Understanding obstacles in structuring people’s struggle for self-determination

How do we save national struggles from decimation and structure these struggles as people-centric? This is the uppermost question we have to address in right earnest, observed, Mr Saba Navalan, the editor of inioru.com in the UK, in reading a paper on Sri Lanka’s case study in the 21st century’s movements for self-determination, at an EU-level conference convened by IBON International that took place in the European Parliament last Monday. According to Mr Navalan’s observations, an obstacle in the realization of self-determination is that the upper layer of each ethnic group is held by pro-imperial forces and despite having fundamental contradiction, the upper middle class, in the absence of national capitalism, is comfortable about its association with the pro-imperial class.

The struggle for right to self-determination is closely associated with anti-imperialism. But in the case of the struggle of Tamils in the island, all their liberation movements were somehow associated with the major imperial powers, which historically destroyed national struggles in various parts of the world. How this is possible? How those fundamentally contradictory forces collaborate with each other, Navalan touched on a question still unaddressed by the incumbency leadership of Eezham Tamils, while facts clearly show who are the ultimate adversaries and where the struggle has to be addressed at now.

The island’s war generation has learnt a political lesson. At least a small section of population now understands what imperialism is taking place. This section of population looks up to the struggle of other oppressed nationalities, instead of looking up to the super powers, Navalan observed.

“The new generation of the oppressed ethnic groups recognizes the struggle of those fighting for self-determination in Kurdistan, Kashmir, Nagaland, and Baluchistan, which was not the case during the past 30 years of war. Thus, the powers, which targeted the self-determination struggle, have inadvertently helped the innocent people learn lasting and valuable political lessons,” he further observed.

The IBON conference was on Democracy, Self-Determination and Liberation of Peoples. Two MEPs of European United Left–Nordic Green Left and the Greens/ European Free Alliance have supported the initiative.

The conference call cited the proclamation of Universal Declaration of Human Rights, 60 years ago; 1976 Algiers declaration stressing on collective rights and the right to fight for liberation by peoples under foreign or local oppression and the1986 UN General Assembly approval on the collective rights, and has said that today these rights are in danger. However, the conference call was carefully avoiding the word nations.



While pro-imperial upper layer and collaborating upper middle class are impediments in leading the Tamil struggle in the anti-imperialist direction, certain ‘socialist’ sections that are no less different from the imperialists in harping on a ‘united Sri Lanka’ for their own ‘geopolitics’, are also equally an obstacle, commented Tamil activists for alternative politics in the island, citing at a recent article in the World Socialist Web Site by Mr K. Ratnayake that appeared on 31 August.

Mr K. Ratnayake of the Socialist Equality Party of Sri Lanka, who was responding to a TamilNet feature of 1st July by a Tamil activist for alternative politics, was challenging a statement in the feature saying that “Mr Ratnayake, who overlooks the Tamils’ struggle for sovereignty resisting genocidal occupation of their homeland by the GoSL, is consciously or unconsciously defending the state structure that he claims to criticize.”

“The SEP rejects the claim of the Eezham activist that the failure to support the demand for a separate Eelam means support for the unitary genocidal Sri Lankan state,” Ratnayake said.

“The Eezham activist, TamilNet and the various Tamil bourgeois parties can keep peddling the lie that some form of self-determination or a separate capitalist state is the sole solution for Tamils, only by maintaining a complete silence on the political lessons of the war,” he accused.

Talking of a “fight for socialism in Sri Lanka and internationally,” Ratnayake was harping on a “revolutionary struggle to establish the socialist Republic of Sri Lanka and Eelam.

What is the ideological justification for keeping the island as one unit in the struggle for socialism, when the manifestations of oppression faced by Eezham Tamils and Sinhalese are identifiably and provably different in the island for several decades now, the Tamil activist asked.

It is for the imperial powers of geopolitical greed, the foremost agenda is to keep the island as one unit, whatever the cost may be – even if it is genocide. Do the ‘socialists’ also have the same ‘geopolitics’ in their outlook for bringing in ‘World Socialism’; asked the activist.

