இலங்கையில் கேள்விக்குறியாகும் நீதித்துறை

இலங்கையில் கேள்விக்குறியாகும் நீதித்துறை:  பன்னாட்டு நீதித்துறை ஆணைக்குழு கவலை

இலங்கையில் தலைமை நீதிபதி மீது குற்றம் சாட்டி அவர் பதவி விலக்கப்பட்ட பின்னர், புதிய நீதிபதியாக மொஹான் பீரிஸ் நியமிக்கப்பட்டார். அவரது நியமனம் குறித்து சந்தேகம் எழுப்பியுள்ள சர்வதேச நீதித்துறை ஆணைக்குழு, இந்தச் சம்பவம் இலங்கையின் நீதித்துறையைக் கேள்விக் குறியாக்கியுள்ளது என்று குறிப்பிட்டுள்ளது. 
மொஹான் பீரிஸ் முன்னர் இலங்கையில் நீதித்துறையில் பல்வேறு பதவிகளையும் வகித்துள்ளார். இருந்தாலும், அவர் ஆளும் அரசைப் பாதுகாப்பதில் முக்கியக் கூட்டாளியாகச் செயல்பட்டவர். இலங்கையில் சட்டத்துறை அதிகாரியாகவும், இலங்கை அதிபரின் சட்ட ஆலோசகராகவும் இருந்துள்ளார். அந்தக் காலங்களில், இலங்கை அரசுக்கு எதிராகக் கூறப்பட்ட மனித உரிமை மீறல் உள்ளிட்ட பல்வேறு குற்றச்சாட்டுகளில் இருந்து அரசைக் காப்பதில் முக்கியப் பங்கு வகித்துள்ளார். இப்படிப்பட்ட பின்னணி உள்ள ஒருவர், இலங்கை நீதித்துறைக்கு தலைமை நீதிபதியாக நியமிக்கப்பட்டது இலங்கை நீதித்துறைக்கே பெரிய சவால் என்றும், பின்னடைவு என்றும் சுட்டிக் காட்டப்பட்டுள்ளது.

US-based Dr Nagalingam Ethirveerasingam, the first president of the Global Tamil Forum (GTF), accepts an ‘advisor’ position to G.A. Chandrasiri, Sri Lanka’s colonial governor and retired Major General of the war crimes accused SL military. The website of SL run Northern Provincial Council on Saturday indicated that Dr Ethirveerasingam is already functioning as Advisor on Education and Sports to the SL Governor. A doctorate in Agriculture education from the Cornell University in the USA, Ethirveerasingam, now 78, is also a recognised sportsman who represented Ceylon in the Olympics of 1950s.

The International Crisis Group (ICG) in its report no 186, dated 23 February 2010 on “Sri Lankan Tamil Diaspora after the LTTE”, said that “hardliners in the GTF, such as the British Tamil Forum (BTF), have reportedly forced out the GTF president, Dr Nagalingam Ethirveerasingam, for moderating his stance on separatism” (page 14).

Rev Fr Dr S.J. Emmanuel replaced Dr Ethirveerasingam as the president of the GTF earlier in 2010.

In the post-war scenario, Dr Ethirveerasingam was interested in contesting elections in the island, informed political sources said.

He managed to find the space to work in Vanni on children and sports after the war.

Writing a comment in Groundviews website in 2008, Ethirveerasingam said:

“The Sinhala and the Tamil communities are like the right and left half of a brain. They were joined with a connective tissue, the “corpus collosum”. Mr. B and his majority blocked communication between the two brains with the Sinhala Only Act in 1956. Mrs B and her leftists performed the surgery to cut the connective tissue in 1972. It is foolish for the right-half to pronounce that there is no left half and that both are one, the right. It is best not to harm each others independent existence until such time we are creative enough to grow a new connective tissue better than the old one, to make both halves benefit equally from each other.”

Dr Ethirveerasingam in his recent comments has come out with appreciating words on TNA’s nominated parliamentarian M.A. Sumanthiran.

