The March resolution at UNHRC in Geneva, designed by the USA and watered down by India, is directly responsible for all the current ‘legalisation’ of the genocidal militarisation carried out by the occupying Sinhala State in the country of Eezham Tamils in the island, said alternative Tamil political activists in Jaffna, citing the ‘legal’ appropriation of 6400 acres of Tamil civilian lands at Jaffna HSZ and another 6000 acres in Vavuniyaa, openly for Sinhala military cantonment purposes, within one month of passing the resolution. The genocidal State was internationally allowed to do so by the LLRC-based resolution. Its basic concept ‘reconciliation’ a camouflage for structural genocide is a brainchild of the US State Department, the activists said.

While the current ‘legalised’ SL military appropriation of Tamil civilian lands of around 50,000 people in Jaffna immediately follows Chinese intelligence ministers visit to Jaffna, India was interested in extending the runway and laying railway lines in the tract of land that is appropriated, the activists further said.

The biannual national convention of the New Democratic Party held in Montreal, Canada from April 12-14 passed a resolution recognizing Jaswant Singh Khalra, a Sikh activist who was allegedly abducted and killed by the police in the Indian state of Punjab in 1995, as a human rights defender. However, a resolution submitted from Scarborough-Rouge River calling for, among others, an independent, international and impartial mechanism in Sri Lanka to ensure justice for the Tamils and a UN conducted referendum to determine their political future, failed to make it to the tables of the convention. While Tamil activists who attended the convention argue that the resolution could have been passed had it been pushed by the Tamil NDP MP from Scarborough-Rouge River, Ms Sitsabaiesan, a NDP source claims that the resolution was brought in late but the MP made sure that it was in the policy book.

The resolution on Mr Jaswant Singh Khalra, the Sikh human rights activist, was strongly pushed for by the NDP MPP for Bramalea-Gore-Malton Mr Jagmeet Singh at the convention, and was passed with overwhelming support.

However, the resolution on Sri Lanka, which included calls for the recognition of the right to self-determination of the Tamils and a UN monitored referendum, was not taken up as it was not pushed as a prioritized one by Ms Rathika Sitsabaiesan, the MP representing Scarborough-Rouge River and as a result, it was not tabled at the national convention, said a community activist from the Tamil Worker’s Alliance (TWA) from that constituency who participated in the convention.

The resolution on Sri Lanka, which was passed in the Scarborough-Rouge River riding, through a democratic process on February 28, was mentioned in a NDP booklet of regular resolutions from ridings across the country and was sent to the organizers of the convention well in advance and was submitted as an emergency resolution, the activist from TWA further said.

While there were other resolutions too that were not tabled, grassroots activists from Scarborough claim that given the gravity of the situation facing the Eezham Tamils both in the homeland and in the international scenario, and given the history of NDP’s position on the Tamil question, the resolution on Sri Lanka could have been tabled at the national convention.

However, a NDP source speaking to TamilNet said that the resolution was brought to the convention late but Ms Sitsabaiesan made sure that it was in the policy book. Adding that Ms Sitsabaiesan worked in the background very strongly to make sure that issues on Sri Lanka are addressed both in the party and the parliament, he further said that Ms Sitsabaiesan also supported the Sikh resolution because she is building solidarity with the Sikh community so that the two communities can work closely and be stronger allies.

An official response to TamilNet from Ms Sitsabaiesan’s office said “NDP conventions have passed resolutions, giving our Leader and Caucus the mandate to fight for Tamil rights. That's what we're doing and we're very proud of our Leader and Caucus taking the strongest and most principled positions toward Sri Lanka. At this convention we also saw Neethan Shan, a Tamil activist and friend, elected to represent Ontario at Federal Council.”

“Thanks to Rathika, Canada's Official Opposition has taken the strongest, most principled stance on Sri Lanka in support of Tamil rights. New Democrats have been standing up in the House of Commons to demand that Conservatives refuse to send any delegation to the Commonwealth meeting in Sri Lanka. The Conservatives have refused. Rathika and Tom Mulcair will continue to increase the pressure on Conservatives on this.”

WHEREAS the NDP has consistently supported the Tamil community’s call for justice, fairness, and human rights while being a strong voice for peace on the global stage; and

WHEREAS Noting while Tamil homes, schools, hospitals, and places of worship remain destroyed by the war in our home land, the Government of Sri Lanka is building symbols of Sinhala hegemony in the occupied lands to destroy any evidence of Tamil existence,

BE IT RESOLVED that New Democrats again reiterate the call on the United Nations to immediately establish an independent, international and impartial mechanism to ensure truth, accountability, and justice in Sri Lanka; and

BE IT FURTHER RESOLVED that New Democrats call on the government of Canada to state unconditionally, and without reservation that it will not be participating in the 2013 Commonwealth Heads of Government Meeting to be held in Sri Lanka; and

BE IT FURTHER RESOLVED that New Democrats call the United Nations to recognize the Tamils’ right to Self-Determination; and

BE IT FURTHER RESOLVED that United Nations to conduct a referendum among the Tamils originally from North and East of Sri Lanka to decide their political future.

