Brian says Aussie FM was with Rajapaksa during his Singapore deportation

Sharing with TamilNet more details of his deportation from Singapore on 14 December, 81-year-old Australian human rights activist of Sinhala origin, Dr Brian Seneviratne said that the Australian Foreign Minister Bob Carr was in Colombo, meeting Mahinda Rajapaksa, at the time of his deportation. Reminding the Australian Prime Minister that what had happened in Sri Lanka was genocide, and the regime is a set of pathological liars, Brian said: “Mr Carr has enhanced the ability of this murderous regime to commit gross violations of human rights by doing what he has just done in Colombo – saying that Australia will help the Sri Lankan Navy to stop people fleeing from the murderous regime in Sri Lanka.”

The letter Brian sent to the Australian Prime Minister after his deportation from Singapore was a version edited by him considering the size. He has now sent to TamilNet the omitted parts of the original draft as well for publication.

“Prime Minister Gillard, your Foreign Minister, Bob Carr, was dining and wining with His Excellency President Mahinda Rajapaksa in Colombo, at the time when one of his Australian citizens was being deported for no valid reason, almost certainly at the request of the Sri Lankan government,” Brian wrote in his original draft.

Brian said that he had worked out the game of India, China, USA, UK and Rajapaksa, but “what is your game and the game of the Labor Party that I have supported for the past 36 years that I have been in Australia,” Brian asked Prime Minister Julia Gillard in the original draft.

“When geopolitics and trade are pitted against human rights, the latter always loses,” Brian said.

“Am I angry? No, just amused. I realised, yet again, that the totalitarian regime that runs Sri Lanka, and the Singapore regime are brothers in arms. From what happened to me in 2009 in Malaysia, that country can be included. To be added might be the unseen faces in Australia,” Brian wrote.

“Everyone knows what happened, and is happening, to the Tamil civilians in the North and East of Sri Lanka.” But the attitude is that “It never happened. Nothing ever happened. Even when it is happening, it wasn’t happening. It didn’t matter. It was of no interest,” Brian cited.

“Neither you nor your Foreign Minister really know, do you? You don’t because neither has been to the North and East of Sri Lanka and spoken to ordinary people to make an assessment of the terrifying life they lead under a brutal, murderous Armed Forces and Police, who are Sinhalese, 99.9% and 95% respectively, who treat Tamil civilians as the ‘spoils of war’ – to be used and abused with impunity,” Brian observed in his original draft of the letter.

“The incidence of rape of Tamil women and girls has escalated. That is one reason why AI, HRW and ICG are banned from visiting Sri Lanka, the Tamil North and East in particular. It was to prevent me from presenting this and other highly damaging information in Malaysia, that I was deported. Of that, there can be no doubt,” Brian said.

“I am just about to publish a paper on this, “An epidemic of Rape of Tamil women and girls in Sri Lanka by the Sri Lankan Armed Forces”. This is not irrelevant when dealing with the problem of asylum seekers, since it is to escape being raped that so many Tamil parents are sending their daughters away as refugees, or getting them married at an early age,” he wrote.

Cautioning on the dangers people like the Bishop of Mannaar might face under a regime like Colombo, Brian said, “The Pope will have to act. After all, it is one of his flock, who is under (real) threat. Will he? I doubt it. I have a photograph of the Pope clasping the blood-stained hands of Mahinda Rajapaksa - clasping it not with one hand but with both!”

“I have been told who in Singapore was responsible for my deportation. No prizes for guessing. He has done a ‘good job’ for once in his life. He will surely be rewarded which has been his game for years,” Brian wrote on his deportation. Along with deportation, his baggage was also pilfered of toys he was carrying for children in Indonesia, Brian records.

Sceptical of any positive response coming from the Australian government for his letter, Brian tells the Australian public that it was written for them. “It was written for you. It was written in the hope that you will protest,” Brian said adding that an economic boycott of Sri Lanka should be coupled with charging the war criminals.

“Sri Lanka has a choice: Peace with Justice or An unjust Peace with permanent hostility of the Tamil people in the North and East. If the latter is chosen, protest we must and we will. Silencing us will not work, nor will deportation,” Brian concluded adding that Australia could not remain a signatory to UN conventions and at the same time violate them.

Australia deals legal setback to US on extradition cases

In a legal blow to U.S. anti-terrorism laws used in extraditing Tamils caught in various sting operations by the U.S. law enforcement authorities, the 109-page opinion issued by the Federal Court of Australia's Judge J. North agreed with the Eezham Tamil defendant, Thulasitharan Santhirarajah, that in approving the extradition request, the Australian Attorney General (AG) fell into jurisdictional error on six different legal issues, the most precedent setting among them being that the offences charged by the U.S. were "political offenses," and therefore, that under section 22(3)(a) of the Extradition Act 1988, the Court was empowered to grant relief by prohibiting the "AG acting on her determination to surrender the defendant to the US."

Washington-based legal scholars told TamilNet that the Australian ruling supported by detailed legal opinion has dealt an irrecoverable legal setback to future requests by the U.S. government to extradite Tamils accused of providing material support to organizations listed under the US State Department's list of "Foreign Terrorist Organizations (FTO)." The legal issue relating to "political offenses' is likely to reverberate in liberal judicial institutions across the world, including consideration of asylum applications of ex-LTTE members, legal sources added.

