Question raised on truth of Navi Pillay statement

UN Human Rights chief Ms Navanetham Pillay, in a press interview in Colombo towards the end of her recent visit to the island, has said that no one she had met there used the word genocide. TamilNet comes to know that there were specific instances in which responsible civil society members meeting her had told her about genocide in the island, using the very word genocide in English. Ms Navi Pillay held her civil society meetings under ‘Chatham House’ rules. In Vanni she told people that they could whisper in her ear. Has she misused such conditions to suppress what had actually been told to her, in order to shield an imperial design that accommodates genocide by the Agent State? Why should she hide the fact that the island Tamils in deed spoke to her on genocide, asks the civil society in the island.

Ms. Navi Pillay gave an exclusive interview to Easwaran Rutnam, the editor of Colombo Gazzette, on 31 August.
“The Tamil Diaspora tends to often raise the issue that there is genocide taking place in Sri Lanka. During your visit have you seen something to that effect or is it an exaggeration,” asked Mr Rutnam.

Navi Pillay replied: “Well nobody used that word to me; not in authorities or civil society. Genocide is particularly a legal word. I [inaudible] people since I was judge on the genocide tribunal to say that there has to be proof of an intent to destroy in whole or in part a nation, a group. This is what happened in Rwanda. That is a clear case of genocide. However it’s not for me to judge. It’s only after proper investigations the judges, based on the evidence, can conclude whether and what crimes were committed.”

At least two respectable civil society members who met Navi Pillay have told her in clear terms that what had taken place was genocide and what is taking place after the war in 2009 is structural genocide committed on the nation of Eezham Tamils, TamilNet learns this week from first hand sources in the island.

If the former international judge, who has investigated Rwanda and has found it a clear case of genocide, now as the UN human rights chief chooses to suppress even submissions on genocide by Eezham Tamils in the island, then that itself is a matter for investigation, commented civil society circles in the island.

Washington and New Delhi that architected the war and the aftermath in the island do not concede that the Sinhala State has committed genocide and is committing structural genocide.

The upper layer of Tamils being pro-imperial is the obstacle to the Tamil struggle for liberation and self-determination, Tamil political analysts say.

If Ms Navi Pillay thinks that genocide in the island has to be proved through proper investigations why shouldn’t she call for it now itself, rather than waiting for the end results to ‘prove’ irrefutable, but then irredeemable genocide, ask civil society circles.

Ms Navi Pillay's predecessor Ms Louise Arbour went as the chief of the International Crisis Group (ICG), after her tenure in the UN. The ICG, under her leadership was in the forefront in denying the genocide committed on Eezham Tamils. At a later stage, when world public criticism was mounting on, the ICG came out with a similar statement like that of the present statement of Ms Navi Pillay that genocide has to be proved by legal means as though it is somebody else's job and not of their concern.

“Australia’s indefinite detention of 46 recognized refugees on security grounds amounted to cruel, inhuman and degrading treatment, inflicting serious psychological harm on them,” the UNHRC said in a statement last week. The statement further said that Australia should release the refugees, of whom 42 are Tamils from Sri Lanka, who have been held for at least two and a half years, and offer them compensation and rehabilitation. Speaking to TamilNet on the UNHRC observations, Trevor Grant, veteran journalist and spokesperson for the Tamil Refugee Council, said the judgement vindicated the strong belief of many advocates and lawyers that indefinite detention was not only illegal but intolerable in a just society. However, the Australia’s Coalition still maintains a hardline approach against refugees.

"The Australian Government has been found guilty of almost 150 violations of a human rights treaty it has signed. It is an international embarrassment for Australia on the week it takes over the presidency of the UN Security Council," he said.

"How can this Government continue to lecture the rest of the world on upholding international law and human rights while it is now officially guilty of inflicting cruel, inhumane and degrading treatment upon innocent refugees? And what's worse, it has publicly ignored this damning indictment, saying only that it will respond in due course,” Mr. Grant Lamented.

“An Abbott government plans to shut down an independent review of Australian Security Intelligence Organisation security assessments that have condemned almost 50 refugees – including a mother and her three children – to indefinite detention,” The Age reported on Thursday, adding that “The Coalition has also cut off on any prospect of the refugees being released from immigration detention on special conditions, including wearing monitor bracelets.”

The mother referred to is Ms. Ranjini, an Eezham Tamil refugee, who has been held in detention for more than two and a half years. Her third child was born in the detention camps.

