Dr Malathy’s ‘A Fleeting Moment’ to be released in Tamil

Tamil Nadu based publication house Vidiyal Pathippakam will be releasing the Tamil version of Dr. N. Malathy’s book ‘A fleeting moment in my country’ by the end of this month. The book in Tamil, titled “Enathu naaddil oru thu'li nearam: viduthalaip pulika'lin nadaimu'rai arasin i'ruthi naanku varudangka'l” will be ready for sale on 30 July, and will be on display at the Erode Book fair by the first week of August.

The book will be an excellent source of information, especially to the new generation of activists in Tamil Nadu who are at the forefront of struggles post-2009, commented Tamil literary circles in Chennai.

The sober assessment by the author of the LTTE de-facto state and the role that the International Community of Establishments played in tilting the balance in favour of genocidal Sri Lanka will also assist the Tamil Nadu activists to correctly identify and challenge the ultimate culprits, they further added.

The Bombay High Court has allowed a litigant who said she was not familiar with Marathi, Hindi or English to depose in Tamil during the recording of evidence. It also granted her permission to use an interpreter.
Koothayee Adimulam Harijan had moved the High Court after the sessions court rejected her request to record her evidence through an interpreter since she only spoke Tamil.
Justice R.P. Sondurbaldota, in her order, said Ms. Harijan’s long stay in Mumbai may have given her some working knowledge of Hindi. “But when she has to depose in a court of law, in proceedings initiated on her complaint, it is necessary that she gets an opportunity to depose in a language she is most comfortable in.”
Ms. Sondurbaldota said section 277 of the code of criminal procedure, 1973, made a specific provision for the purpose. “Sub-section (b) thereof requires that if a witness gives evidence in any language other than the language of the court, it may, if practicable, be taken down in that language.” If it that was not practicable, a true translation of the evidence in the language of the court should be prepared during the examination of the witness. “Such translation is required to be signed by the Magistrate or the presiding judge, which would then form part of the record,” she said.
The accused told the sessions court that Ms. Harijan had appeared before other courts earlier and communicated in Hindi. The judge too noted that the applicant had been residing in Mumbai for the last 23 years and it was highly improbable that she did not know the language. Moreover, she had written to the Malvani police station in Hindi. Ms. Harijan’s counsel Mahesh Vaswani told the High Court that the letter was written by another person she had merely signed it.

It is a welcome development and the judiciary in the entire country
should emulate this example. In fact, The Supreme Court should even
given a directive to all the courts to allow the people to depose in
the language in which they are familiar with. The interpreters could
be used, though the process may be time consuming and cumbersome.
When the members could speak in the language of their choice in the
Parliament, though they are conversant with Hindi & English, there is
no reason why the litigant public should not be allowed to depose in
the language in which they are familiar. It is certainly unfair to
force them to depose only in the local language of the state or hindi
or in english.
Hats off to justice R P Sondurbaldota for her positive and a
trendsetting approach .

An RSS-linked outfit ‘Hindu Sevaa Sangkam,’ (HSS) in collaboration with the genocidal Sinhala military, attempts to hijack and deviate the religious part of the struggle of the genocide-facing Eezham Tamils in the East. Backed by SL military intelligence, and run by members of the Pillaiyaan group, the HSS uses the name of Vishva Hindu Parishad in infiltrating and breaking the national struggle of Eezham Tamils, in order to serve the unholy alliance of Indian corporatism and genocidal Sinhala State, news sources in Batticaloa said. Under the occupying Sinhala military, while Saiva temples face destruction, desecration and plunder everyday, but new Buddhist stupas mushroom, a protest of the grassroot YMHA was banned but an HSS hoodwink was permitted this month in Batticaloa.

Several Hindu temples in the East have been destroyed, desecrated and plundered in the recent times. Many of them are located near to the Sinhala military camps. So far no action has ever been taken on the complaints by Tamils. Even a statue of Mahatma Gandhi was destroyed in Batticaloe recently. In the meantime new Buddhist structures in the form of statues, stupas, shrines and temples appear like mushrooms everywhere, especially in the localities of the Sinhala military camps.

Earlier this month, the Young Men Hindu Association (YMHA) of the Batticaloa district, which is an umbrella organisation of 127 Saiva/ Hindu grassroot associations in the district, has planned to conduct a peaceful protest march against the on-going religious genocide in the East.

While Buddhist outfits such as the Budu Bala Sena that spearhead the genocide against Tamils and Muslims in the East conduct their aggressive marches without any permission from anybody, the occupying Sri Lanka’s police in the East refused permission to the protest march of the YMHA.

The YMHA members later held a meeting at the Theattaath-theevu Pillaiyaar temple to discuss future plans. TNA parliamentarian for Batticaloa, Mr. C. Yogesvaran also has participated the meeting. The parliamentarian was later grilled by the SL intelligence whether any ‘training’ was being planned for the YMHA members.