The Melbourne Federal Court, in Santhirarajah's case, ruled that:

• On the power to determine issue the AG failed to make the determination to extradite "as soon as is reasonably practicable" to do so
• On the political offense exception issue the four offenses charged by the US are "either pure or relative" political offenses, and therefore, the AG violated the exception clause in approving the extradition
• On the torture issue the AG erred in forming her satisfaction that the applicant will not be tortured. The court further added that the AG, in this issue, misunderstood that the obligation of the US was different from that of the Australia under Article 3 of the UN Convention against Torture (CAT).
• On the best interest of the child issue the AG erred in asking the wrong question in the exercise of AG's general discretion under the Extradition treaty
• On the procedural fairness issue the AG failed to inform the defendant of the negotiation of and proposal to accept assurances from the US to protect the defendant from the danger of torture and/or cruel, inhuman, or degrading treatment if returned to Sri Lanka.
• On the 30-day assurance issue the AG erred in relying on the assurances given by the US that it would give Australia 30 days notice of the applicant's removal when the assurance did not address the dangers of torture and/or cruel, inhuman or degrading treatment o punishment faced by the defendant.

Tamils Against Genocide (TAG), a US-based activist organization seeking legal redress to Tamil war victims said, "Santhirarajah was arrested on 14 July 2008 on the US extradition request. He was remanded in custody (for more than 4 years) until the date of this judgment in 31 August 2012. Court also concluded that "in or about November 2009" was the time when it was reasonably practicable for the AG to make a determination whether to surrender Santhirarajah. Santhirarajah's liberty was curtailed extra-legally for a period of 2 years and 9 months," TAG noted.

"Further, Judge North has determined that Australia's AG, Nicola Roxon, has erred in six legal issues, and has ordered the Australian Government to pay Santhirarajah the [legal] cost of the proceeding. Urgently, Tamil Groups in Australia should work with Santhirarajah's attorneys, Ms. Mortimer and the solicitors Galbally & O'Bryan, to file for compensatory and punitive damages against the Australian Government in a tort action arising from illegal incarceration and deprivation of personal liberty," TAG said.

Legal sources who analyzed the Court documents, said that the case reveals the US Justice Department's policy on torture in relation to "terrror" defendants, and its sympathetic view of the regime in Colombo, despite the mounting evidence that the State might be complicit in genocide.

Responding to Santhirarajah's claim that he will be subjected to torture and reprisal if returned to Sri Lanka, the US Justice Department says, "This contention is speculative at best. There is no indication from Sri Lankan authorities to date of any interest in Santhirarajah. The hostilities between the Sri Lankan Government and the LTTE has ended, and a period of reconciliation has begun." US also said that US has safeguards and due process rights within deportation process to protect "aliens" subject to removal from the US.

As seen in the text of the ruling the Judge was unconvinced that there were sufficient safeguards in the extradition process to guarantee that the victim (Santhirarajah) will not be tortured, to comply with the provisions of International Covenant on Civil and Political Rights (ICCPR) (Art 6 and 7) and UN Convention Against Torture and Other Forms of Cruel, Inhuman, or Degrading Treatment or Punishment (CAT) (Art 3).

In an almost identical extradition request to the Singaporean Government, the judiciary there acceded to the US request, authorizing extradition of Mr Balraj Naidu, an alleged co-conspirator in the same Santhirarajah case, without asking many questions.

Australia follows UK, US, enters into new era of suspicion

Under the Cybercrime Legislation Amendment Bill 2011 passed in the Australian Parliament this week, new laws enable the law enforcement authority in Australia to compel Internet Service Providers and Telecommunication Carriers to "collect, monitor and retain" internet records of users. While laws allowing more serious incursion into privacy have been postponed passage until after next year's election, civil activists questioned the haste to pass legislation before public and parliamentary debate and commented that the bill's passage "reflects an international trend towards the enactment of harmonised laws to the detriment of national sovereignty."

Writing on privacy matters in a popular Australian website, Kellie Tranter writes: "Civil liberties groups are right to question whether the proposed changes will be used as a tool for turning open source data into intelligence to block whistleblowers, legitimate political dissent and political movements and to spy on the activities, interests and political views of innocent ordinary citizens.

"Where does the impetus for legislative changes like these come from? Seldom do we see empirical data that supports claims for the expansion of such powers. U.S. is leading the trend in taking advantage of the social-networking sites including Facebook and Twitter which operate a form of self-surveillance. The "surveillance rate" for Australian citizens (per capita) by phone surveillance already is vastly greater than the rate for US citizens, Tranter writes. "If the current proposal is picked up after the next election Australian Security Intelligence Organization (ASIO) will have the ability to "plant material on people’s computers, and destroy material and go through a third party’s computer to do so; criminalizing refusing to cooperate with government decryption attempts and freeing up ASIO agents to break the law if it helps to stay undercover.""

A former employee William Binney of the US National Security Agency (NSA) said after resigning, NSA has "massive power to spy on Americans with the Utah Spy Centre containing huge databases to store all forms of communication collected by the agency, including private emails, mobile phone calls, Google searches and other personal data." Binney warned that the NSA’s data-mining program has become so vast that it could "create an Orwellian state.

New refugee vessels head for Australia from Jaffna, Vanni

Agents involved in human trafficking, backed by influential ministers and personalities of the Rajapaksa government in Colombo, are exploiting the plight of already victimized Tamil youth in the North and East, to brave the Indian Ocean, making a 15-day journey towards Australia in search of a better life than what they could expect in the island, informed sources in Vadamaraadchi told TamilNet Sunday. A deep-sea fishing vessel has left Inparuddi of Vadamaraadchi, four days ago, carrying at least 15 Tamil youth. Another 20 members have been recruited and the next group is expected to leave the coast of Jaffna or Mullaiththeevu in a couple of days, the sources further said.

Each deep sea fishing boat coasts around 2.5 million rupees.

15 to 25 youths are sent in each group. Each passenger is charged 1 million.

At least 200,000 rupees has to be paid by each passenger in advance to the agents, before going on board the vessel. This way, the human traffickers secure their risk free income in advance, regardless of the security of the passengers.

The remaining 800,000 has to be paid by the member of the family residing in the island in SL military control once those on board reach the coast of Australia. The agents are well-connected to the SL military.