"The UN message to the Australian Government is unambiguous. If its' signature on a treaty means anything, it must immediately release these people. If it refuses to act, it is blackening the country's international reputation and making a mockery of its new Security Council position," Mr. Grant said.

The UNHRC statement had asserted that Australia’s treatment of refugees was contrary to accepted international norms.

“The combination of the arbitrary character of (their) detention, its protracted and/or indefinite duration, the refusal to provide information and procedural rights to (them) and the difficult conditions of detention are cumulatively inflicting serious psychological harm upon them,” the UN experts said.

USA, India, UNHRC answerable to provincial meddling in Sri Lanka

[TamilNet, Saturday, 06 July 2013, 23:56 GMT]However condemned by Eezham Tamils, the USA and India have committed on several occasions to ‘provincial’ solutions to the national crisis of Eezham Tamils. The ‘provincial’ wording has also got into the UNHRC resolution, tabled and fine-tuned by the two and passed by 47 Establishments. But, what do they say for Colombo’s current meddling in creating a new Sinhala division, Weli-oya, in the Northern Province, by altering district boundaries and thus endangering the province’s demographic security and contiguity, ask Eezham Tamil civil service circles in the island. While official survey maps show that the Vavuniyaa district of the Northern Province has a boundary with the East, it is now erased out in the 2012 census map, while Anuradhapura will fill the gap.

The Census Map of 2012 showing Weli-oya, a recently created and colonized division of the Mullaith-theevu district as an exclusive Sinhala division. The division has now wedged the contiguity between the Tamil districts Vavuniyaa in the Northern Province and Trincomalee in the Eastern Province, while it established contiguity with the Sinhala district Anuradhapura in the North Central Province.

The Weli-oya division in the Mullaith-theevu district of the Northern Province, newly created for the exclusive purpose of Sinhalicisation of a strategic piece of Tamil Land in order to wedge the North from the East, has been carved out by joining territories of the Mullaith-theevu district as well as territories of the Vavuniyaa district.

This has been done in such a way, so that Vavuniyaa would lose its boundary with Trincomalee and the Sinhalicised Weli-oya will have contiguity with Anuradhapura district of the North Central Province.

No Tamil civil servant in the Northern Province actually knows now what are the district boundaries and what are the village boundaries in the so-called Weli-oya division of the Mullaith-theevu district. No officials’ conferences related to the division invites any Tamil officials. Such conferences don’t take place in the Northern Province either.

All data related to Weli-oya is totally blacked out in the official web portal of Colombo’s Ministry of Public Administration and Home Affairs. In the 2012 Northern Province Statistical Handbook, 9 GSO (village level) divisions are listed under the Weli-oya division, but without proper code numbers due for such GSOs.

Only the map now released by the 2012 Census Commission shows that the Weli-oya division is a 100 per cent Sinhala division in the Mullaith-theevu district and it has a common boundary with the Anuradhapura district of the North Central Province.

Earlier the Mullaith-theevu district didn’t have a common boundary with Anuradhapura. Providing common boundary for Sinhala-colonised Weli-oya of Mullaith-theevu with the Sinhala NW province became possible only by wedging the contiguity of the Tamil districts of Vavuniyaa and Trincomalee.

The new division has been carved out in such a way so that all the potential tanks and arable lands will go the Sinhalese brought in to colonise the division.

Colombo is thoroughly opposed to ethnic divisions to protect Tamils in the Ampaa’rai district in the East. It has not earlier protected the identity of Tamils and Muslims in the Puththa’lam and Kurunegala districts of the North Western Province also.

There can’t be ethnic territories in the island says presidential sibling Gotabhaya and the genocidal regime. But how could an exclusive Sinhala division has been created in the Tamil province, so quickly within the last couple of years, and who is answerable to this, ask Tamils for alternative politics in the island.

The USA, India and the UN are answerable to so many crimes committed against Eezham Tamils as the entire genocide, which they are not prepared to accept, has now largely been perceived by Tamils as something that had been designed and executed by no one but the former two and the third one endorsing it.

But what is now happening even to the province for which they had committed is just another explicit example for the entire world and for those among the Tamils who still look upon to them to realise what these elements are really up to, commented Tamils for alternative politics in the island.

