SLA interferes, sabotages civil group's public awareness event

[TamilNet, Tuesday, 25 June 2013, 02:15 GMT]
Sri Lanka Army (SLA) had interfered and had stopped Mannaar Government officials from attending an event organized by the Mannaar Citizen's Committee (MCC) to bring awareness of the laws and regulations governing ownership and transfer of lands, the President of MCC, Rev. Fr. Emmanuel Sebamalei, said in a media release issued during the second week of June. The agenda for the first two days of the event held for the NGOs was carried out without any difficulty, the organizers said, but that they had protested to the attendance of an SLA Intelligence officer during the first day of the seminar. Consequently, the organizers believe, the SLA took action to disrupt the event aimed at the Government officials, the memorandum said.
"We have observed discrimination in handling of state and private land matters in the Mannar district (and more broadly in Sri Lanka) and thought some awareness is necessary for the ordinary people and NGOs, especially those involved in dealing with housing matters under various housing schemes," MCC's memorandum said.

The memo further said, "The Army as well as the Navy has arbitrarily occupied land without any land related laws and administrative procedures being followed in the Northern Province for number of years. In the last few months this has become very critical and controversial, with the Army trying to occupy more land and local people, politicians, clergy, civil activists protesting and thousands of people filing court cases against the military and the government."

"In view of this, the MCC organized an awareness program about laws related to land, through the Center for Human Rights and Development (CHRD) based in Colombo," the memorandum said.

The MCC cautioned that "unlawful intrusions by the military into the activities of government officials, as well as the civil society, will continue," if the army officials who sabotaged the event are not identified and held accountable for their actions.

Girl student sexually assaulted in Batticaloa near SLA, STF camps

Girl student sexually assaulted in Batticaloa near SLA, STF camps

[TamilNet, Monday, 24 June 2013, 01:36 GMT]
Tamil women from the East continue to be vulnerable to sexual assaults allegedly at the hands of Sinhala men even as another incident of sexual assault on a 17-year-old student was reported in Batticaloa district on Thursday last week.

A girl student from Veappaveddavaan village was rescued from a bush in a sexually abused state on Thursday.

The girl was sexually assaulted in Chengkaladi - Badulla A5 Highway that comes under Karadiyanaa’ru police limits within the division of Ea'raavoor-pattu (Chengkaladi) of the Batticaola district.

The girl is studying arts at GCE (A/L) level at Thannaamunai Va'lanaar School.

On June 20, she had reportedly left for the educational institution and was on her way to home when the abuse took place at Theakkangcheanai after the girl had got down from a bus.

It is reported the miscreants who committed the shameful act remain ‘unidentified’.

A Sri Lanka Special Task Force (STF) camp is situated at Iluppaiyadich-cheanai where the girl had got down from the bus. A Sri Lanka Army (SLA) camp is situated close to the site at Maavadi-oadai.

It may be recalled that a 45-year-old woman was abused last May by four Sinhalese men in the Batticaloa district.

In the meantime, SL military intelligence officers of the occupying Sri Lanka Army (SLA) in the north of Vaakarai are reportedly frequenting the houses of former LTTE members and combatants under the pretext of investigations and are attempting to sexually harass the wives while keeping their husbands in prolonged detention.

Snowden, Thulasi force US into legal extradition quagmire

Snowden, Thulasi force US into legal extradition quagmire

[TamilNet, Monday, 24 June 2013, 00:04 GMT]
In 2008, the United States Government requested the extradition of Eezham Tamil defendant, Thulasitharan Santhirarajah, from Australia for an alleged offense in providing material support to a "terrorist" organization, and now the US is requesting, or will request, the extradition of Edward J Snowden from Hong Kong, and other likely destinations of Snowden, for alleged offenses of “unauthorized communication of national defense information” and “willful communication of classified communications intelligence information to an unauthorized person." In the Thulasitharan case, the Melbourne Court determined that the charged offenses are "either pure or relative political offenses," and in the high-profile Snowden case, legal experts acknowledge that U.S. will likely meet with the same fate for similar reasons.

