The General Secretary of the Tamil National Peoples' Front (TNPF) and former Tamil parliamentarian from Jaffna, Mr Selvarajah Kajendren, has been instructed over the phone by Sri Lanka's Terrorist Investigation Department (TID) to come for an inquiry on Wednesday at the TID office situated on Naavalar Road in Jaffna city, informed sources said adding that many human rights activists, journalists and student leaders have been ‘invited’ over the phone for such investigations in recent times. Mr Kajendren said he is being asked to come for such investigations for the 5th time in recent times.

The TID seems avoiding written invitations for investigations to evade complaints reaching the international human rights watchdogs. Except in a few cases such as the reported investigation of the BBC Tamil reporter Mr Manikavasagam Ponnaiah, almost all the invitations for such investigations are being extended over the phone.

The newly elected student leaders of Jaffna University were also ‘invited’ for such investigations at the Naavalar Road office of the TID, civil activists said. The student leaders were warned against observing remembrance events on Mu’l’livaaykkaal Day in May and during the Tamil Heroes Day in November. The student leaders were threatened with the message that there would be ‘disappearances’ if the students continued to observe such remembrance evens in the future.

Sri Lanka’s notorious Terrorist Investigations Department (TID), operated by SL Defence Secretary and presidential sibling Gotabhaya Rajapaksa, has now established district-level investigation offices in the country of Eezham Tamils.

In Jaffna, the office functions on Naavalar Road at the building of Namathu Eezhanadu daily, which has been seized by the SL military after the Vanni war in 2009.

Sri Lankan ‘Terrorist’ Investigation Department (TID) has placed a phone call to the head of Jaffna University Teachers Association (JUTA) Lecturer A Rajakumaran and summoned him to the notorious TID office in Vavuniyaa, informed circles at the University of Jaffna told TamilNet on Friday. The JUTA has been firm in defending the rights of the students and has extended support to the protest by the students. It has also held its own protests against the detention by the TID.

The TID from Vavuniyaa takes direct instructions from SL Defence Secretary and presidential sibling Gotabhaya Rajapaksa.

Mr Rajakumaran is the head of the department of the English Language Teaching Centre at the University of Jaffna.

A caller from the TID has reportedly told Mr Rajakumaran that they needed to record statement from him regarding the incidents on 26 and 27 November, the sources further said.

Earlier, the TID has also been against the Bishop of Mannaar Rt. Rev. Dr. Rayappu Joseph, who had established that 146,679 people had gone unaccounted for in the Vanni by citing the statistics of the SL government itself.

In a precedent setting order issued by the District Court of District of Columbia Thursday on the case against Sri Lanka's President Rajapakse filed by three Tamil plaintiffs, Judge Kotelly authorized service by "posting the full summons and complaint on the main page of the TamilNet website," and by publication in two Sri Lankan newspapers. Legal sources in Washington said that Rajapakse being haled into a US court to answer charges of complicity in the extra-judicial killings of plaintiffs relatives is imminent.

Judge Kotelly in her short opinion leading to the order said, '[h]aving evaded service in person and refusing service under the international agreement [Hague Convention] established for the purpose of service of process on international defendants, “it is not reasonably possible or practicable to give more adequate warning” to Defendant [Rajapakse] than service by publication.


Bruce Fein, in responding to the Court order said:
    “The District Court’s order authorizing service of the Torture Victims Protection Act Complaint and Summons on Sri Lanka's President Rajapaksa via newspaper publication and posting on TamilNet marks a legal milestone in achieving accountability for the gruesome extra-judicial killings of innocent civilians ordered or condoned by the highest officials of the Sri Lankan government during the ethnic civil war. "After service is effectuated, President Rajapaksa will be compelled to respond to the Complaint’s accusations in a court of law uncompromised by partisan politics. It can be expected that President Rajapaksa will retain an army of luxury-priced lawyers to defend him, who will attempt to throw technical legal obstacles to thwart justice. "We urgently need all available financial and moral support to achieve victory not only for the three named Plaintiffs, but for all the victims of President Rajapaksa’s atrocities. A judgment in our favor in this case would set a precedent that would underwrite copy-cat TVPA suits by other victims of Rajapaksa endorsed or sponsored extra-judicial killings or torture.”


Meanwhile, another Sri Lanka website run by exiled journalists said that "[a] legal expert told this website that the granting of this motion was in itself a huge victory for the Plaintiffs and perhaps an indication of the acceptance by the Courts that the Complaint is sufficiently serious with a sound legal basis that has the potential to go to term rather than crash in the early stages on preliminary objections."

Legal sources point out that there is binding precedent in the District Court of District of Columbia, in Mawani v. Osama Bin Laden, 417 f.3d 1, when foreign defendants avoid recognizing the service of process the court has granted plaintiffs leave to serve those defendants by "publishing...notice for six weeks in the Daily Washington Law Reporter,..."

The court would likely prefer to see more than one of the traditional avenues exhausted before allowing the plaintiffs to seek a default judgment, and in the Rajapakse case, the Court noted that "[h]aving unsuccessfully served Defendant with process via the Hague Convention, mail, and in person, Plaintiffs now seek to serve Defendant with process by one of a number of means, including publication, Twitter, Facebook, and email."

