Systemic disappearances qualify as crimes against humanity in ICC, says Boyle

The enforced disappearances of human beings that are widespread and systematic, such as the abductions of Tamils in the NorthEast including the midnight abduction of 28-year-old Mrs Soundararajan Sivamalar in Uduvil, Jaffna, on Christmas eve by Sri Lanka's Terrorism Division, are a Crime against Humanity under the Rome Statute for the International Criminal Court (ICC), Professor Boyle of the University of Illinois College of Law said. "So if Gotobhaya travels to an ICC Member State, it might be possible to get him prosecuted in the visiting country under its domestic implementing legislation for the Rome Statute," Boyle said.

Spokesperson for Tamils Against Genocide (TAG), a US-based activist group said, "While we are fighting to overturn the protection given to the primary genocidaire, Mahinda Rajapakse, by the United States Department of State under the extra-legal and discretionary application of the doctrine of Head of State Immunity, we will not have a similar issue with sibling Gotabhaya Rajakapakse, when he travels to a ICC signatory state," TAG said.

Boyle added, "under the ICC Rome Statute, it is a requirement that member states enact domestic implementing legislation making ICC Rome Statute Crimes domestic crimes as well. Hence it might be possible to prosecute Gotobaya under these domestic ICC Crimes even if the ICC does not have jurisdiction.

"This is how the objectors scared President Bush out of traveling to Switzerland by demanding his prosecution if he showed up there under their domestic implementing legislation for the ICC even though the USA is not a party to the Rome Statute," Boyle added.

Most of Europe now has domestic implementing legislation for the ICC. International Criminal Court Act No. 41, 2002 facilitates compliance by Australia with obligations under the Rome Statute of the International Criminal Court, and for related purposes.

இந்நிலையில் "அம்மாவின் ஆசை' ஒன்று, ரமணியின் மனதில் உதித்தது. தாய் சகுந்தலாவின் கண்களை எடுத்து, பிறருக்கு பார்வை அளிக்க வேண்டும் எனும் விண்ணப்பபம்தான் அது. வாழ்க்கையில் யாரும் அடுத்து துணைக்கு இல்லாத நிலையிலும், தாய் இறந்த சோகம் கண்முன் இருந்தும், பிறரின் வாழ்வில் வெளிச்சம் கொடுக்க வேண்டும் எனும் ரமணியின் மனிதநேயத்தை, மருத்துவமனையில் இருந்த அனைவரும் பாராட்டினர். இறுதியில் பல்வேறு சட்ட சிக்கல்கள் காரணமாக, கண்தானம் செய்யமுடியாமல் போனது மிகுந்த வருத்தத்தை அளித்தது.

190,000 displaced in Batticaloa due to floods, 30% of paddy destroyed

211 GS divisions in Batticaloa district have been affected by floods that have caused displacement of 190,966 members of 51,379 families in one week, civil officials at Batticaloa district secretariat said. Four persons were reported dead, one injured and two others have been reported missing in the floods. More than 4,000 houses were damaged. 30% of 155,000 acre paddy cultivation has been destroyed. 25,000 fishermen have lost their livelihood and families engaged in firewood and bricks making have lost their expected income. Several hundred heads of cattle have been washed away by the floods and those engaged in animal husbandry have lost their income, according to Department of Animal Husbandry sources.

11,530 members from 3,459 families have been staying in 34 transit centres as displaced, according to Disaster Management Unit in Batticaloa. 51,770 members of 14,323 families have been staying with their relatives and friends as displaced.

Those affected people by the rain and flood have not been provided with any assistance by the Colombo government despite some NGOs assisting them to resume their normal life in a little way, DMU sources said.

250,000 metric tonnes of paddy produce were expected this Maha season, according to R.Hariharan, District Assistant Director of Agriculture.

About 45,000 acres with paddy crops were under flood water for several days. Forty percent of minor crops such as maize, chilli, green grams and other crops were also destroyed due to flood.

4,035 houses were damaged due to one week long heavy rain and flood.

Of them 1,261 houses were completely damaged and 2,774 partially destroyed.

28-year-old Mrs Soundararajan Sivamalar, wife of an LTTE member killed in the war, and presently working at SL government’s Uduvil divisional secretariat, was abducted at midnight at her house recently. Sri Lanka’s Terrorist Investigation Department (TID) now informally acknowledged to the SL Human Rights Commission office in Jaffna that the ‘arrest’ was their act. Complaints of such abductions and ‘arrests’ of around 45 people have been registered in recent days at the SL human rights office in Jaffna, officials acknowledged on Monday. Many more abductions and arrests in the north have gone unregistered as the family members have been sternly warned by the occupying SL forces, not to register complaints at the SL human rights office. Meanwhile, many girl students of the Jaffna University have been ‘summoned’ over telephone by the TID in Vavuniyaa.

The summoning of the girl students of the University of Jaffna over the phone by the TID in Vavuniyaa now takes place directly, without any intimation to the university authorities.

Direct telephonic summoning of the university students has become an unchallenged and established practice now, following such a summon served to the President of the University Teachers’ Association and Head of English Language Teaching Unit at the university, Mr K. Rajakumaran.

Many girl students have silently gone with their parents to Vavuniyaa to submit themselves to TID investigations.

TID at Vavuniyaa is run directly by SL Defence Secretary and presidential sibling Gotabhaya Rajapaksa.

Meanwhile, most of the abductions of Tamil youth in recent days that have gone unregistered, took place in midnights or at dusk times, news sources said.

Occupying Sri Lanka’s Human Rights Commission’s office in Jaffna nowadays don’t encourage direct complaints of abductions coming to them, news sources in Jaffna further said.

