Evidence presented against Sri Lanka at Genocide Tribunal in Germany

During the Second Session of the Peoples’ Tribunal on Sri Lanka which opened Saturday in Bremen, Germany, a panel of eleven eminent judges heard the "Prosecution outline its case that the crime of genocide has been and is being committed against the Tamil people in Sri Lanka," the press release issued by the sponsoring organizations, Permanent Peoples Tribunal (PPT) and Internationaler Menschenrechtsverein Bremen e.V. said. Eleven direct witnesses gave evidence to the panel during the first day. The judges, many of whom are legal scholars on genocide, will apply the principles enshrined in the 1948 Genocide Convention to the evidence presented, and announce their legal determination this Tuesday, December 10th.
Excerpts from the press release follows:
    This Second Session in Bremen was convened in response to the determination by the First Session, held in January 2010 in Dublin, Ireland, that War Crimes and Crimes against Humanity had taken place on the Eelam Tamil population during the final months of the war in Sri Lanka in early 2009, and that further investigation be undertaken regarding the question of genocide.

    These two sessions of the Permanent Peoples’ Tribunal on Sri Lanka have been established in response to a submission made by the International Human Rights Association Bremen (IMRV) and the Irish Forum for Peace in Sri Lanka (IFPSL). As in the First Session, here in Bremen a panel of judges consisting of experts in genocide studies, former UN officials, experts in international law and renowned peace and human rights activists (see attachment) will hear the evidence that is presented and will announce their judgment on Tuesday 10 December 2013 (Human Rights Day).
The spokesperson for Tamils Against Genocide (TAG), a US-based activist group which seeks legal redress to Tamil victims of war, said that the the hearings of the Sri Lanka tribunal is a land-mark event that the Tamil diaspora should use to further shape future legal efforts to ensnare Colombo into a sustainable genocide legal net in the Western Courts.

TAG added, "Parsing the population in the safe zone during the last months of the war into the categories of combatant and civilian is consistent with a laws-of-war analysis of Mu'l'livaaykkaal. However, the combatant-civilian distinction is not appropriate for analyzing Mu'l'livaaykkaal as a case of genocide. A genocide analysis in brief has three prongs. It identifies whether a group existed that was targeted for extermination, whether an actor took demonstrable steps to further this extermination, and whether the actor took those steps with the specific intent to exterminate that group. As such, in Mu'll'ivaaykkaal, combatant and civilians categories are not relevant to a genocide analysis. Both communities of combatants and civilians fall into the unitary group of ethnic Tamil.

"The genocide legal inquiry and the evidence presented, therefore, should remain focused on whether the government's military operations are cognizable as acts of genocide within the aforementioned framework, viewing combatant and civilians as not separate groupings, but part of one unitary group of ethnic Tamils targeted for extermination. Arguments that contemplate laws-of-war factors, such as proportionality or distinction, are not relevant to the genocide framework, TAG said.

"Also, in the determination of whether the GoSL conducted its military operations with genocidal intent, post-Mu'l'livaaykkaal colonization is a significant factor which should be considered in the inference of intent from the facts. When viewed in light of Sri Lankan military operations, the state-sponsored Sinhala colonization of Tamil areas after Mu'l'livaaykkaal, as widely highlighted by International actors, including UN's Special Rapporteur Chaloka Beyani, provide an additional circumstantial factual basis to infer a specific intent to exterminate the ethnic Tamil group," TAG said.

While the proceedings are broadcast alive, the Tribunal has provided private, off-camera facility to witnesses, who fear danger to their lives or to the lives of relatives, to present the evidence.

Article 2 of the Geneva Convention states: Genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:
  1. Killing members of the group;
  2. Causing serious bodily or mental harm to members of the group;
  3. Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;
  4. Imposing measures intended to prevent births within the group;
  5. Forcibly transferring children of the group to another group.