The Human Rights Council voted once again to urge the Sri Lankan government to investigate “alleged violations of human rights” for the growing evidence that government soldiers killed tens of thousands of civilians in their bloody campaign to crush the LTTE. "But as with last year’s resolution, this year’s Council vote offers little more than hand-wringing," an opinion column in the New York Times said, adding, "[w]hile they carry symbolic weight, such resolutions may, in fact, be impeding progress rather than facilitating it."

"The government of President Mahinda Rajapaksa greeted last year’s vote with complaints that it was being persecuted by the international community — and used that as a pretext to obstruct even more thoroughly the work of journalists, lawyers and activists. As Mohan Peiris, a former attorney general who is now Sri Lanka’s chief justice, said last March: “It won’t change anything. We will just forge ahead as planned,” the NYT said.

Four years after the war ended, Colombo has not investigated numerous charges that the army committed atrocities during the waning years of the conflict. Straining the fragile peace yet more, Tamils in the country’s north and east continue to live under the close watch of the Sri Lankan military, the article pointed out.

People are arbitrarily arrested or abducted — “disappeared,” to use what is now a common term. Security forces quell peaceful protests. Relatives of Tiger combatants who surrendered in 2009 are still petitioning, in vain, to find out where their loved ones are, or even to be told that they will not be coming back, the article said of the disappearances that still plague the already war-affected Tamil civilians.

The ability to conduct business as usual appears to have persuaded Sri Lanka that it need not worry about international opinion. “I think they know now that the vote doesn’t mean anything,” a human rights lawyer in Colombo told the author of the article recently.

For the resolution to mean anything, of course, large nations must back words with deeds, but this shows no signs of happening, the NYT said. India, the dominant power in South Asia, is content with the politest of raps on Sri Lanka’s knuckles, lest it alienate a close neighbor, according to the paper.

"Only more principled action will force Sri Lanka to examine the horrors that took place on its northeastern beaches and the frightening abuses that have happened since," the NYT concluded.

Several hundreds of thousands people across Tamil Nadu took to streets on Wednesday in a students-led demonstration unprecedented in recent decades in Tamil Nadu, denouncing the US-tabled empty resolution further diluted by New Delhi at Geneva, and demanding international investigations and plebiscite on the question of Eezham Tamils. Peaceful demonstrations took place at every part of Tamil Nadu, including all the major cities. Conservative estimates put the total number of participants, mostly students, at a million. The positions taken by Washington and New Delhi, the leading architects and abetters to the genocidal war in the island, in bringing out a deceptive resolution at Geneva have contributed immensely to the confirmed awareness among the people of Tamil Nadu that Tamil Eelam is the only solution to the genocide-affected Eezham Tamils, political observers in Chennai commented.

The Student Federation for the Liberation of Tamil Eelam, a spontaneously formed movement of students called for the demonstration on Wednesday. In its formation the movement found inspiration from the people’s struggle against the Koodangku’lam Nuclear Power Plant that started at a village called Idintha-karai in Tamil Nadu.

Even on Wednesday, all the school children of Indinthakarai village came together in an emotional rally carrying in their chests the photos of the slain 12-year-old Balachandran Pirapaharan.

Female students took active part in the civil disobedience protests held in all the cities, towns, villages and schools.

The organizers said the protest was a big success in unequivocally giving articulation to the Tamil struggle for justice.

Mr Rajmohan, a doctoral student at the Indian Institute of Technology (IIT), when contacted by TamilNet said that the protesting students across the State had unanimously sent a clear message on the uselessness of the resolution proposed by the USA, as it failed to address the genocide faced by Eezham Tamils and as it skipped calling for international investigations on Sri Lanka.

The student movement was demanding a UN plebiscite, he said, adding that majority of students from other states in the IIT too was in solidarity with the student community in Tamil Nadu.

At several places students were seen fasting en bloc, numbering at least around 500 on each instance.

On Tuesday, Tamil Youth Front carried a bier having the US resolution from Loyola College and ceremonially cremated it at the nearby cremation ground. Biers for the US resolution were also taken at Hosoor bordering Karnataka and at Chithamparam in the South Arcot district.

On Wednesday, Students, confronted by the Police, were also seen blocking the trains. The Railways, Post offices and Income Tax offices that come under the Central Government were also besieged.

Although the protests drew massive participation, they were largely peaceful and didn’t disturb the traffic, police sources said.