The HR office tells the victim’s family members to lodge complaint at SL police stations.

Since the very SL police is a party to the abductions and arrests, how to lodge the complaint with them, ask the family members of the victims.

Of all the outfits of the occupying Sinhala state, the Human Rights Commission office is the only one for civilians to approach in a civil manner. Even this outfit is now directed to openly play on the side of State’s terrorism, public in Jaffna say. Some days ago, citing weekend, a threatened university student was prevented from surrendering at the HR office.

All the forces that don’t recognize the genocide, the nation of Eezham Tamils and its right to self-determination in the island are invariably parties to the crime of genocide through State terrorism that takes place now, the observers further said.

The terror campaign currently carried out especially against the released cadres of the LTTE, its former activists and even family members of them, is aimed at prodding them to join for safety with outfits and paramilitaries run by the genocidal government in collaboration with some of its international abetters, political observers in Jaffna suspect.

In a letter to the editor published on Christmas Day in 1936 in the Washington Post, on war and peace, a public citizen asks, "...[h]ow can any country whose citizens are engaged in slaughtering other human beings so like themselves call itself “civilized?” Are the lessons which have been handed down from the beginning of time to be thrown aside, or discarded, like an old shoe when the war drums are sounded? Are wisdom and saneness ever to mean anything but the strategy of war?" ....

Yesterday, as I stood among the ancient relics of a building in the Smithsonian; as I stood in a room where I was surrounded by objects so many centuries old, this thought came to my wondering mind: That of all the arts men had learned, had handed down through the ages, that the art of peace had yet to be learned.

Is civilization so old and full of wisdom that the word “war” can be left out of the dictionary? Has the perfect thought — men standing by men, rather than men standing against men — come as a permanent thing? How can any country whose citizens are engaged in slaughtering other human beings so like themselves call itself “civilized?” Are the lessons which have been handed down from the beginning of time to be thrown aside, or discarded, like an old shoe when the war drums are sounded? Are wisdom and saneness ever to mean anything but the strategy of war?

If men are worthy of the name, if nations have any honor: if women are to live and love; if babies are to utter that first sweet birth cry; if Roosevelt’s words, “I hate war,” mean more to us than the neighborhood gossip — then we must have, live and keep peace. A peace within ourselves, a peace among neighbors, peace between the nations of the world, and still more important, our peace with God.

So, in this time of Christmas tide, if our minds grow turbulent, if our hearts hold an ache greater than the heart itself and our very soul is in an agony of doubt and darkness, let us compose ourselves, and think of what the Greatest Peacemaker of all meant by “On earth peace, good will toward men.”

எட்டு ஆண்டுகளுக்கு முன் இந்திய மக்கள் கேள்விப்படாத வார்த்தை சுனாமி. 2004 டிச., 26ம் தேதி, "கடல் அலை' கோபம் கொண்டு ஊருக்குள் வந்த போது தான் தெரிந்தது, அது தான் சுனாமி என்று. இதன் கோபமோ வெறும் பத்து நிமிடம் தான். அது ஏற்படுத்திய சோகம், மக்கள் மனதில் இருந்து என்றுமே அழியப் போவதில்லை.

சமீபத்தில் கூட, அதே சுமத்ரா தீவில் பூகம்பம் ஏற்பட்டு, தமிழகத்தின் பல நகரங்களில் அதிர்வு உணரப்பட்டது. இந்தியா உள்ளிட்ட 42 நாடுகளுக்கு சுனாமி எச்சரிக்கை விடப்பட்டு, வாபஸ் பெறப்பட்டது. தற்போது சுனாமி என்றாலே குலைநடுங்கும் நிலை வந்துவிட்டது. சுனாமி என்பது ஜப்பானிய மொழிச் சொல். "துறைமுக அலை' எனப் பொருள். "ஆழிப்பேரலை' எனவும் அழைக்கப்படுகிறது. இந்தோனேசியாவின் சுமத்ரா தீவில், 30 கி.மீ., ஆழத்தில், ரிக்டர் அளவில் 9.1 என்ற அளவுக்கு பூகம்பம் ஏற்பட்டது. இதையடுத்து எழும்பிய பேரலைகள், இந்தோனேசியா, இந்தியா, மியான்மர், சிங்கப்பூர், இலங்கை, தாய்லாந்து உட்பட 14 நாடுகளில் கடும் சேதத்தை ஏற்படுத்தியது. இந்திய துணைக்கண்டத்தில் மட்டும், 2 லட்சம் முதல் 3 லட்சம் பேர் இறந்தனர். இது, உலகின் மோசமான இயற்கை சீரழிவுகளில் 6வது இடம் என்ற சோகமான சாதனையைப் பெற்றது.

தமிழகம் அதிகம் :

இந்தியாவில் தமிழகம், ஆந்திரா, கேரளா, புதுச்சேரி ஆகிய மாநிலங்களை சுனாமி தாக்கியது. இந்தியாவில் 12 ஆயிரம் பேர் பலியாக, தமிழகத்தில் மட்டும் 7 ஆயிரம் பேர் இறந்தனர். பூகம்பம் மூன்று விதங்களில் ஏற்படுகிறது. தரைப் பகுதியில் ஏற்படும் போது, நிலம் பிளவுபட்டு கட்டடங்கள் தரைமட்டமாகின்றன. மலைப்பகுதியில் ஏற்படும்போது எரிமலை உருவாகிறது. இதுவே கடலில் ஏற்படும் போது, சுனாமி உருவாகிறது.
