Conduct of SL Judiciary exposed in Koonith-theevu temple dispute

Conduct of SL Judiciary exposed in Koonith-theevu temple dispute

Moothoor Magistrate’s Court on Thursday further remanded the three Tamil trustees from Choodaik-kudaa in Kooniththeevu, who were arrested by the Sinhala police that invited them for a meeting at Champoor Police station on 01 January. Despite the occupying police failing to document the existence of a Gazette notification to prove the hill-top as an archaeological reserve as claimed by the Sinhala monks who filed the case, the Magistrate of the SL court went ahead extending the remand without bail, Tamil legal activists in Trincomalee complained. In the meantime, the dispute originated only after the intruding Sinhala Buddhist monks from Seruwila objected to the expansion of the Murukan temple of Tamils and there were no archaeological artefacts discovered or destroyed as being claimed by the Sinhalese, the leader of Champoor Women’s Rural Society Leader told TamilNet on Thursday.

“The chairman, secretary and the treasurer were brought to the Magistrates’ Court. The Police argued that the Tamil temple management had violated the restrictions of ‘Puraviddya’ (Archaeology) without any substantial evidence. The SL Police wanted more time to document the evidence of a Gazette notification. We have not seen any announcement or even a board from the SL Archaeology Department denoting the place as a reserved locality during or prior to the time of the dispute. And, everyone knew very well it was the place of a Murukan temple. This is what I know from my past 34 years of life,” the WRDS leader told TamilNet.

Another community leader from Champoor said Tamil lawyers were now considering to file a case against the wife of SL Governor to East.

Meanwhile, legal activists from Trincomalee said the Magistrate was taking the side of the Sinhala monks and their police.

The SL Judiciary is blindly adhering to the clause of ‘foremost place to Buddhism’ and ‘territorial integrity’ of the genocidal State to permanently Sinhalicise the already heavily militarised traditional Tamil villages in Moothoor East, the Tamil legal activists said.

The remanded trustees were not even provided with official information in Tamil on the charges against them. There was no Tamil translation of what was being said at the courts in Sinhala. Even when the Tamil detainees requested specifically for translation, the court was not able to provide it. After all, this is a court situated in the Tamil-speaking area, they said.

But, Tamil to Sinhala translation was being readily provided as a one-way service to the SL Police and to the Magistrate’s court to gather information from the victimised Tamils.

SL Police had also detained the driver and the owner of a bulldozer vehicle. Both of them are Sinhalese. A Tamil who had facilitated the contract was also detained with the two Sinhalese. But, the three were released on bail 3 days ago. The SL police was influencing Moothoor Magistrate not to give bail to the temple trustees.

The entire dispute has been created by the monks, Sinhala colonial governor to East and his wife, Mrs Deepthi Bogollagama, who behaved in a threatening manner as documented by the video evidences, the WRDS leader said.

Although the SL Constitution attempts to project all religions as having equal status, the constitutional provision of ‘foremost place’ and various other arrangements such as the SL police having a special division to protect the Buddhism under the guidance of SL Ministry of Buddha Sasana, have made it a crime if anyone attempts to peacefully dismantle even a Buddha statue in the occupied country of Eezham Tamils.

At Maththa'la-malai there was no buddha statue. The Tamil people have had their folk-deity at the locality at least for the last 7 generations of his forefathers, Poosaari I. Pathmathan (56) told TamilNet last week.

Article 9 (chapter II) of the current Sri Lankan constitution promulgated in 1978 says: "The Republic of Sri Lanka shall give to Buddhism the foremost place and accordingly it shall be the duty of the State to protect and foster the Buddha Sasana.."

Eezham Tamils say that this Article constitutes a particular obstacle in negotiating any degree of regional autonomy with the genocidal State of Sri Lanka because it is an 'entrenched' section of the constitution. Article 9 can be amended or repealed only with the support of two thirds of all the members of the SL Parliament and only if such amendment or repeal is thereafter approved by the people in an island-wide referendum.

The proposals for new constitution are also not going to change this reality and federalism is not possible under the genocidal configuration of the Sri Lankan system. The fundamental genocidal character will continue to exist despite cosmetic reforms.

In reality, the genocidal Sinhala State, Tamil quisling politicians such as M.A. Sumanthiran and the external powers seeking geopolitical inroads in the island are trying to introduce genocidal uniformity, which is much worse than the unitary system through the Sinhala notion of Ēkīya Rājyaya (ඒකීය රාජ්යය).

Another stupa erected at controversial Buddhist vihara in Kokku'laay

Another stupa erected at controversial Buddhist vihara in Kokku'laay

Sri Thissapura Gunarathna Thero, an extremist Sinhala Buddhist monk, who has been constructing a controversial Buddhist vihara establishment at the private lands of Eezham Tamils in the strategic Kokku'laay, which links the Northern and Eastern provinces, has put up another Buddhist stupa at the locality in recent weeks, Tamil officials at Karai-thu'raip-pattu division said. The monk is fully assisted by Sinhala soldiers who are deployed in civil clothes. Despite repeated complaints and interim orders coming from local and provincial authorities, the monk is continuing the construction with the backing of Colombo government, occupying Sinhala military and the extremist Buddhist Power Force (BBS). Mr Manivannathas, the Tamil owner of the land has once again sought help from the public to stop the construction work, but says no-one is coming forward to take up his case.