Madurai, the second largest city in Tamil Nadu, was brought to a standstill on Wednesday. On Tuesday, Coimbatore witnessed the same situation, as 10,000 students had stormed the city.

On Wednesday, 10,000 students took part in the protest in Thanjavur.

The students received solidarity from their families and the people from all walks of life. At Vellore, auto drivers gave free transport to the students participating in the protests.

Law students mobilized in extending support to students at other schools offering legal help to challenge the administrations or owners of the colleges when some schools attempted to forbid participation in the protests.

At New Delhi, a row erupted at both the houses of the Indian Parliament on Wednesday, as the AIADMK, DMK and CPI demanded immediate amendment to the US resolution to be submitted by the Government of India.

However, the New Delhi Establishment, confronted by the demands for a resolution in the Indian Parliament on Tamil genocide and international investigations on Sri Lanka, manoeuvred to secure the support of North Indian parties, even from its opposition, in countering the demand of the Tamil Nadu parties.

Unconfirmed reports also said that Trinamool Congress and its leader Mamata Banerjee was backing the GoI in whatever decision it takes. The Deccan Herald cited party sources as saying that Ms Banerjee wanted to keep the ‘political issues’ separated from the ‘national issues’.

Deccan Herald on Wednesday cited the DMK Chief Mr Karunanidhi saying that the US-proposed resolution at the UNHRC had been “already amended four times and it had been substantially diluted.”

“There were no strong words of censure against Sri Lanka in that resolution, which indicated that there was no scope at all to incorporate amendments suggested by the DMK like including the word ‘genocide’ in the draft among others,” Karunanidhi has said, justifying DMK’s decision to pull out from the Centre.

While all those who have gone through the latest draft of the US resolution was blaming New Delhi for further dilution of the already empty resolution, The Economic Times of India on Wednesday was citing New Delhi’s Finance Minister Mr P. Chidambaram saying that India would make the resolution strong with a resolute message.

Mr Chidambaram was on record in painting a deceptive picture a couple of days before the final carnage at Mu’l’livaaykkaal in May 2009. In recent times, The Economic Times was also found buttressing the genocidal State and regime in Colombo.

Chidamparam on Wednesday tried to diffuse the situation by proposing to bring out a resolution on Sri Lanka in the Indian parliament. But most of the political parties didn’t favour the move. Many of them viewed it as an issue between the Congress and the DMK and didn’t want the parliament to get involved.

A parliamentary resolution of no practical effect is a further hoodwink when they could not come out with a just resolution at Geneva, political observers in Chennai said.

Meanwhile, the ground realities in Tamil Nadu have forced even the Congress President Ms Sonia Gandhi to make a statement on Tuesday at her Parliamentary Party Meeting.

“We are anguished by reports of unspeakable atrocities on innocent civilians and children, especially during the last days of the conflict in 2009. That is why we demand an independent and credible inquiry into the violation of human rights in Sri Lanka," she was cited saying.

Ms Sonia Gandhi not recognizing the genocide and not calling for international investigation is not going to answer the nature of the upsurge in Tamil Nadu, political observers said.

At the height of the war, Sonia Gandhi’s daughter Priyanka Gandhi went on record saying human beings don’t forgive. But the question of forgiving or forgetting now doesn’t involve individuals but a nation and a civilisation, the observers further commented.

 The US draft resolution at Geneva that is based on Sri Lanka’s LLRC recommendations and that neither welcomes international investigation nor initiates any meaningful new action on Sri Lanka, also undermines efforts to check Sri Lanka through the Commonwealth, political observers said. The US resolution subverts any opposition to the CHOGM taking place in the island or the Colombo regime leading the Commonwealth for the next two years. Losing no time in playing second fiddle to Washington’s patronage to genocidal Sri Lanka, the UK’s Labour shadow foreign secretary, Douglas Alexander, subtly urging the UK government not to boycott the Colombo summit of CHOGM, said on Monday that “the British Government should keep its attendance at this summit under review as it awaits effective action from the Sri Lankan Government.” British Tamil supporters of the Labour Party try to project the Labour stand as one that is favouring international investigation on Sri Lanka. But using that as a rhetoric and camouflage, the Labour Party that was in complicity with the war, ultimately tries to save the genocidal State and regime in the island of Sri Lanka, Tamil political observers in London said. Implying that everything, including an international investigation, should be completely left in the hands of Sri Lanka by ‘encouraging’ it, the Labour shadow foreign secretary said the following: “Commonwealth Day should be a day for celebration of the role of the Commonwealth in promoting human rights globally. “But with the next Commonwealth Heads of Government Meeting due to take place in Sri Lanka in November, it should also be a day for action by the Sri Lankan government: action that acknowledges the appalling human rights abuses which have taken place there over recent years. “The Commonwealth must use the prospect of the meeting in Colombo to encourage the Sri Lankan government to now meet its clear international obligations, and begin rapid change to acknowledge the human rights abuses which took place during its bloody armed conflict. “The British government must urgently raise with the Sri Lankan government the need for a full, independent, international investigation into the allegations of war crimes committed by all parties. "And the British Government should keep its attendance at this summit under review as it awaits effective action from the Sri Lankan Government.”