The families of the youth facing harassment by the SL military are prepared to take the risk of sending their sons and daughters through the dangerous route away from the island.

Political personalities in Colombo organise financing of the vessels through Sri Lankan banks and recruit asylum-seeking crew-members from the already affected section of Eezham Tamils in the North and East.

Those on board are advised to destroy their vessel once they spot the Australian coast guard so that they are not instructed to return in the same vessel, informed sources further said.

Similar trafficking through deep-sea fishing vessels was also taking place from Negombo, Chilaapam (Chilaw) and Puththa'lam, the sources added.

According to earlier reports, SL president's son Namal Rajapaksa was involved in the human trafficking from Vanni.

His involvement in the latest trafficking is not known, but the sources were able to confirm that they had high-level backing in Colombo.

The SL Navy has been instructed to give green signal to the vessels by the political figures in Colombo, is what the agents who have stepped up their campaign in recent weeks in Jaffna and Vanni, tell their clients who are subjected to structural genocide and exploitation by the occupying SL military and Colombo's corporate agents.

It is not known whether Sinhalese are on board such boats, but the passengers are mostly Tamils from North, East and from the South.

After messing up the national question of Eezham Tamils into genocide, the so-called international community now conceives identical models for the struggling nationalities in the island of Sri Lanka and Myanmar (Burma). The basic message is that the struggling nations should abide by the existing constitutions, compromise with the genocidal militaries of the respective states, envisage only non-descript solutions to come eventually and now concentrate only on resettlement rehabilitation and reconciliation to facilitate the ‘development’ of the so-called international community. Following the peace initiation of Norway in Burma, Australia and Singapore embark upon to play a role there, resembling what the Co-Chairs did to Eezham Tamils.

The Australian Foreign Minister Bob Carr on Friday announced that Australia would provide $ 5 million as initial contribution to promote peace in Myanmar’s conflict affected regions, said a report of the Australian Agency for International Development.

Australia will work with Norway and other international donors to create the necessary environment for the settlement of internally displaced people, the report said.

According to Bob Carr explaining the model, "While Australia strongly supports rapid assistance for peace-building efforts, we will also continue to work with international partners to expand the delivery of our substantial aid program to conflict-affected areas in Myanmar […] "With concrete improvements in their lives, people will have greater incentive to make enduring peace."

Australia is the second largest bilateral aid donor to Myanmar. Meanwhile Democratic Voice of Burma (DVB) cited a source from a local humanitarian group saying on conditions of anonymity: “It is now clear to me that the intention of the plan is to back the Burma government to bring the ethnic groups under the 2008 constitution and not support the UNFC [United Nationalities Federal Council] or KIO [Kachin Independent Organisation] requests to have dialogue outside of parliament.”

The policy also coerces exiled groups into registering as official NGOs in Burma, if they want funds. But they are not in a position to move back into Burma as legal entities, DVB commented on the peace initiative.

The Secretary of the Karan National Union, cited By DVB, did not want such programmes expanded before a political settlement was reached.

Without finding no solution at all to Eezham Tamils after the IC abetted genocidal war, and leaving them in the straits to face Sinhala militarisation, colonisation and structural genocide, the IC has now embarked upon peace facilitation in Myanmar. It is not peace facilitation but peace intimidation, commented Eezham Tamil political activists.

After ending the war in genocide and parading it, Myanmar was the first country visited by Mahinda Rajapaksa.

Meanwhile, Singapore has also sent a business delegation to Myanmar this week, reminding of a proverb in Jaffna on business greed putting the finger on hot pie (Aa’raatha soattinilum avukken’ru kaivaiththal).

Last month the Singapore Foreign Minister Shanmugam led a business team to Colombo too.

‘Slash and burn development’ is the term perceived by political analysts to describe the kind of activities practiced by the IC and peace facilitators operating at its instance, in various parts of the world in the name of international crisis management and conflict resolution.

Mu’l’livaaykkaal remembered as symbol of protest in Australia, Canada

Exhibiting a spirit of commitment to the Tamil Eelam freedom struggle and seeking to undo defeatist mentalities of some in the diaspora, Eezham Tamil youth in Australia and Canada organized Mu’l’livaaykkaal remembrance events in their countries as symbolizing Tamil resistance to oppression and genocide, on Friday and Saturday respectively. Speaking to TamilNet, the organizers asserted that Mu’l’livaaykkaal was not a time to weep and mourn, but an occasion to remember the heroic deeds of those who went down fighting for freedom though a genocidal army assaulted them without respite with the aid of world powers, and an occasion to pledge commitment to the ideals of struggle for Tamil Eelam.

Speaking to TamilNet, Seran Sribalan, Tamil youth activist from Australia said “Throughout the history of Tamil Eelam struggle, we have seen different types of problems and atrocities. But the Tamil resistance was able to overcome it. Similarly with Mu’l’livaaykkaal. While the occasion tells the world about the genocide of our people, it also reminds us that we will continue to fight till Tamil Eelam is won.”

On Friday, a full capacity crowd of Tamils gathered at the Bahai centre in Sydney to remember the May massacre, three years ago in their homelands. Meena Krishnamoorthy, who was eye witness to the war crimes of the Sri Lankan state, talked about her harrowing experiences in that period.

Senator Lee Rhiannon from the Greens Party, a mainstream Australian political outfit that has principally stood by struggle of the Eezham Tamils, expressed regret at the conditions of Tamil refugees in Australia, and pledged her party’s solidarity to Tamils in Australia fighting for the rights of the same.

Thiru Kathiravel from the TYO stressed the importance for the youth to move forward without compromising the goals of the struggle.

The Australia TYO had also organized an awareness campaign on Friday noon named “G for Genocide” to inform people of the situation in the Tamil homeland.

