Colonel Kumar Lama, a 46-year-old Nepalese officer, currently seconded to the UN, was held at his East Sussex home by Metropolitan Police officers on Thursday, charged with intentionally "inflicting severe pain or suffering" as a public official on two separate individuals, BBC reported. "This encouraging development puts on notice persumptive war-criminals from Sri lanka who have participated or commanded extra-judicial killings, torture of civilians, and killings of surrendees, all qualifying as war-crimes during a State sanctioned massacre that comes perilously close to genocide, on visiting UK, or other European Countries where the Courts exercise Universal jurisdiction for such crimes," a spokesperson for Tamils Against Genocide (TAG) said.

Detectives with specialist experience of war crimes arrested the officer under Section 134 of the Criminal Justice Act, a law that defines torture as a "universal jurisdiction" crime, BBC said.

The offences are thought to have taken place between April and May 2005 and April and October 2005 at the Gorusinghe Army Barracks in Kapilvastu, Nepalese media reported. The arrest followed after a file of evidence gathered by Amnesty International and law firm Hickman & Rose was given to Scotland Yard on behalf of the Nepal-based human rights group Advocacy Forum.

"While Lama's charges are only on two torture incidents, miniscule compared to the egregious crimes committed by Sri Lanka's ex-Commanders and rulers holding high positions, British Police had no qualms in arresting the Colonel. The arrest sends a powerful message to all alleged war-criminals in stepping on British soil," TAG, a US-based activist group seeking legal redress to Tamil victims of Sri Lanka war, said.

“The arrest of the Nepali army officer sends a strong and important signal that the UK takes its international obligation to hold torturers accountable for atrocity crimes seriously, even if Nepal does not,” Brad Adams, Asia Director of Human Rights Watch said. “The UK’s move should remind those accused of rights abuses the world over that they can run, but it’s getting a lot harder for them to hide.”

Colombo has routinely sought to exploit the immunity provisions available in several countries to sanitize alleged war-criminals and genocidaires by offering them diplomatic posts, Tamil activists say.

Several expatriate Tamil groups and liberal legal institutions have been active in filing legal actions against alleged war criminals in the last three years, political observers noted.

In December 2010, Sri Lankan Major General Chagi Gallage, a member of Mahinda Rajapaksa's entourage to London, fled UK by chartering a flight after receiving information that war crime charges were to filed against him in the courts of London.

In September 2011, Maj. Gen. (retd.) Jegath Dias, deputy Counsel in Sri Lanka’s embassy in Germany, and commander of Sri Lanka Army's (SLA's) 57th division during the last phase of the Sri Lanka war, was recalled by Colombo "in response to accusations he was involved in war crimes," from Switzerland.

"While litigation in several countries are on-going, and some of these may not result in a successful outcome, the legal accumulation of evidence against alleged criminals will be critically important when the associated individuals are relieved of their diplomatic shields and stand naked to receive natural justice," TAG spokesperson added. "Legal actions should continue unabated on every presumptive war-criminal in all judicial fora so that at the minimum the movement of these individuals are curtailed and the horrors inflicted on its own citizens by a State regarded as a member of comity of nations is exposed, to the discomfort of major powers that either stood in silence or helped the State to carryout the massacres," TAG spokesperson added.

TAG is currently involved in litigation on behalf of three Tamil plaintiffs against Sri Lanka's President Rajapakse alleging he committed war-crimes. The case is in appellate phase after the U.S. Department of State intervened to "suggest" head of state immunity to Rajapakse.

While U.S. Courts granted diplomatic immunity to the ex-Army General and currently Sri Lanka's Acting Permanent Representative to the United Nations, Shavendra Silva, against war crimes charges filed by the American University Washington College of Law on behalf of two Tamil plaintiffs, South Africa declined to receive Silva to a diplomatic post, linking General Silva to the commission of war crimes and crimes against humanity during the Sri Lankan civil war.

The United States Court of Appeals for the District of Columbia Circuit granted appellants’ motion for extension of time to file the Reply brief, by two weeks, in the appeal case against Sri Lanka's President Mahinda Rajapakse for civil damages on war-crimes charges, according to the court docket. The revised briefing schedule indicated that the Appellant's Reply brief will now have to be filed by December 7, 2012. Attorney for the Appellants, Bruce Fein, told the court that the the intervening holidays and his case work load had necessitated the request for extension and the Court granted his motion.

