சென்னை, செப். 2: இலங்கை கால்பந்து விளையாட்டு வீரர்களுக்கு சென்னையில் பயிற்சி அளித்துள்ளதற்கு கடும் கண்டனத்தை தெரிவித்துள்ள முதல்வர் ஜெயலலிதா, அவர்களை திருப்பி அனுப்ப உத்தரவிட்டுள்ளார். மேலும், நேரு விளையாட்டு அரங்கில் பயிற்சி அளி்க்க அனுமதி அளித்த பொறுப்பு அதிகாரியை தாற்காலிக பணிநீக்கம் செய்யவும் முதல்வர் உத்தரவிட்டுள்ளார்.இது குறித்து முதல்வர் வெளியிட்டுள்ள அறிக்கையில்,இலங்கைத் தமிழர்கள் சிங்களர்களுக்கு சமமான உரிமைகளைப் பெறும் வரை அந்நாடு மீது பொருளாதாரத் தடை விதிக்கப்பட வேண்டும் என்று தமிழக சட்டப் பேரவையில் தீர்மானம் நிறைவேற்றப்பட்டது. அந்த தீர்மானத்தின் மீது மத்திய அரசு நடவடிக்கை எடுக்காமல், தமிழக மக்களின் உணர்வுகளை புண்படுத்தும் வகையில், இலங்கை ராணுவ வீரர்களுக்கு தமிழ்நாட்டில் தொழில்நுட்பப் பயிற்சி அளிப்பதற்கான நடவடிக்கையை எடுத்து வருகிறது.  மத்திய அரசின் இந்த நடவடிக்கையை எதிர்த்து கடும் கண்டனத்தை நான் வெளியிட்டவுடன், இலங்கை ராணுவ வீரர்களை இந்தியாவில் உள்ள வேறு மாநிலத்திற்கு அனுப்பி வைத்து மத்திய அரசு தொடர்ந்து பயிற்சி அளித்து வருகிறது. அண்மையில், இரண்டு இலங்கை ராணுவ வீரர்களுக்கு வெலிங்டன் ராணுவ பயிற்சிக் கல்லூரியில் பயிற்சி அளிக்கப்பட்டு வருவதை அறிந்தவுடன், அவர்களை உடனடியாக இலங்கைக்கு திருப்பி அனுப்ப வேண்டும் என்று நான் வலியுறுத்தினேன். ஒட்டுமொத்த தமிழகமும் இதே கோரிக்கையை விடுத்தது. ஆனால், மத்திய அரசு அதற்கு சிறிதும் மதிப்பளிக்கவில்லை. மாறாக, இது போன்ற பயிற்சிகள் அளிப்பது நிறுத்தப்பட மாட்டாது என மத்திய அமைச்சர் தெரிவித்து, தமிழக மக்களின் உணர்வுகளை புண்படுத்தியுள்ளார்.  இந்தச் சூழ்நிலையில், இலங்கையைச் சேர்ந்த கால்பந்து விளையாட்டு வீரர்கள்,  தங்களுடைய திறமையை வளர்த்துக் கொள்ளும் வகையில், நட்பு ரீதியிலான போட்டிகளில் கலந்து கொள்ள தமிழகம் வர மத்திய அரசு அனுமதி அளித்துள்ளது. மத்திய அரசின் இந்தச் செயல் தமிழக மக்களை அவமானப்படுத்தும் செயல் ஆகும். மத்திய அரசின் இந்தச் செயலுக்கு எனது கடும் கண்டனத்தைத் தெரிவித்துக் கொள்கிறேன்.  