The U.S. Justice Department's complaint in the Eastern District Court of Virginia contained three charges that the defendant Snowden violated the provisions of:
  • 18 U.S.C. 641 Theft of Government Property
  • 18 U.S.C. 793(d) Unauthorized Communication of National Defense information
  • 18 U.S.C. 798(a)(3) Willfull Communication of Classified Communications Intelligence Information to Unauthorized Person
Edward J Snowden
Edward J Snowden
While legal experts believe Snowden admitted to the disclosure of secret information, and therefore, have lost any legal defense against the violations, other factors, domestic and international, might frustrate the US Government interests in prosecuting Snowden.

Locally, while NSA snooping has been deemed 'legal,' scholars believe that the NSA activities are likely unconstitutional and that the US Executive overreach has dangerously compromised "expectations of privacy." Snowden episode has triggered substantial debate in the media, making the issue an embarrassing political setback for the current US administration, giving the matter a political character.

In Santhirarajah v. Attorney General (Australia) the court determined that the AG erred in several legal issues, the two pertinent to Snowden case are that:
On the political offense exception issue the four offenses charged by the US are "either pure or relative" political offenses, and therefore, the AG violated the exception clause in approving the extradition

On the torture issue the AG erred in forming her satisfaction that the applicant will not be tortured. The court further added that the AG, in this issue, misunderstood that the obligation of the US was different from that of Australia under Article 3 of the UN Convention against Torture (CAT).
Historically, in jurisprudence, there has been tension between positive law, i.e., written law of a society...legal rules, statutes, regulations, and natural law, i.e., moral, ethical principles inherent in human nature. Snowden and Santhirarajah's actions likely fall into the space which can be reasonably characterized as morally defensible, and prosecuting individuals for such alleged crimes, while legal, are considered to fall under the political exception regime. While U.S. administration will argue the legality of its charges under positive law, Snowden may triumph with his increasing world-wide support underpinned by the natural law claims.

"There is a bar under Hong Kong's extradition law to extradition for an offence that is of a political character, [where] the prosecution is thought not just to be the application of the criminal law, but to crush that person or to crush their dissent," a Hong Kong based immigration lawyer, Mr Parker, told the BBC.

Another hurdle to extradition is related to the "well-founded fear of persecution," a doctrine that evolved from the asylum cases that help determine non-refoulement.

In Thulasitharan's case, the Melbourne court believed that the AG erred in her judgement in determining that the defendant will not face torture if he was extradited.

Similarly, a handover could also be halted if Mr Snowden was believed to be in danger of receiving inhumane treatment in the US, according to Mr Parker.

The treatment of Bradley Manning, the Army private who was charged for sending war-related and other classified U.S. documents to WikiLeaks, while in solitary confinement, which was described by the UN special rapporteur on torture as "cruel, inhuman and degrading", may bolster Snowden's chances of avoiding a US trial altogether by fighting extradition.

"In terms of seeking asylum, Snowden would definitely qualify in terms of fear of persecution," a legal expert said. "Bradley Manning would be exhibit A in that argument."

International media reported that, Snowden, after flying to Moscow, has sought asylum in Ecuador, and is speculated to be travelling to Ecuador via Cuba soon. Wikileaks staff and legal counsel are said to be assisting Snowden, according to reports.

Meanwhile, US officials watching Mr Snowden’s movements from afar, "expressed private and public fury with both Russia and Hong Kong," and also cancelled Snowden's passport.

