Tamil Heritage Month Bill Proposed in Canadian Parliament

Tamil Canadian federal MP Rathika Sitsabaiesan introduced Bill C-471 in the Canadian Parliament on January 31, to designate the month of January as Tamil Heritage Month in Canada by an Act. This bill, a private member’s bill that doesn’t often become law, if passed, will enshrine at the federal level an ongoing practice among Tamil community organizations. Neethan Shan, founder and chair of the Tamil Heritage Month Committee, believes that such a commemoration of Tamil heritage will provide a platform for discussion of Tamil national identity. "We have been working hard for two years to get both the federal and provincial governments to recognize Tamil Heritage Month formally and we are hopeful that it will happen before our fifth year anniversary in January 2014," Neethan Shan, founder and chair of the Tamil Heritage Month Committee, told TamilNet.

While cultural heritage months are often largely symbolic, Shan added that he believes a federal Tamil heritage month would "definitely help us create broader awareness not only about our culture, traditions and heritage but also about our nationhood and histories. Therefore, discussion and documentation of our struggle for self-determination in Eelam will and must be an integral part of Tamil Heritage Month." A similar Act was introduced in the province of Ontario last year but the Ontario legislature heard first reading on the bill, but it seemed to have stalled after the first reading. It is not law until it passes third reading and receives royal assent.

“This bill would enshrine Tamil Heritage Month in law so that throughout Canada, every year, the month of January will be known as Tamil Heritage Month. I am proud to present a bill that recognizes and honours Tamil heritage and will help raise awareness of the contributions of Tamil Canadians throughout our country," said Ms. Sitsabaiesan in a press release dated January 31.

In her speech before the House of Commons, she saluted the "organizations and individuals in [her riding of] Scarborough—Rouge River and across the country, who have organized events during this month, for the pride they take in our Tamil heritage."

According to the website of the Tamil Heritage Month Committee, "municipal governments of Ajax, Brampton, Markham, Oshawa, Pickering, Toronto, Whitby and York Region have proclaimed January as Tamil Heritage Month."

A similar bill passed first reading in the Ontario Provincial Legislature on June 12, 2012.

Ms. Sitsabaiesan's bill was also read and printed, and now awaits further action from the House of Commons.

British Under Secretary’s ‘war picnic’, misleading comments, draw flak from Tamils

While Alistair Burt, British Under Secretary of State at FCO, endorsed on Twitter on Wednesday the self-determination of the people of the Western Sahara, in his Twitter discussions on Tuesday with Eezham Tamils, he opined that “Detail of political settlement must be for Sri Lankans themselves. We encourage TNA and govt to make serious progress.” Likewise, in a video recording taken with the British High Commissioner in Sri Lanka a few days back at the Mullaitheevu coast, which witnessed the worst massacres in May 2009, he welcomed the defeat of the LTTE calling it “terrorism” and picked only politically insignificant flaws with the Sri Lankan government. Civil society activists from the North remarked that the minister seemed to be on a sort of a “war picnic”, appreciating some aspects with Sri Lanka and criticizing others. Activists in the UK have also reacted to Mr. Burt’s comments.

Civil society activist and Jaffna University academic, Mr Guruparan Kumaravadivel had tweeted Mr. Burt asking him whether UK would support a call from the Tamils to hold a referendum towards a just political solution.

To this, Mr. Burt had replied that “Detail of political settlement must be for Sri Lankans themselves. We encourage TNA and govt to make serious progress.”

While stating in the video that CHOGM would likely be held in Colombo this year, Mr. Burt responded to a question of ACF France that “the UK has not yet decided on level of any attendance at CHOGM.”

Answering to a query of Freedom from Torture, Mr. Burt tweeted that UK was concerned about human rights situation in Sri Lanka, including torture, and that it would support action at the HRC.

He was also seen upholding the LLRC.

Responding to Mr. Burt’s overall observations from the island, British Tamils forum’s Parliamentary Coordinator Nad Mylvaganam told TamilNet “We were surprised by many of his comments, lack of political clarity and the ignorance in using diplomatic wordings without deep political understanding of the Tamil struggle. These statements have undermined the genuine efforts taken by Human Rights Defenders to bring an independent international investigation on Sri Lanka.”