By calling for pressure on Colombo to immediately implement the 2012 UNHRC resolution as solution, TESO is misrepresenting the cause as well as plight of Eezham Tamils, and is misleading the world in lines with the agenda of New Delhi and Washington, Tamil activists in the island and in the diaspora commented. The UNHRC resolution harping on the implementation of LLRC recommendations of Colombo is actually ‘international legitimisation’ of the structural genocide and annihilation of the territoriality of the nation of Eezham Tamils in the island. This only serves the agenda of New Delhi and Washington that uphold the genocidal Sinhala State in the island for their geopolitical and imperialistic purposes. TESO has to urge the International Community of Establishments to revise the resolution, the activists further said.

Led by Mr MK Stalin, the DMK Treasurer and son of the DMK chief, Mr M. Karunanidhi, a team of TESO members, the DK chief Mr. K. Veeramani, VCK chief Mr Thol Thirumavalavan, Prof. Supa. Virapandiyan, former central minister Ms Subbhulakshmi Jagdeesan and DMK parliamentary leader Mr TR Balu are on a visit to New Delhi on Sunday to meet Indian Minister of External Affairs and Ambassadors of the 47 countries in the UNHRC, a DMK press release said on Saturday.

The team will request the dignitaries they meet to facilitate peaceful life to Eezham Tamils, acceleration of rehabilitation, political solution and pressure on Colombo for the immediate implementation of the 2012 UNHRC resolution, the press release of the DMK headquarters cited Mr TR Balu.
It may be a printer’s devil that the press release coming from the Dravidian movement, known for its use of pun in Tamil, talked about requesting Pu’nar Vaazhvu for Eezham Tamils instead of Punar Vaazhvu. But Pu’nar Vaazhvu (life of assimilation) is exactly what would happen if the current UNHRC resolution is implemented as requested by the TESO, Eezham Tamil activists commented.

As recently pointed out by the DMK Chief Mr M Karunanidhi, in a letter to the Centre at New Delhi, ‘Pu'nar Vaazhvu’ is the one that is implemented every day by the occupying Sinhala soldiers in Vanni.

One of the members in the TESO team, Mr Thol Thirumavalavan, sometimes back requested Congress President Ms Sonia Gandhi to facilitate the implementation of LLRC recommendations to help ‘Sri Lankan’ Tamils.

Except the DK chief, the others in the team are members of parties that align with the ruling Congress at New Delhi.

In the political parties, bureaucracy, media and the intelligence and security services of India, it is difficult to trace where India ends and the USA begins or vice versa, political observers commented.

Unless the Tamil movements directly challenge the structural-genocide outlook of New Delhi and Washington towards the nation of Eezham Tamils in the island, and mobilise the world to go beyond the machinations of the two powers, they are not helping the Eezham Tamils but only serve their ultimate adversaries, alternative shades of Tamil activists in the island and in the diaspora commented.

“If anybody thought Sri Lanka would mend its ways after the United Nations Human Rights Council resolution, they are mistaken,” writes G Pramod Kumar, a senior editor of Indian news portal FirstPost.com on Monday. In a story titled ‘Impeachment of Sri Lankan chief justice is India’s foreign policy failure’, Mr Pramod Kumar notes that “while the international community continues to put pressure on the country to improve its human rights standards and fix accountability for its alleged war crimes, it has become more defiant.”

“With the decision to impeach chief justice Shirani, it has once again cocked a snook at the international community, and more importantly its own citizens,” the editor of FirstPost observes adding that Sri Lankan government’s impeachment decision is a foreign policy failure for India.

Whenever political parties and civil society groups from Tamil Nadu asked for India's intervention for an equal and dignified life to the Tamils in the island, New Delhi had always brandished the 13th amendment.

“But now, with the proposed bill to take back powers of the provinces and the impeachment motion against the chief justice, it’s clear that Sri Lanka was bluffing with India,” the writer observes, concluding his article by saying: “Obviously, the Rajapaksas have made Sri Lanka a better best practice, than India, on how to establish an autocratic dynasty in a democracy.”

Supplementing the views of the Senior Editor of FirstPost, a young generation Eezham Tamil politician in the island said, while New Delhi Establishment has been showcasing the 13th Amendment argument to Eezham Tamils, the TNA hierarchy in the island and certain sections of Tamils in the diaspora were being systematically waylaid by the Washington Establishment that tabled the resolution, backing Colombo's LLRC, which is a blueprint of structural genocide against the Tamil Nation.