Relatives of detainees expecting post-Geneva release get no answer

Following the recent UNHRC process in Geneva, hundreds of kith and kin of the missing people in the occupied country of Eezham Tamils have again started visiting the Sri Lankan military camps, the so-called human rights commission offices and the offices of the Tamil politicians to locate the details of their loved ones. Some reports that appeared in the Tamil press in recent days, citing information obtained in Geneva by the Colombo-based Committee for Investigation of Disappeared, provided a list of 35 names saying that a section of Tamil prisoners, whose whereabouts were hitherto unknown, were to be produced in the courts by the Sri Lankan authorities. However, none of the relatives of the 35 names leaked in the report have managed to locate details of their missed ones, human rights activists in Jaffna told TamilNet.

The media reports had stated that the Colombo-based Committee for Investigation of Disappeared had obtained the list from a document allegedly produced by a Sri Lankan government outfit in Geneva.

The document was allegedly part of a move by Colombo to ‘convince’ the human rights stakeholders in the Geneva process that Colombo was doing ‘something’ in the direction of releasing those who are being detained at undisclosed locations.

In the meantime, NSSP politician Sunderam Mahendran, who is a director of the Committee for Investigation of Disappeared, said that he had no information of anyone having managed to locate the whereabouts of those mentioned in the list of 35 names.

While it turned out that the report was part of the annual drama staged by the SL government during the UNHRC sessions, with the USA and India in complicity, a senior Tamil parliamentarian in Jaffna, Appapillai Vinayagamoorthy, held a press meeting in Jaffna on Monday stating that he had no faith in any process expecting the Colombo regime to produce the details of the detained Tamils.

“The only way to establish the truth and conclude the fate of thousands of missing is to conduct an independent international investigation,” Mr Vinayagamoorthy said.

The TNA parliamentarian said that he had personally witnessed people who had handed over their family members to the SL military later being told that there was no information on their whereabouts.

“Even a university academic, a mother, who handed over her son and daughter to the SL military at Ki'linochchi, has been told by the same SL military now that there was no information on them,” the TNA parliamentarian said addressing journalists in Jaffna.

Following is a video recorded this week at Ki'linochchi where many mothers like Rajakrishnan Sarasvathy, have been again visiting various offices seeking information on their loved ones.



Mr Sarasvathy, from Aanaivizhunthaan of Karaichchi division in Ki'linochchi district, seeks the whereabouts of her daughter, Rohini, reported missing in 2012, more than 8 months after she was released from SL military detention in 2011.

Ms Rohini, after her release from SL military detention, had opted for a vocational training programme for 6 months at Kanakaampikaipuram in Ki'linochchi.

The victim was reported missing at Thirunakar where she was staying with her friend, according to her mother, who shows the ID card provided to her daughter by the International Organization for Migration (IOM). She also shows a photo of the victim with her friend.

Hundreds of Eezham Tamils gathered in front of the US Embassy in London on Friday evening, burnt the copy of the US resolution tabled at the UNHRC session in Geneva and the copy of the LLRC recommendations of Sri Lanka, based on which the USA has tabled the resolution. All the speakers at the protest welcomed the student uprising in Tamil Nadu opposing the US designs as an inspiration to global Tamils in continuing the struggle of Eezham Tamils. Viewing the US resolution as one that is facilitating the agenda of the genocidal State and regime of Sri Lanka in the annihilation of the nation of Eezham Tamils, the demonstrators demanded protection and solutions based on identity, territoriality and sovereignty of Eezham Tamils as a nation in the island. The protestors who gathered at a short notice braved rains and detractors pinning hopes on the USA.

Tamil activists of various walks addressed the protest: Journalists, alternative political activists, Leftists, activists of Tamil Youth Organisation and social activists.

Speaking at the demonstration, senior writer and columnist, Mr. Ithayachandran said that youth upsurge of such a scale in Tamil Nadu for the cause of Eezham Tamils takes place nearly after four decades. The youth would have risen up in 2009, but Mr. Karunanidhi sabotaged it, he said.

Speaking on the US resolution, Mr Ithayachandran said that even the usage ‘urges’ found in the 2012 US resolution on directing Sri Lanka has become ‘encourages’ in the 2013 resolution, and this shows the real orientation of the line of thinking adopted by the US resolutions.

Youth activist Sasithar Maheswaran, a democratically elected representative of Eezham Tamils in London, who has been articulating the perspectives of the second generation Tamil youth at various forums, told reporters that the LLRC report produced by Sri Lanka “actually outlines way in which the genocide can be completed - one of which was to ensure that no part of the island to be claimed by the Eezham Tamil Nation”.