TYO Canada organized Tamil Uprising Day to mark Mu’l’livaaykkaal remembrance at Queen’s Park, near the Legislative Assembly of Ontario, on Saturday, drawing huge crowds mainly from second generation Eezham Tamil youth in Canada.

The event was titled “Tamil Uprising Day” to symbolize that events to mark Mu’l’livaaykkaal should be used to remember, commemorate and take a vow upon thousands that were brutally killed there that the founding principles of the Tamil freedom struggle namely; nation, homeland and the right to self determination struggle will not be compromised, the organizers of the event told TamilNet, adding that this was imperative at a time when certain sections of the diaspora have marked Mu’l’livaaykkaal remembrance with mourning alone.

Speaking at the event, Vijay Than from TYO Canada opined that the memory of Mu’l’livaaykkaal must be used a catalyst to advance the struggle of the Tamil nation and that should further strengthen the resolve of the Tamils to work towards the liberation of Tamil Eelam.

"There can be no peace and reconciliation in Sri Lanka without justice and self-determination in Tamil Eelam. There will be no peace until the genocide stops; there will be no peace without national liberation; there will be no peace until the Sri Lankan Armed Forces leaves our land and our skies," said Krisna Saravanamuttu, spokesperson of the National Council of Canadian Tamils.

"There is an international revolution brewing amongst the youth and students in the diaspora and the homeland. We reject the unitary state of Sri Lanka and therefore condemn the genocide, ethnic cleansing, and colonization of occupied Tamil Eelam,” he added.

James Clarke from the Canadian Peace Alliance, Canada’s largest peace organization, also affirmed the solidarity of his group with the cause of the Eezham Tamils.

Australian Tamils critical of Rudd's response to LLRC report

While the Australasian Federation of Tamil Association (AFTA) said it is disappointed to see Australia’s response to LLRC "lacks either the persuasive language or open caution to Sri Lanka for its failure to address alleged violations of international humanitarian and human rights," Australian Tamil Congress (ATC) said it is "concerned that Mr Rudd has continued to call on Sri Lanka to investigate itself. The Tamil community has no confidence in the Government of Sri Lanka to conduct an independent investigation and deliver justice to the victims of the war. We cannot expect justice when an investigation is initiated by a party to the alleged crimes," ATC release said.

While the two representative organizations of the expatriate Tamils in Australia were highly critical of Rudd's response to the LLRC report, Sri Lanka's controversial ambassador to Australia praised the same report for "refusing to back calls for an independent international inquiry into his country's vicious civil war."

Australian Tamil Congress said in its release: "The LLRC's failure to acknowledge and address issues of war crimes has revealed Sri Lanka will not genuinely pursue justice for war victims. Furthermore, history has proven that internal inquiries by Sri Lankan authorities have predominantly failed. With a well entrenched culture of immunity still persisting, a truly independent investigation is only possible through an international mechanism as recommended by the UN panel of experts last year."

AFTA commented: "It is obvious that our FM has chosen to ignore the fact that the Sri Lankan President has failed not only to implement a number of simple, mere symbolic and easiest recommendations of the LLRC such as the National Anthem should be sung in both languages at national functions using the opportunity at the recently held Independence day celebrations but also has tried to hoodwink the international community by saying in his independent speech that during the 6 weeks period after the release of the report his government has been actively implementing the recommendations of the LLRC."

Expatriate Tamil circles widely believe that the reluctuance of the Western Governments, including the US and Australia, to push for an external independent investigation into the alleged war-crimes, reflect possible complicity of several countries in violating international treaties including Genocide Convention for the failure to intervene and stop the "genocide."

"Expatriate Tamils should be vigilant and understand the background to the "statements" by the international community which criticize Sri Lanka's rights violations but continue to allow Sri Lanka space to avoid an independent investigation despite the presence of plausible evidence that "international crimes" were committed in the final stages of war. Individual diplomats may also be criminally liable for "Crime against peace" for efforts to disrupt the peace process while a Ceasefire Agreement was in place and when the two antagonist parties were involved in a peace process," spokesperson for the US-based activist group, Tamils Against Genocide (TAG) said.

ஒக்டோபர் 20, 21, 22ம் நாட்களில் உலகத் தமிழர் மாநாடு அவுஸ்திரேலிய சிட்னி நகரில் நடத்தப்பட்டது. ஜேர்மனி, பிரித்தானியா, மலேசியா, கனடா, அவுஸ்திரேலியா, தென்னாபிரிக்கா, இந்தியா, சிறிலங்கா ஆகிய நாடுகளில் இருந்து பேராளர்கள் வருகை தந்தனர். பெருந்திரளான அவுஸ்திரேலியத் தமிழர்கள் மூன்று நாட் கலந்துரையாடலில் கலந்து கொண்டனர்.

ஈழத் தமிழர்களின் இறைமை, சுய நிர்ணய உரிமை, போர்க் குற்ற விடயங்கள் தொடர்பான தலைப்புக்களின் கீழ் ஆய்வுரைகள் நிகழ்த்தப்பட்டன. இந்த விடயங்கள் தொடர்பான நிபுணத்துவ அறிவும் அனுபவமும் உள்ள சட்டவாளர்கள், பேராசிரியர்கள் தமது பெறுமதிமிக்க கருத்துக்களைத் தெரிவித்தனர்.

அண்மைக் காலமாக ஈழத் தமிழர்களுக்கு இழைக்கப்பட்ட இன அழிப்புக் கொடூரங்கள் தொடர்பான விழிப்புணர்வு அவுஸ்திரேலிய அரசு மட்டத்தில் ஏற்பட்டுள்ளது. சமஷ்டிப் பொலிஸ் போர்க் குற்றங்கள் தொடர்பான விசாரணைகளைத் தொடங்கியுள்ளதால் தமிழ் மக்களின் நம்பிக்கை வலுத்துள்ளது. மேற்கூறிய மாநாடு இந்தப் பின்னனியில் நடப்பதால் அதற்குப் பாரிய முக்கியத்துவம் காணப்படுகிறது.

