Boyle compares Syria action, dismisses UNHRC resolution as a "fraud"

Dismissing the US sponsored United Nations Human Rights Council Resolution as "a fraud," Professor Francis Boyle, an expert in international law, said, "if the US were serious about Government of Sri Lanka (GoSL) genocide, crimes against humanity and war crimes against the Tamils, US would have done something like it did to Syria this week." The U.S. State Department established a Clearinghouse on Syria and provided $1.25m to assist to "collect, collate, analyze, and securely store evidence, documentation, and other information concerning human rights abuses and violations, while protecting witnesses and sources."

While the conduct of the Syrian Government is similar to that of the Rajapakse Government in its crimes committed against the Tamils, the number of people affected in Syria is an order of magnitude less than that in Sri Lanka.

Boyle pointed out that until U.S. takes action similar to that it has taken against Syria in helping the Tamils to "collect, collate, analyze, and securely store evidence" that will enable the victims to "develop case dossiers that could support prosecutions in Syrian, hybrid, or international courts," diaspora should not be optimistic about U.S.'s intentions.

Full text of the announcement on Syria by the State Department follows:
    Recognizing that perpetrators of gross violations of human rights in Syria must be held to account, and that the Syrian people will lead the way, the United States will work with international partners to establish a Syria Accountability Clearinghouse that will support Syrian and international efforts to promote accountability. By providing a forum for coordination, the Clearinghouse will advance efforts to assist and train the Syrian people and partner organizations to collect, collate, analyze, and securely store evidence, documentation, and other information concerning human rights abuses and violations, while protecting witnesses and sources. The record that is compiled could be used for a broad range of transitional justice and reconciliation processes, including truth-seeking, memorialisation, and prosecutions. These efforts will also help develop trial-ready dossiers against individuals responsible for violations of international or domestic criminal law. The Clearinghouse will be guided by a Steering Committee of representatives of the Syrian people, cooperating states, and regional organizations. Projects that could be coordinated via the Syria Accountability Clearinghouse would aim to: Train and mentor Syrian investigators/lawyers, human rights actors, and other NGOs/independent actors to collect information about the full range of human rights abuses and violations.
  • Establish a secure storage facility, including a database, for collected information.
  • Establish protection and security best practices and procedures and seek assistance from states to implement them.
  • Establish a “Prosecutors’ Unit” to collect and analyze available evidence and develop case dossiers that could support prosecutions in Syrian, hybrid, or international courts.
There may also be ways for the Clearinghouse to complement the efforts of the Office of the High Commissioner for Human Rights, which is facilitating safe and secure storage of information and evidence collected by the Commission of Inquiry.

The Syria Accountability Clearinghouse will maintain secure virtual linkages with affiliated groups and organizations around the world, including in Syria. The United States will provide an initial $1.25 million to support the Clearinghouse and related accountability efforts, and ask other partner nations and organizations to provide additional funding and support for these accountability efforts. While the US sponsored resolution's thrust was in the implementation of the recommendations of the LLRC, the recent "factual supplement" on Sri Lanka's war released by the US Office of Global Criminal Justice headed by Ambassador Stephen Rapp, pointed out the serious defects of the LLRC in addressing the International Humanitarian, and Human Rights Law violations.

Pointing out that the UNHRC resolution is not the First Step to liberation but a Closing Step conceived by Globalized Establishments to conclude the process of Tamil subjugation started by the 2002 CFA, mere exposure of the collusion games of the Establishments is not enough, but action is needed rather than the euphoric diaspora chasing mirages, writes TamilNet Economic and Geopolitical Analyst in the Asia Pacific. Being in the Fourth World of nations without state, Tamils paid the price for not building solidarity with fellow peoples of the world. We paid the highest price and should take the initiative otherwise even our future struggle will be organized only by our enemy in a reactionary way. Our alliance with Tamil Nadu is of great importance. As Globalized Establishments cannot survive without consumption and consumers, they will certainly respect the strength of numbers.

The much hyped US resolution in the UNHRC has been just passed in the recently concluded 19th sessions amidst euphoria that it is the first step to Tamil Eelam among the Diaspora who campaigned for the passage just as the CFA was welcomed by the Homeland Tamils in February 2002.

In 2002, it was the first exposure of the Eezham Tamil nation to geopolitics and till then our “God Fathers” had been either India or the West. Since we had burnt our fingers with India after the IPKF episode, the Co-chairs threw the net of the CFA. We all know the price paid in May 2009 and we are yet to recover.

In the three years after the disaster of May 2009, many of us have invested in the understanding of Geopolitics as well as in the understanding of the context in History but apparently the similarities between the CFA and the just adopted US resolution have been missed.

In short, the CFA was used to crush the LTTE and the present US resolution is designed to disarm the Tamil diaspora. This will be clearly seen when viewed in the geopolitical and historical context as well as in relation to the relevance and relationship to National Liberation.

In the recently concluded 19th sessions of UNHRC, USA and India played a “Collusion Game” to hide the real issues of sharing the spoils of war among the main foreign partners of the War- India, USA and China.

The US resolution was proclaimed as anti Sri Lankan but initially the US wanted to move it jointly with Sri Lanka and invited Sri Lanka to participate at the draft stage.

Though the Foreign Minister GL Peiris saw the advantages of “sealing the issues with minimum sacrifice by the Victors of the War”, Mahinda saw the usefulness of opposing the US Resolution as anti West and anti Indian Rhetoric will help him in diffusing the rising local protests.

While Mahinda is still continuing with anti Indian and anti Western Rhetoric and sections of the Tamil Diaspora are still in the euphoria of the first step, “pragmatic measures in sharing of the spoils of war” are being discussed by US and Sri Lankan teams including IMF, World Bank etc.

It is unfortunate if oppressed peoples cannot see these collusive (for and against) cries of human rights to hide the real issues of sharing the spoils of war.

In order to understand “where do we go from here”, we need to draw the correct conclusions from the history as well as the current status of geopolitics described above.

From a scientific outlook of social and spiritual point of view, completion of National Liberation is the next critical stage evolution.

As the liberation theologists and many spiritualists say, the ultimate liberation is dependent on social and economic liberation in this World.

As many socialists say, socialism is not possible without the completion of the National Liberation.

The oppression of one nation by another nation is imperialism and so long as imperialism exists, a more equitable world or socialism is not possible.

Thus completion of National Liberation is very important for progress and change.

The pro status quo, Globalised Establishments have realized this more than the oppressed peoples and are all out to block National Liberation as a preemptive move to maintain the Status quo and they are uniting more and more for this purpose.

It is to be noted free market of the first world and socialism of the second world are mere Rhetoric of the past and all Globalised Establishments are moving towards State Capitalism and that in turn encourages the structural Unity of the Globalise Establishments.

Thus we have well uniting Oppressor of Globalised Establishments (1%) on the one side and the divided oppressed peoples and Nations without state (99%) on the other side.

Where we should go from here is obvious. Unity of the oppressed Peoples and oppressed Nations without state for a more equitable world is the target. The Occupy Movement and its call for 99% against 1% is the light house of the times.

While pessimists have silenced themselves and joined the oppressed who have been silenced by the enemy (simply by making them to work without spare time to make ends meet), one could hear the voices of “pragmatists” who say that the Light House is light years away and that the suffering people, particularly in the Eelam Homeland, need immediate relief.