He pointed out that the genocidal land grab, carried out by the Sri Lankan state for the past 65 years has been accelerated within the past 18 months.

The Geneva process, taking up the resolution, brings Sri Lanka to the table, but nonetheless the resolution itself, by promoting the LLRC recommendations is actually an act calling for the completion of the genocide of the Eezham Tamil Nation, Sasithar said adding that this is going to be UN seal of approval for the genocide of the Eezham Tamil Nation, being carried out by the Sri Lankan state.



“This time, it seems like Tamil Nadu students are determined to cause an attitudinal change,” said TU Senan, a leftist activist representing the Tamil Solidarity campaign group in UK. “This is a big inspiration. This struggle should be taken forward. There will be attempts to sabotage such uprisings, as it happened back in 2009 in Tamil Nadu. So, the students should plan carefully how they are going to take it forward overcoming the attempts to sabotage the trend,” he said.

“We will stand shoulder-to-shoulder with Tamil Nadu students because they are giving voice for our struggle and it is inspiring to see all the students joining hands together for our cause,” she said.

“We don’t support any resolution, such as the US-LLRC resolution, because it does not recognise the sovereignty of Tamil people. We came down here to send this message across,” Ms Bharathy further said.



Another student activist of the TYO-UK, Ms. Suganthy, coming hard on the LLRC-based resolution as a genocide-facilitation, said, “We are very much inspired by the protest and the hunger strike taken up by the Tamil Nadu students […] We will stand with the students in Tamil Nadu.”



According to Mr. Kandiah Rajamanoharan, a social activist and a representative of the TCC-UK, making the culprit the judge and giving time to the Sri Lankan state to complete the genocide, is what the USA is doing year after year in Geneva.

All the countries of the International Community know in their heart that what is taking place in the island is genocide. But, instead of giving time to the SL State to complete the genocide, they should recognise the fact as it is and come forward to support the Tamil struggle towards the independence of Tamil Eelam, which only will be the practical and just solution to end the misery of Tamil people in the island,” he further said.



When contacted by TamilNet, sections of Eezham Tamil Leftists in London said that many of them were not aware of the protest as the call for the protest was on a very low key.

Had it been circulated widely there would have been a mammoth crowd of like-minded Tamils who had been dormant with simmering feelings, the Tamil Left circles said, adding that organisers of such trend-setting protests should not depend on conventional elements and outfits, but should reach out to the alternative ones.

Attitudinal changes will not come by meekly compromising with fundamentally dangerous processes, arguing that there is at least something in them or by talking to diplomats who are bound by positions taken by the Establishments. People showing their power with consistent uprising at the right time could only force attitudinal changes in the Establishments, the Tamil Left circles further said.



Speaking at the demonstration, youth activist Mr. Sivanthan, who had walked across Europe raising awareness and who had been on a campaign recently in a caravan vehicle to Geneva, said that the London protest in front of the US Embassy amidst opposition from the detractors, is only a beginning and it should take momentum in the diaspora in the coming days, months and years.

He urged the world Tamils, especially the youth, to get the inspiration from the students of Tamil Nadu in taking the message across the world, in addition to showing solidarity with them.

“Of all the demands, what inspired me a lot was the way they exposed the LLRC-based resolution that is being tabled for the second time by the USA in Geneva,” Sivanthan said adding that he fully supports the 9-point demand put forth by the intelligent students in Tamil Nadu.

Do not give up, it is a sharp demand and is a just demand. It has clearly identified that what USA seeks is only regime change and not resolving our problems, Sivanthan further said.

UNHRC, CHOGM, Regime Change: people’s power has no substitute

A drama has been carefully executed by all in the game ultimately guilty of crimes and detract the question of Eezham Tamils: first by giving hope and by deploying agents among Tamils that something serious in ‘procedure’ is going to take place, so that any righteous Tamil mobilisation in the island and in the diaspora could be diffused; then by pointing to New Delhi competing in the crime so that the political parties fixed and the gullible in Tamil Nadu would be facilitators, and finally by tabling a mischievous resolution so that whether it is passed or not passed it would favour the genocidal State and regime in Sri Lanka, writes TamilNet political commentator in Colombo, welcoming the youth uprising in Tamil Nadu and adding that there is no substitute to people’s power in altering the machinations.

Those among the Tamils, who lament that if not for the US resolution what are the ‘realistic’ options, and those who see the Tamil Nadu student uprising against the resolution as an Indian conspiracy to evade passing the resolution, need not worry about the resolution getting passed or not. All in the game have an array of programmes to keep them engaged and deviated in the forthcoming months and perhaps in the many years to come.