Mr. Mylvaganam further added that “Tamils around the world see this statement as offensive, as it portrays that the struggle and the conflict ended with the end of the war. LLRC does not have any recommendations to address the root cause of the conflict. First and foremost the Minister must understand that there are two nations in that Island”.

A release by the BTF on Tuesday also criticized Mr. Burt’s perspective on the question of the Eezham Tamils.

“Here in Britain, it will be considered an insult to refer the Scottish or the Welsh people as minorities. Yet, labelling the Tamil people as minority goes unchallenged causing extreme distress to the Tamil people who see it as a direct attack on their nationhood. It is important that her Majesty’s government and its officers understand the nature of the conflict in Sri Lanka before trying to address it,” the release said.

“Given the fury raised by the statement by one of its minsters, the British Tamil people would like to have a formal clarification from Her Majesty’s government whether it considers the end of the war in May 2009 to be the end of the 65 year old conflict for which Britain bears substantial responsibility owing to her imperfect decolonisation process in the Island of Ceylon,” the BTF statement further noted.

Genocide prosecution, a Guatemalan lesson

A Guatamalan judge made history Monday by authorizing a public trial to prosecute a dictator and former Guatamalan "head of state" in Guatamalan domestic court for the ultimate crime of genocide. While Guatamala's counter-insurgency massacres provide a stark parallel to Mu'l'lvaaykkaal killings of Tamil civilians, and even while, Sri Lanka's hardline nationalist Sinhala population and the passive liberal voices will likely take generations to chart a similar path to justice for Rajapakse crimes, the Guatamalan lesson is crucial to the Tamils and its widely spread diaspora: "Credit for [the landmark case] goes to the survivors and victims’ families for 30 years of tenacious research and advocacy. International human rights groups, the Inter-American Court of Human Rights, the United Nations and foreign governments helped," New York Times said of the struggle in Guatamala to seek justice.

Judge, Miguel Ángel Gálvez, made his country, Guatamala, the first in the Americas to prosecute former "head of state," Efraín Ríos Montt on charges of genocide.

The judicial landmark, further comes at a poignant moment, to Eezham Tamils, when the United States Department of State, is exercising its discretion to intervene in the appellate proceedings in the Appeals Court of District of Colombia, where three Tamil families are plaintiffs in a case charging the crime of genocide and war-crimes against Sri Lanka's President Rajapakse. Rajapakse's appointed lawyers in Washington, Patton Boggs, are depending entirely on the U.S. Government to save their client from receiving justice through the legal system, by claiming "Head of State immunity," legal sources in Washington said.

Montt seized power by a coup in March 1982, taking charge of a 20-year old counterinsurgency. "To deny the guerrillas local support, he sent soldiers to wipe out hundreds of Mayan villages," NYT said, adding, [i]n 1999, after the war’s end, the United Nations-sponsored Historical Clarification Commission tallied thousands of rapes, tortures, disappearances, violations of cultural rights and extrajudicial executions his forces committed while he held power, and concluded that he presided over acts of genocide."

In Mu'l'livaaykkaal, under Rajapakse command, the State military slaughtered more than 80,000 Tamil civilians under the pretext of wiping out 5000 strong LTTE fighters, Petrie Report and UN appointed Expert panel concluded. Accusations of war-crimes, and crimes against humanity during the war, and post-war continuation of systemic cultural genocide, including rapes, disappearances, abductions including planned colonization continue with unchecked belligerency, commented Tamil activists, drawing parallel to Guatemala.

Montt was ousted in another coup in August 1983, but became a right-wing congressman and a losing presidential candidate. No other high-ranking Guatemalan Army or police official was brought to justice. Military rule formally ended in 1985, and a peace accord was signed in 1996. But activists seeking to shed light on the past were still threatened and killed, a story familiar to Sri Lanka observers.

While elected as president Otto Pérez Molina, a former general who commanded troops in the Ixil region — the focus of the genocide trial — during Mr. Ríos Montt’s rule, insists “There was no genocide,” resilience of the victims families, rights groups, and Guatemalan Attorney General since 2010, Claudia Paz y Paz, who revolutionized the prosecutor’s office, pushing cases involving war crimes, have made the difference, NYT says.