One cannot see any effective relief being given to the Homeland Tamils except by their kith and kin abroad.

In any case nobody is asked to stop the relief that is being provided for whatever the reason and however effective that may be. What needs to be understood is that such relief is only like the immediate pain killer but neither a long term nor even short term solution.

This is again like the “lobbying of parliamentarians and officials of Globalised Establishments particularly from the West” by certain Diaspora groups.

These groups even claim with euphoria that their lobbying contributed to the passage of the UNHRC resolution. However there was no such euphoria in the Homeland and it was short lived even in India as pointed out by India Today on 28.03.12 as follows:

“The euphoria was short-lived. The hopes generated after India's vote at Geneva for holding Colombo accountable for war crimes, have now evaporated.

With Prime Minister Manmohan Singh bending over backwards to placate our tiny southern neighbour, there is nothing much to cheer about.”

Also Malaysia has clarified that its abstaining was to give more time to Sri Lanka as if the time given till the 22nd sessions of the UNHRC (with the hands of the UN High Commissioner tied by the Indian amendment) is not enough.

Further more the Sri Lankan Island paper of 30th March 2012 Reported online the following:

“A very different kind of powwow: Soon after Geneva episode, US here for trade and investment talks, deepen 150 year relationship.”

Do all these not show that the US Resolution in the UNHRC was a “closing step” and not a “first step” for the foreign partners of war to share the spoils of War and the local partner to continue with the genocide in “peace”?

Some “pragmatists” may even say : “Wait till the 22nd sessions of the UNHRC”.

We need real structural changes” and not “regime changes” as in Iraq, Afghanistan, Tunisia, Egypt, Libya and the like.

Neither silence nor inaction will bring about real structural change.

Many in the Homeland, in the Tamil Nadu and in the Diaspora had similar views even long before the passage of the US resolution as continuously reported in TamilNet with news items from Homeland as practical evidence and these certainly helped to expose the “Globalised Establishments”.

But exposing the Globalised Establishments is not enough.

We need action to develop solidarity among the 99%. We failed to build up this solidarity base during our 60+ years of struggle and paid the price for it.

We in the diaspora now have an opportunity for developing such a solidarity base and we should concentrate on that knowing that, being far away, we cannot influence organized resistance in the homeland.

The form and nature of organized resistance will be determined by the enemy not even by the people in the Homeland except as a reaction to enemy action, matching his technology.

We need to act fast so that the international environment will be ready to support the Homeland struggles as and when they occur.

Already efforts have begun in few countries like Canada, UK, France, and Australia in this direction for the development of solidarity base.

It is difficult as it is new not only to Eezham Tamils but even to other nations without state. But there is no other way. Since we have paid the highest price, we are in a position to invite other nations without state.

When the other oppressed peoples (including those among the Sinhalese) realize that a more equitable world cannot be built without completing the National Liberation, they will also certainly join us in solidarity.

We should understand that there are 6000 Nations without State in the world representing 1/3rd the population of the world and in any major city in the world, you can find representatives of more than 200 Nations.

It is also important to remember that 1/3rd the nations without state (in the world) are in India. This and not Rajiv was the main reason for the vengeance with which India moved against the National Liberation of Eezham Tamils.

For the same reason, India is likely to be the next “boiling point” in the world. So our alliance with the Tamils of Tamil Nadu is of great importance as they along with other Tamils of the world will be our partners in stopping the genocide of Eezham Tamils and our strongest partners in National Liberation.

Let us move in this direction and in that process we will also get the strength to make use of the contradictions among the Globalised Establishments.

Since the Globalised Establishments cannot survive without consumption and consumers, they will certainly respect the strength of Numbers.

The analyst further elucidates on the historical background of Globalized Establishments operating against the Fourth World:

Nations are historically and naturally evolved communities with common territory, common language, common technology (economy) and common culture in the rising period of capitalism, i.e. in the period after the industrial revolution.

Capitalism developed into imperialism when powerful nations conquered weaker nations for obtaining cheap raw materials and ensuring captive markets for manufactured goods.

When imperialistic countries shared the whole world for exploitation, it was also the beginning of the first phase of globalization and the beginnings of geopolitics on a global scale. The first two world wars were about redistribution of colonies and the beginning of cracking of imperialism giving birth to National Liberation.

However imperialist countries marked the borders of independent countries artificially for political considerations after the end of the World War II without any consideration to the natural and historical boundaries of Nations and devolved political imperialism to the dominant Nations of the countries who became agent imperialist. Eg the Sinhalese nation in Sri Lanka is an agent imperialist.

To date, this drawing of artificial boundaries of Countries, remains the most successful preemptive against National Liberation because even the dominant nations who won their Liberation through protracted armed struggle are drunk with their “agent imperialist political power” and are turning their back to the completion of National Liberation.

Geopolitics that developed as a “Cold War between imperialist west and socialist east” after the World War II and the establishment of the United Nations while the countries that got political independence (in reality it was devolution of political imperialism to make these countries as “agent imperialists” by the former imperialist countries who retained economic imperialism) grouped themselves as “Non Aligned Countries” also referred to as the Third World to distinguish from the First World of former imperialists and the Second World of the “socialist countries” that in reality promoted not socialism but State Capitalism.

So the “Cold War” was in reality an attempt to resolve the developing contradictions in capitalism developed to a new form of imperialism of trade as opposed to the physical conquest of earlier times.

While the First World talks of free trade and the Second World give preference to bilateral or even barter trade, the terms of trade are always manipulated and if a country gets better terms than in the World market (which again is neither free nor fair), then it has to be compensated in political terms.

There are nearly 6000 nations in the world but only 193 countries in the UN meaning that there are 193 dominant nations who are either former imperialists or agent imperialists since they are oppressing some nations without state, who are collectively called the Fourth World. Eezham Tamil nation is a member of the Fourth World.

The Cold War came to an end with the collapse of the Soviet Union and for a short time (between the two Iraq Wars); we had Unipolar World instead of the Bi Polar World of the Cold War days.

The Unipolar world also symbolized the transformation of imperialism to Globalised Capital. The unipolar world is unstable and hence since 9/11 an artificial pole of ‘terrorism’ was conceived and terrorist phobia was used as a cover for continuing the oppression of the peoples of the world.

The evolution of a multipolar world necessitated the need for a coalition of 30 to 40 countries whether it is in the Afghanistan war, Iraq war or war against Eezham nation to cite a few recent examples.

30 to 40 Countries uniting in a coalition of aggression is new phase in the development of imperialism, a transformation from “Globalised Capital” to “Globalised Establishments”.

The first step in their strategy is to “isloate the target” and the convenient method in the age of terrorist phobia is to “call the dog terrorist and then shoot it”.

The terrorist phobia is no different to the “communist phobia” in those days when there was no communism or not even socialism but only State Capitalism.

It is to be noted that even the First World is now entering to a stage of State Capitalism by “bailing out” big capital with the resources of States instead of bailing out the suffering poor. It should also be noted that terrorism and terrorist phobia invented by the First World are becoming “catch words” even in the Second and Third Worlds.