Gunarathna Thero has also seized portions of public lands that belong to the post office and the base hospital at the site, according to officials at the District Secretariat of Mullaiththeevu. Lands of Hindu temple and a public road have also been absorbed into the Buddhist establishment, Tamil villagers say.

The area surrounding Kokku'laay has been the focus area of Sinhala colonisation in Mullaiththeevu district, as it is the key location for wedging the demographic contiguity of the North and East.

Kokku'laay is a traditional Tamil fishing hamlet.

In 1970s, only two Sinhala fishing operators used to come here with a 15-member workforce on seasonal fishing. All of them were Catholics except two members who were Buddhists.

Since then the demography of the village has been changing slowly.

Migrant Sinhala fishermen from Negombo and other coastal villages of the Western Province were officially encouraged to engage in fishing in this eastern coastal lagoon of Kokku'laay, which is famous for prawn.

Tamil villagers were uprooted following the 1983 anti-Tamil pogroms. A small Buddha statue was placed after the Tamils were fully evicted from their village. All of the Tamil people had displaced by 1985.

During the times of the war, the area was occupied by the SL military and was declared as a military High Security Zone.

However, due to the presence of the LTTE, Colombo was prevented from Sinhalicising the link during the 30-year-long armed struggle.

After the end of genocidal onslaught on Vanni in May 2009, Sinhalicisation was intensified through the land link from the neighbouring Sinhala colony of Padaviya in Anuradhapura district and Ma'nalaa'ru (Weli-oya) division in Vavuniyaa district.

Sinhala military silently recruits Tamil teenagers through deceptive ‘cadet training’ in North

Sinhala military silently recruits Tamil teenagers through deceptive ‘cadet training’ in North

Selfies of school-going Tamil children as young as 15-years from Uruththirapuram in Ki’linochchi and from Jaffna, including from the prestigious colleges such as Jaffna Central, have surfaced in the social media revealing ongoing silent recruitment to the occupying Sinhala military of genocidal Sri Lanka in recent days. The building of one of the key native Tamil academic institutions, that evolved in Jaffna to protect the native language and heritage against European colonialism, the Arya Dravida Bhasha Viruthi Sangam (Academy for the Development of Aryan and Dravidian languages) located at Koddaddi in Jaffna, has become the secretariat for the occupying Sinhala military to recruit Tamil children. Questions have arisen on ‘silent advice’ to SL military on the move was coming from Colombo-based foreign missions that sustain seek to sustain the ‘uniformity’ of genocidal Sri Lanka.

The recruited children and students are being sent to South for training at military training bases.

The Northern Provincial Council’s Education Ministry has not been consulted on the controversial issue.

Eezham Tamils who regard the Sinhala military as the tool of the protracted genocide, have not volunteered to military recruitment at any juncture. But, they are lured with various ‘advantages’ such as a point-system giving benefit in employment, informed sources said.

In the past, even those who had been recruited to SL military through deceit have managed to escape from the Sinhala military as earlier reported. Thus, the approach has now become more sophisticated.

In the South, the school-oriented cadet training given to Sinhala students has traditionally been an avenue to enlist young military recruits.

The tactic was to be experimented in the North starting from the times of former SL Defence Secretary Gotabhaya Rajapaksa.

But, Mr Gotabhaya became more obsessed with enforcing all students entering the universities to be subjected to a so-called leadership training by the Sinhala military.

In the North-East, the ‘leadership training’ given to students became almost synonymous to ‘military rehabilitation’ imposed on former LTTE members.

However, when the so-called "Yahapalanaya" government was brought to power in 2015 by the ‘strategic partners’ of US Bandwagon through the 2013 Singapore Principles paradigm, the so-called leadership training, which had earned the ire of the Tamil public, was abandoned as one of the cosmetic gestures by the agent State in Colombo.

But, on the other hand, more sophisticated forms of recruitment drives targeting school children were advocated by the SL Army commander Mahesh Senanayake during his tenure as Jaffna Commander starting from January 2016.

Senanayake was promoting more interaction between school boys and the occupying military through various psychological operations, which also includes deploying Sinhala soldiers for

After becoming SLA Commander Lt Gen (promoted by Yahapalanaya) Mahesh Senanayake has accelerated the Cadet programme based on inputs coming from foreign Establishments.

He started to claim that the Sinhala military was now becoming a ‘capacity’-based organization rather than a ‘threat’-based one, justifying the school ‘Shramadanas’ and ‘house-constructing’ (enslaving resettling Tamils) military.

It is under this context, Tamil boys as young as 15 are now being allowed to play with firearms by the Sinhala trainers from the SL armed forces.

The question is why foreign powers, having military-to-military engagement with the genocidal State in the occupied country of Eezham Tamils are showing a keen interest now in deceiving Tamil students into Sinhala military. That question has to be answered by the NPC Education Ministry, its minister and the Chief Minister of the NPC, a Tamil principal who had participated in the ‘cadet training’ told TamilNet.

The principal of a reputed Tamil school, who did not wish to be named for obvious security reasons, had recently gone to study how the programme is being conducted and was shocked to see the deceptive psychological design of the scheme.

The latest move has to be seen together with SL military running a school for Sinhalicisation of Tamil children at Puththoor, which was visually exposed in August 2017, when the Chief Prelate of Asgiriya Buddhist chapter visited the controversial Buddhist conversation project.

NPC Minister of Education for Northern Province, K Sarweswaran when contacted by journalists in Jaffna said it was important for schools to collaborate with the NPC Ministry providing further details of the alleged hidden elements of the programme.