In the meantime, in order to diffuse any polarisation of mass protest coming from the Eezham Tamils in the East, and in order to hijack and deviate any such polarisation, the Sinhala military intelligence has backed the RSS-linked Hindu Sevaa Sangkam (HSS) to conduct a hoodwink protest.

The HSS members were ushered by the Sinhala military intelligence to meet the Eastern Commander of the occupying Sinhala military at the Welikanda base, to plan the ‘protest’ demonstration, informed sources said.

The HSS ‘protest’ was staged in the name of the Vishva Hindu Parishad (VHP).

A person named Sudharshan of the Pillaiyan group, which is collaborating with Mahinda Rajapaksa, runs the HSS in the East.

VHP is considered as an outfit having links with the Hindu right wing Bharatiya Janata Party (BJP) in India, which in turn has links with the Rastriya Swayamsevak Sangh (RSS) headquartered in Nagpur in Maharashtra, and with the Mumbai-based Shiv Sena.

The TNA parliamentarian Mr.Yogeswaran is an elected political representative in the international body of the VHP, but he had nothing to do with the HSS-SL military hoodwink staged in the name of the VHP, informed sources said.

For a long time the VHP and other Indian-linked religious outfits operating from Colombo are engaged in ‘Sanskritizing’ Saiva/ folk religion of Tamils in the East, grassroot cultural activists in the East say.

A few years back, a Chennai-based, non-Tamil academic, having long links with New Delhi’s ‘national security’ apparatus tried to create a wedge in the religious shades between the Jaffna Tamils and the Up-country Tamils.

A diaspora activist, who recently organized a conference in a Western country on the Saiva Siddhanta shade of religion of Eezham Tamils, was not permitted to land in India (after given with visa) when he went there with his family for the medical treatment of a seriously ill family member. Only such Eezham Tamils have become a ‘security threat’ for New Delhi, when all kinds of crime-accused elements of the Sinhala State and its military come and go as guests.

Tamils carefully watch the developments in the East as the signals coming from the BJP camp are in defence of the genocidal Sinhala military occupying the country of Eezham Tamils and show patronage to the genocidal brand of Buddhism of the Sinhala State.

Sometime ago, an Indian holy man of political engagements, Sri Sri Ravishankar went to Batticaloa as a guest of Pillaiyan collaborating with Rajapaksa, when Pillaiyan was CM of East.

Neither the right wing BJP nor the left wing CPI-M make any difference from the Sonia Congress-led Establishment in New Delhi that is steadily in complicity with the genocide committed and being committed by the Sinhala State. The same is reflected in the stands of whether the Mumbai-based Times Group or the Chennai-based The Hindu, Tamil political observers in the island said.

On the whole, the genocide and annihilation of the nation of Eezham Tamils in the island has become an obsession more with both the fundamentalist as well as Stalinist elements in India, than with the Sinhala State in the island, as this genocide is now considered to be the easiest highway to promote corporate and imperial interests, the observers further said, adding that the elements would not hesitate even in creating a hybrid religion and imposing that on the subjugated Tamils.

It is such patronage coming from India that emboldens the Sinhala State to arrogantly insist that even Tamils in Tamil Nadu should accept its military committing genocide on Eezham Tamils. This week, Colombo was adamant in its military personnel getting Indian training in the soil of Tamil Nadu. After protests in Tamil Nadu, when India wanted to shift the personnel to another State, Colombo rejected it and withdrew the personnel.

Hundreds of Tamil refugees, including several hundreds who have been declared as "Mandate" refugees by the United Nations High Commission for Refugees (UNHCR) in compliance with the UNHCR Charter and associated statutes, are languishing in camps in East Asian countries, and recently in Dubai, while Australia, Canada, New Zealand, the Netherlands, the Nordic countries (Denmark, Finland, Norway and Sweden) and the U.S., which have traditionally admitted mandate and convention refugees, are denying resettlement to many of these refugees. Australia, which is one of the contracting countries with UNHCR, is even keeping in detention, citing security threat, Tamil boat refugees who have been granted asylum. 

New Zealand has routinely rejected applications for admission and resettlement of Tamil "mandate" refugees, even while the quotas for UNHCR recommended refugee intakes were not exceeded, published documents show. While individual states can reach independent determination of the refugee status based on the 1951 UN Convention and 1967 protocol, "convention" refugees, legal sources say, the differences are relatively few resulting in differing determinations. 

"The rejection rates in Australia and New Zealand are increasing, advocates of humane resettlement policy in both countries say. While Australia, collaborating with Colombo whose alleged genocidal crimes in Mu'l'livaaykkaal drove Tamils to flee Sri Lanka, repatriates many potential Tamil refugees while being accused of violating non-refoulement guidelines of the U.N., New Zealand silently rejects Tamil Mandate refugees even when UN-agreed quotas have not been exceeded and the refugees pose no risk to security," Tamils Against Genocide (TAG), a US-based rights group earlier said.