Thus geopolitics of the Globalised Establishments is entering into a stage of greater unity of the oppressor (1%) while the oppressed (99%) are divided and isolated.

Of course, there are contradictions, real and collusive, among the Globalised Establishments. In the process of resolving the real contradictions, the Establishments enter into “collusion games” to cheat and disarm the oppressed.

The UN Security Council Meeting in the basement of the UN during the peak of war against Eezham Tamil nation was a “collusive meeting” to give GoSL a freehand in the war as all Globalised Establishments have common interest in preserving the existing world order or the status quo.

Contrary to popular belief, China which was previously neutral was invited to join the War by Mahinda at the behest of both India and the US. US and India knew that they alone couldn’t motivate the Sinhala population for a successful conclusion of the war.

It was not difficult for China to join as it has for long given up Mao’s Proletarian Internationalism and was concentrating on State to State relations to obtain a better share of the resources of nature.

Second generation Eezham Tamil youth in Canada strongly criticized the support lent to the pro-LLRC US resolution by some diaspora organizations at a panel discussion organized by the National Council of Canadian Tamils on Saturday about the recent United National Human Rights Council meeting. While the older generation on the panel were welcoming the US resolution as a “step in the right direction”, the youth activists criticized it for being a “step backward”. Urging the diaspora leadership to have a “slightly longer memory than the last four weeks,” Krisna Saravanamuttu of the NCCT said that the US resolution was “fundamentally flawed” because it used the LLRC as a basis for achieving accountability and a political solution from the Sri Lankan government guilty of genocide.

Nearly 250 members of the Tamil Canadian community packed the hall of the Canada Kandaswamy Temple in Toronto to hear the panellists provide their thoughts on the US sponsored resolution in Geneva.

The panellists included Dr. Paul Newman (Professor, University of Bangalore), Raj Subramanium (Director, National Council of Canadian Tamils), Krisna Saravanamuttu (spokesperson, National Council of Canadian Tamils/National Executive Representative, Canadian Federation of Students-Ontario), and Suren Surendran (Spokesperson, Global Tamil Forum). Anton Phillip from the Centre for War Victims and Human Rights moderated the meeting.

In their remarks to the community the panellists presented the developments in Geneva and the passing of the US resolution as a positive “step in the right direction.” Raj Subramanium provided a report back to the community on his experience in Geneva, and spoke about the harassment he faced from members of the Sri Lankan delegation. Dr. Newman explained the geo-political issues plaguing the Tamil Freedom Struggle, underling that both China and India are vying for regional dominance, and reiterating that the US resolution is a first step in achieving an international inquiry.

Contrarily, Krisna Saravanamuttu argued that the US resolution is a “step backwards” in achieving justice for the victims of war crimes and crimes against humanity. Saravanamuttu further reminded the audience that the LLRC was established to evade international scrutiny for the Mu’l’livaaykkaal genocide and was already rejected by prominent human rights organizations, the Tamil Diaspora, and civil society in the North-East.

He went on to point out that the Sri Lankan government stands accused of serious violations of human rights and international humanitarian law and to expect the accused party to carry out an investigation is against both reason and natural justice. Saravanamuttu pointed out that it was contradictory for the US State Department to ease its restrictions on the sale of weapons to Sri Lanka on the very same day that the US resolution passed in Geneva

Saravanamuttu maintained that what was happening to the Tamil nation for the last 60 years was a protracted genocide, and even three years after the war the Sri Lankan government continues to implement policies to dismantle the Tamils as a distinct nation.

Suren Surendran began his remarks by saying that while Saravanamuttu’s argument was legitimate and could not be refuted, he suggested “young blood boils quickly” and that the diaspora needed to be ‘realistic’. Surendran explained to the audience of his role in Geneva, and the necessity to engage with both diplomats from the International Community and Sri Lanka, in order to convey the aspirations of the Tamils. Surendran, in a presentation, further outlined the GTF ‘strategy’ on the current international situation for the Tamil struggle, and the necessity to work within the established mechanisms of the international community.

During the heated debate that followed many from the audience raised questions with regards to the US Resolution. An elderly person pointed out that in his presentation, Surendran said nothing about genocide or the need for a United Nations referendum on Tamil sovereignty in the North-East of the island. The GTF spokesperson replied that it would be ineffective for Tamils to claim genocide and contended that a legal basis did not exist for a referendum.

Saravanamuttu instead argued that the Sri Lankan government used a coordinated plan of different actions aiming at the destruction of essential foundations of the Tamil nation, and therefore the Tamils had a responsibility to assert the reality of Sri Lankan oppression because. He also referenced the historical and earned sovereignty of the Tamils as well as the legal principle of remedial sovereignty as arguments for an international referendum on the Tamil question.

The second-generation Eezham Tamil students were particularly vocal in expressing their dismay with the US resolution. Priyanth Nallaratnam, spokesperson for the TYO-Canada asked how Surendran can confidently suggest that the US resolution is a step forward when one considers the history of the Tamil struggle’s encounter with the Indian Peace Keeping Force and the role of Norway in the failed peace talks, both of which were initially welcomed by the Tamils only to get disappointed later. Surendran replied that the Tamils do not exist on another planet and must therefore adjust to the present circumstances.

Similarly, Samuel Nithiananthan, director with the NCCT, pointed out that the US resolution comes in the backdrop of the US tilting the balance of powers against the Tamil liberation struggle, and the intentional failure to act by the international community during the 2009 massacre, how then could the US motivations behind in Geneva not be seen without an eye of suspicion to blunt the Tamil national question and the issue of genocide. Instead of directly answering the students question Surendran admonished the student for being “unrealistic”, and asked whether the Channel 4 video would have been as effective had it been taken by a Tamil.

Dhurga Vijay of the TYO asked the panel in general if the Tamil diaspora organizations are losing credibility because it now endorsed a resolution that upholds the very same LLRC that the Diaspora was vehemently opposed to since 2009. While other panel members remained silent, Saravanamuttu agreed with the student and went on to say that the role of the Tamil Diaspora today is to bring attention to the ongoing genocide of the Tamil nation, to internationally advocate for the rights of the Tamils living under military occupation, and to uphold the principles of the struggle.

The public disapproval by the Tamil students in Canada of the pro-LLRC US Resolution comes after the recent declaration made at the ‘Eelam Tamil Youth Conference – Canada 2012’ in Toronto where Tamil students across Canada from high schools, universities and colleges resolved to continue the Tamil liberation struggle and reject the legitimacy of the unitary state imposed on the Tamil nation.

While the passage of the US-tabled LLRC-based resolution on Sri Lanka at the UNHRC sessions has renewed expectation in some quarters of the Tamil diaspora that the resolution will be the first step towards exposing the culpability of Colombo in committing war-crimes, Tamil circles expressed the need to exercise caution, pointing out that the history of failed Commissions in Sri Lanka during the last 30 years, and the futility of UN-approved domestic transitional justice mechanisms where alleged perpetrators will be allowed to direct and control internal criminal investigations, will result in the resolution turning into an albatross around Tamils neck, providing political space to Rajapakses to whitewash war crimes and the on-going structural genocide.