இலங்கை நாட்டைச் சேர்ந்த கால்பந்து விளையாட்டு வீரர்கள் பயிற்சி பெறும் வகையில், சென்னையில் உள்ள பாரத ரிசர்வ் வங்கியில் பணிபுரியும் அலுவலர் ஒருவரை ராயல் காலேஜ் ஆப் கொழும்பு நிர்வாகம் தொடர்பு கொண்டு, இங்குள்ள கால்பந்து அணிகளுடன் நட்பு ரீதியிலான விளையாட்டுப் போட்டிகளில் விளையாட ஏற்பாடு செய்யும்படி கேட்டுக் கொண்டதாகவும், அதன்பேரில், அந்த அலுவலர் அதற்கான ஏற்பாட்டை செய்ததாகவும், கடந்த ஆகஸ்ட் 30-ல் தமிழகம் வந்த இலங்கை கால்பந்து விளையாட்டு வீரர்கள் மறுநாள் சென்னை சுங்க இலாகா அணியுடன் நேரு விளையாட்டரங்கில் விளையாடியுள்ளதாகவும் தகவல் வந்துள்ளது. இது குறித்து  நடத்தப்பட்ட விசாரணையில், பாரத ரிசர்வ் வங்கி அலுவலர் நட்பு ரீதியிலான கால்பந்து போட்டியை நடத்துவதற்கு வாய்மொழியாக நேரு விளையாட்டரங்கத்தின் பொறுப்பு அதிகாரியை அணுகியதாகவும், அந்த பொறுப்பு அதிகாரி விளையாட்டுப் போட்டிகளுக்கு நேரு விளையாட்டரங்கத்தை பயன்படுத்த வாய்மொழியாக அனுமதி வழங்கியதாகவும் தெரிய வந்தது.  நேரு விளையாட்டரங்கில் விளையாட்டுப் போட்டிகளை அனுமதிக்க நேரு விளையாட்டரங்க பொறுப்பு அதிகாரிக்கு எந்தவித அதிகாரமும் இல்லை. தமிழ்நாடு விளையாட்டு மேம்பாட்டு ஆணையத்திற்கு தான் அந்த அதிகாரம் உள்ளது. தனக்கு இல்லாத அதிகாரத்தை பயன்படுத்தி இலங்கை விளையாட்டு வீரர்களை நேரு விளையாட்டரங்கில் கால்பந்து விளையாட அனுமதி அளித்ததன் மூலம் தமிழக மக்களின் உணர்வுகளை நேரு விளையாட்டரங்க பொறுப்பு அதிகாரி கொச்சைப் படுத்தியுள்ளார்.  எனவே, அந்த அதிகாரியை தற்காலிக பணிநீக்கம் செய்து துறைரீதியான நடவடிக்கை எடுக்கும்படி தலைமைச் செயலாளருக்கு உத்தரவிடப்பட்டுள்ளது. மேலும், இலங்கை கால்பந்து வீரர்களுக்காக எந்த போட்டிகளும் தமிழகத்தில் நடத்தக் கூடாது என்றும், அவர்களை இலங்கைக்கு உடனடியாக திருப்பி அனுப்ப நடவடிக்கை எடுக்க வேண்டும் என்றும் உத்தரவிடப்பட்டுள்ளது.  இதே போன்று வேலம்மாள் மேல்நிலைப் பள்ளியுடன் கால்பந்து போட்டி விளையாட சென்னை வந்துள்ள இலங்கை, ரத்தினபுராவைச் சேர்ந்த ஹில்பர்ன் இன்டர்நேஷனல் பள்ளியின் 8 மாணவர்கள் மற்றும் ஒரு பயிற்சியாளரையும் திருப்பி அனுப்ப உத்தரவிட்டுள்ளேன் என்று கூறியுள்ளார் முதல்வர் ஜெயலலிதா.

