the whereabouts of more than 20,000 people in the past and the genocidal military occupying the Tamil homeland continues to seize lands from Mannaar to Ampaa'rai. “Unless we see any credible move within a few months time this year, the Tamil people will be mobilised to wage a civil disobedience campaign,” said Northern Provincial Councillor M.K. Shivajilingam, who organised a protest in Jaffna on Wednesday. “The few Tamil politicians who are telling Tamils not to protest against the visit of SL President Maithiripala Sirisena and SL Prime Minister Ranil Wickramasinghe, have a very short time now to prove their claims,” he further said.

More than 1,300 people have registered to visit Rajeswaray Amman temple on Friday, when SL President Maithiripala Sirisena and SL Prime Minister Ranil Wickramasinghe come to Jaffna to stage Pongkal Celebrations.

“The people are going there not to celebrate, but to use the opportunity to see their occupied lands that have been seized by the genocidal State for decades,” the NPC councillor said.

NPC Councillor Ananthy Sasitharan, TNPF politicians Selvarajah Kajendren and Pathmini Sithamparanathan joined the protest attended by the families of missing people and political prisoners.

“The SL regime came to power promising change within 100 days. Now, 365 have passed. The Colombo government thinks that the reconciliation is a one-way process. The time is running out for the Colombo regime and those who back it to prove their credibility,” Mr Shivajilingam said.