Despite the horrendous historical record of failure of several Sri Lanka appointed Commissions of Inquiries, the International community's recommendations continue to rely on internal Colombo controlled investigation mechanisms to identify perpetrators of the alleged genocide on Tamils. While the accepted doctrine of complementarity may necessitate exhaustion of internal mechanism before external intervention, the willingness of the International Community to continue to provide additional time while Colombo has squandered more than 3 year without any credible action, has increasingly alienated many diaspora Tamils from the power players of the West, Eezham Tamil observers in Washington said.

The West's evolving muted and suspect solution space to seek accountability and justice for Tamils, coupled with the Wikileaks-exposed behind the scenes maneuvering of the coalition countries to advance Blake's policy of blunting Tamils struggle, highlight the need of the Tamil diaspora to avoid over-dependence on any single international mechanism, but to unitedly marshal the resources and talent and work independently using the legal, and other local and international mechanisms for maximum sustained effectiveness, diaspora activists say.

The report labeled Post-war Justice in Sri Lanka, released by the International Commission of Jurists (ICJ), and Amnesty's "Twenty Years of Make-Believe:...," provide a clear record of the fate that befell more than 10 commissions appointed by Colombo during the past thirty years. Pertinent excerpts from these reports are listed below.

Sansoni Commission: (August 1977)
Supreme Court Judge, Justice M.C. Sansoni, to examine the causes and events surrounding ethnic violence in August 1977. But instead of improving the situation, the government enacted new legislation to shield errant government forces from prosecution. The CoI’s proceedings were reportedly hampered by political interference. The report put most of the blame for violence on the Tamil political leadership, and discounted significant witness testimony that implicated the state (although it reported the allegations). Amnesty 2009.

To inquire into the shooting and attack by aircraft which caused injury and damage to personnel and property of Medecins Sans Frontieres (MSF) on 3 May, 1991 and to ascertain whether the firing upon of the MSF vehicle by a government helicopter was intentional or accidental. ICJ 2010

Comment: In the evaluation of contested testimony, this Commission report appears uncritically to favour government over MSF testimony.

To report on whether there was any connection between the two incidents of the explosion of a device on 12 June 1991 resulting in the deaths of two soldiers and the injury to another and the killing of sixty-seven civilian inhabitants of nearby villages in Batticaloa. It was also required, inter alia, to report on whether the civilian deaths resulted from actions of the armed forces and, if so, the reasons for such killings.

Commission Report: The killings were not found to be the result of military action but rather, offences committed by soldiers who ran amok. The Commission opined that the offences were punishable in terms of the Penal Code but that, due to the finding that there was no evidence against any particular soldier or soldiers as such, it was determined that “the offenders cannot be brought before a criminal court of law.” ICJ 2010.

Sri Lanka's President created “The Commission of Inquiry Appointed to Investigate and Inquire into Serious Violations of Human Rights which are alleged to have arisen in Sri Lanka since 1 August 2005, and also invited an International Independent Group of Eminent Persons (IIGEP) to act as observers of the activities of a local Commission, which would investigate these violations.

CoI partially completed investigations and submitted a report to the President. The report has not been made public. IIEGP quit its mission saying the CoI's work "lacks transparency," and the process "falls short of international norms and standards."

It is time for the international community to stop believing the charade that has been played for nearly 20 years. Sri Lanka is neither willing nor able to address impunity on its own. The international community should use its significant influence to encourage the Sri Lankan authorities to investigate past violations of international human rights and international humanitarian law, prosecute suspected perpetrators in proceedings which meet international standards of fairness, ensure reparations for victims and prevent future violations. Spokesperson for Tamils Against Genocide (TAG), a US-based activist group that helps Tamil victims of war seek legal redress, said "Despite the presence of soft language related to violation of international law in the UNHCR resolution that purports to put Sri Lanka on notice, only continued exposure by the diaspora Tamils of the gruesome details of the crime of the 21-st Century, the slaughter of 40,000+ Tamils in Sri Lanka's killing fields, in the legal system and corridors of power in the West, will force the International Community to take punitive action on the perpetrators of war crimes in Sri Lanka."