காலத்தால் அழியாத திருக்குறளை பேருந்துகளில் இருந்து அழித்துவிட்டு, தன்னுடைய வாசகங்களைப் போட்டுக் கொண்ட கருணாநிதி, வள்ளுவர் சிலைக்காகப் போராட்டம் நடத்துகிறாராம்..! என்று முதல்வர் ஜெயலலிதா திமுக தலைவர் கருணாநிதியை விமர்சித்துள்ளார்.
இன்று தேனி மாவட்டம் லோயர் கேம்ப் பகுதியில் பென்னி குயிக் நினைவு மணி மண்டபத்தை திறந்து வைத்துப் பேசிய முதல்வர் ஜெயலலிதா, திருவள்ளுவர் சிலை விவகாரத்தில் கருணாநிதியை விமர்சனம் செய்து பேசினார்.

இன்று திருவள்ளுவர் தினம்.  மனிதவாழ்வுக்கு திருக்குறள் மூலம் நல்வழி காட்டியவர் திருவள்ளுவர்.  நாடு, மதம், மொழி கடந்து நல்வழி காட்டும் உலகப் பொதுமறை நூலாக திருக்குறள் விளங்குகிறது.  அறம், பொருள், இன்பம் என்ற வாழ்வின் அடிப்படையான கருத்துகளுக்கு விளக்கம் அளிப்பதே திருக்குறள்.  இரண்டே வரிகளில் இருந்தாலும், அதனுள் உலகையே அடக்கி நிற்கும் ஆற்றல் படைத்தது திருக்குறள். திருக்குறளில் திருவள்ளுவர் கூறிய கருத்துகள் அனைவராலும் ஏற்றுக் கொள்ளக் கூடியவையாக விளங்குகின்றன. இதனால் தான், “வள்ளுவன் தன்னை உலகினுக்கே தந்து வான் புகழ் கொண்ட தமிழ்நாடு” என்று பாடினார் மகாகவி பாரதியார்.
இப்படிப்பட்ட சிறப்பு வாய்ந்த உலகப் பொதுமறையாம் திருக்குறளை எழுதிய  திருவள்ளுவர் தின நன்னாளில், எண்ணியதைச் செயல்படுத்துவதில் உறுதி உடையவர்களாக இருந்தால் அவர்கள் எண்ணியவாறே வெற்றி பெறுவார்கள் என்ற திருவள்ளுவரின் வாய்மொழிக்கேற்ப, முல்லைப் பெரியாறு அணையினை உருவாக்கிய கர்னல் பென்னிகுயிக்கின் மணிமண்டபத்தை திறந்து வைத்ததில் எனக்கு இரட்டிப்பு மகிழ்ச்சி. இந்த ஜான் பென்னிகுயிக் நினைவைப் போற்றும் வகையில், தற்போது தேனி நகரில் புதிதாக கட்டப்பட்டு வரும் பேருந்து நிலையத்திற்கு “கர்னல் ஜான் பென்னிகுயிக் பேருந்து நிலையம்” என்று பெயர் சூட்டப்படும் என்பதை அறிவிப்பதில் நான் பெருமகிழ்ச்சி அடைகிறேன்.
அரசுப் போக்குவரத்துக் கழகப் பேருந்துகளில் திருவள்ளுவரின் காலத்தால் அழியாத திருக்குறளை அழித்துவிட்டு, தன்னுடைய வாசகங்களை எழுத வைத்த  கருணாநிதி, கன்னியாகுமரியில் உள்ள திருவள்ளுவர் சிலை சரியாக பராமரிக்கப்படவில்லை என இல்லாத ஒன்றைக் கூறி, அதற்காக போராட்டம் நடத்தப் போவதாக கூறி இருந்தார். நான்  கருணாநிதிக்கு ஒன்றைத் தெரிவித்துக் கொள்கிறேன்.