The Appellant attorney affirmed that "[t]he motion has not been filed for the purpose of delay or other improper purpose. Federal Rules of Civil Procedure (FRCP)-11 (c)(1) allows the Court to impose sanctions on the attorney or law firm if the court determines that the motion is "being presented for an improper purpose, such as to harass, cause unnecessary delay, or needlessly increase the cost of litigation."

The case filed by three Tamil plaintiffs is on appeal from a final order dismissing the complaint for lack of jurisdiction based on a suggestion of immunity for Rajapakse filed by the Department of Justice on behalf of the Department of State.

The complaint was filed first in 2011 at the District Court for this case alleged multiple violations of the Torture Victims Protection Act (TVPA) based on Sri Lanka's President Rajapaksa’s command responsibility for the extrajudicial killings of Ragihar Manoharan, the son of Plaintiff Dr. Kasippillai Manoharan, of Premas Anandarajah, a humanitarian aid worker for Action Against Hunger, and husband of Plaintiff Kalaiselvi Lavan, and four members of the Thevarajah family, all relatives of Plaintiff Jeyakumar Aiyathurai.

Reacting to arguments put forth by the panel of discussants at the London book launch event of Frances Harrison's 'Still Counting the Dead' on Friday, especially to the opinions of Norwegian politician and peace-broker Erik Solheim, Indian academic Radha D'Souza and UK-based academic Amanda Latimer, criticized the politics of deceit the International Community of Establishments (ICE) was playing with the Tamils. In exclusive videos to TamilNet, both Dr. D'Souza and Ms. Latimer came down hard on the Western Establishments and those working with vested interests for spreading misinformation to the Tamil diaspora about the liberation struggle of the Eezham Tamils.

The panellists at the event besides Mr Erik Solheim were Mr Alan Keenan, Sri Lanka project director in the International Crisis Group (ICG) and Ms Yasmin Sooka, member of the UNSG panel that brought out a report on the war in the island of Sri Lanka.

Earlier, at the book launch event, both Dr. D'Souza and Ms. Latimer had raised questions on the UK and India providing arms and other help to the genocide-accused Sri Lankan government. Their questions were not satisfactorily answered.

Dr. D'Souza and Ms. Latimer were interviewed by TamilNet during the book launch event of Ms. Frances Harrison in London on Friday.

ராணுவத்திடம் சிக்கியுள்ள 60 விடுதலைப்புலிகள் மீது போர் குற்ற வழக்கு: இலங்கை அரசு அறிவிப்பு

இலங்கையில் கடந்த 3 ஆண்டுகளுக்கு முன்பு நடந்த இறுதி கட்ட போரின் போது விடுதலைப்புலிகள் பலர் ராணுவத்தினரிடம் சிக்கினர். அவர்களில் 300 பேர் கைது செய்யப்பட்டு ராணுவ கட்டுப்பாட்டில் உள்ளனர். அவர்களில் 60 விடுதலைப்புலிகள் மீது போர்க்குற்ற வழக்குகள் பதிவு செய்யப்பட உள்ளது.

இந்த தகவலை இலங்கை ராணுவ அதிகாரி ஜெனரல் சுகத் கம்லத் தெரிவித்துள்ளார். இவர்கள் போர்க்குற்றங்கள் மற்றும் மனித குலத்துக்கு எதிரான குற்றங்களை இழைத்துள்ளதாகவும், அதற்கான தெளிவான ஆதாரங்கள் கிடைத்துள்ளன. மேலும் இவர்கள் விடுதலைப்புலிகளின் ஆதரவாளர்களுடன் தொடர்பு வைத்து இருந்ததும் மற்றும் நாடு கடந்த தமிழீழம் அரசை அமைக்கும் ரகசிய சதித்திட்டத்தில் புலம் பெயர் தமிழர்களுடன் தொடர்பு வைத்துள்ள நம்பகமான தகவல்கள் கிடைத்துள்ளன.