Syrian crisis - a case study in ‘regime change’ politics

Even as Western governments are stepping up covert and overt pressure on the current Syrian regime of Bashar al-Assad, those following the Kurdish national question are unsure of the future of Kurdish regions in Syria. With reports emerging of Turkey arming the anti-Assad force ‘Free Syrian Army’ (FSA) that receives support from governments in the West, simultaneously Turkey pursues a militarist approach against the PKK. There is apprehension that Turkey might use the opportunity to strike at Kurdish regions in Syria to deal a blow to the PKK sphere of influence. At this conjuncture, those Tamils who are considering Western intervention in Syria as a positive step against repressive regimes should study in detail the intricacies of ‘geopolitics of regime change’ and the dynamics of the Kurdish national struggle in the region, commented a Tamil political analyst.

Bashar al-Assad’s Syrian government, which has been criticized by many for being a dictatorial government that favours an Alawite minority, is also considered a secular regime in a region of theocratic states. The FSA on the other hand is an ‘umbrella group’ largely composed of Sunnis and it is alleged that it also has foreign fighters from the al-Qaeda.

While Kurds were discriminated under the Assad regime, after the Syrian crisis unfolded in 2011, they were able to get some sort of political relief through a reduction in Syrian government intervention in their affairs. The Democratic Union Party (PYD), a Kurdish political force located in Northern Syria, a region which has a sizeable number of Kurds and considered as Western Kurdistan, is negotiating for a Kurdish autonomous region within Syria, a better version of the Iraqi Kurdistan Regional Government.

Turkey, however, has accused the PYD as being a front of the PKK and is working hard to ensure that a politically significant autonomous Kurdish region does not emerge in the region. In television interviews in July 2012, Turkish Prime Minister Recep Tayyip Erdogan has expressed the opinion that greater autonomy to Kurds in Northern Syria would affect Turkey’s interests and that Turkey would intervene against “those terrorist formations”.

Ankara, which allied with Assad when he was repressive towards the Kurds, is now backing the opposition forces after the Kurds managed to wean out some concession from the Syrian regime. The FSA too is reported to be cooperating with Turkey in ensuring that the PKK does not extend its influence into Syria. Likewise, Syrian opposition forces have started accusing the PYD of siding with Assad and for exploiting the opportunity to get autonomy for the Kurds in Syria.

Turkey and the West are engaging only with those political forces in Syria that are not working with the PYD and desisting from providing greater autonomy to the Kurds. One of them is the Syrian National Council (SNC), a major player in opposition politics, which was officially formed in Istanbul, Turkey. The SNC recognizes the Kurds only as a minority and has offered administrative decentralization to them as the highest political solution.

Kurds on their part have formed the Kurdish Supreme Committee, jointly comprised of the PYD and the Kurdish National Council (KNC), which now rules as a shadow state, with its own local defence forces, in the Kurdish regions that the Syrian government forces vacated.

This development has set off alarms in Ankara, which sees the emergence of such a zone with pro-autonomy Kurdish groups as a boost for the PKK. And as recent clashes with PKK increase and police repression in Kurdish areas intensify, Turkey is seeking for a friendly regime in Syria that would restrict any sort of political or ideological support for PKK in its territory.

Turkey’s defence circles of late are also excessively referring to the ‘Sri Lanka model’ to deal with the Kurdish movement.

While Western establishments have strongly condemned the Assad regime for human rights violations and have given legitimacy to Syrian opposition forces, very little has been said about a political solution to the Kurds.

A report of the ICG on “Syria’s Mutating Conflict” released on 1st August criticized the methods used by the current regime to crush opposition and recognized the support of the West, Turkey and other regional forces to the Syrian opposition. It also appealed to the opposition to ensure a political transition that would be pluralistic, which would accommodate the interests of groups like Alawites, Christians, Druze, Ismailis and Kurds, lumping all together as minorities.

Speaking to TamilNet a Tamil political analyst involved in solidarity building among the Nations without State said that the crisis in Syria must be studied as a case in regime change politics and its implications for oppressed nations.

His comments follow:

“It is popularly said among Kurds that they have no friends but the mountains. From the vested interests of different powers operating in the regions in and around Kurdistan, they have an experience of historical betrayals and partial political settlements.”

“However, the Kurdish national struggle has also matured to a point that it makes opportune use of a political crisis in its region with the long term interests of its goals in mind, without falling for temporary solutions. The way the Kurds have utilized the situation in Syria makes it clear that there is no black and white perspective on the Syrian regime and the Syrian opposition, and that the Kurds are willing to critically engage with different forces so as to strengthen themselves politically. This is also seen in the formation of a united front in the Kurdish Supreme Committee with ideologically different groups.”