திருவள்ளுவர் பெயரில் விருதை அறிமுகப்படுத்தியது அதிமுக அரசு.  திருக்குறளை தேசிய இலக்கியமாக அறிவிக்க வேண்டும் என்று தமிழ்நாடு சட்டமன்றப் பேரவையில் தீர்மானத்தை இயற்றியது அதிமுக அரசு. திருவள்ளுவர் பெயரில் பல்கலைக்கழகம் ஆரம்பிக்கப்பட்டது அதிமுக ஆட்சிக் காலத்தில்தான்.
இன்னும் சொல்லப்போனால், கன்னியாகுமரியில் விவேகானந்தர் நினைவுப் பாறைக்கு அருகிலுள்ள பாறையில் திருவள்ளுவர் சிலை ஒன்றினை நிறுவ முடிவெடுத்து, அப்போதைய பாரதப் பிரதமர்  மொரார்ஜி தேசாயால், அப்போதைய முதல்வர் எம்.ஜி.ஆர். முன்னிலையில் 15.4.1979 அன்று அடிக்கல் நாட்டப்பட்டது. பின்னர், பாறையின் தன்மை, சிலையின் வடிவமைப்பு, அதை நிறுவுவது பற்றிய திட்டங்கள், மதிப்பீடு போன்ற பல்வேறு அம்சங்களை விரிவாக ஆராய்ந்து ஓர் அறிக்கையினை சமர்ப்பிக்க நிபுணர் குழு அமைக்கப்பட்டதும் எம்.ஜி.ஆர். ஆட்சிக் காலத்தில் தான். எனது முதல் ஆட்சிக் காலத்தில் 1 கோடியே 28 லட்சத்து 50 ஆயிரம் ரூபாய் இந்த சிலை அமைக்கும் பணிகளுக்காக விடுவிக்கப்பட்டது.  இதனை வைத்து, கணபதி ஸ்தபதி ஓரளவு பணிகளை அப்போதே மேற்கொண்டார். உண்மை நிலை இவ்வாறிருக்க, கன்னியாகுமரியில் திருவள்ளுவர் சிலை திறப்பதற்கு தான் மட்டுமே காரணம் என்று  கருணாநிதி கூறுவது முழுப் பூசணிக்காயை சோற்றில் மறைப்பது போல் உள்ளது. இவ்வாறு அண்டப் புளுகு புளுகுவதற்கு, தன்னை விஞ்சியவர் வேறு யாருமில்லை என்பதை கருணாநிதி மீண்டும் நிரூபித்திருக்கிறார்.
திருவள்ளுவர் சிலைக்கு ரசாயனக் கலவை பூசுவது என்பது நான்கைந்து ஆண்டுகளுக்கு ஒரு முறை நடைபெறுவதாகும். முதன் முதலாக, எனது ஆட்சிக் காலத்தில் 2004 ஆம் ஆண்டு 
இப் பணி நடைபெற்றது. பின்னர் 2008 ஆம் ஆண்டு ரசாயனக் கலவை பூசப்பட்டது. தற்போது இதற்கான பணிகள் நடைபெற்று வருகின்றன.  உண்மை நிலை இவ்வாறிருக்க, 2011 ஆம் ஆண்டு ஆட்சி மாறிய பிறகு, ஒன்றரை ஆண்டுக் காலமாக இந்த ரசாயனக் கலவை பூசப்படவில்லை என்று  கருணாநிதி கூறுவது விஷமத்தனமானது. திருவள்ளுவரைப் பற்றிய அக்கறை கருணாநிதியைவிட எனக்கு அதிகம் உண்டு என்பதையும் தெரிவித்துக் கொள்கிறேன்.
“பல்லார் முனியப் பயனில சொல்லுவான்
எல்லாரும் எள்ளப் படும்”.
அதாவது, பலரும் வெறுக்கும்படியான பயனற்ற சொற்களைப் பேசுபவரை எல்லோரும் இகழ்ந்துரைப்பார்கள் என்ற வள்ளுவரின் வாய்மொழியை  கருணாநிதிக்கு இந்தத் தருணத்தில் சுட்டிக்காட்ட விரும்புகிறேன்.