தமிழ்த் தேசிய கூட்டமைப்பு பாராளுமன்ற உறுப்பினர் சரவணபவான் மக்களின் பிரச்சனைகள் பற்றிப் பேசினார். இராணுவ ஆட்சியில் வடக்கு கிழக்குத் தமிழர்கள் அனுபவிக்கும் துன்ப துயரங்களைப் பற்றி எடுத்துச் கூறினார்

கனடிய தமிழ் காங்கிரஸ் பிரதிநிதி கனடா அரசு தமிழர்கள் தொடர்பாகக் காட்டும் கரிசனைக்கு கனடிய தமிழர்களின் அரசுடனான நெருக்கமும் அரசை தமிழர் சார்பில் செயற்பட வைக்கும் திறமையும் முக்கிய காரணம் என்று சுட்டிக் காட்டினார்.

அவுஸ்திரேலியா தமிழ் காங்கிரஸ் தலைவர் டாக்டர் இராஜேந்திரன் அவர்கள் மிகவும் பயனுள்ள பேருரையை நடத்திப் பேராளர்களின் பாராட்டைப் பெற்றார்.

இந்த மாநாட்டில் பேசப்பட்ட கருத்துக்களை ஈழத் தமிழர்களின் சுய நிர்ணய உரிமை, போர் குற்ற விசாரணை, கடினவாழ்வின் பிடியில் அகப்பட்ட தமிழர்களுக்கு நிவாரணம் என்ற தலைப்புக்களின் கீழ் வகைப்படுத்தப்படலாம்.

While Sri Lanka's media spokesperson told a website that Sri Lanka's President, Mahinda Rajapakse "will not answer and is not answerable" to charges in the complaint filed by three Tamil plaintiffs in the District Court of District Columbia, Shavendra Silva, an ex-army commander and currently Deputy Permanent Representative to the United Nations (UN) has hired a New York-based multi-national law firm as his defense counsel for charges of torture and extra-judicial killings filed in the District Court of Southern District of New York (SDNY). Both are civil cases.

While in Rajapakse case, the Court has authorized the Plaintiffs to serve summons by publication in Sri Lanka papers and in TamilNet website, in Vathsala Devi v. Silva there has yet to be evidence of any involvement by the US State Department as claimed by State run media in Sri Lanka.

Mr Rajapakse is scheduled to travel to Perth Australia for the Commonwealth Heads of Government Meeting (CHOGM) in ten days. Australian Prime Minister said Tuesday that the Australian Federal Police are investigating allegations of war crimes against Sri Lanka officials. Mahinda Rajapakse is one of the three officials under investigation, according to ABC television.

The Notice of Appearance filed by Mr Silva's attorney informs the court that his client is not waiving any immunities, and indicating that the defense will be likely based on "Vienna Convention on Diplomatic Relations, the Convention on the Privileges and Immunities of the United Nations, the Agreement Between the United Nations and the United States of America Regarding the Headquarters of the United Nations," among others.

The rates for a mid-level partner in the NY firm runs from $700-$1000/hour.

Sri Lanka in war crimes quagmire before CHOGM

Sri Lanka is sinking deeply inside a torrent of allegations of war crimes against three senior officials, including Sri Lanka's President, ten days before the Commonwealth Heads of Government Meeting (CHOGM) is to take place in Perth, prompting Premier Julia Gillard to confirm that Australian Federal Police (AFP) is conducting investigations on Sri Lanka officials over allegations of serious war-crimes, and forcing shadow foreign affairs minister Julie Bishop to demand Foreign Affairs Minister Kevin Rudd to reveal whether the government knew about the allegations against Admiral Thisara Samarasinghe before it accepted him as Sri Lanka’s high commissioner.

The Australian Federal Police Commissioner, Tony Negus, confirmed that they are considering whether there is sufficient evidence for a war crimes investigation against Mr Samarasinghe. AFP also confirmed that they'd received a submission compiled by the International Commission of Jurists (ICJ), a legal rights lobby group composed of respected legal figures.

Meena Krishnamoorthy, eye-witness to war crimes

Sri Lanka's President Mahinda Rajapakse, who is facing summons in a US court for war-crimes, and SriLanka's UN representative Palitha Kohona who is also facing possible investigations by the International Criminal Court over war crime allegations, are the other two officials under investigation, ABC TV reported.

The war-crime allegations gained further credibility after the emergence of an eye-witness, Meena Krishnamoorthy, who spent several years in the war-zone before escaping the final stages of the war to reach Australia safely. Ms Krishnamoorthy told ICJ that she has witnessed massacres by Sri Lanka soldiers.

Australia's Prime Minister Julia Gillard in a news conference said: "These allegations are come to light since the Sri Lankan High Commissioner has come to Australia. These allegations are now being looked at by the Australian Federal Police."

Mr Samarasinghe refuted the allegations saying that they are baseless and unsubstantiated, adding, he was commended for saving civilians from the clutches of terrorism. He also said that the military has never shelled any hospital.

While there is no evidence that Samarasinghe was directly involved in shelling civilians, or that he gave direct orders, the accusation turns on the question of accountability. Legal experts said that the doctrine of Command Responsibility attaches to Mr Samarasinghe, and with an additional element if Samarasinghe knew or should have known of his troops shelling unarmed civilians, are suffiicient to hold him culpable.

Professor of International Law at Australian National University, Don Rothwell told ABC, "[u]ltimately what's the real obligation, what's the incentive? Well the incentive is that Australia is a party to the Rome Statute of the International Criminal Court. That statute does create certain obligations for Australia to conduct these types of investigations and indeed I think there's a very strong argument that Australia both legally and morally needs to do so."