TamilNet recently obtained a letter written by the Office of Hon Kate Wilkinson, member of cabinet who held the portfolio of Immigration (before being removed by Prime Minister John Key) in response to a query by a NZ MP. The MP wrote to the Minister on behalf of a local New Zealand Tamil with regards to a rejected Tamil asylum claimant who was alleged to be a member of the Liberation Tigers. Full text of the letter follows:
    "There is no blanket government policy which requires that those associated with the Tamil Tigers be declined a visa or banned from entering New Zealand. 

    The individual we discussed may be caught by Immigration New Zealand (INZ) policy which requires that individuals who pose a risk to New Zealand’s international reputation be declined a visa. 

    When assessing whether Sri Lankans associated with the Tamil Tigers pose such a risk, INZ considers the level of association a person has had with the organisation on a case-by-case basis."
An activist closely involved with helping Tamil refugees told TamilNet, "studying the cases of Tamil refugees rejected by New Zealand and other countries mentioned here reveals an intriguing pattern. These countries appear to readily accept Tamil refugees who have had affiliations with Tamil militant groups that were working against the LTTE and those who have had very limited association with the LTTE. These same countries have consistently rejected Tamil refugees who have had long associations with the LTTE even when the association is non-military.

"Indeed one of the single mothers rejected was the wife of a well known civilian journalist who was killed by artillery fire in 2008 in Vanni. Her application has been rejected by Finland, Netherlands and New Zealand. 

"It's ironic that people who are the most vulnerable to Sri Lanka's beastly methods of torture are the ones the liberal West is unwilling to provide sanctuary," the refugee worker added.

Further, the Director of Deakin University’s Centre for Citizenship, Development and Human Rights, Professor Damien Kingsbury, has pointed out that the Australian Security Intelligence Organization's (ASIO's) investigations on the eligibility of Tamil refugees "bore the hallmarks of an anti-Tamil campaign being directed by the Sri Lanka government."

As seen, the discretionary powers afforded to the NZ Minister involves assessing if the claimant posed a risk to NZ's "international reputation," a overly broad-power, leaving a refugee with well-founded fear of persecution at his country of birth and left homeless in a foreign country, according to legal analysts in Washington. 

"Only sustained media exposure of the fate of the "mandate" and "convention" refugees by the rejecting contracting countries, including legal action for possible violation of international law, will pressure these countries to be more sympathetic in accepting additional refugees," TAG added when queried on the asylum progress.

TAG-UK has been pro-active in critically questioning the policy documents of the UK-Border Agency, and has achieved legal rulings favorable to refugees by showing many Tamil returnees have been tortured, and that legal pro-Tamil activity in the UK can result in persecution by Sri Lanka authorities.

Non-contracting countries, and countries which use allowed temporal or geographical limitations, can deny Convention status to mandate-refugees, legal sources say.

In addition to the earlier mentioned Western liberal democracies, Argentina, Brazil, Chile, Iceland, Ireland and the U.K. have also joined the U.N. program offering resettlement in the last decade. Since 2007, 13 new countries, Bulgaria, the Czech Republic, France, Germany, Hungary, Japan, Paraguay, Portugal, Spain, Romania and Uruguay, have added their names to the UN's resettlement list, according to published UNHCR documents.

Science validates history at Pattanam, located 25 km north of Kochi and identified as Muziris, lost port town frequented by Roman traders. Nuclear physicists have confirmed what archaeologists had proposed: the 3,000 year timeline of this village and its trade connections with Rome. Doubts, if any, about the antiquity of Pattanam appear settled.
Molecular biologists too are at work in Pattanam. Their DNA analysis of excavated human remains would answer questions about the origins of Pattanam inhabitants. Did Dravidians, Europeans and Africans live in this village near the Kerala coast?
Archaeologists of the Kerala Council for Historical Research (KCHR), over the last seven years, had unearthed thousands of artefacts in Pattanam.
Based on a careful analysis of the material evidence and a close study of the stratigraphy (layers of deposits), experts had suggested that Pattanam was inhabited from Iron Age (10th Century BCE to 5th century BCE) and Roman trade peaked between 1st century BCE and 4th century CE.
However, the KCHR did not undertake a comprehensive carbon dating of the objects so far. This had raised questions about the accuracy of proposed chronology. Suggestions about the multicultural setting of the lost city also needed supportive evidence.
Last year, the KCHR decided to corroborate their findings. They sought the help of G.V. Ravi Prasad of the Center for Applied Isotope Studies (CAIS), University of Georgia, U.S. The CAIS, using Accelerator Mass Spectrometry, analysed 13 organic samples that included bone fragments, charcoal bits and frankincense taken from different layers of two trenches.
The results validated Pattanam’s timeline and its links with Romans.
A sample of frankincense, probably brought from Saudi Arabia and found at 4.2 metre depth, is among the oldest objects. This, as carbon analysis reveals, is datable to 356 to 196 BCE and predates the Roman phase.
A piece of charcoal, found along with carnelian stone beads, gold filament and amphora shreds, at 3 metre depth is dated to 111 to 40 BCE when trade with Roman empire was active in Pattanam.
The only note of discordance between carbon and archaeological dating is regarding the layers containing bone fragments. The carbon analysis has found the bone fragments older than what archaeologists think.
Dr. Prasad, in a brief note provided by the KCHR, explained that this difference, which is about 300 years, could be due to the nature of the sample material.
“The carbon isotopic composition of a bone can be different after burning due to exchange with the fuel used for burning,” he said.