"The overarching goal of the Guatemalan counterinsurgency was to destroy all oppositional thinking," the NYT story author, Kirsten Weld, an assistant professor of history at Harvard writes, and quotes Hannah Arendt, the German political scientist who wrote that any state’s efforts to make its opponents “disappear in silent anonymity” are doomed to failure.

TESO urges New Delhi to move for referendum at Geneva

New Delhi should take firm efforts to bring forward a resolution at the UNHRC sessions next month for conducting a referendum among Ilangkai Tamils, said a resolution passed by Tamil Eelam Supporters Organisation (TESO) in Chennai on Monday. The organisation cited its earlier resolution passed in this regard in August last year and said that it had already presented the case for the consideration of the UN, member countries of the UN, the Government of India and the UNHRC. In presenting the plight of Eezham Tamils, TESO has resolved to convene an all-India level meet of political party leaders in New Delhi in March. Condemning New Delhi encouraging Sri Lanka President Mahinda Rajapaksa visiting India this week, TESO has also resolved to organise a black-clad demonstration in Chennai on Friday morning, protesting his visit.

TESO welcomed the US Deputy Asst. Secretary James Moore’s statement on a procedural resolution to follow the earlier resolution at Geneva, and resolved that India should support and should take a stand without any ambiguity in the event of such a move taken by the USA.

Last year the Government of India voted in favour of the resolution due to pressure from Tamil Nadu. But later, not only it didn’t take any action, but also it is engaged in a wrong campaign against the resolution, TESO accused.

The other resolutions of the TESO reiterated on international investigations of the war crimes in the island, Indian intervention in the release of the remaining two Jaffna University students in SL military detention, Indian and IC intervention in arresting the cultural genocide and erasure of Tamil identity, and Indian and IC pressure on Colombo in getting an answer on the whereabouts of a number of LTTE senior leaders captured alive.

On the fishermen issue of Tamil Nadu, TESO demanded the Government of India to establish a Naval Base at Ma’ndapam. Condemning the continued attack on the fishermen of Tamil Nadu by the Navy of Sri Lanka, TESO resolved to conduct two protest demonstrations, one at Raameasvaram on 18 February and the other at Naakap-paddinam on 19 February.

The 9-point TESO resolutions on Monday were released to media in a press statement stamped by the DMK headquarters.

An earlier TESO press statement on 26 January, stamped by the DMK headquarters, cited DMK parliamentary leader T.R. Balu talking about a TESO delegation visit to New Delhi, on 28 and 29 January, to meet Indian Minister of External Affairs and envoys of the 47 countries in the UNHRC.

According to Balu, the delegation that was led by Mr. MK Stalin and included Mr K. Veeramani, Mr. Thol Thirumavalavan, Ms. Suppulakshmi Jagadeesan and Prof. Supa Veerapandian, was to campaign for the implementation of the UNHRC resolution.

The TESO delegation’s New Delhi visit was coinciding with the visit of the US officials to Colombo.

Welcoming the TESO statement on Monday reiterating referendum at least as its 7th resolution, new generation Tamil activists in the island commented that TESO should not encourage the USA’s ‘procedural’ follow up of the LLRC-based UNHRC resolution that ultimately legitimises the annihilation of the territoriality of the nation of Eezham Tamils in the island.

The most precarious act of permanently damaging consequences that is currently committed on the nation of Eezham Tamils in the island is the militarized Sinhala colonisation. Unless this is directly addressed with utmost priority and urgency, even a referendum would be useless, the Tamil activists cautioned.

There are strong circumstantial evidences that the USA and India are tacitly encouraging the Sinhala State to complete the demographic, geographic and territorial genocide of the nation of Eezham Tamils, as much as possible and as early as possible, the activists alleged.

What prevents the TESO that has Tamil Eelam in its name from internationally voicing for the protection of the territorial integrity of the country of Eezham Tamils in the island, asked the activists.