சமீபத்தில் அமெரிக்காவில் தங்கியுள்ள சர்வேந்திர சில்வாவிற்கு எதிராக வழக்கு தொடரப்பட்டமை யாவரும் அறிந்ததே. 58ம் படைக்கு தளபதியாக இவர் இருந்த கால கட்டத்தில் யுத்தக்குற்றங்கள் இழைத்தார் என இவர்மேல் வழக்கு தொடரப்பட்டு நஷ்ட ஈடும் கோரப்பட்டுள்ளது. இதனை அடுத்து அமெரிக்க நீதிமன்றம் அவருக்கு விடுத்த அழைப்பாணையின் பிரதியை சர்வேந்திர சில்வாவின் வீட்டிற்குச் சென்று சிலர் வழங்கியுள்ளனர். நியூயோர்க்கில் உள்ள தொடர்மாடி ஒன்றில் வசித்துவரும் அவர் வாசல்ஸ்தலதைத் தட்டி அங்கே இருந்த அவரது உதவியாளிடம் இந்த அழைப்பாணையின் பிரதி கையளிக்கப்பட்டுள்ளது. இதனை இவர் இனி மறுக்க முடியாது. காரணம் அனைத்தும் படமாக்கப்பட்டு அவை ஆதாரமாக மாற்றப்பட்டுள்ளது.

அமெரிக்க சட்டத்துக்கு அமைவாக நீதிமன்றத்தால் வழங்கப்படும் சில அழைப்பாணை 120 நாட்களுக்கே செல்லுபடியாகும். அதனை 120 நாட்களுக்குள் குறிப்பிட்ட நபரின் கைகளில் சேர்க்கவேண்டும். அப்படி சேர்க்காவிட்டால் போட்ட வழக்கு காலாவதியாகிவிடும். எனவே சர்வேந்திர சில்வாவுக்கு எதிராக வழக்கை தொடுத்த அலி பவுடா என்னும் வழக்கறிஞர் சாதூரியமான முறையில் இந்த அழைப்பாணையை சர்வேந்திர சில்வாவிடம் ஒப்படைத்துள்ளார். அதுமட்டுமல்லாது அதனை படமாக்கி ஆதாரத்தையும் திரட்டிவிட்டார். எனவே இனி நிச்சயமாக சர்வேந்திர சில்வா நீதிமன்ற வாசல் ஏறியே தீரவேண்டும்.  அது உறுதியாகிவிட்டது. இவ்வழக்கைத் தொடுக்க உலகத் தமிழர் பேரவை(GTF) வழக்கறிஞர் அலி பவுடாவுக்கு உறுதுணையாக நின்றமை பாரட்டத்தக்கவிடையமாகும்.

இதனையே செயல் திறன் என்று அழைப்பார்கள். அதை விடுத்து நான் வழக்கைப் போட்டு விட்டேன். போடப் போகிறேன் என்று கதை அளப்பதும் கண்ணாம்பூச்சி காட்டுவதையும் விடுத்து ஆக்கபூர்வமான செயலில் ஈடுபடுவது நல்லது. ஆதாரங்களை தகுந்த முறையில் வெளியிடுவது நல்லது. அறிக்கையை மட்டும் விட்டு விட்டு செயல் திறன் இல்லாமல் இருக்கும் ஒரு சில அமைப்புகளைப் பற்றி நாம் ஏற்கனவே சுட்டிக்காட்டி இருந்தோம். அவர்களுக்கு இது நல்லதொரு முன் உதாரணமாக அமையும். தொலைக்காட்சியில் தோன்றி மக்களுக்கு அதனை இதனைச் சொல்லி ஏமாற்றுவதை விடுத்து செயல்திறன்கொண்ட இனமாக நாம் மாறவேண்டும். உண்மையை எழுதினால் “பொய் கூறும் இனமாக எம்மைச் சித்தரிக்கவேண்டாம்” என கவிதைகளை பாடுகிறார்கள். கவிதை கட்டுரை எல்லாவற்றையும் ஒரு புறம் மூட்டை கட்டிவிட்டு 40,000 தமிழர்களைக் கொன்ற சிங்களதேச அரசியல்வாதிகளையும் இராணுவத்தையும் யுத்தக் குற்றக் கூண்டில் ஏற்ற அனைவரும் ஒன்றாக முயலுவோண்டும்.

நியுயார்க், செப்.26: தற்போது அமெரிக்காவில் உள்ள இலங்கை அதிபர் மஹிந்த ராஜபட்சவுக்கு நியுயார்க் மாவட்ட நீதிமன்றம் அழைப்பாணை அனுப்பியுள்ளது எனத் தெரிய வருகிறது.விடுதலைப்புலிகளின் தளபதியாக இருந்த ரமேஷின் மனைவி நியுயார்க் தெற்கு மாவட்ட நீதிமன்றத்தில் தாக்கல் செய்த வழக்கிலேயே ராஜபட்சவுக்கு அழைப்பாணை அனுப்பப்பட்டுள்ளது என செய்திகள் தெரிவிக்கின்றன.இலங்கை படைகளிடம் சரணடைந்த பின்னர் படுகொலை செய்யப்பட்ட கர்னல் ரமேஷின் மனைவி வத்சலாதேவியின் சார்பில் வி.ருத்ரகுமாரன் கடந்த 22 -ம் தேதி இந்த வழக்கை தாக்கல் செய்திருந்தார்.ரமேஷின் படுகொலை மற்றும் போரின்போது இடம்பெற்ற போர்க் குற்றங்கள், மனிதகுலத்துக்கு எதிரான குற்றங்களுக்கு அடிப்படைக் காரணமாக இருந்தவர் என்ற அடிப்படையிலேயே ராஜபட்ச மீது இந்த வழக்குத் தாக்கல் செய்யப்பட்டுள்ளது.ராஜபட்சவுக்கு அழைப்பாணை அனுப்பப்பட்டுள்ளதை அடுத்து அவர் அவசரமாக இலங்கை திரும்பலாம் என்று எதிர்பார்க்கப்படுவதாக தகவல்கள் தெரிவிக்கின்றன.