In a January 11 ruling, a Canadian judge in the provincial British Columbia Supreme Court struck down a section of the Canadian government’s ‘human smuggling’ law for being “unnecessarily broad”. The immediate effect is the adjournment of the trials of four Eezham Tamil refugees who arrived aboard the Ocean Lady in 2009. All four had been charged with ‘human smuggling’ under Section 117 of the Canadian ‘Immigration and Refugee Protection Act’ (IRPA). Section 117 of the IRPA defines ‘human smuggling’ and imposes mandatory minimum sentences for convicted ‘human smugglers.’ However Justice Silverman’s ruling in the R. v. Appulonappa case found Section 117 of the IRPA “overbroad” and a violation of the principles of fundamental justice guaranteed by Section 7 of the Canadian Charter of Rights and Freedoms.

Justice Silverman struck down Section 117, declaring it “to be of no force or effect.”

Jury selections for the trials of Francis Appulonappa, Hamalro Handasamy, Jeyachandran Kanaharajah, and Vignaraja Theverajah were due to begin on January 16.

Canadian Prime Minister Stephen Harper had repeatedly promised legislation to target ‘human smugglers’ in response to the arrival of Tamil refugees aboard the Ocean Lady on October 17 2009, and the MV Sun Sea on August 13 2010.

Section 117 of the IRPA is the result of attempts by the Conservative Harper government to amend the IRPA following mass arrivals of Eezham Tamil refugees. Amendments to the IRPA to define ‘human smuggling’ and impose mandatory minimum sentences upon ‘human smugglers’ were first introduced as the failed Bill C-49 in the Canadian House of Commons in October 2010.

Once the Conservatives had secured a parliamentary majority, the IRPA was amended through Bill C-4, the ‘Preventing Human Smugglers from Abusing Canada’s Immigration System Act’ which was introduced in June 2011.

When Bill C-4 was tabled in parliament it was criticized by refugee and human rights organizations like the Canadian Council for Refugees and the Canadian Civil Liberties Association as being anti-refugee rather than anti-smuggling.

Section 117 (1) of the IRPA states “No person shall knowingly organize, induce, aid or abet the coming into Canada of one or more persons who are not in possession of a visa, passport or other document required by this Act.”

In the R. v. Appulonappa ruling, Justice Silverman found Section 117 (1) “overbroad” because it criminalizes the actions of humanitarian aid workers as well as close family members. Section 117 (1) and the mandatory minimum sentences laid out in Section 117 (2) and (3) do not distinguish between criminal groups or organization exploiting migrants and those who act out of compassion and concern for the lives and safety of migrants.

Justice Silverman noted that Section 117, as it stands, could criminalize a migrant parent for the ‘human smuggling’ of their child. Justice Silverman’s ruling cites failure of Section 117 to solely target criminal activity for material benefit as reasoning for finding Section 117 in violation of the principles of fundamental justice laid out in Section 7 of the Canadian Charter of Rights and Freedoms. Section 117 was therefore ruled unconstitutional.

Reacting to this development, Eezham Tamil political observers in Canada speculate three courses of action that the Conservative government may take.

The government can appeal for a stay of the ruling so that the legislation remains in effect while continuing to appeal the content of the ruling to the Supreme Court. It can amend Section 117 of the IRPA to be more specific, and then charge the accused again. Or, the Conservative government can drop the charges altogether which seems the most unlikely, they ar

Members of Front Line Socialist Party (FLSP), a breakaway faction of the JVP of the Sinhala South, who were seeking end of SL military rule over Tamils, land grab and abductions, as well as release of all political prisoners and Jaffna University student leaders were attacked publicly in the heart of Jaffna city, allegedly by SL military intelligence squads on Tuesday. The political faction from the South, under the banner, Sama Urimai Iyakkam in Tamil (Movement for Equal Rights) was engaged in a signature campaign among the Tamil public when motorbike squads attacked them and threw crude oil on to them in the typical way the SL military intelligence used to carry out attacks on Tamil activists in Jaffna.

Members of the public and journalists were also targeted in the attack.

The vehicles in which the southern political activists arrived were attacked.

According to news sources, the members of the public were responding to the call of the southern political activists and were enthusiastically signing on the banners carried by the activists of the FLSP.

The Front Line Socialist Party, led by Premakumar alias Kumar Gunaratnam, a veteran activist of the old JVP, finds criticism from sections of Sinhala left that the FLSP has not taken any defined stand on the solutions to the national question.

“Our stand is very clear which says that devolution of power is not a solution for the national question in Lanka,” says a clarification note coming from the FLSP.

“We oppose the present unitary constitution and any future federal constitution under these circumstances quite similarly as both reflect the same capitalist objectives and also hide the bourgeois class character,” the note said adding that “When we oppose a federal system it doesn't mean that we refuse it as a form of a governmental structure at all as we oppose only the class character and not the structures.”

“On the other hand, if we are compelled to deal with the reality and a practice of a federal constitution, the dealing with the national question will proceed onwards the same as right now,” the note further said.

Except Vickramabahu Karunaratne’s NSSP, none of the Sinhala Left in the South has come out with any practical models coming near to longstanding Tamil aspirations, Tamil activists in the North commented.