Study on skeletal remains

Niraj Rai, molecular biologist with the Centre for Cellular and Molecular Biology (CCMB), Hyderabad, is studying the skeletal remains excavated in Pattanam.
“The morphological features of the remains suggest that they are of human origin,” he said. The samples, about 13 of them, would be tested at the advanced DNA laboratory dealing with ancient human skeletal materials in the CCMB.
“DNA would be extracted from the samples and the mitochondrial DNA would be sequenced and matched with both published and unpublished DNA data base of modern human beings throughout the world,” Mr. Rai said.
“Depending on the mitochondrial sequences and their match, we can ascertain whether the human remains are that of Romans or Dravidians or Africans.” The results of this analysis would be known in a couple of weeks.
P.J. Cherian, Director, Pattanam Excavations, said “this exercise, which corroborates the chronological assumptions derived from the excavation data, reiterates the importance of archaeo-science and need to invest more in this field. We expect the Archaeological Survey of India and Oxford University to directly participate in the excavations in future.’

An Eezham Tamil male currently residing in Melbourne, Australia was tortured and sexually abused by Sri Lankan forces when he paid a visit to the island a few weeks before, Australian media reports. Speaking under a different name of ‘Kumar’ to the ABC on Wednesday, the father of three described in graphic detail of how he was abducted and tortured. This was, however, flatly rejected as “false allegations” by the SL High Commissioner for Australia, Thisara Samarasinghe, himself a military officer accused of war crimes. Despite living in Australia, the torture survivor is unable to come out in public owing to fear of retaliation by the GoSL on his family back in the island. Tamil sources from Australia further said that as long as the US and its bloc are going to churn out only impotent resolutions, this arrogance of the genocide-accused SL state would continue.

A report by Michael Gordon, Political Editor with The Age, for the Sydney Morning Herald on Thursday further elaborates on the case of the torture survivor.

Extracts from Mr. Gordon’s report titled ‘Scarred by Sri Lankan torture’ follows:

“''Kumar's'' scars are real and are only just beginning to heal - the result, he maintains, of four gruesome days of torture in a dark room, somewhere outside Colombo, barely two weeks ago.”

“What seems beyond question is that Kumar, not his real name, was un-scarred when he left Melbourne in March to return to Sri Lanka to run the restaurant of a hospitalised uncle - and very badly scarred when he returned on April 11.”

“Kumar admits he accepted money to carry some parcels for the Tamil Tigers while working as a bus driver in Sri Lanka in 2006. He says he left the country two years later and entered Australia on a student visa before completing a course in cooking and being granted a 457 visa in January last year.”

“Twice, he says, he returned to Sri Lanka to visit family before his wife and three children were able to join him. Each time, he says, he kept a low profile, staying in the family home, and had no trouble.”

“This time, he suspects he was spotted by Sri Lankan intelligence officers while working front-of-house in his uncle's restaurant.”

“He was riding home from the restaurant on a motor bike with his brother when they were intercepted. Kumar says he was bound, blindfolded and driven to a room and tortured for four days.”

“Early on, he says he saw a stove in a blood-spattered room, discarded women's underwear and an iron bar in a bucket. The ordeal reached its climax on the fourth day, when he says his back was beaten with the scalding bar.”

“''They wanted me to admit that I'm a LTTE [Tamil Tiger] and I said, 'No. How can I admit? I just delivered some parcels for some money','' Kumar told Fairfax.”

“''On the last day I begged them not to kill me, [saying] 'I've got family, I've got kids'. They showed me a blank sheet of paper and wanted me to sign.'' He claims that 30 minutes after signing the paper, he was released by a roadside.”

“Now he is seeking asylum, saying he fears that his back injuries will prevent him returning to work at a suburban Indian restaurant - and leave him liable to deportation.”

Separately, in a press release by the Tamil Refugee Council on Thursday, Aran Mylvaganam, spokesperson for the TRC, said that Kumar’s case was a living proof to the lie of the Australian Government's claim that it was safe for Tamils to return to Sri Lanka, whether they be asylum seekers or people returning voluntarily.

“Australia’s policy on Sri Lanka and on asylum seekers and refugees is in turmoil. It is morally, ethically and legally bankrupt,” said Mylvanagam.

The reason people like Kumar have to suffer is because governments like Australia engage with this brutal regime, giving it the cover to commit atrocities, he added.