“Emboldened by the internationally abetted genocide in Mu’l’livaaykkaal, states like Turkey openly talk about a Sri Lanka solution to militarily combat the Kurds.”

“At the other end, the human rights groups like ICG churn out watered down political solutions to the Kurds like minority rights, political pluralism etc that would ensure the smoother flow of the interests of the establishments.”

“Eezham Tamils continue to face structural genocide without recognition of a just political solution owing to this hard and soft approach used by the so-called IC”

“The Kurds have learnt from this. We need to learn from the Kurds in being able to convert a crisis to our advantage.”

“Already the world powers, who clearly know that what is happening to the Eezham Tamils in the island is genocide, are on a process of bringing a regime change in Sri Lanka for a ‘pluralistic’ government which would treat the Tamils ‘properly as minorities’. To this extent, numerous political games are being played in the diaspora and in the island to arm-twist the Tamils into a temporary solution.”

“The Kurdish experience also shows the vital importance of a rear-base for any struggle. Our political rear-base is definitely in 70 million population of Tamils in the state of Tamil Nadu. In the post-Mu’l’livaaykkaal scenario, it is imperative that this resource be politically tapped. The onus lies greatly on the diaspora to remain firm on fundamentals and to engage and convince political actors of all shades in Tamil Nadu to take a conceptually clear stand on Tamil Eelam.”

Australian Court denies US extradition request

Melbourne Federal Court Judge, Justice Tony North, in a precedent setting verdict delivered Friday, denied extradition of an Eezham Tamil, Thulasitharan Santhirarajah, to the U.S., ruling that the US charges against Santhirarajah, were "political". The Court also ruled that Australia's Attorney General (AG) Nicola Roxon's decision to authorize extradition "denied Santhirarajah procedural fairness," and that the AG "erred in the way she accepted extradition would not result in Mr Santhirarajah's torture." Justice North appeared to have also heeded the warning of Mr Santhirarajah's wife, Priya, who is an Australian citizen and who said previously that "to consent to Thulasi's extradition will amount to the signing of his death warrant."

Justice North also held that the Extradition Act required a determination "as soon as is reasonably practicable" and the Attorney-General had signed the order two years too late. "As a result, the purported determination to surrender the defendant was made without power and is invalid."

The Judge also said that the Attorney General has "failed to properly consider the best interests of Varun (Santhirarajah's son)."

Ms Roxon signed the extradition order in February, and Santhirarajah's lawyer, Paul Galbally, filed a legal challenge arguing that the charges US has trumped up are more political than security-related.

Mr Santhirarajah welcomed the decision from his Victorian prison cell. "After spending four years in jail, he was very pleased to receive such positive news," his lawyer, Paul Galbally, said, according to The Australian.

"Using several provisions of anti-terrorism laws, U.S. prosecutors routinely stack charges against defendants residing in US-friendly countries to agree to extradition requests. Balaraj Naidu, a Singaporean citizen with similar charges in the same case was extradited from Singapore in 2010 and is currently serving jail term in the U.S. While Singapore readily admitted to Naidu's extradition, it is an enviable testimony to the fiercely independent Australian judge to have denied the U.S. request and to assert that the charges were politically motivated and that the defendant was denied due process," spokesperson for Tamils Against Genocide (TAG), a US-based activist group that seeks legal redress to war-affected Tamils told TamilNet.

"The Australian judiciary's dismissal of Santhirarajah's case, illustrates the widening divide between American extraterritorial terrorism prosecutions, and the legitimacy of America's War on Terror legal framework as interpreted by other sovereign jurisdictions, such as Australia. One ground of the Australian dismissal construed the terrorism charges as political, and therefore, an illegitimate legal basis to execute Santhirarajah's extradition. The judgement also illustrates a divide within Australia's body politic, between the judicial and political branch, and their dissimilar views on the presumptive validity of U.S.'s continuing War on Terror prosecutions of Tamils even after the genocidal military siege of Mu'l'livaaikkaal," TAG said.