In the meantime, a former Communist power, enjoying benefits from the crisis in the island, is spending lavishly on media, especially on Tamil media in the diaspora, in addressing minds dejected about the West and India and the activists tagged behind them, but at the same time protecting and shielding the State and regime in Colombo and its military, senior media sources in Colombo said.

Premakumar Gunaratnam, an Australian citizen, who was in Sri Lanka organising the FLSP was abducted in April 2012 by the SL military intelligence and was released to SL Police after 3 days of torture. The SL Police deported him to Australia.

Two FLSP activists in Jaffna, Lalith Veeraraj and Kugan Murugananthan, were abducted in December 2011. Their whereabouts are still not known.

Grabbing pastureland in Ampaa’rai district goes unabated

Over four thousand acres of pastureland allocated for grazing in Chaakamam area in Ampaa’rai district is being grabbed day by day for illegal settlement by Sinhalese, civil sources in the district said. Next to agriculture and fishing, one of the major livelihood activities in Ampaa’rai and Batticaloa districts for resettling Tamils is livestock farming. Colombo’s Sinhala establishment, backed by its occupation military, is occupying these pasturelands with the intention of accomplishing structural genocide on Eezham Tamils and Sinhalicisation of traditional Tamil villages in the East.

According to a Sri Lankan government gazette notification 217/151 of 17 June, 1976, under section 2, around four thousand acres of lands lying between the dams of Rubes Tank and Vammiyadik-ku’lam within the Akkaraippattu DS division is meant for grazing.

The then Government Agent for Ampaa’rai District D.Wijesinghe in 1974 in a circular had categorically defined that the said land is solely meant for cattle grazing and for growing good quality grass. No illegal encroachment on this land would be allowed, the circular had clearly stated.

Mr Wijesinghe had further ordered all those who were engaged in clearing land for settlement to leave the area.

However, some Muslim politicians continued to defy the order by the GA and encouraged their supporters to grab large tracts of grazing lands including residential lands that belonged to Tamils who were chased away from their villages bordering the grazing lands.

Currently, the Colombo-centric Sinhala establishment and its politicians are in full swing in occupying the pasturelands for settlement of Sinhalese, depriving the Tamils of their major livelihood.

Also in Batticaloa district, pasturelands were demarcated in early 1970s. But, Colombo government has seized the lands, depriving the Tamils access to one of their major livelihood vocations in the region.

A former minister of ruling UPFA government and a councillor of the Eastern Provincial Council (EPC) Amir Ali Shihabdeen and SL Deputy Minister Vinayagamoorthy Muralitharan of SLFP and Sivanesathurai Chandrakanthan of TMVP in the UPFA who is also a councilor at the EPC have given their consent to changes in the administrative divisions of Vaakarai DS division, Koa’ralaip-pattu Centre DS division and Koa’ralaippattu West DS division, news sources in Batticaloa said. The latest move of annexing villages from Tamil dominated Vaakarai division with Muslim dominated Koa’ra’laip-pattu Centre and Ko’a’ralaippattu West, aims at reducing Tamil representation and contributes to uneven development by seeking to upgrade Muslim dominated divisions in civic governance, say Tamil National Alliance (TNA) parliamentarians from Batticaloa.

TNA Parliamentarian Mr P. Selvarasa has condemned the SL government for making decisions in Colombo without listening to all sections of the people in the district.

Muslims dominate the divisions of Koa’ralaip-pattu Centre and Koa’ra’laip-pattu West. Vaakarai division is predominantly Tamil.

Koa’ra’laippattu Centre division was created in 2008.

12,500 acres of lands, comprising Oamadiyaamadu, Paalampak-kea’ni, Aalang-ku’lam, Puvanesapuram, Mealaa’nda-ku’lam, Rithi-thenna and Jayanthiyaaya in Pu’naa’nai East (211B GS division) of Vaakarai DS Division are being annexed with Koa’ralaip-pattu Centre DS division in Batticaloa district.

At the same time, lands belonging to 610 families in villages Ku’laththumadu, Kudaamunaik-kal, Ku’lavaal-cheanai and Peddaik-ku’lam of 210 GS division of Kiraan DS division, and lands belonging to 240 families in 210E GS division comprising the villages of Pu’naa’nai, Mayilanthanai, Chaa’lampaich-cheanai, Mu’l’li-vaddavaan and Pu’naa’nai bund, are to be annexed with Koa’ralaippattu West DS division.