50 ஆண்டுகளுக்கும் மேலாக அமெரிக்காவை எதிர்த்து அரசை நடத்தி வரும் ஃபிடல் காஸ்ட்ரோவுக்கும் இந்தப் பட்டியலில் நிரந்தரமான இடமுண்டு.
தமிழர்களுக்காக உலகமெங்கும் குரல் கொடுப்பவர்களில் பலர் தங்களைப் புரட்சியாளர்களாக முன்னிறுத்திக் கொள்வதற்கு இவர்களில் ஒருவரைத்தான் இன்று வரைக்கும் பயன்படுத்திக் கொண்டிருக்கிறார்கள். தமிழர்களில் பலருக்கு இவர்கள்தான் முன்னோடிக் கதாநாயகர்கள். தமிழக அரசியலிலும் இவர்களுக்கு முக்கியப் பங்குண்டு.
இப்படி உணர்வுப்பூர்வமாக இணைந்திருந்த தமிழர்களையும் அவர்களுக்காகப் போராடி வருவோரையும் சே குவேரா உள்ளிட்ட புரட்சியாளர்களின் வழி வந்தவர்கள்தான் இப்போது ஒட்டுமொத்தமாகக் கைவிட்டிருக்கிறார்கள். எப்படி என்கிறீர்களா?
ஐ.நா. மனித உரிமைக் கவுன்சிலில் கொண்டுவரப்பட்ட தீர்மானத்தை இந்தியா வலுவிழக்கச் செய்துவிட்டது என்று பெரும்பாலானவர்கள் குற்றம்சாட்டுகிறார்கள். புரட்சியாளர்களை நெஞ்சுக்குள் ஒட்டி வைத்திருப்பவர்களும் இதையேதான் சொல்கிறார்கள்.
உண்மையில் இந்தத் தீர்மானத்தை வலுவிழக்கச் செய்து, பத்தோடு பதினொன்றாக தூக்கிப் போட்டது யார் தெரியுமா? புரட்சியாளர்களால் உருவாக்கப்பட்ட கியூபா, ரஷியா, சீனா ஆகிய நாடுகள்தான்.
ஐ.நா. மனித உரிமைக் கவுன்சிலில் இலங்கைக்கு எதிராக அமெரிக்கா கொண்டு வந்த தீர்மானம் கடுமையான எந்தக் கோரிக்கையையும் முன் வைக்கவில்லை. இலங்கை அரசே அமைத்த ஒரு ஆணையத்தின் அறிக்கையை நடைமுறைப்படுத்துவதைப் பற்றி மட்டுமே அந்தத் தீர்மானம் பேசியது.
பாதுகாப்புக் கவுன்சில் தீர்மானங்களைப் போன்று தாக்குதல் நடத்துவதற்கு முன் அனுமதி பெறும் அவசரமும் இந்தத் தீர்மானத்துக்குக் கிடையாது. இவ்வளவு பலவீனமான ஒரு தீர்மானத்தை "இறையாண்மை', "அன்னியத் தலையீடு கூடாது' எனத் திருத்தத்தைப் போட்டு மேலும் பலவீனமாக்கியது இந்தியா.
உறவுகளைத் தக்கவைத்துக் கொள்வது, புவியியல் ஒருமைப்பாடு என சாதாரண மக்களுக்குப் புரியாத பல்வேறு ராஜதந்திர அம்சங்களைக்கூறி நியாயப்படுத்தினாலும், இந்தியா அந்தத் தீர்மானத்தைப் பலவீனமாக்கியது என்பதுதான் உண்மை.
இந்தியாவின் திருத்தத்தால், இலங்கையை நிர்பந்திக்காமல் செயல்பட விட வேண்டும் என்பதாக தீர்மானத்தின் நோக்கம் திரிந்துபோனது. அதேநேரத்தில் மதில்மேல் பூனை போன்ற மனநிலையில் இருந்த நாடுகள் இந்தத் திருத்தம் காரணமாக தீர்மானத்துக்கு ஆதரவளிக்க முடிந்தது; எதிர்த்து வாக்களிக்க இருந்த சில நாடுகள் மெüனமாக இருந்தன என்பதையும் மறுக்க முடியாது.
இப்படியொரு வலுவற்ற தீர்மானம் நிறைவேற்றப்பட்டதால், தமிழர்களுக்கு உரிமை கிடைக்கச் செய்வதிலும், போர்க்குற்றங்கள் தொடர்பாக நீதி கிடைக்கச் செய்வதிலும் முழு வெற்றிபெற்று விட்டதாகக் கருத முடியாது. அதற்கெல்லாம் இது முதற்படியாக வேண்டுமானால் இருக்க முடியும்.
இந்தத் தீர்மானத்தால் தமிழர்களுக்கு நேரடியான ஒரேயொரு நன்மைதான் கிடைத்திருக்கிறது.
நெருக்கடிகள் சூழ்ந்திருக்கும்போதுதான் உன் நண்பர்களையும் எதிரிகளையும் அடையாளம் காண முடியும் என்று சொல்வார்கள்.
அதைப்போல, இந்தத் தீர்மானம் தமிழர்களுக்கு தங்களது உலக அளவிலான நண்பர்களையும் எதிரிகளையும் அடையாளம் காட்டியிருக்கிறது.
சர்வதேச அரசியல் சதுரங்கத்தில் புலப்படாத எத்தனையோ ராஜதந்திரங்கள் இருக்கும். அதில் ஒரு பகுதிதான் இலங்கைக்கு எதிரான அமெரிக்காவின் தீர்மானம். ஆனாலும், லிபியா, சிரியா, வடகொரியா, ஈரான் போன்ற நாடுகளுக்கு எதிராக பல அவைகளில் கொண்டு வந்த தீர்மானங்களைப் போன்றது கிடையாது. அப்படிப்பட்ட கடுமையான தீர்மானங்களின்போதுகூட ஐ.நா.வின் வெவ்வேறு தளங்களில் ரஷியாவும் சீனாவும் பல நேரங்களில் மெüனமாக இருந்திருக்கின்றன.
அதே நாடுகள்தான் இப்போது இலங்கைக்கு ஆதரவாக வாக்களித்திருக்கின்றன. கியூபா ஒருபடி மேலேபோய், "இலங்கை எங்களது நண்பன்' என்றது.
பல்லாயிரக்கணக்கான மக்கள் கொல்லப்பட்டார்கள், அதற்கான நல்லிணக்க முயற்சிகள் ஏதும் மேற்கொள்ளப்படவில்லை என்று விவாதித்துக் கொண்டிருந்தபோது, முதலில் குவாண்டனாமோ சிறையை மூடுவதாக அறிவித்த வாக்குறுதியை நிறைவேற்றுங்கள், மற்றவற்றை பிறகு பார்க்கலாம் என்று ஒபாமாவைக் குற்றம்சாட்டியது கியூபாதான்.
""லிபியாவில் பன்னாட்டுப் படைகள் நடத்திய மனித உரிமை மீறல்களை விசாரித்து விட்டு இலங்கையை விசாரிக்கலாம்'' என்று விவகாரத்தின் திசையை மாற்றியது. இந்தியாவின் திருத்தத்துக்குப் பிறகுகூட, கியூபா தனது நிலையை திருத்திக் கொள்ளவில்லை.
இத்தனைக்கும் பிரபாகரன் எத்தகைய போரை நடத்தினாரோ, கிட்டத்தட்ட அதே மாதிரியான போராட்டத்தால் புதிய அதிகாரத்தைப் பெற்ற நாடு அது. அதை நடத்திய தலைவர்கள்தான் இன்றைக்கும் ஆட்சி செய்து வருகிறார்கள். அமெரிக்கா கொண்டு வந்த ஒரே காரணத்துக்காக இந்தத் தீர்மானத்தை கியூபா எதிர்த்தது என்றால், உண்மை நிலையை உணர்த்தி அந்த நாட்டை வழிக்குக் கொண்டுவர முடியாதது தமிழ் அதிகாரக் குழுக்களின் ராஜதந்திரத்துக்குக் கிடைத்த மிகப்பெரிய அடி என்றுதான் சொல்ல வேண்டும்.
இந்தியாவின் திருத்தம் தீர்மானத்தை வலுவிழக்கச் செய்தது என்றால், சீனா, ரஷியா, கியூபா ஆகியவற்றின் எதிர்ப்புதான் அந்தத் தீர்மானத்துக்கு "வழக்கமான அமெரிக்க தீர்மானம்' என்கிற தோற்றத்தை அளித்தது. இராக்கில் புகுந்தீர்கள், ஆப்கானிஸ்தானை தரைமட்டமாக்கினீர்கள், கடாஃபியை கொன்றீர்கள் இப்போது இலங்கைக்குள் நுழையப் பார்க்கிறீர்களா என்பது போன்ற கேள்வியை முன்னிறுத்தியது.
அந்த நாடுகளின் எதிர்ப்பையும் மீறி எண்ணிக்கை அடிப்படையில் தீர்மானம் வெற்றிபெற்றுவிட்டது. ஆனால், ஐ.நா.வின் பிற தளங்களுக்கு இதை எடுத்துச் செல்ல வேண்டுமானால், நிச்சயம் சீனாவும் ரஷியாவும் தமிழர்களுக்கு முக்கியம். கியூபாவை நம் பக்கம் இழுக்க வேண்டியது உணர்வுப்பூர்வமான பிரச்னை என்றால், சீனாவையும் ரஷியாவையும் இழுக்க வேண்டியதுதான் உண்மையான ராஜதந்திரப் பிரச்னை.

பிள்ளையையும் கிள்ளி தொட்டிலையும் ஆட்டும் செயலை மீண்டும் செய்துள்ளது இந்தியா!