Already the opposition (and not the ruling factions) in the US-UK bloc has been set to talk about the CHOGM in November, to demand international investigation at the inferior forum, when the USA has already tabled a resolution not welcoming such an investigation at the UNHRC that will be officially binding the international process in the coming years.

There are others who swear on the prospects of the USA bringing in a ‘regime change’ in Colombo and tell the Tamils to pin hopes on that for their salvation, while all in the game are busy in grooming the Sinhala military in the island. What is the point in the ‘regime change’ when the fundamentals of the Eezham Tamil question are not recognized and when the genocidal Sinhala military is pampered in competition in every walk of life in the island by every power concerned?

Those among the Tamils, who have no inclination to struggle against the ultimate culprits and are made to look upon like the unfortunate Tamils at Mu’l’livaaykkaal, who were made to look in vain for the US ships to come to their rescue, could keep themselves busy in the anticipation of the ‘regime change’.

In exploitation of the question of Eezham Tamils, and in complicity with the genocidal State, regime and the opposition in Colombo, the Sinhala nation gradually falling a prey to international vultures is in no way going to help the nation of Eezham Tamils sharing the same island.

Imperialism has a 200-year-old history in experimenting certain ‘firsts’ in the island, affecting the peoples of the island and the entire region.

Those who talk about diplomatic manoeuvrings and soft power–hard power formulas, by exercising no power at all and merely by sitting in the pockets of the powers, forget that there is no substitute for people’s power.

The students of Tamil Nadu have taken a unique stand in speaking the people’s language, which only will be inevitably intelligible to those who habitually pretend deaf.

The diaspora in the USA has become a vegetable long back. The old generation of the diaspora in the UK, Canada and Australia may have no voice to address the ultimate culprits. But let them not stand in the way of young generation spontaneously voicing in Tamil Nadu and having a discourse with the young generation in the diaspora.

The empty draft resolution tabled by the USA has provided an opportunity for Tamils to know who is standing where.

Whether the hollow resolution is passed or not is now immaterial. Whatever the respite the Rajapaksa regime may get over it, is short lived, provided Tamils in the island, Tamil Nadu and in the diaspora in unison demonstrate the people’s power of resentment. Both the USA and India cannot escape from taking action in the desired direction, if the youth uprising in Tamil Nadu is going to be strengthened in concept and mobilisation.

The resolution tabled in the Geneva UNHCR sessions by the USA in concert with India, which sidesteps forcing an independent international investigation into the Mu'l'livaaykaal killings, and misleads the Eezham Tamils into a mirage that international community will seek accountability, appears entirely consistent with the intervention of the U.S. State Department in the legal actions pursued by Tamil plaintiffs against Sri Lanka's President Rajapakse, legal sources in Washington said. U.S. is acting as a proxy to Rajapakses in filing legal briefs and replacing Patton Boggs as "the attorneys" for Rajapakse.

"The U.S. State Department exercising the discretionary powers to intervene legally in the case against Rajapakse effectively blocks a pre-trial discovery process which would have uncovered facts related to the Sri Lanka killings. Therefore, this US intervention is not inconsistent with the resolution which does not call for an independent international investigation," spokesperson for Tamils Against Genocide (TAG), a US-based activist organization that seeks legal redress to Tamil victims war, said.

United States Court of Appeals for the District of Columbia circuit has scheduled March 8th, 9:30 am for the oral argument in the appeal case against Sri Lanka's President Mahinda Rajapakse for civil damages on war-crimes charges filed by three Tamil plaintiffs whose relatives were extra-judicially executed or unlawfully killed under the "command responsibility" of Rajapakse.

United States Justice Department lawyers, under the direction from the State Department, will present the legal oral argument supporting immunity to Defendant-Appellee Rajapakse, legal sources in Washington said. Rajapakse appointed attorneys at Patton Boggs, a large law firm in Washington D.C. will concede their full allocagted time to the US Government to argue the case for Rajapakse, the procedural motions in the case docket indicated.

"The U.S. Government has affirmatively exercised its option, first in the trial court, and now in the appellate court, to intervene to save Rajapakse from legal action by legitimate victims of his allegedly murderous conduct. Ambassador Blake architected policy of appeasing Sri Lanka overlooking the killing more than 80,000 Tamil civilians in Mu'l'livaaykkaal, appears to have even trumped Sri Lanka's continued dismissal of the chorus of disapproval from the West on autocracy-leaning governance matters in Colombo," TAG spokesperson said in an earlier note to TamilNet.