The Tamil National Alliance and other parties are lining up with US imperialism as it prepares for conflict against China after a decade of brutal neo-colonial war in Afghanistan, Iraq, Libya and Syria, Ratnayake observed.

He may be partly right about the gagged and hapless ‘bourgeois’ politicians of Tamils, who may be taking that line hoping for at least crumps to come out of it. But why should they worry about the Establishment in China, the activist asked.

Ratnayake traces the origins of anti-imperialism of socialist and internationalist perspective in the island to Trotskyist Bolshevik Leninist Party of India in the 1940s. The origins of Left movement among Eezham Tamils were much earlier than that. There were a series of occasions for Eezham Tamils to steer the course of their struggle with a Left orientation.

But every time it was thwarted and discredited within the Tamil public by the Left in the South refusing to see Tamils as a nation, by they harping on one socialist State that would ostensibly and automatically give the leadership to ‘majoritarian socialists’ and by the endorsement this brand of Leftism was getting from the then international godfathers of socialism or communism.

The World Socialist Web Site has not changed in any way from that ‘heritage’, even after seeing how the one-State policy of both the bourgeois imperialists and social imperialists has led to the genocide in the island. It will not change ether, if the priority of ‘socialist geopolitics’ too is to provide space for the one-State mania of majoritarianism in the island, the Tamil activist commented.

After staging one of the worst genocides humanity has seen–this time a paradigm setting one experimented jointly by all the major Establishments of the world–a torturing structural genocide is now conducted almost as a daily routine against the remaining Eezham Tamils and their nation in the island. This is facilitated by an agenda agreed upon and legitimised at Geneva by the ultimate culprits, especially New Delhi and Washington. The pressure that is now exerted on Tamil leaders to accept the 13th Amendment or any provincial deception under the unitary constitution of the genocidal State, whether in the guise of a ‘starting point’ or not, aims at making Tamils to confirm their own genocide. In the last four years both New Delhi and Washington proved nothing in stopping the structural genocide, but demonstrated only to the contrary, commented a Tamil activist for alternative politics.

Further comments from the activist in the island:

Ancient texts of India talk of four strategies in facing adversaries: Saama (peaceful approach), Daana (donation), Bheda (show of difference/ non-cooperation) and Danda (armed action).

A Saama or peaceful struggle of decades failed with genocidal Colombo, Even the peaceful pleadings of Tamils in the last four years fell on an international community pretending deaf and blind, but actively competing in facilitating the genocidal State. Of course, the Tamils don’t have anything to give as Daana now, as everything is occupied and seized. The IC tilting the balance has crushed Danda, the armed struggle.

In their long struggle, if the Tamils have not given any serious consideration to a strategy so far, that is the third one, Bheda (non-cooperation), and that is the only one they could do now in spearheading the struggle. Mahatma Gandhi made an effective use of the strategy in the struggle against a world empire.

Tamils in the island, in Tamil Nadu and in the diaspora should have no hesitation in boldly showing Bheda to the ultimate culprits, who because of their own interests or because of the need to appease the Sinhala State for their interests, dare to talk to the genocide-affected nation of Eezham Tamils to ‘start’ with unitary solutions.

Eezham Tamils and their politicians should never forget that the genocide was staged and is being continued by New Delhi, which they were always looking upon as saviour, and by the Washington-led West with which they never had any qualms in history. Yet the two didn’t hesitate on staging the genocide. It is time to ask that how could we ‘cooperate’ any further with our own genocide.

Detractors of non-cooperation and advocates of collaboration have been planted among Tamils at every place.

Those who advocate ‘cooperation’ with the provincial model in a unitary State as a ‘starting point,’ know well and have seen well, how the model, especially after the war, has become the starting point of a bulldozing structural genocide in the East. Yet they speak of ‘starting’ that in the North too. They are also prepared to welcome the unitary constitution giving special status to Buddhism proposed by the UNP, in order to satisfy the ‘regime change’ masters. Rather than exposing them, Tamils expect that they should mend their ways.

In the inevitability of not shunning the Northern PC election and in facing the ground realities, the TNPF leader, Mr Gajendrakumar Ponnambalam advises open denouncement of the model even as a starting point, and to field a set of independent and committed candidates commonly supported by the Tamil national parties.