Ilangkaith-thu’rai, meaning in this context “the islet-port,” is an ancient Tamil coastal village at a scenic location in the Eechchilam-pattai division of Trincomalee district. The occupying Sinhala military has Sinhalicized the place-name as “Lankaa-patana” and insists the local villagers to use the Sinhala name even in their speech. If any of the villagers mention their village name in Tamil, they are beaten up by the Sinhala military, news sources in Trincomalee said. Two years ago, the occupying military destroyed a Murukan temple located at the port entrance, appropriated 15 acres of land, and built a Buddhist temple named “Samudra-giri Vihara,” at that spot. While the village roads are in dilapidated condition, a new, broad road now links the Buddhist temple, facilitating Sinhala visitors from the South who come in thousands nowadays.

The word Ilangkai in ancient Tamil usage originally meant any island in the sea or any islet in rivers etc. The Austro-Asiatic form of the word Lankaa also originally meant the same as could be seen in many place names in the tribal parts of Central India and Andhra.

By popularity of usage, Lankaa/ Ilangkai became exclusive terms for what is called the island of ‘Sri Lanka’ today.

The Tamil usage of calling any islet in the river or in the backwaters also as Ilangkai is not found in Sinhala.

Ilangkaith-thu’rai village in Trincomalee district gained the name, as there is a small islet located at the entrance to the port, at the mouth of the sea-inlet. Ilangkai, in this context, stands for the islet at the mouth of the lagoon and this evidences an ancient form of usage of the word by the Tamils in the island.

This name has nothing to do with the Lankaa or ‘Sri Lanka’ that is imposed on Eezham Tamils in a genocidal fashion by the State in Colombo and by its international abetters. The SL military has no justification or authority in Sinhalicizing the place name and forcing the Tamils to use it, the civil society sources in Trincomalee said.

Depriving Tamils of their coasts and sea is the larger plan, which is in fact genocide at sea to go hand in hand with genocide at land, the civil society sources said.

If the Eastern Provincial Council has any meaning, how could a place name be changed, the civil society sources asked, adding that the Geneva resolution is aiming on a similar course to the North too, by harping on the Northern PC elections.

The State in Sri Lanka and its Sinhala military occupying the country of Eezham Tamils are encouraged in every way to accelerate and continue the structural genocide, by the attitude of the International Community of Establishments (ICE), especially by the USA and India that neither recognized the territoriality of Eezham Tamils, nor the genocide, Tamil civil society circles in Trincomalee said.

Colombo’s structural genocide activities show a marked escalation since the passing of the US-tabled, Indian fine-tuned, resolution at Geneva this March, the civil society circles further said.

Sikh resolution passes, Tamil resolution not tabled at NDP national convention

The biannual national convention of the New Democratic Party held in Montreal, Canada from April 12-14 passed a resolution recognizing Jaswant Singh Khalra, a Sikh activist who was allegedly abducted and killed by the police in the Indian state of Punjab in 1995, as a human rights defender. However, a resolution submitted from Scarborough-Rouge River calling for, among others, an independent, international and impartial mechanism in Sri Lanka to ensure justice for the Tamils and a UN conducted referendum to determine their political future, failed to make it to the tables of the convention. While Tamil activists who attended the convention argue that the resolution could have been passed had it been pushed by the Tamil NDP MP from Scarborough-Rouge River, Ms Sitsabaiesan, a NDP source claims that the resolution was brought in late but the MP made sure that it was in the policy book.

The resolution on Mr Jaswant Singh Khalra, the Sikh human rights activist, was strongly pushed for by the NDP MPP for Bramalea-Gore-Malton Mr Jagmeet Singh at the convention, and was passed with overwhelming support.

However, the resolution on Sri Lanka, which included calls for the recognition of the right to self-determination of the Tamils and a UN monitored referendum, was not taken up as it was not pushed as a prioritized one by Ms Rathika Sitsabaiesan, the MP representing Scarborough-Rouge River and as a result, it was not tabled at the national convention, said a community activist from the Tamil Worker’s Alliance (TWA) from that constituency who participated in the convention.

The resolution on Sri Lanka, which was passed in the Scarborough-Rouge River riding, through a democratic process on February 28, was mentioned in a NDP booklet of regular resolutions from ridings across the country and was sent to the organizers of the convention well in advance and was submitted as an emergency resolution, the activist from TWA further said.

While there were other resolutions too that were not tabled, grassroots activists from Scarborough claim that given the gravity of the situation facing the Eezham Tamils both in the homeland and in the international scenario, and given the history of NDP’s position on the Tamil question, the resolution on Sri Lanka could have been tabled at the national convention.

However, a NDP source speaking to TamilNet said that the resolution was brought to the convention late but Ms Sitsabaiesan made sure that it was in the policy book. Adding that Ms Sitsabaiesan worked in the background very strongly to make sure that issues on Sri Lanka are addressed both in the party and the parliament, he further said that Ms Sitsabaiesan also supported the Sikh resolution because she is building solidarity with the Sikh community so that the two communities can work closely and be stronger allies.

An official response to TamilNet from Ms Sitsabaiesan’s office said “NDP conventions have passed resolutions, giving our Leader and Caucus the mandate to fight for Tamil rights. That's what we're doing and we're very proud of our Leader and Caucus taking the strongest and most principled positions toward Sri Lanka. At this convention we also saw Neethan Shan, a Tamil activist and friend, elected to represent Ontario at Federal Council.”