Legal sources who have knowledge of the functioning of the U.S. Justice department speculated that the delay in Australia's AG in signing the extradition order two years late may be due to the Maryland prosecutor's internal agenda to spread-out the Terrorism cases to plan a propaganda time-line that allows maximum publicity to the law enforcement on "terror" related cases. The Naidu case was completed in 2011, and the pursuit of Santhirarajah may have begun after that. The publicity planning delay may have caused the derailment of the Santhirarajah's extradition, the sources added.

Santhirarajah was arrested in July 2008 for seeking to procure US weapons for the Liberation Tigers of Tamil Eelam two years earlier. Mr Santhirarajah, 38, is a Sri Lankan citizen who came to Australia on a short-term business visa and whose bid for permanent residency was rejected after his arrest. His wife Priya -- a Sri Lankan-born Australian citizen who was granted refugee status on the grounds she was a Tamil.

In a trial held in February 2006 in Maryland, four of the six alleged conspirators, Thirunavukarasu Varatharasa, 40, a Sri Lankan citizen; Haji Subandi, 73, and retired Indonesian Marine Corps General Erick Wotulo, 62, both citizens of Indonesia; and Haniffa Bin Osman, 59, a citizen of Singapore, pleaded guilty to their participation in the same conspiracy and were sentenced to 57 months, 37 months, 30 months, and 37 months in prison, respectively.

Balraj Naidu is the 5th co-conspirator the U.S. successfully extradited from Singapore and sentenced to 4.5 years in prison after a jury trial in Baltimore, Maryland in 2010.

Paramilitary group unleashes violence in Batticaloa, Ampaa'rai against TNA

Paramilitary operatives of Pillaiyaan group, contesting the forthcoming election to the Eastern Provincial Council on the ticket of Colombo's ruling United Peoples Freedom Alliance (UPFA) have been attacking the candidates and supporters of the Tamil National Alliance. The poll to elect 35 councilors to the EPC is to take place on September 8.

Pushparasa, former councilor in the dissolved EPC has been leading the terror campaign against TNA supporters and voters in the Ampaa'rai district with armed gangs. He was charged in the last PC elections in 2008 for threatening the voters, the sources further said.

Meanwhile, Samurdhi officers [social service officers of the occupying Sri Lanka government] in the Batticaloa districts are instructed by UPFA politicians to participate in election propaganda of the ruling UPFA.

They have been threatened by the UPFA that they would be deprived of their salary and other monetary benefits if they fail to attend election propaganda meeting favouring the UPFA.

Basil Rajapaksa dispatches 1000-member squad to Trincomalee to ensure UPFA polling in PC elections

More than one thousand persons have arrived in Trincomalee district under the instruction of SL presidential sibling and Economic Development Minister Basil Rajapaksa to manipulate the polling in the forthcoming provincial elections in the East in favour of the ruling United Peoples Freedom Alliance (UPFA), informed sources in Trincomalee told TamilNet Friday.

Expenses of food and lodging of these persons are to be borne by the SL Economic Development Ministry.

Most of these persons have been brought down from Colombo. They are being distributed to eleven Divisional Secretariat divisions in the Trincomalee district at 100 persons per DS division.

More than eighty percent of voters in the DS divisions of Padavi Siripura, Gomarankadawela, Seruwila, Kantha’laay and Morawewa have become Sinhalese due to demographic changes in the recent decades.

In the meantime, Namal Rajapaksa, a son of SL president and a parliamentarian from Hambantota, is also in Trincomalee district in mustering support to the ruling UPFA candidates by organizing seminars for youths using the resources of the Colombo regime under the guise of ‘development projects’ now being implemented in the district by several non-governmental organizations such as NECORD, NEIAP and NECCDEP.