Either through such an elected body or by other means in other eventualities, Eezham Tamils should plan and be ready for a non-cooperation struggle.

The PC deception should never be allowed to provide excuse to an anti-humanity Commonwealth of Establishments that will be meeting at the backyard of Rajapaksa this November, or to serve the enactment of another round of confirmation of genocide at Geneva by Washington and New Delhi.

In their struggle, Tamils need not worry about the ‘bear hug’ of Beijing or ‘economic expansion’ ambitions of New Delhi or ‘regime change’ imperialism of the USA that aim at sustaining the genocidal State, because none of them would ideologically or otherwise justify the credibility of these Establishments in the long run. Eezham Tamils have a universal case for humanity and they should succeed if they are fearless in showing non-cooperation with injustice, and if the global Tamils cast their weight in the process.

The Eezham Tamil grassroot may have to bring in new leadership that has faith in people’s power; that has the ability to mobilise people’s power; that gets its power from the people and that invites the ‘diplomats’ to come to it rather than going to them. Never forget that non-cooperation is an effective way of democratic struggle, especially in struggles facing imperialism. With confidence coming from the Tamil Nadu upsurge to embark on a new genre of struggle, Eezham Tamils should know converting the solidarity into a joint people’s power rather than detracting it or hijacking it. The Tamil Nadu upsurge cannot be silenced like the defeatists silencing the diaspora uprising. New Delhi and Washington may brush aside the upsurge by adamantly passing an empty resolution. But the effects of the upsurge are already showing and it depends on how the struggle is going to be led further.
The ritual at Geneva was over for this year, with the USA and India as main players enacting another crime in the series–this time an open assault on the international justice Eezham Tamils deserve and grant of further international confirmation to the structural genocide carried out in the island in the name of LLRC implementation.

The OHCHR could now once again count the trees and there will be another display of ‘Tamil wounds’ before the next round, just for the designers of the genocidal war to extract some more of what they want in the island.

Genocidal integration inside the island is now almost openly accepted in exchange for imperialists’ integration of the island. Whether the Sinhalese have understood it or not the on-going upsurge in Tamil Nadu shows that the new generation there has understood it with clarity.

Tomorrow if China says that it would openly help Sri Lanka in the genocide, India should immediately come forward competing to do it better for Sri Lanka – this is the line of thinking a leading ‘national’ newspaper of India was implying on Thursday on the issue of India building satellites for Colombo in competition with China.

Both the USA and India that have no qualms in citing ‘national’ interests in doing every thing, deny nationalism for genocide-affected Eezham Tamils, saying it is out dated. Perhaps the CPI-M may able to explain it ideologically.

Just before the worst carnage at Mu’l’livaaykkaal, the then Indian Foreign Minister and the current President of India, Mr Pranab Mukherjee, came out with a misleading statement on the number of people inside the war zone and the then Home Minister and the present Finance Minister Mr P. Chidambaram came out with a deceptive statement to quell public upsurge that the war was over, implying that the people were safe.

Chidambaram came out with a similar statement on Thursday about India strengthening the US resolution at Geneva, while it was doing the opposite. But Indian media entered into a campaign especially outside of Tamil Nadu, giving an image saving the Establishment. Now, there are other elements that harp on a verbal statement made by the Indian representative at Geneva to prove the ‘strong’ stand of India.

The aim is to create confusion and diffuse the uprising in Tamil Nadu.

But what is worse is that some of those who were put at ‘articulating’ positions in the diaspora polity hastily jumping at pre-empting any public uprising in the diaspora and sending signals to Tamil Nadu by defending the US resolution that there is ‘something’ achieved by it now and it is a defeat for Rajapaksa. They shield the fact that the ‘something’ is the crucial foundation to complete the structural genocide.

The way such articulators ‘thank’ the student movement in Tamil Nadu sounds like ‘now stop it as we have achieved something.’

There is another section of diaspora articulators who believe that the student upsurge in Tamil Nadu, like the diaspora taking to streets during the war, has not achieved anything and the ‘something’ was achieved only by their ‘diplomatic’ manoeuvres at Geneva.