“Thanks to Rathika, Canada's Official Opposition has taken the strongest, most principled stance on Sri Lanka in support of Tamil rights. New Democrats have been standing up in the House of Commons to demand that Conservatives refuse to send any delegation to the Commonwealth meeting in Sri Lanka. The Conservatives have refused. Rathika and Tom Mulcair will continue to increase the pressure on Conservatives on this.”

WHEREAS the NDP has consistently supported the Tamil community’s call for justice, fairness, and human rights while being a strong voice for peace on the global stage; and

WHEREAS Noting while Tamil homes, schools, hospitals, and places of worship remain destroyed by the war in our home land, the Government of Sri Lanka is building symbols of Sinhala hegemony in the occupied lands to destroy any evidence of Tamil existence,

BE IT RESOLVED that New Democrats again reiterate the call on the United Nations to immediately establish an independent, international and impartial mechanism to ensure truth, accountability, and justice in Sri Lanka; and

BE IT FURTHER RESOLVED that New Democrats call on the government of Canada to state unconditionally, and without reservation that it will not be participating in the 2013 Commonwealth Heads of Government Meeting to be held in Sri Lanka; and

BE IT FURTHER RESOLVED that New Democrats call the United Nations to recognize the Tamils’ right to Self-Determination; and

BE IT FURTHER RESOLVED that United Nations to conduct a referendum among the Tamils originally from North and East of Sri Lanka to decide their political future.

Armed squad attacks Tamil paper office in Jaffna setting ablaze press machines

An armed squad, allegedly operated by the Sri Lankan military intelligence, stormed the main office of the Uthayan Tamil daily in the city of Jaffna in the early hours of Saturday, setting ablaze the press machines and the copies of printed papers that were ready for distribution. The squad chased media workers away at gun point and poured petrol on the papers and machinery in the fourth attack to be reported on the popular Tamil daily since January this year. The pre-dawn attack, carried out Saturday at 4:45 a.m., comes 10 days after a similar attack on its Ki'linochchi office this month. Colombo's systematic attack on the Tamil daily, owned by Tamil National Alliance (TNA) parliamentarian E. Saravanapavan, seeks to destabilize the operation and dissemination of the paper in the occupied country of Eezham Tamils, especially before conducting elections to Northern Provincial Council.

The sequence of attacks on Uthayan began with a series of targeted assaults on its staff disseminating the Paper in Jaffna, Mullaiththeevu, Vavuniyaa and Ki'linochchi districts.

The attackers burnt the copies of Uthayan paper each time. Then, the attacks escalated on its offices and staff.

“Now, the the terror has finally reached the stage of committing an act of arson on the press machinery itself,” said a media worker, who was chased away at gunpoint by the squad that stormed the office.

Tamil National Alliance (TNA) and Tamil National Peoples Front (TNPF) politicians, who visited the Uthayan office have condemned in the strongest terms the arson attack on Uthayan daily.

Uthayan's personnel were getting ready for the day’s distribution, at the main office, when the attack took place.

The editorial staff had already left the office concluding their work.

The squad that stormed the office opened fire at the air to chase away the media workers.

Then, the attackers, who had brought petrol with them, poured it on to the machinery, setting the machines ablaze.

Bursts of gun fire have also been directed by the attackers at the press machinery.

Colombo is seeking to completely curb the operation of the paper, which has become the most targeted newspaper ever in the occupied country of Eezham Tamils.

This article does not understand the source of Tamil pride. It is NOT the difference between north Indian languages and Tamil that is the source. It is in the antiquity and richness of Tamil language, which is comparable to Greek and Latin, and Tamil culture. Also there are plausible theories that the great Indus Valley civilization is a Tamil civilian. There are words and constructs which Sanscrit borrowed from Tamil. Tamils are justifiably proud. The problem comes when Brahmins and other Indians try to super-impose a Sanscrit base for everything about Tamil. Take for instance, Bharathnatyam, a classical art form which originated from Tamil Nadu, which is dated to early few centuries of Christian era. Brahmins invent a new history to say that it was invented by Sanscrit scholars!! Take for instance Carnatic music which originated from Tamil Nadu a couple of centuries back. Though some improvements have been made to the original millennium old Tamil music, the claim that it is Sanscrit based is preposterous. To everyone's dismay in Tamil Nadu, the Brahmins sing only non-Tamil songs even in Tamil Nadu!

This article is written in such a biased manner, I don't know where to start from. The "English" probably understand the 'dictum" "quidquid latine dictum sit altum viditur." For 'ordinary" people who speak English it means apparently "Whatever is said in Latin seems profound." It is this syndrome at work! Is it such a horrible thing that the courts use the language of the people? The British easily forget that only when they hook off the shackles of Latin and French could they grow. Every language, even unlettered language is capable of rendering justice. When you make justice a business and a tool of power, and that too an imperial power, then you probably want to make it as opaque as possible. You will say ignorance is no excuse to break the law, but you would want to keep that law in some opaque and alien tongue. Is this justice at all, of course if you understand justice?!!