While representatives of a section of Indian political parties were on a fact finding mission to the island, meeting various Tamil political, civil society, chamber of commerce and former civil members in Jaffna on Tuesday and Wednesday under the aegis of the Indian High Commission and the Indian Consulate in Jaffna, the SL government in Colombo is engaging with a high level Pakistani Defence delegation comprising 19 members who are on a one-week visit to the island. The visit by Pakistani defence delegation follows the visit of the Chinese Deputy Minister of Intelligence last week.

The Pakistani delegation visiting Colombo was ‘concentrating’ on gaining awareness on Sri Lanka’s ‘defence, development, domestic and foreign policy matters’, reports in Colombo said.

The Pakistani delegation is meeting the SL Defence Secretary and presidential sibling Gotabhaya Rajapaksa, all the commanders of the three armed forces and the governor of the Central Bank, the reports further said.

The Pakistani defence delegation was also scheduled to visit the North, informed sources in Colombo said.

Last week, the Chinese intelligence minister visited Jaffna and Trincomalee in the company of the occupying Sinhala military.

The SL State in Colombo, as usual, is counting on its underhand abilities in prompting bureaucrats in New Delhi and sections of media in India, to sustain the line of the New Delhi Establishment to remain hostile to the interests and existence of the nation of Eezham Tamils, informed sources in Colombo said.

In the meantime, the Tamil delegates in Jaffna were unanimous in explaining to the delegation of Indian political party representatives that India talking about 13th Amendment or about 13 plus, would not help Eezham Tamils under the unitary character of the Sri Lankan constitution, sources in Jaffna said.

Except a few individuals of the Tamil National Alliance (TNA), planted or prodded by the very powers that directed the genocidal war and continue to facilitate the structural genocide against the nation of Eezham Tamils, the grassroots sections of the Tamil polity remain sharp in comprehending the machinations and in articulating for the righteous aspirations of Eezham Tamils, young generation politicians told TamilNet.

Responding to the protest waged by the Actor’s Guild of the Tamil Nadu Film industry in Chennai against the genocide of Tamils in the island of Sri Lanka, a Colombo media Ceylon Today on Thursday came out with a feature written by a “special Correspondent,” titled “A friend turned foe.” The feature detailed the long and two-way connections between the film industries of Tamil Nadu and Sri Lanka. The implied message, against the backdrop of ‘economic embrace’ contemplated in the corporate circles of India, is that ‘business should not be affected.’ Whether India’s economic embrace of the Sinhala State should take place over the annihilation of the nation of Eezham Tamils, and whether the Indian Establishment and corporatism are unable to conceive anything alternative, are the questions righteously raised by the protest coming from the Tamil artists, writes an academic in Jaffna.

Further discussion brought out by the academic in Jaffna follows:

The Ceylon Today feature talking on the friendship of the two film industries said: “It is not as if it has been a one-way street between Tamil Nadu and Sri Lanka, with traffic flowing only in one direction, from Chennai to Colombo. Talent and music have gone from Sri Lanka to Tamil Nadu as well.”

But the Ceylon Today feature’s perception of the two-way traffic and what is ‘Sri Lankan’ was restricted to Bhanumathi singing a Sinhala song in 1958 and Malini Fonseka acting with Sivaji Ganeshan in 1978.

There is no one to remember that the first woman who went from the island to act in the Madras film industry, as heroin as early as in 1936, was Thavamanidevi who came from the then high society of Jaffna.

Because, to the heritage academics and media of the Sinhalese, an Eezham Tamil cannot be a ‘Sri Lankan.’ And the Eezham Tamils don’t have a State for them to be proud about the achievements of their nation or for inviting the ‘embrace’ of Establishments and corporates.

What is noticed in writing film history could be seen in every walk of study in the island.

A few years ago, a veteran Sinhala Professor and Editor in Chief of Sinhala Encyclopaedia, KNO Dharmadasa, sponsored by the Sri Lanka Deputy High Commission in Chennai, delivered a lecture on “Religions in Contact: Syncretism of Beliefs, Deities and Rituals in Sri Lanka and Southern India.”

His lecture, published as a booklet, had a map showing the distribution of the cults of folk deities in the island. Surprisingly, the map was almost blank on the North and East of the island.