Professor Rothwell added that under the Commonwealth Crimes Act and related legislation giving effect to the Geneva conventions allow the AFP to conduct investigations into the commission of war crimes that occurred overseas including crimes against humanity by any person including non Australian citizens.

Australia’s bids to lend legitimacy to Sri Lanka’s war-crime regime condemned

Vehemently condemning Australia’s envoy for Sri Lanka, Kathy Klugman, for partaking in a high-profile propaganda ceremony at the Sri Lankan Presidential residence in Colombo, head of the International Commission of Jurists in Australia, John Dowd, has accused the Australian government of trying to legitimise the actions of Rajapaksa regime, which is credibly accused to have committed wide-spread war crimes during the final months of the war, a media report by The Age said. Australia’s high commissioner to Sri Lanka, Kathy Klugman, took part in a ceremony in Colombo on Friday to release 1,800 ex-members of the LTTE after what the Sri Lankan military called “a two-year rehabilitation program”. She also handed out certificates to alleged ‘rehabilitated’ Tamils, who were later detained and prevented from reuniting with their families.

According to The Age newspaper, John Dowd, who was formerly the Attoney-General of the New South Wales, has condemned the program in the Sri Lankan military camps as “re-education and not rehabilitation”.

“He warned that Australia was lending legitimacy to a regime that refuses to allow an investigation of alleged war crimes during the country's vicious civil war,” the Age said, adding that more than 11,000 people who were captured in the dying days of the conflict that ended in May 2009, had been held without charge in at least 24 military-run camps.

Ms Klugman - who last month congratulated the “effectiveness” of Sri Lanka's ‘security services’ for stopping a boat carrying 44 Tamils fleeing to Australia - was one of a number of foreign envoys, including from the US, at the ceremony.

Local media and even the SL Ministry of Defence gave wide publicity and carried images of the Australian envoy handing out certificates to the ex-LTTE members.

Although the members of the international community were made to believe that the former Tiger members were rehabilitated and handed over to their parents and next of kin, the parents have said that their loved ones were continued to be detained by the military and were not allowed to reunite with their families as promised in public.

Of the 44 Tamils stopped on September 11 on the boat to Australia, six have reportedly been accused of being ex-LTTE members and sent to a camp in the country's south.

The Greens in Australia are demanding Sri Lanka be suspended from the Commonwealth Heads of Government Meeting to be held in Perth this month - a move Professor Dowd has backed.

Australia, though appeared to be adopting a cautious approach on Sri Lanka in international forums, commended last week the establishment of a Sri Lankan reconciliation commission in a statement to the UN Human Rights Council in Geneva.

According to the media report, a Foreign Affairs Department (Australia) spokesman has said Australia had not provided any funding for Sri Lanka's rehabilitation programs.

“Nor has Australia supported activities relating to ex-combatants in detention. Australia has urged the Sri Lankan government to charge or release ex-combatants,” the Age has quoted the Australia’s Foreign Affairs Spokesman as saying.

மெல் ​போர்ன்,​​ டிச:​17: ஆஸ்​தி​ரே​லி​யா​வில் தஞ்​சம் புகுந்த இலங்​கைத் தமி​ழர்​களை குடி​ய​மர்த்த நியூ​சி​லாந்து,​​ கனடா,​​ நார்வே நாடு​க​ளு​டன் ஒப்​பந்​தம் செய்ய உள்​ள​தாக தெரி​விக்​கப்​பட்​டுள்​ளது.​ இதற்​காக அமெ​ரிக்​கா​வி​டம் உதவி கோரப்​பட உள்​ள​தா​கத் தெரி​கி​றது.​ கடந்த அக்​டோ​பர் மாதம் ஆஸ்​தி​ரே​லி​யா​வின் கடல்​ப​கு​தி​யில் தஞ்​சம் கோரி 78 இலங்​கைத் தமி​ழர்​க​ளு​டன் வந்த படகு கவிழ்ந்​தது.​ இதில் வந்த 78 பேரை​யும் ஆஸ்​தி​ரே​லிய கடற்​ப​டை​யி​னர் காப்​பாற்​றி​னர்.​ இவர்​க​ளைக் குடி​ய​மர்த்​து​வ​தற்கு நியூ​சி​லாந்து,​​ கனடா,​​ நார்வே நாடு​கள் ஆர்​வம்​காட்டி வரு​கின்​றன.​ ஆஸ்​தி​ரே​லி​யா​வில் புக​லி​டம் கோரி பட​கில் வரும் இலங்​கைத் தமி​ழர்​க​ளின் எண்​ணிக்கை சமீ​ப​கா​ல​மாக அதி​க​ரித்து வரு​கி​றது.​ கடந்த செவ்​வாய்க்​கி​ழ​மை​கூட ஆஷ்​மோர் தீவில் 55 பேரு​டன் வந்த படகு கடற்​ப​டை​யி​ன​ரால் தடுத்​து​நி​றுத்​தப்​பட்​டது.​ ​ பட​கில் வந்​த​வர்​கள் ஆஸ்​தி​ரே​லி​யா​வில் தஞ்​சம் புக வந்​த​தா​கத் தெரி​வித்​த​னர்.​ அவர்​கள் கிறிஸ்​து​மஸ் தீவில் தங்க வைக்​கப்​பட்​டுள்​ள​னர்.​ ​ இது​போல் இந்​தாண்​டில் மட்​டும் 55 பட​கு​கள் இலங்​கைத் தமி​ழர்​க​ளு​டன் வந்​துள்​ளன.​ இப்​ப​ட​கு​க​ளில் வந்​த​வர்​க​ளின் எண்​ணிக்கை 1498 என்று ஆஸ்​தி​ரே​லி​யா​வின் குடி​யேற்​றத்​துறை செய்​தித்​தொ​டர்​பா​ளர் தெரி​வித்​தார்.​ இவர்​க​ள​னை​வ​ரும் ஆஸ்​தி​ரே​லி​யா​வில் போலீஸ் பாது​காப்​பு​டன் கூடிய அக​தி​கள் முகா​மில் தங்​க​வைக்​கப்​ப​டு​வர்.