This section draws a line between those who have the ‘privilege’ of acquaintance with diplomats and those who don’t have, and frowns at the latter for spoiling the game by addressing the struggle against the US-tabled resolution.

These sections don’t accept that their polity with the powers, compromising with crucial fundamentals, miserably failed. They are not even prepared to take up and disseminate the spirit of the student upsurge in Tamil Nadu. They prevent the empty resolution getting rejected outright by Eezham Tamils and leading to a new stage of people’s struggle.

Unless such a polity in the diaspora is addressed to its edification by the grassroot in the diaspora, the next stage of the struggle is not possible. The grassroot may have to find ways of bringing in new leadership that has faith in people’s power; that has the ability to mobilise people’s power; that gets its power from the people and that invites the ‘diplomats’ to come to it rather than it going to them.

The same is applicable to the Tamil polity in the island. Always beware of getting ‘invitations’ to Washington and New Delhi or playing the liaison, before doing work at the ground, gaining people’s confidence and consolidating the people’s power.

Nothing will be lost but there are chances of only gaining, if the Eezham Tamil politicians and civil outfits in the island and the activists, articulators and intellectuals in the diaspora in unison completely boycott dealing with the diplomats and agencies of the powers concerned, in protest of what they are doing to Eezham Tamils.

Even when the polity ‘collaborates’ this is what they do Eezham Tamils, and they will do only what they have pre-decided, then they cannot do anything worse when there is a boycott of them either. But chances of forcing them to listen are much higher.

Eezham Tamil public in the island and in the diaspora may first start with boycotting the politicians, activists and articulators, propped up by the powers and in turn prop up the powers.

Never forget that non-cooperation is an effective way of democratic struggle especially in struggles facing imperialism.

This doesn’t mean that Eezham Tamils should not represent themselves in telling their position in the international forums. But the present culture and outlook of the lobbyists and their lobbyism that are apologetic in asserting to fundamentals and in addressing the real adversaries should be completely replaced by a new generation.

For those who worry about the number of Eezham Tamils in effectively deploying the power of non-cooperation, the awakening and solidarity that now come from the youth of Tamil Nadu should provide confidence. But Eezham Tamils, especially those who are in the diaspora, should know how to build up that solidarity into a joint people’s power rather than detracting it or hijacking it.

On the part of the youth uprising in Tamil Nadu, it cannot be silenced like the defeatists in the diaspora silencing the massive diaspora uprising following the genocidal end of the war.

New Delhi and Washington may brush aside the upsurge by adamantly passing an empty resolution. But the effects of the upsurge are already showing and it depends on how the struggle is going to be led further.

Whether perceived as a drama or not, Mr. Karunanidhi coming out of the New Delhi Establishment and his ‘confessions’ are a significant development. The DMK has to now prove what it has said if the resolution was not going to be justifiable.

The Tamil Nadu government of Ms Jayalalithaa cannot continue any further in speaking the language of the International Crisis Group when coming to solutions.

காவேரியில் இருந்து தமிழகத்திற்கு உரிய தண்ணீரை வழங்க வலியுறுத்தி தமிழ் அமைப்புகளை திரட்டி போராட்டம் நடத்தப்படும் என்று வீரப்பன் மனைவி முத்துலட்சுமி கூறினார். திருச்சி, தஞ்சாவூர், நாகப்பட்டிணம், திருவாரூர், கடலூர் உள்ளிட்ட காவேரி டெல்டா மாவட்டங்களில் சுற்றுபயணம் செய்த வீரப்பன் மனைவியும், மலைவாழ் மக்கள் உரிமை இயக்கத்தின் தலைவருமான முத்துலட்சுமி உளுந்தூர்பேட்டை வந்தார் அங்கு அவர் நிருபர்களுக்கு பேட்டியளித்தார். அப்போது அவர் கூறியதாவது:-

கன்னட அமைப்புகள் தமிழர்களுக்கு எதிராக செயல்பட்டு வருகிறது. தமிழகத்தில் இருந்து கன்னடத்திற்கு பஸ்கள் செல்ல முடியாத நிலை ஏற்பட்டுள்ளது. அவர்கள் ஓசூர் வரை வந்து போராட்டங்கள் நடத்தி வருகின்றனர். இவற்றை கன்னட அமைப்புகள் கைவிட வேண்டும். இங்கு விவசாயிகளுக்கு தண்ணீர் கிடைக்கவில்லை.