Whether it meant that Tamils in the island didn’t have any folk religion of theirs worthy of note, or the Eezham Tamil folklore was not Sri Lankan folklore, or the author was ignorant, the book had the label ‘Sri Lankan’ for what was exclusively Sinhala.

Typical of its ‘embrace’ to whatever that is ‘Sri Lankan’, The Hindu group in Chennai jumped at interviewing and highlighting his lecture. But no one asked him why the Eezham Tamil heritage was missing.

In July 2011, Professor Dharmadasa “celebrating multilingualism” in the island didn’t want to acknowledge any early presence of Tamil in the island. Tamil came to be introduced into the island at a later time, especially after the Polonnaruva period (c. 13th century AD), he said.

Another Sinhala academic, an Emeritus Professor of Geography from the University of Peradeniya, C.M. Madduma Bandara, published a paper in 2009 on “Exploring the link between culture and biodiversity in Sri Lanka.”

The paper appeared in SANSAI, an environmental journal of Kyoto University connections, discussed the cultural outlook for human-biodiversity phenomenon in the island, using terms, names and literary references of fauna, flora and place names that are exclusively Sinhala.

The Eezham Tamil perception of the human-biodiversity phenomenon in their own land, expressed through names, terms and toponyms in their own language Tamil for centuries, has no recognition under ‘Sri Lanka’.

Professor Madduma Bandara was attached to the Geography Department of the Peradeniya University in Sri Lanka for forty years. Still one may excuse him for not knowing Tamil and for not knowing the cultural diversity part of the human-biodiversity expressions in the island. But what is academically un-excusable is the paper presenting an image in an international journal that what is expressed in Sinhala and by Sinhalese alone is the Sri Lankan culture – unless the learned professor concedes that the Tamil-prevailing territories are not Sri Lanka.

International refereed journals, such as SANSAI connected to the Kyoto University of Japan, should take care of the unjustified use of terminologies, especially when they come from genocidal contexts. Otherwise they contribute to the genocide.

Even today universities, international conferences and refereed journals impose the use of the word Sri Lanka on Eezham Tamils. There was a time when the universities in the West equated Tamil with ‘terrorism,’ frowned at the word and insisted on having ‘conferences’ on ‘Sri Lanka’ even when the subject matter was confined to Eezham Tamils. But these ‘temples of knowledge’ don’t take care when Sri Lanka is exclusively equated to Sinhala, even in academic treatment, because the ‘temples’ are just handmaids of the Establishments and States.

Genocide begins from the mind-set

The way the Sinhala mind-set has long been established on the idea of nation and State in the island and the way it has been internationally presented and in return internationally groomed, the nation of Eezham Tamils would only face genocide and annihilation if they do not achieve independence.

The paly-paly lure aimed at the influential Tamil Nadu film industry by the corporate interests of both India and Sri Lanka as well as by both the Establishments that have deployed all kinds of forces to diffuse any hindrances to their agenda, is ineffective when the basic mind-set is unjustifiable.

I agree with your observation that"Most of today's problems are due to corrupt politics. Unless it is cleansed, nothing would improve. "
At the same time due to the wrong and rotten approach of the politicians people are suffering a lot.For example,take the "Koodankulam Atomic powerplant project" which is a threat to the lives of Fishermen living in the surrounding area.It is also an impending hazard
detrimental to the ecological system.Due to the mixing of the waste the ocean itself may turn as a poison to the flora and fauna.
Thousands and thousands of village peoiple are conducting Dharnas and holding fasts for more than a period of Four months there.I wonder how can your party be termed as Aamaadmi Party,while you are not at all uttering even a word about the plight of the people there at Koodankulam?
The Genocide conducted by Rajapakshe at SriLanka is condemned by the people throughout the world and almost the entire humankind is pressing the U.N. to conduct an impartial enquiry about the sufferings of the Eezham Tamils.
You never spoke a word expressing your condmnation of the atrocoties committed by Rajapakshe government.Is it not the duty of a humanist to sympathise the people who are tortured and tormented by a racist military junta under the mask of Anti-terorism?
It is quite clear that your whole attention is concentrated at Delhi.