தகவல் தொழில் நுட்பம் மற்றும் செல்போன்கள் மூலம் வெளிநாடுகளுடன் தொடர்பு வைத்து அவர்களின் ஆலோசனைக்கு ஏற்ப செயல்பட்ட ஆதாரங்களை தீவிரவாத விசாரணை பிரிவு கண்டுபிடித்துள்ளது என்றும் அவர் தெரிவித்துள்ளார். இவர்களிடம் விசாரணை நடத்த அனுராதபுரம், வவுனியா, மன்னார், வெலிக்கடை ஆகிய சிறைகளில் 4 புதிய உயர்நீதிமன்றங்கள் அமைக்கப்பட உள்ளன.

ஏற்கனவே கைது செய்யப்பட்ட 300 விடுதலைப்புலிகளில் 150 பேர் மீது மோசமான குற்றங்கள் இழைத்ததற்கான ஆதாரங்கள் இல்லை எனவே அவர்கள் புனர்வாழ்வுக்கு அனுப்பப்பட உள்ளனர்.

இலங்கை ராணுவ தளபதி மற்றும் அதிபர் ராஜபக்சேவின் சகோதரருமான ஜெகத் ஜெயசூர்யாவின் பேச்குக்கு பாமக நிறுவனர் ராமதாஸ் கடும் கண்டனம் தெரிவித்துள்ளார்.
இலங்கை சிறப்புப் படையைச் சேர்ந்த 45 உயரகாரிகள் டிசம்பர் மாதம் இந்தியாவில் பயிற்சி பெற வரவிருப்பதாகவும், முடிந்தால் தமிழக அரசியல்வாதிகள் அவர்களை தடுத்து நிறுத்தட்டும் என்று செய்தியாளர்களிடம் பேசிய ஜெகத் ஜெயசூர்யா கூறினார்.
இது குறித்து இன்று கண்டன அறிக்கை அனுப்பியுள்ள ராமதாஸ், இலங்கைப் போரின் போது லட்சக்கணக்கான தமிழர்களை கொன்ற ஜெயசூர்யா, அமெரிக்காவிலும், பல ஐரோப்பிய நாடுகளிலும் நுழைய தடை விதிக்கப்பட்டுள்ளது. இனப்படுகொலை செய்த குற்றத்துக்காக போர்க் குற்ற நடவடிக்கைக்கு உட்படுத்தப்பட வேண்டிய ஒருவர், இன்று தமிழக அரசியல்வாதிகளுக்கு சவால் விடும் அளவுக்கு பேசத் துணிந்திருப்பதற்குக் காரணம் இலங்கை அரசுக்கு இந்தியா அளித்து வரும் ஆதரவுதான்.
இதைப் பார்க்கும்போது, இந்தியா ராஜபக்சேவின் காலணி ஆதிக்கத்தின் கீழ் செயல்பட்டு வருகிறதா? என்ற வினா எழுகிறது. இந்த பேச்சு இந்திய இறையாண்மைக்கு விடப்பட்ட சவாலாகும்.
மத்திய அரசு தமிழக மக்களின் உணர்வுகளை மதிப்பதே இல்லை. தமிழ்நாடு இந்தியாவின் ஒரு பகுதி என மத்திய அரசு கருதினால், இந்த பேச்சுக்கு இந்தியா கடும் கண்டனம் தெரிவிக்க வேண்டும்.அதுமட்டுமில்லாமல், இந்தியாவில் பயிற்சி பெற வரும் இலங்கை வீரர்களை திருப்பி அனுப்ப வேண்டும் என்று ராமதாஸ் கேட்டுக் கொண்டுள்ளார்.

An official who recently visited the outskirts of Mu'l'livaaykkaal with the soldiers of the Sri Lanka Army told TamilNet this week that he had personally witnessed skeletal remains of hundreds of slain people surfacing along the few kilometers long, L-shaped bunker, running from Vadduvaakal to northwards along the land of the genocidal onslaught. A vast area is still not cleared and is strictly prohibited from access to anyone except SL military officials. “There are booby traps and UXOs. Rotten automatic rifles and RPG ammunitions are lying around in the area. When I walked across a bunker, I was able to sense that it was a bunker of mass slaughter. As the bodies buried underneath have rotten, the soil was going under as we walked across,” he said. Meanwhile, some other mass graves show the use of chemicals that have burnt even the bones to become ashes, journalists report.