Ibsen’s Doll’s House translated into Eezham Tamil in Norway

Ibsen’s Doll’s House translated into Eezham Tamil in Norway

[TamilNet, Monday, 24 June 2013, 00:02 GMT]
Modernism’s world famous playwright Henrik Ibsen’s Et Dukkehjem (A Doll’s House) has found earlier translations in Tamil. But what is special about the present translation by Kasinather Sivapalan is that it is in spoken Eezham Tamil, making the reading and staging of the play homely to Eezham Tamils in their country and in the diaspora across the world. A Doll’s House, written in 1879 and said to be the world’s most performed play by the early 20th century, is not new to Eezham Tamils. Even 50 years ago it was staged in Jaffna, scripted in Tamil and directed by veteran writer, the late Mr E. Mahadeva (Thevan-Yaazhppaa’nam), who was Mr Sivapalan’s teacher at Jaffna Hindu College. The current translation by Mr Sivapalan, produced in Norway where he is in exile now, comes as a publication of Mithra Arts and Creations in Chennai.

Born in 1944 to teacher parents at Pa’l’lik-kudiyiruppu in the Trincomalee district of the country of Eezham Tamils, Mr Sivapalan is an Attorney-at-Law in Ilangkai, Solicitor (England and Wales) and Barrister and Solicitor (Australian Capital Territory).

Mr Sivapalan was a founder member and Deputy Chairperson of the NorthEast Secretariat on Human Rights (NESoHR), established in 2004 and envisaged as a human rights commission for the evolving State of Tamil Eelam. After the assassination of its Chairperson Rev Fr. M X Karunaratnam by Sri Lankan armed forces in 2008, Mr Sivapalan had to escape from the island. He found asylum in Norway. NESoHR is recently revived in exile, with Mr Sivapalan as its Chairperson.

What makes Sivapalan’s translation of Ibsen’s play a remarkable success is his long experience and expertise in theatrics, says veteran Eezham Tamil stage artist, playwright and director, A C Tarcisius, writing a foreword to the translation.

Mr Sivapalan was pivotal in founding Naadodika’l Theatre Group in 1969, and he inspired him in conceiving the idea of designing a curriculum to train stage artists, Tarcisius further says. Sivapalan has also founded another theatre group Munnoadika’l in Trincomalee.

Apart from Tarcisius’s foreword in Tamil, Prof Ilangko Balasingham of the Norway Oriental Fine Arts Academy and Prof A Mangai of Stella Maris College, Chennai, have also written a foreword and an introductory note in Norwegian and in English respectively to the translation appearing with the title “Pe’n Paavai.”

Henrik Ibsen (1828–1906), born in Norway in a family of Danish–Norwegian ancestry, is regarded as one of the founders of modernism in theatre, the father of realism, and as the most frequently performed dramatist in the world, after Shakespeare.

For 27 years he was living in Italy and Germany in a self-imposed exile and A Doll’s House was published in 1879 while he was in Germany.

A Doll’s House is acclaimed as a pioneer revolutionary theatrical piece and literature that had a tremendous impact on feminist thinking in the West. It universalised the issue of gender throughout the world, literary critics say.

But the universalism in Ibsen’s play is more than the issue of gender.

The realisation and courage of the main character Nora in the play, in defying the society-imposed norms of the institution of ‘home’ in seeking liberation, and her decision to leave home, husband and even children, are also applicable to people on whom the institution of State (however genocidal it is) is imposed as the norm to follow by the world’s Establishments.

When Helmer the husband says that he would be prepared to ‘change,’ Nora implies that it may be considered at another time if that miracle happens, but then she has no faith in miracles. Even for that change they should first get separated, Nora insists.
Pe'npaavai
There was no physical violence, but psychological violence is worse than that.

In the context of Eezham Tamils as a genocide-affected nation, Nora should be an inspiration for those who are still conditioned by the norm and name ‘Sri Lanka’ or by ‘being Sri Lankan and being Tamil’, to realise and to break away.

Any Eezham Tamil who consciously reads the play would feel the universalism transcending gender.

Sivapalan has not chosen the task of translating A Doll’s House just to mark his life in Norway.