UNHRC heads for structural genocide if Tamil nation territory is not guaranteed: TNPF

An internationally monitored interim administration in the North and East under UN supervision outside the parameters of the Sri Lankan Constitution is the only way forward to stop the genocide being committed on Tamils, especially to put an immediate end to the accelerated structural genocide taking place in the Tamil homeland, reiterated Gajendrakumar Ponnambalam, the president of the Tamil National Peoples Front (TNPF), in the first press meeting held at the newly opened press club in Jaffna on Monday. The current indications are that the UNHRC would end up giving another year of time and space to Colombo and the TNA that supported the resolution last year without a principled approach is answerable to what resulted from the resolution in the past 12 months, Gajendrakumar further said.

Blaming the Tamil National Alliance (TNA) and the section of media that were refuting the position the TNPF took during the last round of UNHRC sessions, Mr Gajendrakumar said that the so-called step-by-step approach is a farce on the part of the powers that were limiting the UNHRC resolution to the internal paradigms set by the Sri Lankan State.

Arguing that the way forward could be nothing else than securing the territoriality of the Tamil nation in the North and East to safeguard it from existential threat, by clearly articulating the Tamil demands to the international community, he reminded the press in Jaffna that an interim solution is needed even to fulfil the iota of demands being advocated by the IC.

Limiting the investigations to the last phase of the war is ignoring the Tamil demand for investigation of the protracted genocide since the British left the island, Gajendrakumar said.

To ensure that people in the North and East are able to take part in free and fair investigations and present their evidences without any fear, an extra-constitutional interim administration must be in place, he said.

The leaders of the TNA and the section of media that were trumpeting about the resolution framed last year are now answerable to the people for their utter ignorance and lack of a principled approach with regards to the Tamil aspirations, the TNPF leader said.

Citing reliable sources and information obtained through direct contacts, Gajendrakumar said that the resolution to be framed this time is going to end up giving another year calling for the implementation of the resolution tabled last time. The situation on the ground has only worsened during the last 12 months, he said citing that the best evidence to the trend is nothing else than the latest report by UN High Commissioner for Human Rights Ms Navaneethampillai.

In the meantime, the TNA bringing in the UNP into the North and East, harping on a ‘regime-change’ agenda has come under severe criticism among Tamil political analysts in the island. They cited Ranil Wickramasinghe favouring the Sinhala military to stay in the Tamil country and advocating that the solution to the ethnic question is implementation of the LLRC. Mr Wickramasinghe was also seen ridiculing the sections that call for federal solutions.

The ‘regime change’ strategy meekly followed by the TNA on the ill advices of the powers, by taking the side of the former SL military commander Sarath Fonseka and the UNP in the last presidential election of Colombo, is now interpreted in India by unscrupulous elements like Subramainam Swamy as a proof for Tamils endorsing the SL military that fought against the LTTE, Tamil political observers in the island cited.

Elements in India that don’t hesitate to deploy genocide a tool to promote imperialist interests and back Rajapaksa regime, now use the imprudence of the TNA to argue that there is no need for war crimes investigations, the political observers further cited.

Tamils raped in Sri Lanka custody - HRW

Human Rights Watch (HRW) said in a report released this week that Sri Lankan security forces have committed crimes of sexual violence against ethnic Tamils in state custody between 2006 and 2012. The said detainees were arrested because of their suspected links to the LTTE. The report gives 75 accounts of alleged sexual abuse and torture, saying most of them are backed by medical evidence.

Noting that the sex crimes committed by government security forces "sharply increased" following a ceasefire breakdown in 2006, the report said most of the abuses were politically motivated.

"Rape was one of the unlawful tools used by the military and police against suspected LTTE members or supporters to gather intelligence during the fighting and immediately after the conflict ended in May 2009, as well as to obtain information about any remnants of the LTTE since then, whether in Sri Lanka or abroad," BBC said quoting the report.

The research was carried out secretly because of government access restrictions, the organisation says. As a result, it was able to speak only to ex-captives and not to current detainees, whose "fate is of urgent concern," the Rights group said.