The kilometers-long bunker, which was the last Forward Defence Line position dug by the Liberation Tigers of Tamil Eelam (LTTE) in May 2009, was one of the major locations where the genocidal SL military slaughtered thousands of severely wounded cadres and civilians in the final days of the onslaught.

A large number of blindfolded youth, who were filtered away from the people as they crossed the Vadduvaakal Bridge, were taken here after stripping off their clothes and blindfolding them. It is believed that they were photographed here, before the massacre in cold-blood, the official said.

The remains, found inside the bunkers, look as sand bags had been placed on them for cover up, the official said.

Only 21 houses, along the main road, in Ve'l'laam-mu'l'livaaykkaal have been allowed for resettlement and these houses are situated along the road. Even here, one could still witness skeletal remains spread throughout the area, he said providing some of the photographs he had managed to take in the outskirts of the genocidal land.

“Despite the SL military bulldozing and removing the traces, there are still hundreds of skeletal remains scattered all around the lands,” he said adding that the scale of mass slaughter was beyond imagination.

“I knew it was horrible. But, I could sense the mass scale of the slaughter only when I walked through the mass graves,” he said.

Meanwhile, journalists who visited Aananthapuram, adjacent to Mu’l’livaaykkaal, report of seeing mass graves that show evidences for the use of chemicals in burning the dead bodies. Even bones have been burnt to the extent that they become ashes at touch. A kind of chemical sheet was used to cremate the bodies, say journalists who visited the site recently.

சென்னை:""இலங்கை அதிபர் ராஜபக்ஷேவை, இந்தியாவிற்கு மீண்டும் அழைத்தால், லட்சம் பேர் திரண்டு சென்று, பிரதமர் வீட்டை முற்றுகையிடுவோம்,'' என, வைகோ எச்சரிக்கை விடுத்தார்.
ம.பி., மாநிலம் சாஞ்சியில் கடந்த, 21ம் தேதி நடந்த புத்த மத விழாவில் பங்கேற்க ராஜபக்ஷே, இந்தியா வந்தார். ராஜபக்ஷேவுக்கு, கறுப்புக் கொடி காட்டி போராட்டம் நடத்த, வைகோ தலைமையில், 21 பஸ்களில் 1,000 பேர் சாஞ்சிக்கு சென்றனர். ரயில், விமானம் மூலம், 200 பேர் அங்கு சென்றனர். வைகோ உள்ளிட்ட கட்சியினரை ம.பி., போலீசார் தடுத்து நிறுத்தினர்.இந்த போராட்டத்தின் போது, ராஜபக்ஷேவின் உருவ பொம்மையை ம.தி.மு.க.,வினர் எரித்தனர். தொடர்ந்து, சாஞ்சியை நோக்கி, பேரணியாகச் சென்றவர்களை போலீசார் கைது செய்தனர்.

நேற்று காலை, 7 மணிக்கு, வைகோ சென்னை திரும்புவதாக எதிர்பார்க்கப் பட்டது. வழியில் மழை பெய்து, சாலைகளில் நீர் தேங்கியிருந்ததால், போக்குவரத்து பாதிப்பு ஏற்பட்டுள்ளது.
இதனால், குறித்த நேரத்தில் பஸ்கள் சென்னைக்கு வர இயலவில்லை. இதற்கிடையில் விமானம், ரயில் மூலமாகச் சென்றிருந்த கட்சியினரும், போபாலில் இருந்து ரயிலில் புறப்பட்டு, நேற்று காலை, சென்னை சென்ட்ரல் ரயில்வே ஸ்டேஷனிற்கு வந்தனர். அவர்கள் ரயிலிலிருந்து இறங்கியதும் ராஜபக்ஷே, காங்கிரஸ் தலைவர்களுக்கு எதிராக கோஷம் எழுப்பினர்.இதனால், அங்கு திடீரென பரபரப்பு ஏற்பட்டது.