இந்த நிலை நீடித்தால் விவசாயம் பெருமளவில் பாதிக்கும். கன்னட திரைப்பட இயக்குனர் ரமேஷ் கன்னடத்தில் அட்டகாசம், தமிழகத்தில் வனயுத்தம் என்ற பெயரில் ஒரு சினிமா படம் தயாரித்துள்ளார். அதில் எனது கணவர் வீரப்பன் போல் வேடமணிந்தவர், மம்மட்டியான் 4 கொலை செய்தான். நான் 500 கொலை செய்தேன் விளம்பரத்திற்காக என கூறும் ஒரு வசனமும் அந்த படத்தில் உள்ளது. அதனால் அந்த படத்தை தடை செய்ய வேண்டுமென கோர்ட்டில் வழக்குதொடர்ந்தேன். அதற்கு அந்த படத்தை போட்டு பார்க்க எனக்கு கோர்ட் அனுமதி அளித்தது.

அதில் உள்ள பாதிப்புகளை நான் கோர்ட்டில் தெரிவித்தேன். அந்த காட்சியை நீக்க வேண்டும். இது வன்முறையை தூண்டுவதுபோல் உள்ளது. என் கணவர் எந்த நீதிமன்றத்திலும் குற்றவாளியாக நிறுத்தப்படவில்லை. அவர் செய்த தவறுகளை ஒரு திரைப்படமாக வந்து அது இளைஞர்களின் மனநிலையை தவறான நிலைக்கு கொண்டு செல்லும். இந்த திரைப்படம் வெளியே வந்தால் தமிழக இளைஞர்கள் தவறான பாதையில் நடக்க நேரிடும். எனது கனவர் செய்த தவறின் காரணத்தினால் எனது குடும்பமும், மலைவாழ் மக்கள் எவ்வளவோபேர் பாதிக்கப்பட்டுள்ளனர். இனிவரும் காலங்களில் மக்கள் மத்தியில் வண்முறையை தூண்டும் வகையில் எதுவும் அமையக்கூடாது என்பதால் தான் நீதிமன்றம் வரை சென்றுள்ளேன்.

இதற்கு மக்கள் ஆதரவு எனக்கு கிடைக்க வேண்டும். எனது கணவரின் 8-ம் ஆண்டு நினைவுநாள் வரும் 18-ந் தேதி அனுசரிக்கிறோம். எனது கணவர் தமிழகத்திற்காக குரல் கொடுத்தார். அன்று கன்னட வெறியர்கள் தமிழகத்தில் வந்து கொடி பிடித்து கோஷங்களை எழுப்பவில்லை. அவர் இருக்கும் வரை கன்னட வெறியர்கள் அடங்கி கிடந்தனர். ஆனால் இன்று ஓசூர்வரை வந்து தமிழர்களை தாக்குகிறார்கள். அதனால் கன்னடத்தில் உள்ள தமிழர்களுக்கு எந்த நேரத்தில் என்ன நடக்குமோ என்ற அச்சத்துடனே வாழ வேண்டிய நிலை ஏற்பட்டுள்ளது.

அக்டோபர் 18-ந் தேதிக்கு பிறகு தமிழ் அமைப்புகளை திரட்டி காவேரி நதிநீர் பிரச்வினைக்காக போராட்டம் நடத்த தயாராகி வருகிறோம். தமிழர்கள் வன்முறையின்றி ஜனநாயக ரீரியில் வீதியில் இறங்கி போராட்டம் நடத்த வேண்டும்.

இவ்வாறு அவர் பேசினார்.