வழமையாக இந்தியா தொட்டிலையும் ஆட்டி பிள்ளையையும் கிள்ளும் செயலைச் செய்யும். அதனையே இந்த விடயத்திலும் செய்திருக்கிறது.இரண்டு பேரையும் திருப்திப்படுத்துகின்ற வேலையை இந்தியா செய்திருக்கிறது. இதனை நாம் பெரிதாக அலட்டிக் கொள்ளத் தேவையில்லை என தெரிவித்துள்ள தமிழ் தேசிய கூட்டமைப்பு பாராளுமன்ற உறுப்பினர் பா.அரியநேத்திரன், சர்வதேசத்தில் கவனிக்கும் ஒரு விடயமாக தமிழரின் பிரச்சினை சென்றிருக்கிறது என்பது மாத்திரமே தற்போதைய நிலையில் முக்கிய விடயமாகுமெனவும் அவர் தெரிவித்தார்.
கொக்கட்டிச்சோலை, இராமகிருஸ்ண மிஷன் வித்தியாலயத்தின் வருடாந்த மெய்வல்லுனர் போட்டியில் பிரதம அதிதியாக கலந்துகொண்டு உரையாற்றும்போதே அவர் இவ்வாறு தெரிவித்தார்.
அவர் அங்கு தொடர்ந்து உரையாற்றுகையில்,
அது அகிம்சை ரீதியான போராட்டமாக இருக்கலாம், ஆயுத ரீதியானதாக இருக்கலாம். நாங்கள் பல இடங்களில் கூறியிருக்கிறோம் அகிம்சை போராட்டமும் தோற்றிருக்கின்றது, ஆயுதப்போராட்டமும் தோற்றதாக அரசாங்கம் கூறுகின்றது.
ஆனால் எங்கள் பிரச்சினை இன்று சர்வதேசத்திற்கும் சென்றிருக்கிறது. என்பதனைத்தான் நாங்கள் கூறியிருந்தோம். அது நேற்று முன்தினம் ஜெனிவாவில் அது அரங்கேறியிருக்கிறது. ஆனால் 24 நாடுகள் எங்களது பிரச்சினைக்கு ஆதரவு தெரிவித்திருக்கிறது.
இதில் இருந்து எள்ளளவும் விலக முடியாத நிலை ஏற்பட்டிருக்கிறது. இதில் பல சந்தேகங்கள் இருக்கின்றன. இந்த பிரேரணையின் போது, இந்தியா இரட்டைத்தன்மையான இராஜதந்திரத்தைக் கடைப்பிடித்திருக்கின்றது. இந்த இரட்டைத்தன்மை இராஜதந்திரம் என்பதை நாங்கள் விளங்கிக்கொள்ள வேண்டும்.
இந்தியாவுக்கு ஒரு அழுத்தம் இருந்தது. தமிழ் நாட்டு மக்களைப் பொறுத்தவரையில் சிறிலங்காவை எதிர்க்க முடியாத நிலை இந்தியாவுக்கு இருக்கிறது. அந்த நிலையில் தமிழ் நாட்டு மக்களின் உணர்வுகளை மதிக்க வேண்டிய கடமை இந்தியாவிற்கிருந்தது. இந்த இடத்தில் தான் இந்தியா இந்த இராஜதந்திரத்தைக் கொண்டிருக்கிறது.
ஜெனிவா பிரேரணையில் இரண்டு விடயங்கள் திருத்தப்பட்டதாக நீங்கள் அறிந்திருப்பீர்கள், அது என்ன விடயம் என்றால், இறமையுள்ள ஒரு நாட்டில் ஐ.நா சபை நேரடியாக தலையிட வேண்டும் என்று அமெரிக்கா கொண்டு வந்த பிரேரணையை, இந்திய அரசாங்கம் இலங்கையின் ஒப்புதலுடனேயே செய்ய வேண்டும் என அதனைத்திருத்தியிருக்கிறது. இரண்டு இடத்தில் இந்த வசனம் வருகிறது.
எங்களைப் பொறுத்தமட்டில் அந்த வசனம் இருந்தாலோ இல்லை என்பதோ பிரச்சினையல்ல. ஒரு நாட்டில் ஐ.நா.சபை தலையிடவேண்டும் என்கிற விடயம் வந்திருக்கிறது. ஒரு நாட்டில் ஐ.நா சபை தலையிடும் போது, நிச்சயமாக தன்னிச்சையாக நாட்டின் அனுமதியில்லாமல் செய்ய முடியாது. ஆனால் அது இல்லாதிருந்த போதும் இந்தியா அதனைச் செய்திருக்கிறது. அந்த வகையில் உலகத்திலுள்ள தமிழ் மக்களையும் காப்பாற்றியிருக்கிறது, மஹிந்த ராஜபக்ஷ்வையும் காப்பாற்றியிருக்கிறது.
ஜெனிவாவில் இலங்கைப் பிரச்சினை சென்றிருப்பதன் நோக்கம் எதிர்வரும் காலத்தில் அமெரிக்கா இதில் எதனை வகுத்து வைத்திருக்கிறது என்பதற்குப் பலரும் பல விளக்கங்களைக் கொடுத்திருக்கிறார்கள். ஆனால் இறுதி யுத்தத்தின் போது நடைபெற்ற மனித உரிமை மீறல்களுக்குத் தண்டனை வழங்குங்கள் என்றோ, முள்ளிவாய்காலில் கொல்லப்பட்ட இரண்டரை லட்சம் மக்கள் பற்றிக் கேட்கவில்லை.
இலங்கை அரசாங்கத்தினால் நியமிக்கப்பட்ட நல்லிணக்க ஆணைக்குழுவின் சிபார்சுகளை நடைமுறைப்படுத்த வேண்டும் என்றுதான் தான் அமெரிக்கா கேட்டிருக்கிறது. அதாவது, உங்களது அரசாங்கத்தால் நீங்களே நியமித்த குழு வழங்கிய சிபார்சுகளை நடைமுறைப்படுத்துங்கள் என்றுதான் கூறப்பட்டிருக்கறது. ஆனால் அதற்குக் கூட என்ன நடக்கிறது. அதனைக்கூட பரிசீலிக்க முடியாது என்று அமைச்சர் விமல் வீரவங்ச கூறுகிறார்கள்.
இலங்கையில் இருந்து சென்ற மூன்று ஊடகவியலாளர்கள் ஒரு தமிழர். பாக்கியசோதி சரவணமுத்து உடன் இன்னும் இரண்டு சிங்கள ஊடகவியலாளர்கள். மனித உரிமை விடயங்கள் பற்றி நேரடியாக ஜெனிவாவில் சொன்னார்கள். வாதிட்டார்கள். அவர்களுக்கு நாடு திரும்பியதும் காலை வெட்டுவோம் என்று அமைச்சர் மேர்வின் சில்வா கூறுகிறார். அவர் நினைக்கிறார் கால் என்பது முருங்கைத்தடியால் செய்யப்பட்டது, பப்பாசித்தடியால் செய்யப்பட்டது என்று நினைக்கிறார் அந்த அளவில்தான் இலங்கை அரசாங்கம் இன்று இருந்து கொண்டிருக்கிறது.
ஒரு அமைச்சர் ஒரு வார்த்தையை தேவையற்ற வகையில் வெளியிட்டால் அது நாட்டுக்குச் சொல்லுகின்றது என்றோ, அது நாட்டுக்கு அவமானது என்றோ இந்த நாடும் உணராது. இவ்வாறு அவர்கள் நடந்து கொள்வதும், கருத்துக்களை வெளியிடுவதும் தமிழ் மக்களுக்குக்கிடைக்கின்ற வரவு என்பதை அவர்கள் விளங்கிக்கொள்ள வேண்டும். இதற்குப்பின்னால் நீங்கள் என்ன செய்யவெண்டும் என்பதை உணர்ந்து கொள்ள வேண்டும்.
அந்த இடத்தில் தமிழ் தேசியக் கூட்டமைப்பினர் பற்றிக் கூறவேண்டும். தமிழ் தேசியக் கூட்டமைப்பு ஜெனிவாவுக்குச் செல்லவில்லை எனப்பலர் குற்றம் கூறினார்கள், இன்று தமிழ் தேசியக் கூட்டமைப்பின் இராஜதந்திரம் வெற்றியளித்திருக்கிறது. எமது தலைவர் சம்பந்தன் ஐயாவின் இராஜதந்திரம் எந்த அளவில் இருக்கறது என்பதற்கு ஜெனிவாவில் கொண்டுவரப்பட்ட இலங்கைக்கு எதிரான பிரேரணை வெற்றியளித்திருக்கிறது.
ஆகவே தமிழ் தேசியக்கூட்டமைப்பானது, தமிழ் மக்களுக்கான உரிமையை, சுதந்திரவாழ்வை பெற்றுக்கொடுப்பதற்காக அதன் பங்களிப்பை எந்தெந்த வழியில், முறையில் செய்ய வெண்டுமோ அந்தந்த முறையில் செய்திருக்கிறது என்பதை மக்கள் புரிந்து கொள்ள வேண்டும்.
அந்த வகையில் நின்றுதான் நாங்கள் எங்களை தீர்மானிக்கக்கூடிய நாங்கள் எங்களைப் பாதுகாக்கக்கூடிய ஒரு நிரந்தர அரசியல் தீர்வை வென்றெடுப்பதற்கு இந்த ஜெனிவா தீர்மானம் ஒரு ஆரம்பப் படியாக கிடைத்திரப்பதையிட்டு கொக்கட்டிச்சோலை, மட்டக்க்களப்பு மாவட்டமாக இருந்தாலும் வடகிழக்காக இருந்தாலும் நாம் அடைந்த இழப்புகளுக்கெல்லாம் ஒரு பரிகாரம் கிடைப்பதற்கான வாய்ப்பு என்பதை அனைவரும் புரிந்து கொள்ள வேண்டும்.