This article is misleading the people.The article 348 of the constitution clearly says that Hindi or Official language of a State can be used as official language in a High court with the permission of the Governor.The Governor has to get the consent of the President from this.The President has to act on such demands as per the advice of the Union.So in Hindi's case the Union had allowed the use of regional language Hindi in 4 Hindi states since it is official language of the state.But this status is denied to Tamil and this is violation of constitution and racism.
Also the judiciary exists for providing verdicts to PEOPLE and not for Lawyers or Judges to earn.So lawyers learning ,law in English has no place here.A common man needs access to his language in his MOTHER TONGUE.So the languages of all states must be allowed to be used in the respective states.

Tamil in the courts

LANGUAGES are a touchy business in India, with 22 recognised in the constitution. Hindi and English get prime status in the central government, but nearly every state has its own distinct policy. If providing adequate language services in courtrooms is hard in America, where English is spoken well by a large majority, then it’s Herculean in India, where not even Hindi is natively spoken by a majority.
The constitution is clear about which language to use in India's senior courts. In the Supreme Court and High Courts, English is used in all official documents. This makes sense. The language of the law in India is English. At the appellate level, only lawyers, who are mostly competent in English, present to the court. (The trial courts, which hear directly from witnesses and litigants, can use a state’s other official languages.) Lawmakers can allow another language in a High Court, but so far only four High Courts—in the states of Rajasthan, Bihar, Uttar Pradesh, and Madhya Pradesh—have done so, in each case with Hindi.
The unique allowance made for Hindi in some High Courts smarts for the country’s Tamil-speakers, who have long resented Hindi encroachment from the north. On Sunday, the chief minister of Tamil Nadu called upon national lawmakers to allow Tamil to be introduced as an official language in the Madras High Court. She argued that “If we are to take the administration of justice genuinely closer to people, then it is absolutely imperative that the local language is used in the High Court, as is already being done by the state government and legislature."
Tamil, India’s fifth most-spoken language, is a Dravidian language with few links to Hindi, an Indo-European language. Unlike other Dravidian languages, Tamil has largely resisted borrowings from Sanskrit, the ancestor of modern north Indian languages. This makes Tamil particularly different from India’s other major languages. These differences are a source of pride. In some ways, the country’s north-south divide is sharpest in Tamil Nadu. Between 1937 and 1986, Tamil-speakers repeatedly protested against the broad adoption of Hindi in India’s central government. Indian states were largely reorganised in 1956 to take account of language. National leaders had planned to keep Hindi and phase out English soon after independence. But pro-Tamil protests catalysed the adoption of the Official Languages (Amendment) Act of 1967, which ensured the survival of the central government’s official bilingualism, a practical recognition that English remained the only workable lingua franca for central government.  
This hardly put an end to the squabbling, especially at the state level. Internal immigration since then has led to a sharp rise in Hindi use in major cities, such as traditionally Kannada-speaking Bangalore, and to resistance by speakers of the regional languages. Of course, some of this tension is manufactured. Though there is genuine popular resentment against Hindi in some quarters, regional parties (many of which rose to prominence in the wake of these protests) have sometimes waved the flag of language nationalism to distract from more pressing matters.
Given this history, it’s apparent why Tamil Nadu lawmakers would want Tamil in the Madras High Court. It’s less clear that it is “absolutely imperative”. (Why is Hindi necessary in those four High Courts, either?) High Courts do sometimes hear trial-level cases, but these are rare. Language exceptions for such cases might make sense. But why extend the services to appeals, which make up most of High Courts' dockets? Only lawyers participate in appellate proceedings. Indian lawyers—even Tamil-speaking ones—learn the law in English. In trial courts, interpretation and translation are indeed vital. In appeals-courts which mostly host exchanges only between English-educated judges and lawyers, Tamil doesn't seem so necessary. Are cultural preservation arguments persuasive enough to justify the expenditure? If Tamil and Hindi, why not all other languages? Is there a genuine and unique need for Tamil (or, in fairness, Hindi) in a higher court? Indian readers and appellate lawyers are particularly welcome to jump in here with their thoughts.

NZ Intelligence alleged of monitoring former Green MP for involvement in Tamil question

New Zealand's Security Intelligence Service (SIS), which is part of the so-called Five Eyes intelligence network, comprising the intelligence agencies of Australia, Canada, Britain and the USA, was alleged of monitoring former Green party politician Keith Locke, who has been sympathetic to the Tamil cause. Mr Locke believes the SIS began covert operations on him in 2003, when he travelled to Sri Lanka, reports The Dominion Post. The former Green Party politician has demanded apology for illegal spying and that all 88 New Zealanders who were being spied on should be notified if the Government Communications Security Bureau (GCSB) has illegally snooped on them.