நேற்றிரவு, சென்னை திரும்பிய வைகோவும், அவரது கட்சியினரும் அண்ணாதுரை சமாதிக்குச் சென்று, மலர் வளையம் வைத்து அஞ்சலி செலுத்தினர்.தொண்டர்கள் மத்தியில் வைகோ பேசியதாவது:இனப் படுகொலையை நடத்திய இலங்கை அதிபர் ராஜபக்ஷேவை, மூன்று முறை, பிரதமர் மன்மோகன் சிங் இந்தியாவிற்கு வரவழைத்துள்ளார். இந்த நடவடிக்கை இனியும் தொடருமேயானால், ரயில், விமானம், பேருந்து என, லட்சம் பேர் திரண்டு சென்று, பிரதமர் வீட்டை முற்றுகையிட்டு போராட்டம் நடத்துவோம். ராஜபக்ஷேவுக்கும், இந்திய அரசுக்கும் உள்ள கள்ளத் தொடர்பை அம்பலப்படுத்துவேன்.

சிந்துலாரா, செப்., 20 : மத்தியப்பிரதேச மாநிலம் சாஞ்சியில் நடைபெறும் நிகழ்ச்சியில் கலந்து கொள்ள வரும் இலங்கை அதிபர் ராஜபக்சேவுக்கு எதிராக போராட்டம் நடத்த சென்னையில் இருந்து கிளம்பிய வைகோ உள்ளிட்ட ஆயிரக்கணக்கான மதிமுகவினர் சென்ற வாகனத்தை சிந்துலாரா மாவட்டம் பந்துர்ணா என்ற இடத்தில் அம்மாநில போலிஸார் தடுத்து நிறுத்தினர்.கடந்த 17ம் தேதி சென்னையில் இருந்து பல்வேறு வாகனங்களில் புறப்பட்ட மதிமுகவினர், நேற்று இரவு பந்துர்ணா என்ற இடத்தை அடைந்தனர்.  அப்போது அவர்களை தடுத்து நிறுத்திய காவல்துறையினர், போராட்டத்தைக் கைவிட்டு திரும்பிச் செல்லுமாறு கூறினர்.இதனை ஏற்காத வைகோ, அங்கேயே உட்கார்ந்து தர்ணா போராட்டம் நடத்தினார். இரவு அங்கேயே சமைத்து சாப்பிட்டு, சாலையோரத்தில் படுத்துறங்கினர். இன்று காலையும் உயர் அதிகாரிகள் வந்து வைகோவை சந்தித்து பேச்சுவார்த்தை நடத்தினர். ஆனால் வைகோ திரும்பிச் செல்வதில்லை என்று தெளிவாக கூறிவிட்டார்.இதற்கிடையே மத்தியப்பிரதேச முதலமைச்சர் ஷிவ்ராஜ் சிங் சௌஹான், மதிமுக பொதுச் செயலாளர் வைகோவை தொடர்பு கொண்டு, போராட்ட முடிவைக் கைவிட்டு திரும்பிச் செல்லுமாறு கோரிக்கை வைத்தார். மேலும், இது முழுக்க முழுக்க அரசியல் விவகாரமாகும், ஆசிய நாடுகளுடன் இந்தியா நட்புணர்வை மேம்படுத்தவே விரும்புகிறது என்று குறிப்பிட்டார்.தற்போது சாஞ்சிக்கு செல்லும் அனைத்து வழிகளும் அடைக்கப்பட்டுள்ளன. பலத்த சோதனைக்குப் பிறகே வாகனங்கள் அனுமதிக்கப்படுகின்றன. சுமார் 11 ரயில்கள் நாளைக்கு போபாலில் இருந்து விதிஷா வரை எங்கும் நிற்காமல் செல்ல ரயில்வே நிர்வாகம் அறிவுறுத்தியுள்ளது.

திரு சேஷாயி அவர்களுக்கு, வைகோ விளம்பரத்திற்காக செய்வதாக இருந்தால், எதற்கு மத்தியபிரதேசத்தில் உள்ள ஒரு சிறு கிராமத்தில் போராட வேண்டும்? இதே போராட்டத்தை சென்னையிலோ இல்லை மதுரையிலோ நடத்தி இருக்கலாமே. கூட்டமும் சேர்ந்து இருக்கும்... செய்திகளும் பரபரப்பாகி இருக்கும். பாவம் அவருக்கு மற்றவர்களைப் போல வோட்டு அரசியல் நடத்தி பிழைக்க தெரியவில்லை.