You are under the assumption that Delhi is India or India is Delhi.
Please see the plights and perils of the people at Assam,Nagaland,Andhra and Tamilnadu and assess a possible action programme to redress the grievances of people from Himalayas to Capecomorin.

The time has come for people to rise up together and say that they will not allow this corruption.

To give people strength to protest, to remove fear from their minds and join the civil disobedience movement I have been sitting on an indefinite fast at a jhuggi colony in Sundar-nagri , New Delhi since 23rd March. More than 9 lakh people of Delhi and several eminent and patriotic citizens of the country such as Shri Annaji Hazare , Justice Krishna Iyer, Admiral Ramdas and Shri J.M. Lyngdoh have already pledged support towards this campaign.

Gandhiji said that politics devoid of honesty and spirituality is disastrous for the country. We have to change the politics of this country. I am confident that together, we can.

A squad operated by the Sri Lankan military intelligence on Wednesday stormed the Ki'linochchi office of the Uthayan daily around 4:30 a.m., when the distributors of the paper arrived at the office to unload the papers for distribution. The branch manager of the office and four distributors sustained injuries and three of them with serious injuries have been admitted at Ki'linochchi hospital. The office, subjected to the attack is situated on Karadippoakku Junction on A9 Road, heavily guarded by the occupying SL military. The attack has been carried out in a similar fashion as the one reported Saturday on the meeting of ITAK, a constituent party of the Tamil National Alliance.

The SL military has been stepping up attacks on Tamil paper distributors in Jaffna, Ki'linochchi, Mullaiththeevu and Vavuniaya dsitricts in recent times.

The office has sustained damage and the computers have been smashed, according to E. Saravanapavan, the owner of the paper, who is a TNA parliamentarian representing Jaffna district. He had narrowly escaped from the attack on ITAK meeting on Saturday.

A vehicle and two motorbikes have also been damaged in the attack, which has been carried out by the SL military.

இந்நிலையில், வியாழன் அன்று இரவு, இலங்கையின் தலைநகரான கொழும்புக்கு அருகே உள்ள பெப்பிலியானா என்ற இடத்தில், முஸ்லிம் ஒருவரின் கடை அடித்து நொறுக்கப்பட்டு தீக்கிரையாக்கப்பட்டுள்ளது. இதில் பலர் காயமடைந்துள்ளதாகவும், பல வாகனங்கள் சேதப்படுத்தப்பட்டதாகவும் செய்தி வெளியாகி உள்ளது.

பொது பால சேனா என்ற புத்தப்படைப் பிரிவினர், முஸ்லிம் மக்கள் ஹலால் என்ற முத்திரையை உணவுப்பொருட்களின் மீது பயன்படுத்துவதைத் தடைசெய்யக் கோரி வந்தனர். 20 மில்லியன் மக்கள்தொகையில் 10 சதவிகிதத்தினரே முஸ்லிம் என்பதால் மற்றவர்களை இது அவமதிப்பதாகும் என்பது இப்பிரிவினரின் கருத்தாகும்.

எனவே, இந்த சம்பவத்தில் அவர்கள் ஈடுபட்டிருக்கலாம் என்ற யூகங்கள் எழுந்தன. ஆனால், ஞானசேகரா என்ற இப்பிரிவின் தலைவர் இதனை மறுத்துள்ளார்.முஸ்லிம்களின் தீவிரப்பற்றினைத்தாம் தாங்கள் எதிர்ப்பதாகவும், மக்களை அல்ல என்றும் தெரிவித்தார்.

இது எதேச்சையாக நடந்த ஒரு விஷயம் என்றும், மற்றொரு இனக்கலவரத்தைத் தாங்கள் விரும்பவில்லை என்றும் அவர் கூறினார்.  இலங்கையின் காவல்துறையினரும், சிறப்புப் படைப்பிரிவினரும் நிலைமையைக்கட்டுக்குள் கொண்டுவந்துள்ளனர்