Attacks against Tamil farmers escalate in Vellaave’li, Batticaloa

A Tamil village official looking after agricultural tracts (Vaddavithaa’nai) in Kevu’liyaa-madu in Vellaave’li division of Batticaloa district was severely assaulted four days ago by a group of Sinhalese settlers who have occupied the farm and grazing lands of Tamils. Two weeks ago, Sinhala ‘home guards’ had assaulted Tamil youths who were breeding their cattle in the same area, news sources in Vellaave’li said.

Earlier, the land official had made a complaint with the SL police in Kevu’liyaa-madu that the cattle of the Sinhalese person were daily causing damage to paddy crops of the Tamil farmers.

As the SL Police did not take any action to the complaint, the Vaddavithaa’nai official went straight to the Sinhala owner of the cattle, requesting him not to allow his cattle to damage paddy crops of Tamil farmers.

The Sinhala settler denied the allegation and started attacking the land official.

The Vaddavithaanai official, who was subjected to the assault, again went to the SL police and made another complaint about the assault by the Sinhala dairy farmer. The SL police did not take action on that complaint too.

Kevu’liyaa-madu is located along the border of Ampaa’rai district.

NZ Tamils raise question on applying SA model to Eezham Tamils

“We are constrained to seek a clarification from those few who are waxing eloquently on the need to study and gain from the recommendations of the Truth and Reconciliation Commission of South Africa vis-à-vis the LLRC recommendations of Sri Lanka,” said a press release coming from the Tamil Action Front (TAF) of New Zealand on Sunday, raising the question, “Will those protagonists of the South African experience please explain to the Tamil diaspora at least what they mean – what is it that is so significant for the Tamils to emulate?” The press release signed by the TAF coordinator Mr. A Theva Rajan, brought out the contextual difference between South Africa and the island of Sri Lanka.

The press release hinted at New Delhi’s hands behind the out of context conflation of South African model with the island of Sri Lanka, where the Rajapaksa regime is still engaged in genocide, and said that K M Panikkar’s dream about India and the Indian Ocean has been shattered by M K Narayan, Shiva Shankar Menon, and Nirupama Menon.

The TAF has earlier accused the Obama administration for doing nothing to check genocide in the island, in its letter addressed to the US President Mr Barack Obama on last Wednesday, and asked the question “ are our beliefs that Russia is a champion of the downtrodden and oppressed a false dream,” in a letter addressed to Mr Vladimir Putin on last Thursday.

The TAF statements were impelled by the US position of bringing out a resolution of lacuna in Geneva that doesn’t recognise the territoriality of the nation of Eezham Tamils in the island and the reported stand of Putin that Russia have vowed to see that the motion against Sri Lanka scheduled to be taken up at the March sessions of the UNHRC is not carried through.

The current statement of the TAF targeted New Delhi for being an “amused onlooker” even when the 13th Amendment has been reduced to zero by the Divineguma Law under genocidal Colombo, and when a Chief Justice of the State had to face impeachment for rejecting that law as unconstitutional.

The stand taken by the Tamil Action Front of New Zealand in targeting the Establishments that globally orchestrate in silencing the grassroot voices of Eezham Tamils is refreshing, when sections of politicians, activists and academics are hijacked by the orchestration, commented political observers among Eezham Tamils.

Navi Pillay precludes ‘procedures’ to adopt by UNHRC process

While the US officials, who visited the island of Sri Lanka last month, were talking of tabling a ‘procedural resolution’ to approach affairs of the island at the March sessions of the UNHRC in Geneva, the report that has come from the office of Ms Navi Pillai (OHCHR) on Monday outlined what procedures have to be taken to further the processes started with last year’s resolution at the UNHRC. When the US-tabled resolution, watered down by India and passed last year, was fundamentally responsible for the acceleration of structural genocide of Eezham Tamils as witnessed in the course of the year, any further ‘procedural’ enhancement of the resolution is like decorating the rat’s tail with a silk tassel, as the saying in Tamil goes (eli vaalukku padduk kungncham), commented human rights activists in Jaffna.

Navi Pillay, UN High Commissioner for Human Rights

Ms. Navi Pillay is the UN High Commissioner for Human Rights and heads the Office of the United Nations High Commissioner for Human Rights (OHCHR).

The United Nations Human Rights Council (UNHRC) is a UN body of 47 elected countries, the sessions of which are facilitated and convened by the UN High Commissioner for Human Rights.

Upholding Colombo’s genocidal blueprint of the LLRC as “significant and far-reaching”, the report by the OHCHR observed that the Government of Sri Lanka has made “significant progress in rebuilding infrastructure”.