TESO should directly and openly tell the USA engineering resolutions that the Tamil priority is protection of its nation and land, and only when that is addressed Tamils could think of cooperating with anyone. Rather than naively campaigning for the US procedures, TESO should lead alternative opinion to come openly from the international arena. It should prevail upon New Delhi to come out with better and competitive alternatives, the activists said.

Tamil civil society in the island and in the diaspora, from New Zealand to the USA and Canada should not remain silent at this crucial juncture. Getting the cue from the ambiguity within organisations such as the TESO, politicians and activists, the civil society should rise up and tell its demand for nation and territory openly and frankly to the edification of ambiguity and to strengthen positive forces within the organisations, politicians and activists. Failing, Tamils would only see ambiguity hijacking their cause, the new generation Tamil activists in the island commented further.

Tamil diaspora protests Sri Lanka’s freedom committing genocide

Tamil diaspora activists in Europe, Canada and Australia staged protests on Monday coinciding with the Sri Lanka’s official 65th ‘independence day’, with activists alleging that this so-called ‘independence’ was only a freedom given to the Sinhala nation to commit a protracted genocide of the Eezham Tamil nation. Speaking to TamilNet from a solidarity gathering in Geelong in the state of Victoria, Australia, labour union leader Tim Gooden said that there was a need to recognize the sovereignty of the Eezham Tamil nation. “Unless the aspirations of people are met then there is no peace. One side will always have to suppress people if they are not going to recognise their sovereignty. People on both sides cannot develop culturally, economically or morally until the national question is resolved,” he said.

“Unless we recognise all people and their aspirations then we are helping to fuel and prolong the national struggle to the determent of the oppressed and ultimately ourselves,” Mr. Gooden further said.

Tim Gooden, the secretary of the Geelong Traders Hall Council, hoisted the Tamil Eelam national flag over the Geelong Traders Hall on Monday as a mark of solidarity with the Eezham Tamil nation and as a symbolic protest against Sri Lanka that prevents the use of any symbol associated with Tamils’ sovereignty in the militarily occupied homeland of the Eezham Tamils.

He further emphasised the need to take the information about the cause of the Eezham Tamils to the labour movement and the trade unions.

“Even a simple thing like raising a flag can create debate and discussion that leads to better education around and issue and the more people that are educated then the more chance there is to reaching a resolution of the dispute. At the end of the day the majority of workers don’t want to see the atrocities and human suffering we have witnessed in Sri Lanka to last few years. Governments rely on ignorance to hide behind – it is our job to break that ignorance to begin real solidarity in all struggles against repression,” he said.

Eezham Tamil activists participating in these protests asserted the sovereignty of the Eezham Tamil nation that was left unrecognized by the colonial powers as they the handed ‘independence’ in the island of Ceylon in the form of a unitary state that favoured Sinhala majoritarianism, laying the foundation for the genocide.

A copy of the unitary constitution of Sri Lanka was burned in Berlin, Germany, in front of the Sri Lankan embassy by Tamil protestors. Sources from Berlin told TamilNet that personnel within the embassy were taking photographs of the protestors.

In a novel manner of protest on Multicultural week at York University, Canada, an image of the Sri Lankan constitution was carried same was carried on a coffin by Tamil students. Organizers of the protest said that this was to symbolically convey the end of the attempts to seek a political solution within Sri Lanka’s constitution.

Speaking to TamilNet, Prynth Nallaratnam from York University Tamil Students Association (YUTSA), told TamilNet that "beyond talking over and over again about reconciliation and accountability which are little more than hollow terms now, Canada, as the host to the largest Tamil diaspora, should take concrete steps towards a political solution based on the nationhood and territorial sovereignty of the Eezham Tamils."

Complementing him Praventh Jegatheesh, Vice president of events in YUTSA said "In this crucial time we have to remember that we shouldn't settle down for a toothless solution or be instrumented by global imperialists and water down our liberation movement, we are a huge diaspora and we have to learn from our history to facilitate our own path to a permanent solution that represents the political aspirations of Eezham Tamils."

Protesting outside the Commonwealth Office in London, Eezham Tamils from the UK submitted a petition to the Commonwealth Secretariat demanding removal of Sri Lanka from the Commonwealth.
