Colombo sabotages DNA testing on skeletal remains from mass graves

A new site of a mass grave was located this week in Mannaar, 75 meters from Maanthai junction towards Thirukkeatheesvaram, in an area that has been under the control of the occupying Sri Lanka Army since 1990 to the end of Vanni war. Such discoveries, which get highlighted as news stories, do not get proper investigative follow-up by the media, complain legal activists in Jaffna. Observing the pattern of systematic sabotage by the Colombo-centric Sri Lankan justice system on similar discoveries of mass graves in North in the past, Tamil lawyers say all requests for forensic examinations forwarded to Colombo by the SL courts in North and East get blocked in Colombo.

“Everything gets stopped in Colombo. There has been no single action on any request for DNA analysis on the recent discoveries of mass graves in Jaffna,” a lawyer who didn’t wish to be named told TamilNet.

There should be efforts by independent groups to send such skeletal remains outside the island for inspections in the future, the lawyers say.

A mechanism should be evolved to do this in a clandestine manner, as the Sri Lankan system would not allow it. However, the process should be credible enough to meet the standards of any future investigation on Sri Lanka at international level.

There is no use of demanding justice from a genocidal system to document the evidences, the lawyers say.

When the water supply workers were laying a pipeline along the roadside near Maanthai junction, they located two skeletal remains. Later, there were more than 10 skeletal remains found at the mass grave.

Similar graves were located in Jaffna inside the former ‘High Security Zone’ surrounding the military bases. Abducted Tamils were taken into cells operated by the SL military intelligence operatives. The victims were tortured and executed and dumped inside the abandoned wells, toilet pits or inside the bunkers dug for the purpose of doing away with the victims.

Sri Lanka Army (SLA) had interfered and had stopped Mannaar Government officials from attending an event organized by the Mannaar Citizen's Committee (MCC) to bring awareness of the laws and regulations governing ownership and transfer of lands, the President of MCC, Rev. Fr. Emmanuel Sebamalei, said in a media release issued during the second week of June. The agenda for the first two days of the event held for the NGOs was carried out without any difficulty, the organizers said, but that they had protested to the attendance of an SLA Intelligence officer during the first day of the seminar. Consequently, the organizers believe, the SLA took action to disrupt the event aimed at the Government officials, the memorandum said.
"We have observed discrimination in handling of state and private land matters in the Mannar district (and more broadly in Sri Lanka) and thought some awareness is necessary for the ordinary people and NGOs, especially those involved in dealing with housing matters under various housing schemes," MCC's memorandum said.

The memo further said, "The Army as well as the Navy has arbitrarily occupied land without any land related laws and administrative procedures being followed in the Northern Province for number of years. In the last few months this has become very critical and controversial, with the Army trying to occupy more land and local people, politicians, clergy, civil activists protesting and thousands of people filing court cases against the military and the government."

"In view of this, the MCC organized an awareness program about laws related to land, through the Center for Human Rights and Development (CHRD) based in Colombo," the memorandum said.

The MCC cautioned that "unlawful intrusions by the military into the activities of government officials, as well as the civil society, will continue," if the army officials who sabotaged the event are not identified and held accountable for their actions.

MLAM Hizbullah, the SL deputy minister of child development and women's affairs in Mahinda Rajapaksa's ruling UPFA, has allegedly instructed the divisional secretary of Kaaththaankudi SHM Muzammil to ignore the list of poverty stricken beneficiaries compiled by 18 village (GS) officers, placing instead his list of UPFA supporters as recipients of a housing grant under the ‘Shelter to the Nation’ housing development that comes under the SL ministry of Housing & Common Amenities, which is led by SL minister Wimal Weerawanse, the former propaganda secretary of the JVP and a Sinhala extremist ally of SL president Mahinda Rajapaksa.

Mr Muzammil on Wednesday informed the GS officers to put aside the list of 65 house-less families, whom the village officers had selected under his earlier instruction to identify poverty stricken families as recipients of the grants of 100,000 SL rupees per family.

The GS officers have opposed to the latest intervention by Mr Hizbullah and have rejected to acknowledge the list allegedly furnished by Mr Hizbullah.

The embarrassed divisional secretary has conveyed the anger of the grassroots to the SL deputy minister Hizbullah, informed sources in Kaaththaankudi said.