Sri Lanka steps up threats on journalists and NGO activists

In the wake of two powerful documentaries that have been released this year, ‘Silenced Voices’ by Norwegian film-maker Beate Arnestad, and Channel 4’s ‘Sri Lanka’s Killing Fields : War Crimes Unpunished’, and a resolution voted demanding domestic action by Sri Lanka, Colombo's media has increased threats against journalists and activists both in its territory and abroad as well. In a recent wave of smear campaigns, the state-owned Associated Newspapers of Ceylon Limited, better known as Lake House, and the state run Independent Television Network have targeted journalists, branding them as ‘terrorists’ and ‘traitors’. “Lake House, which controls many newspapers and TV stations, is using accusations of terrorism, separatism and collaborating with the LTTE as a weapon to undermine those who defend freedom of information and media freedom,” a release of Reporters without Borders said.

Among others, these targets include Bashana Abeywardane of the JDS, Dharmasiri Lankapeli of the Federation of Media Employees Trade Unions and Sunanda Deshapriya, a journalist and media freedom activist.

Bashana Abeywardane prominently featured in Ms. Arnestad’s documentary and in a minor segment in Channel 4’s latest release.

Likewise, Minister of Public Relations, Mervyn Silva has promised publicly in Kiribathgoda on Friday to break the limbs of journalists and NGO activists who had given evidence on Sri Lanka at the UNHRC, accusing them of being traitors.

“Ironically, these hate campaigns have come at a time when UN experts on human rights defenders are calling on governments to take steps to facilitate, rather than deter, civil society's safe and unimpeded access to the UN,” a joint statement by activists and journalists dated 21st March, forwarded by the Asian Human Rights Commission, said.

“We observe that such malicious attacks are carefully orchestrated by the authorities with the clear objective of deviating attention elsewhere when the human rights record of the government is being challenged nationally and internationally,” the statement further added.

The High Commissioner for Human Rights Ms. Navi Pillay also warned on Friday that there should be no reprisals on activists after the adoption of the pro-LLRC US resolution at UNHRC.

Projecting the watered down resolution passed at the UNHRC that doesn’t recognize the genocide committed on Eezham Tamils and that doesn’t call for international investigation, but stops only at implementing the flawed LLRC recommendations as a ‘first step to victory’ is sawing false hopes in the minds of Eezham Tamils, said Tamil National People’s Front (TNPF) in the island in a press release on Friday. Confining the phenomenon to mere war crimes, the application of limited pressure serves only the interests of certain competing powers that consider the whole island as a single unit to make their economic inroads. Certain forces use Tamil aspirations for only a regime change in the island, TNPF said.

Eezham Tamils have to beware of traps and false hopes in conceiving their political course, the TNPF further said in the press release.