மெல்போர்ன், அக். 15: இலங்கையிலிருந்து படகில் தப்பிச் சென்ற போது இந்தோனேசிய கடற்படையிடம் சிக்கிக் கொண்ட தமிழர்கள், தங்களுக்கு அடைக்கலம் அளிக்குமாறு ஆஸ்திரேலியாவிடம் வேண்டுகோள் விடுத்துள்ளனர். இந்த வாரத் தொடக்கத்தில் சரக்குகளை ஏற்றிச் செல்லும் பெரிய படகு ஒன்றில், 250-க்கும் மேற்பட்ட இலங்கைத் தமிழர்கள் ஆஸ்திரேலியாவில் உள்ள ஒரு தீவில் தஞ்சம் அடைவதற்காக சென்று கொண்டிருந்தனர். ஆனால், அந்தப் படகைத் தடுத்து நிறுத்துமாறு ஆஸ்திரேலியப் பிரதமர் கெவின் ரூத் கேட்டுக் கொண்டதையடுத்து, இந்தோனேசிய கடற்படையினர் அவர்களைத் தடுத்து தங்களது கட்டுப்பாட்டில் வைத்துள்ளனர். இலங்கையிலிருந்து தப்பி வந்த இவர்கள், ஆஸ்திரேலியாவில் தஞ்சம் அடைவதற்காக பல மாதங்களாகப் பல இடங்களில் சுற்றித் திரிந்தனர். மலேசிய வனப் பகுதியில் ஒரு மாதத்துக்கும் மேலாகத் தங்கியிருந்தனர். இந்தத் தமிழர்களைச் சந்திப்பதற்கு செய்தியாளர்கள் சிலருக்கு அனுமதி அளிக்கப்பட்டது. இந்தப் படகில் உள்ளதைவிட மிக மோசமான நிலையில், இலங்கையில் உள்ள முகாம்களில் தமிழர்கள் வசித்து வருகின்றனர் என, தப்பி வந்த தமிழர்களின் சார்பில் அலெக்ஸ் என்பவர் செய்தியாளர்களிடம் கூறினார். இலங்கையில் இனப் பாகுபாடு தலைவிரித்தாடுகிறது என்றும், தங்களது எதிர்காலத்தை உத்தேசித்து அங்கிருந்து தப்பி வந்ததாகவும் அவர் தெரிவித்தார். "இலங்கைக்கு மீண்டும் சென்றால் நிச்சயமாக சாக நேரிடும்; இந்தோனேசியாவிலும் நீண்ட காலம் தங்கியிருக்க முடியாது. எனவே, ஆஸ்திரேலியா போன்ற மூன்றாவது உலக நாடுகள்தான் எங்களுக்கு அடைக்கலம் அளிக்க வேண்டும்' என்றார் அலெக்ஸ். "இலங்கையில் எங்களால் வசிக்க முடியாது. எங்களை உங்கள் நாட்டில் அகதிகளாக ஏற்றுக் கொள்ளுங்கள்' என ஆஸ்திரேலியாவுக்கு இந்தக் குழுவினருடன் வந்துள்ள 9 வயதான சிறுமி பிருந்தா வேண்டுகோள் விடுத்தார். தங்களை மீண்டும் இலங்கைக்கு அனுப்பினால் படகைத் தகர்த்து தற்கொலை செய்து கொள்வோம் என இந்தத் தமிழர்கள் முன்னதாக எச்சரித்தனர்.

அவுஸ்திரேலியாவுக்கு செல்லும் போது இந்தோனேசிய கடற்படையினரால் கைப்பற்றப்பட்ட கப்பலில் உள்ள இலங்கையர்கள் (பெருமளவானோர் தமிழர்கள்) தாம் கப்பலை வெடிக்கவைக்கப் போவதாக அச்சுறுத்தியுள்ளனர்.

தம்மை கப்பலில் இருந்து இந்தோனிசிய கடற்படையினர் இறக்க முற்பட்டால், தம் வசம் உள்ள சிலிண்டர்களை வெடிக்க வைக்கப் போவதாக அவர்கள் அச்சுறுத்தியுள்ளனர். இந்த கப்பலில் பயணித்த, ஒவ்வொருவரும், தலா 15 ஆயிரம் அமெரிக்க டொலர்களை முகவர்களிடம் செலுத்தியுள்ளனர். இந்தநிலையில் கப்பலில் இருந்து தகவல் தந்த யாழ்ப்பாணத்தை சேர்ந்தவர் என தம்மை அடையாளப்படுத்திக்கொண்ட அலெக்ஸ் என்பவர், தாம் யார் எனத் தெரிந்தால் இலங்கை அதிகாரிகள் தமது மனைவியையும் பிள்ளைகளையும் கொன்று விடுவார்கள் என குறிப்பிட்டுள்ளார். தூம் அவுஸ்திரேலியாவுக்கு செல்லவே பயணித்தோம். இந்தநிலையில் இந்தோனேசிய கடற்படையினர் தம்மை கப்பலில் இருந்து கீழே இறக்கினால் தாம் கப்பலை வெடிக்கவைப்போம். என்றும், கடலில் குதித்து உயிரை மாய்த்துக் கொள்ளப் போவதாகவும் அவர் எச்சரித்துள்ளார். தமிழீழ விடுதலைப் புலிகள் அமைப்பை தடை செய்யுமாறு இலங்கை அரசாங்கம் தொடர்ச்சியாக விடுத்து வரும் கோரிக்கைகளை அவுஸ்திரேலிய அரசாங்கம் உதாசீனம் செய்துள்ளதாக அந்நாட்டு ஊடகங்கள் செய்தி வெளியிட்டுள்ளன. அவுஸ்திரேலியாவில் ஆட்சி செய்த முன்னாள் பிரதமரும், இன்நாள் பிரதமரும் புலிகளை தடை செய்யும் திட்டத்திற்கு உரிய கவனம் செலுத்தவில்லை என இலங்கை அரசாங்கம் அதிருப்தி வெளியிட்டுள்ளது.