வாய்ச்சொல்லில் வீரர் தான் பெரும்பாலான அரசியல் தலைவர்கள்! ஒப்புக்கு எதையாவது செய்வார்கள்! ஆனால் வைகோ அப்படிப்படவர் இல்லை என்பதை தெளிவாக நிரூபித்துள்ளார்கள். 1000 வைகோக்கள் வந்தாலும், இதனை நம்மக்கள் உணரவே மாட்டர்கள் என்று ஒரு சகோதரர் சரியாக சொல்லியுள்ளார். மனிதாபிமானம், மனித நேயம் இல்லாதவர்களால் இது போன்ற செயல்களை உணரமுடியாது!

நன்றி வைகோ அவர்களே! இமயவரம்பன் நெடுஞ்சேரலாதன் , கங்கை கொண்டான், கடாரம வென்றான் பரமபரையிலே வந்த நாம் இன்று வரலாற்று போக்கில் இந்தியார்களாகி விட்டதால்அப்படி சில நன்மைகளையும் பெற்றுள்ளதால் , நம் இனத்தவர்களை கொன்றவர்களை கூட எதிர்த்து அடக்கி நமது இன உடன்பிறப்புகளுக்கு உரிமைகளையும் சிங்களனுக்கு இழந்த மண்ணையும் பெற்றுத்தர இயலவில்லை. உங்களின் உண்மை முயற்ச்சிகளையும் கூசாமல் இகழுகிறார்கள்! வேதனைதான் .பதவிகளையும் பணத்தையும் அனுபவித்துவிட்ட இரு பெரும் கழகங்களும் ஈழ தமிழனுக்கு தேவையான விடுதலையை பெற்றுதர மாட்டார்கள். கூட்டணி சேர்ந்து ராஜபக்சே தீவில் கிழக்கு தமிழ் பகுதியில் தனது கட்சிகாரரை பதவியில் அமர்த்திவிட்டார். நடப்பவைகளை வேதனையுடன் பார்த்துகொண்டிருக்கிறோம்.

வைகோ ஒருவர் மட்டும்தான் தமிழர்களின் உணர்வை மத்திய அரக்கனுக்கு ( சோனியா அரசுக்கு) வெளிபடுத்துகிறார் . இந்திய ராணுவத்திலிருந்து தமிழர்கள் வெளியேறவேண்டும் . தமிழர்களை காப்பாற்றாத இந்தியாவிற்கு , வட இந்தியனை நாம் ஏன் பாகிஸ்தானிடம் எல்லையில் காப்பாற்ற போராடவேண்டும்.

திரு வைகோ விற்கு ஒரு MLA கூட கிடையாது. கட்சிக்கு அங்கீகாரம் கூட ரத்துஆகிவிட்டது என்று தேர்தல் ஆணையம் கூறிவிட்டதாக நாபகம் . ஏலேக்டயொனில் கூட நிற்கவில்லை . இவர் ஏன் தமிழக மக்களுக்கு இந்த அளவு போராடவேண்டும் . மக்கள் தனக்கு குடுத்துள்ள ஒட்டு உரிமையை சாதிக்கவும் ,பணத்திற்காகவும் பயன்படுத்துகிறார்கள் என்பது தெரிகிறது.இல்லையெனில் இவ்வளவு கொள்ளை அடித்தவர்கள் மீண்டும் தேர்தலில் வெற்றி பெற முடியாது. தேர்தலில் நின்று ஜெயித்த நபர்கள் ஆளுக்கு ஒரு டிவி வைத்துக்கொண்டு மெத்தையில் படுத்த்கொண்டே அறிக்கை விட்டு அரசியல் செய்துகொண்டிரிக்கிரார்கள். ஆனால் இவர் மிகவும் கஷ்டப்பட்டுகொண்டிருக்கிறார். இது நம் மக்களுக்கு சத்தியமாக் உணரவே மாட்டார்கள்.இவர்களை 1000 வைகோ வந்தாலும் திருத்தவே முடியாது.

தமிழகத்து மக்களுக்கு,காவிரி நீரை பெற்றுத்தர பெங்களூர் சென்று போராட்டம் நடத்தினால் பயன் உண்டு. தேவை அல்லாத விஷயங்களுக்கு, போராட்டம் நடத்தி,விளம்பரம் தேடுகிறார் வை கோ.