கூடங்குளம் அணு மின் நிலையத்துக்கு எதிரான போராட்டக்குழு ஒருங்கிணைப்பாளர் உதயகுமாரின் வீடு நாகர்கோவில் இசங்கன் விளையில் உள்ளது. பொதுமக்களை திரட்டி தொடர் போராட்டத்தில் ஈடுபட்டு கூடங்குளம் அணுமின்நிலையத்தை செயல்பட விடாமல் தடுத்து வரும் அவரது வீடு முன்பு நாளை (9-ந் தேதி) முற்றுகை போராட்டம் நடத்தப்போவதாக குமரி மாவட்ட காங்கிரசார் அறிவித்துள்ளனர்.

காங்கிரசாரின் இந்த போராட்டத்துக்கு குமரி மாவட்ட ம.தி.மு.க.வினர் கடும் கண்டனம் தெரிவித்துள்ளனர். அவர்கள் காங்கிரசுக்கு எதிராக போட்டி போராட்டத்தில் ஈடுபடப்போவதாக அறிவித்துள்ளனர். குமரி மாவட்ட ம.தி.மு.க. செயலாளர் தில்லை செல்வம் வெளியிட்டுள்ள அறிக்கையில் கூறி இருப்பதாவது:-

Diaspora Tamils should focus their full efforts in demanding the United Nation to conduct a plebiscite among the Tamil speaking people in the Tamil homeland, told Professor Giuseppe Burgio from the University of Palermo, Italy, at the Pongku Thamizh rally held Saturday in front of the United Nations Office in Geneva in Switzerland. More than 3,500 Tamil activists across Europe gathered in Geneva to assert their resolve to uphold the struggle for the independence of the nation of Eezham Tamils. A group of mayors and lawyers from France appeared in the stage vowing their support to Eezham Tamils' Right to Self Determination and international legal efforts that sought to pave the way forward. Norwegian Red party politician Stian Nicolajsen told the gathering that his party would extend full support to Tamils' independence.

A meaningful peace could only be achieved when Tamils gain their long desired freedom, Nicolajsen told the gathering.

The Italian professor in his address said that the Tamils have a long history spanning thousands of years. It is only a matter of time before the Tamil flag is flown in the UN assembly, declared.

Tamils from France came to the event in large numbers hiring a train, news sources in Geneva told TamilNet.

Apart from the attendance of progressive forces from France, Germany, Norway, Italy and UK, the rally has also brought together youth activists who have been in the forefront in mobilising the masses in the diaspora.

The Tamil activists raised issues of land-grabs, militarization and colonization of the Tamil homeland and the release of Eezham Tamil prisoners of war. They also called for a complete rejection of any solution based on the LLRC report, alleging that it was a product of the "genocidal intent" of the Sri Lankan state.

A total of nine grassroot diaspora organizations further urged the member states to take action in the 21st session of the UNHRC based on five immediate measures.

  1. Accept the existence of a historic homeland of Eelam Tamils, respect Eelam Tamils as a nation of people, and facilitate them to exercise sovereignty over their homeland.
  2. Take immediate measures to halt genocide of Eelam Tamils in their homeland by the Sri Lankan military.
  3. Reject the report of the LLRC, identify the genocidal intent underlining its report, and implement the recommendations of the UN Experts Panel by immediately initiating an independent, international investigation into all violations of international law, including war crimes, crimes against humanity and genocide, by Sri Lanka.
  4. Note the genocidal pattern of the land grabs, order withdrawal of Sri Lankan military from Eelam Tamil land and cease funding of colonisation programmes carried out under guise of economic development.
  5. Recognise that surrendered cadres of Liberation Tigers of Tamil Eelam (LTTE) served in the defense or civil structures of a de-facto state and as such they are prisoners of war under appropriate international legal mechanisms; ensure Sri Lanka accepts this legal recognition and the UN initiates a process of repatriation.