In 2003, following the ceasefire agreement between the LTTE and the GoSL, Mr Keith Locke, travelled to the country of Eezham Tamils and met the political leadership of the LTTE.

Blaming the international community for its failure, Mr Keith Locke, in June 2009 said the following at the New Zealand parliament:

“While I was in the Liberation Tigers of Tamil Eelam capital of Kilinochi, a Tamil proposal for an interim self-governing authority was presented to the Norwegian peace negotiators and was covered by the international media, but substantive discussions on an autonomy solution never eventuated.

“There was probably blame on both sides for that, but most damaging was the failure of the international community to keep the pressure on the Sri Lankan Government to go down the negotiating track and to not resort to war again. To do this, the international community should have consciously taken the conflict out of the context of the Government on one side and the terrorists on the other.”

“During the 2002-2005 ceasefire, the Liberation Tigers of Tamil Eelam was made a legal organisation by the Government of Sri Lanka and could freely operate anywhere in that country, yet the US, British, and Australian Governments kept their designations of the Liberation Tigers of Tamil Eelam as a terrorist organisation and the European Union added the Liberation Tigers of Tamil Eelam to its terrorist list. Of course, it is true that the Tamil Tigers have engaged in terrorist actions in the past, including political assassinations, and so has the Sri Lankan Government on an even larger scale according to the statistics of civilian deaths in the reports of human rights monitors like Amnesty International.”

The GCSB operates wiretaps, intercepts email traffic and monitors other interactions such as internet message boards, another report by The Dominion Post said.

Security analyst and former US spy Paul Buchanan told the paper that the information of any significance would be passed to the other partners in the Five Eyes intelligence network.

New Zealand houses a spy base, named Waihopai Spy Base, which is said to be part of a US-led worldwide network of spy stations, known as Echelon.

The government had promised the New Zealanders in 1989 during the launch of the Waihopai Spy Base that this secretive station would not be used to spy on New Zealanders.

The Echelon spy system is said to be capable of capturing and analysing ‘virtually every phone call, fax, email and telex message sent anywhere in the world’, according to Patrick S. Poole, a lecturer in government and economics at Bannockburn College in Franklin, Tennessee, USA, who previously served as deputy director of the Center for Technology Policy in Washington, DC.

It remains to be seen whether this network was deployed by an intelligence network of the International Community of Establishments (ICE) in crushing the armed struggle of the Eezham Tamils.

The framework of genocide carried by Colombo on Eelam Tamils is featured in a poster presentation at the Slovenia conference on R2P being held in the Faculty of Law, University of Lkubljana, Thursday by Tamils Against Genocide [TAG], a US-UK based activist organization, the conference details reveal. More than 80 speakers and poster presenters from almost 40 states and international institutions will discuss issues regarding R2P in 2 parallel panels each day, according to the conference program.

TAG's poster outlines how the failure of United Nations doctrine, Responsibility to Protect failed in Sri Lanka, and points out the Petrie report statement:
    “The concept of a ‘Responsibility to Protect’ was raised occasionally during the final stages of the conflict, but to no useful result. Differing perceptions among Member States and the Secretariat of the concept’s meaning and use had become so contentious as to nullify its potential value. Indeed, making references to the Responsibility to Protect was seen as more likely to weaken rather than strengthen UN action. The events in Sri Lanka highlight the urgent need for the UN to update its strategy for engagement with Member States in situations where civilian populations caught up in the midst of armed conflicts are not protected in accordance with international human rights and humanitarian law.”
Asserting that Genocide is "Clear and Uncontestable grounds for R2P," TAG's statement lays out the present state of affairs, as:
    Enduring Militarization. Rejection of a political solution. Lack of accountability. Cultural genocide. Demographic reconfiguring.

    TAG research (‘Returnees at Risk’ and ‘Activist Intimidation’) has identified that the GoSL defines ‘traitor’ and ‘terrorist’ broadly to include both those who call for accountability for crimes committed before during and after Eelam IV, and those who are considered to bring Sri Lanka into international disrepute, such as asylum seekers and protesters. Commensurate with its assessment of the threat, the GoSL allocates resources to collecting (both through surveillance and interrogations) and then acting upon that threat.

    The International Community mirror Sri Lankan rhetoric and reasoning, and vice versa, and are appeased by talk of Counter – Terrorism, Development and Reconciliation.
and says, that the State is the problem,
    The fetishisation of the State. The bias towards the State. The presumptions regarding a State.

    The near infallibility of an existing State and the reluctance to recognise new States.

    The sacred cow of “Sovereignty”, then and now. There were a myriad of reasons for the reluctance to intervene in 2009 and today, including considerations of humanitarian access, the hope for diplomacy but also geo-political, strategic and national interest concerns.
and concludes:
    Recognise that this is an on-going situation not an historical case study.

    Through adoption of a post colonial critique, dispense with attempts to’solve’ that apply universal prescriptions without consideration of local specificities.

    Demand as the first step an International Independent inquiry that embraces the historical context in order to expose the scale of the crimes by the State, both historic crimes and on-going human rights violations.