However, the report identified that the commitment for implementation of LLRC findings had come only on selected recommendations.

It also said that the Colombo government had not adequately engaged civil society in support of a “more consultative and inclusive reconciliation process”.

On investigation of alleged serious violations of human rights, the steps taken by Sri Lanka have been “inconclusive, and lack the independence and impartiality required to inspire confidence”, the report said.

The report urged urgency of action to combat impunity, pointing out reports of “extrajudicial killings, abductions and enforced disappearances”.

The report was harping on the “establishment of a truth-seeking mechanism as an integral part of a more comprehensive and inclusive approach to transitional justice”.

Shallowly dealing with recent manifestations of congenital issues in the island, the report suggested to “engage civil society and minority community representatives in dialogue on appropriate forms of commemoration and memorialization that will advance inclusion and reconciliation.”

On the crux of the matter, elusive to solutions in the island for ages, the report restricted itself only to taking “further steps in demilitarization and devolution to involve minority communities fully in decision-making processes.”

The report concluded by citing the stand of Ms Navi Pillai that “In this regard, she reaffirms her long-standing call for an independent and credible international investigation into alleged violations of international human rights and humanitarian law, which could also monitor any domestic accountability process.”

While what crisis that has taken the island to the international scrutiny is a national question and is a question of genocide, the approach and procedural suggestions viewing it as something not connected to the questions, but to connected to all-island structural issues, is a fundamentally deviatory and a knowingly wrong machination repeated over the ages due to the Power interests.

TESO misrepresents Tamil cause by harping on UNHRC resolution

By calling for pressure on Colombo to immediately implement the 2012 UNHRC resolution as solution, TESO is misrepresenting the cause as well as plight of Eezham Tamils, and is misleading the world in lines with the agenda of New Delhi and Washington, Tamil activists in the island and in the diaspora commented. The UNHRC resolution harping on the implementation of LLRC recommendations of Colombo is actually ‘international legitimisation’ of the structural genocide and annihilation of the territoriality of the nation of Eezham Tamils in the island. This only serves the agenda of New Delhi and Washington that uphold the genocidal Sinhala State in the island for their geopolitical and imperialistic purposes. TESO has to urge the International Community of Establishments to revise the resolution, the activists further said.

Led by Mr MK Stalin, the DMK Treasurer and son of the DMK chief, Mr M. Karunanidhi, a team of TESO members, the DK chief Mr. K. Veeramani, VCK chief Mr Thol Thirumavalavan, Prof. Supa. Virapandiyan, former central minister Ms Subbhulakshmi Jagdeesan and DMK parliamentary leader Mr TR Balu are on a visit to New Delhi on Sunday to meet Indian Minister of External Affairs and Ambassadors of the 47 countries in the UNHRC, a DMK press release said on Saturday.

The team will request the dignitaries they meet to facilitate peaceful life to Eezham Tamils, acceleration of rehabilitation, political solution and pressure on Colombo for the immediate implementation of the 2012 UNHRC resolution, the press release of the DMK headquarters cited Mr TR Balu.

It may be a printer’s devil that the press release coming from the Dravidian movement, known for its use of pun in Tamil, talked about requesting Pu’nar Vaazhvu for Eezham Tamils instead of Punar Vaazhvu. But Pu’nar Vaazhvu (life of assimilation) is exactly what would happen if the current UNHRC resolution is implemented as requested by the TESO, Eezham Tamil activists commented.

As recently pointed out by the DMK Chief Mr M Karunanidhi, in a letter to the Centre at New Delhi, ‘Pu'nar Vaazhvu’ is the one that is implemented every day by the occupying Sinhala soldiers in Vanni.

One of the members in the TESO team, Mr Thol Thirumavalavan, sometimes back requested Congress President Ms Sonia Gandhi to facilitate the implementation of LLRC recommendations to help ‘Sri Lankan’ Tamils.

Except the DK chief, the others in the team are members of parties that align with the ruling Congress at New Delhi.

In the political parties, bureaucracy, media and the intelligence and security services of India, it is difficult to trace where India ends and the USA begins or vice versa, political observers commented.

Unless the Tamil movements directly challenge the structural-genocide outlook of New Delhi and Washington towards the nation of Eezham Tamils in the island, and mobilise the world to go beyond the machinations of the two powers, they are not helping the Eezham Tamils but only serve their ultimate adversaries, alternative shades of Tamil activists in the island and in the diaspora commented.