தமிழர்கள் செறிந்து வாழும் அவுஸ்திரேலிய பிராந்தியங்களில் புலிகளுக்கு எதிரான தடைக்கு அதிகளவு ஆதரவு கிடைக்கப் பெறவில்லை என சுட்டிக்காட்டப்படுகிறது. இதேவேளை, அவுஸ்திரேலிய அரசாங்கத்தின் இந்த நடவடிக்கைகள் கடும் அதிருப்தியளிப்பதாக அந்நாட்டுக்கான இலங்கை உயர்ஸ்தானிகர் சேனக வல்கம்பல தெரிவித்துள்ளார்.தமிழீழ விடுதலைப் புலிகளுக்கு வெளிநாடுகளில் கிடைக்கப் பெறும் ஆதரவு இலங்கையில் மாற்றங்களை ஏற்படுத்த வழிகோலும் என அவர் எச்சரிக்கை விடுத்துள்ளார்.

இலங்கையில் விடுதலைப் புலிகள் முற்றாக இல்லாதொழிக்கப்பட்டுள்ள போதிலும், இவ்வாறு சில நாடுகளில் புலிகளுக்கு கிடைக்கப் பெறும் ஆதரவு பாதகமான விளைவுகளை ஏற்படுத்தும் என அவர் குறிப்பிட்டுள்ளார்.புலம் பெயர் தமிழர்களை தூண்டி அதன் மூலம் விடுதலைப் புலிகள் பயங்கரவாதத்தை முன்னெடுக்க முனைவதாக அவர் தெரிவித்துள்ளார்.அதிக எண்ணிக்கையிலான சிரேஸ்ட விடுதலைப் புலி உறுப்பினர்கள் தற்போது அவுஸ்திரேலியாவில் தங்கியிருக்கக் கூடுமென தாம் நம்புவதாக உயர்ஸ்தானிகர் வல்கம்பொல சுட்டிக்காட்டியுள்ளார்.

அவுஸ்திரேலியாவில் வசிக்கும் விடுதலைப் புலி ஆதரவாளர்கள் பயங்கரவாத நடவடிக்கைகளை முன்னெடுக்கக் கூடுமென அவர் எச்சரிக்கை விடுத்துள்ளார். இலங்கையில் பயங்கரவாதம் இல்லாதொழிக்கப்பட்டுள்ள போதிலும் புலம் பெயர் தமிழர்களுடன் இணைந்து விடுதலைப் புலிகள் ஏனைய நாடுகளில் பயங்கரவாதத்தை விதைக்க கூடுமென அவர் தெரிவித்துள்ளார்.

இதேவேளை, தமிழீழ விடுதலைப் புலிகளினால் மட்டுமே இலங்கைத் தமிழர்களுக்கு நியாயத்தைப் பெற்றுக்கொடுக்க முடியும் என அவுஸ்திரேலிய தமிழர் பேரவையின் தலைவர் டொக்டர் ராகா ராகவன் தெரிவித்துள்ளார்.விடுதலைப் புலிகளின் நடவடிக்கைகளின் மூலம்தான் பல தசாப்த காலமாக தமிழர்கள் மீது கட்டவிழ்த்துவிடப்பட்ட அடக்குமுறைகளுக்கு முற்றுப்புள்ளி வைக்க சந்தர்ப்பம் உருவாகியதாக அவர் சுட்டிக்காட்டியுள்ளார்.

அவுஸ்திரேலியாவில் தமிழீழ விடுதலைப் புலிகள் தடை செய்யப்பட்டதாக அறிவிக்கப்பட்டால் அது தமிழர் மத்தியில் பெரும் அதிர்ச்சியை ஏற்படுத்தும் என அவர் குறிப்பிட்டுள்ளார். இவ்வாறான ஓர் சந்தர்ப்பம் ஏற்பட்டால் இலங்கை அரசாங்கத்தின் இனப்படுகொலைக்கு சர்வதேச சமூகம் அங்கீகாரம் அளித்ததாகவே தமிழர்கள் கருத நேரிடும் என அவர் சுட்டிக்காட்டியுள்ளார்.

இந்திய மாணாக்கர்கள் எனக் குறிப்பிடப்பட்டாலும் பொதுவாக இந்தி பேசும் மாணாக்கர்கள்தாம் தங்களின் தேவையற்ற ஆரவாரப் போக்கால் வன்முறைக்கு ஆளாகி வருவதாகச் சிலர் எழுதி வருகின்றனர். எப்படி இருப்பினும் மாணாக்கர்களுக்கு எதிரான வன்முறை என்பது உடனடியாக நிறுத்தப்பட வேண்டும். அதே நேரம் அரசு அதறகான நடவடிக்கையை எடுத்து வருகையில் வன்முறைக்கு எதிரான வன்முறை என்பது சிக்கலை மேலும் வளர்க்குமே யன்றித் தீர்க்காது. எனவே இதுவும் நிறுத்தப்பட வேண்டும். அதே நேரம் அறவழிகளில் தங்கள் எதிர்ப்பைக் காட்டலாம்.