சென்னை, மார்ச்.23: இலங்கைக்கு எதிராக அமெரிக்கா கொண்டுவந்து நிறைவேற்றியுள்ள தீர்மானம் நீர் மோர் என்றும் அதில் இந்தியா தலையிட்டது நீர்மோரில் மேலும் தண்ணீரை ஊற்றியது போலாகிவிட்டது என்றும் தேமுதிக தலைவர் விஜயகாந்த் தெரிவித்துள்ளார்.இதுகுறித்து அவர் வெளியிட்ட அறிக்கை: ஆள் கடத்தல், ஆட்களை காணாமல் செய்வது, ஆட்களை கொலை செய்வது போன்ற காரியங்களில் ஒரு அரசே ஈடுபட்டால் அது மனித உரிமை மீறல்களாகும். ஒரு போரில் சரண் அடைய வந்தவர்களை சுட்டுக் கொல்வதோ, போரில்லாத பகுதி என்று அறிவித்து அங்கு மக்களை சேர்த்து அவர்கள் மீது குண்டு போடுவதோ, மருத்துவமனைகள், பள்ளிக்கூடங்கள், வழிபாட்டு இடங்கள் ஆகியவற்றின் மீது தாக்குதல் நடத்துவதோ போர்க் குற்றங்கள் ஆகும்.2009ஆம் ஆண்டு மே மாதத்தில் இலங்கை அரசு தமிழினப் படுகொலையை நடத்தியதன் மூலம் இந்த இரு குற்றங்களையும் செய்துள்ளது. ஐ.நா. மனித உரிமைக் குழுவில் இலங்கை அரசு புரிந்துள்ள இந்த இரு குற்றங்களையும் ஐ.நா.வின் மேற்பார்வையில் விசாரிக்க வேண்டும் என்று அமெரிக்காவால் தீர்மானம் கொண்டு வரப்பட்டது. இதில் இந்தியா தலையிட்டு ஐ.நா. மனித உரிமை கவுன்சில் தன் விருப்பத்திற்கு இலங்கைக்கு ஆலோசனை கூறவோ அல்லது பிரதிநிதிகளை நேரடியாக அனுப்பவோ கூடாதென்றும், இலங்கை அரசின் சம்மதத்தை பெற்ற பிறகு ஐ.நா. செயல்பட வேண்டும் என்றும் அமெரிக்கா கொண்டு வந்த தீர்மானத்தை திருத்தியுள்ளது.அமெரிக்கா கொண்டு வந்த தீர்மானத்தின்படி ஐ.நா. மனித உரிமைக் குழு எதைச் செய்தாலும் அதை இலங்கை அரசு ஒப்புக் கொள்ள வேண்டும் என்று இருந்தது. ஆனால் இந்தியாவினுடைய திருத்தம் இலங்கை அரசின் சம்மதம் இன்றி ஐ.நா. மனித உரிமைக் குழு எதையும் செய்ய முடியாது என்ற நிலையை உருவாக்கியுள்ளது. அமெரிக்காவும் இந்தியாவை தன் பக்கம் தக்க வைத்துக் கொள்ள வேண்டும் என்று கருதி, இந்தியாவின் திருத்தத்தை ஏற்றுக் கொண்டு, அப்படி திருத்தப்பட்ட தீர்மானம்தான் தற்பொழுது நிறைவேறியுள்ளது.ஒரு நாட்டின் உள் விவகாரத்தில் தலையிட அனுமதிக்கக் கூடாதென்றும், அந்நாட்டின் இறையாண்மை மதிக்கப்பட வேண்டும் என்றும் இந்தியா இதற்கு காரணம் கற்பித்துள்ளது. இறையாண்மை என்பதன் மூலம் தன் சொந்த குடிமக்களையே கொன்று குவிப்பதற்கு எந்த அரசையும் அனுமதிக்கக் கூடாது என்பதாலும், உலக சமுதாயம் அதை வேடிக்கை பார்க்கக் கூடாது என்பதாலுமே ஐ.நா. மன்றம் அத்தகைய நாடுகளில் தலையிட்டு மனித சமுதாயத்தை காப்பாற்ற உரிமை வழங்கப்பட்டுள்ளது. இறையாண்மை என்பதன் பெயரால் உலகளாவிய மனிதாபிமான உரிமைகளை தடுக்கவோ, தவிர்க்கவோ எந்த அரசுக்கும் உரிமை இல்லை.போர்க் குற்றங்கள் நிகழ்ந்தாலோ, இனப் படுகொலை நடந்தாலோ அதை தடுத்து நிறுத்த எந்த நாட்டிலும் தலையிடலாம். அதை ஒரு நாடு உள் விவகாரம் என்று சொல்லி தப்பித்துக் கொள்ள முடியாது. இந்த அடிப்படையிலேயே தமிழினப் படுகொலை சம்பந்தமான தீர்மானம் மனிதாபிமான அடிப்படையிலும், போர்க் குற்றங்கள் நிகழ்த்தப்பட்டன என்ற அடிப்படையிலும் ஐ.நா. மனித உரிமைக் குழுவில் கொண்டு வரப்பட்டுள்ளது. அமெரிக்காவின் தீர்மானம் நீர் மோர் என்றால் இந்தியாவினுடைய தலையீடு அதில் மேலும் தண்ணீரை சேர்த்து நீர்த்து போகச் செய்து விட்டது.இலங்கையை குற்றவாளிக் கூண்டில் நிறுத்த வேண்டும் என்ற போக்கை மாற்றி, அதை அப்பாவி நாடாகக் கருதுகின்ற அணுகுமுறையையே இந்திய அரசு மேற்கொண்டது என்று இந்திய அரசின் அதிகார வர்க்கம் தெரிவித்துள்ளது. இலங்கையைப் பொறுத்த வரையில் இந்தியா கொண்டு வந்த திருத்திய தீர்மானத்தின் மூலம் தங்களுக்கு இந்தியா மிகப் பெரிய சலுகையை செய்துள்ளது என்று இலங்கை அதிகார வர்க்கம் மகிழ்ச்சி அடைந்துள்ளது.எனினும் ஐ.நா. மன்றத்தில் அமெரிக்கா கொண்டு வந்த இந்த தீர்மானத்தின்போது, இந்திய அரசு வெளிப்படையாக இலங்கை அரசின் பக்கம் சாயாமல் இந்த தீர்மானத்தை ஆதரித்துள்ளது. இந்த தீர்மானம் நிறைவேறியதன் மூலம் இலங்கை அரசு உலக நாடுகளின் கண்டனத்திற்கு ஆளாகவில்லை என்றாலும், கண்காணிப்புக்கு ஆளாகியுள்ளது என்பது திருப்தி அளிக்கிறது.

Watered-down resolution passes in UNHRC, stops short of international investigations

The UN Rights Council on Thursday approved the LLRC-based US-tabled resolution urging Colombo to probe Human Rights violations domestically with assistance and advice from the UN rights body. The resolution stopped short of calling for an international investigation. In the 47-member UNHRC, 24 countries including India, voted for the resolution while 15 voted against. 8 countries abstained. Meanwhile, Chinese news agency Xinhua reported SL minister Laksman Yapa Abeywardene as saying that Colombo's relationship with close neighbor India and powerful USA would not be changed despite the resolution passed in UN Human Rights Council. "Whatever decisions taken by India and the U.S. with regard to the resolution, that will be limited to that issue only," the Sri Lankan minister said.

Meanwhile, India's External Affairs ministry issued a statement echoing Colombo's concerns that the primary responsibility for the promotion and protection of human rights lies with the States. “Consequently resolutions of this nature should fully respect the sovereign rights of states and contribute to Sri Lanka's own efforts in this regard,” the Indian statement said.

“While we subscribe to the broader message of this resolution and the objectives it promotes, we also underline that any assistance from the Office of the High Commissioner on Human Rights or visits of UN Special Procedures should be in consultation with and with the concurrence of the Sri Lankan Government,” the Indian statement said.

Observers in Tamil Nadu said that the Indian statement contradicted the demands put forward by Tamil Nadu Chief Minister Ms. J. Jayalalithaa, who had demanded India to declare SL President Mahinda Rajapaksa complicit in genocide and war-crimes and to call for economic sanctions against Sri Lanka till the country ensured equal status to Tamils.

The Indian statement further said that a “democratic country like Sri Lanka has to be provided time and space to achieve the objectives of reconciliation and peace. In this Council we have the responsibility to ensure that our conclusions do contribute to this objective rather than hinder it. ”

Further, the Indian statement expressed hope in Sri Lankan measures saying that “this Council has also been briefed by the Government of Sri Lanka in this session on the series of steps taken to implement the report and other measures. We welcome these steps. We are confident that implementation of the report will foster genuine reconciliation.”

Sri Lanka's Foreign Minister G.L. Pieris, paramilitary leader and SL minister Douglas Devananda and Plantation Industries Minister Mahinda Samarasinghe were present in Geneva to oppose the resolution.

China, Russia, Cuba, Bangladesh, Maldives, Thailand, Indonesia, Philippines, Saudi Arabia, Uganda, Kuwait, Qatar, Congo, Mauritania and Ecuador are the countries that voted against the resolution while Malaysia, Senegal, Jordan, Kyrgyzstan, Botswana, Burkina Faso, Djibouti and Angola abstained.

The countries that voted for the resolution are: United States, India, Norway, Switzerland, Benin, Cameroon, Libya, Mauritius, Nigeria, Chile, Costa Rica, Guatemala, Mexico, Peru, Uruguay, Austria, Belgium, Italy, Spain, Czech Republic, Hungary, Poland, Moldova, and Romania.