IC turns deaf ear to struggling Eezham Tamil Prisoners of War’

The international community of establishments and their agenda-driven outfits continue to turn deaf-ear to the plight of the Eezham Tamil Prisoners of War (POWs), failing to accord the necessary international legal status to Eezham Tamil POWs, who have become the ‘pawns of genocide’, activists in the island blamed following the reports on Wednesday that a 28-year-old Tamil prisoner, Ganesan Nimalarooban from Nelukku'lam in Vavuniyaa, had succumbed to his injuries at Mahara prison in South. All the 122 prisoners who were inside the raided prison cell in Vavuniyaa last Friday were taken to Anuradhapura prison, where Sinhala prison guards and criminal inmates tortured them for more than 10 hours. 22 of these Eezham Tamil POWs were later transferred to Mahara prison and Nimalarooban, hailng from a poverty-stricken family in the suburb of Vavuniyaa, was one of them.

According to the family of the victim, he was only arrested on mere allegations that he was an LTTE member. The family was struggling to access the body of the victim for burial. The body of the victim is at the mortuary of Ragama government hospital, informed sources said.

Sri Lankan prison guards and Sinhala inmates in the prisons in the South, especially at the notorious Anuradhapura prison, have been torturing and harassing 122 Eezham Tamil Prisoners of War, who were forcefully relocated after the fatal commando attack on the protesting prisoners last Friday, the sources in the South said.

TNA parliamentarians Selvam Adaikkalanathan, Sivasakthi Ananthan and Suresh Premachandran visited Mahara prison on Wednesday. Six of the 22 prisoners transferred to Mahara prison have been admitted at the hospital in the prison, they said. Another four are admitted at public hospital outside the prison, they said. The victim is one of these four, they added.

Suresh Premachandran, the media spokesman of the TNA, speaking to TamilNet said he was concerned that the lives of Tamil ‘political prisoners’ are threatened at the hands of the Sri Lankan prison guards and Sinhala prisoners in Anuradhapura prison. He was counting on legal action in Sri Lankan courts on behalf of the family to get the body of the slain victim.

There were 32 confirmed political prisoners and prisoners of war in Vavuniyaa prison although there were 122 prisoners in total at the raided facility. It was these 32 prisoners who were severely attacked.

Mr Premachandran said he was only able to confirm that 3 prisoners were transferred to Bogombara prison in Kandy, 1 to Anuradhapura and 22 to Mahara.

In the meantime, Jaffna based rights activists have called for Eezham Tamil diaspora in Norway and Switzerland to take up the matter with their respective governments, which had the ‘opening’ to engage with the LTTE and the GoSL, the parties till the last moment of the failed peace process and the war in which they even attempted to assist and witness as remote third parties to white-flag surrender of certain LTTE officials and cadres.

“Why the establishments of the IC that seek to control the flow of Tamil asylum seekers taking boats through human trafficking agents, avoid focusing on the plight of the Tamil POWs,” one of the activists questioned.

Meanwhile, providing details of the raid on Vavuniyaa prison, the sources in Vavuniyaa said that the SL forces had also fired gunshots causing injuries to the suffering prisoners after firing more than 20 tear gas bombs into their cell on Friday.

Many of the prisoners were bleeding and were in unconscious state already when they were brought to Anuradhapura, where they were subjected to torture between 1:00 p.m. to 10:00 p.m. They were not provided any food or water.

The ill-treatment of the Tamil POWs were exposed to the global Tamils following the raid on Friday, which has come three years after the end of war.

The Tamil prisoners were peacefully protesting over a number of days, demanding to show them one of their inmates who was subjected to severe torture and allegedly taken away by the SL military.

However, their protest took the form of a ‘polite’ hostage taking drama, when three Sinhala officers attempted to forcefully feed them to end their hunger strike last week.

The enraged prisoners of war, most them former LTTE cadres, kept three of the prison officers as hostages causing the prison authority to enter into negotiations through a Judge. They were demanding the return of the tortured inmate, Saravanabhavan, for the release. The hostage drama and the ‘negotiation’ failed to produce any result. Later, on Friday, the SL Special Task Force commandos raided their cell.

The news was completely suppressed by the SL prison authorities. Even the southern media that wage a campaign against the ruling regime in Colombo failed to give coverage. The prisoners, using cell-phones, which they kept hidden in their possession, had communicated to the outside world through exiled Tamil journalists who are operating websites from outside the island.

The SL Defence establishment, in a hurried psy-ops manoeuvre twisted the story in its projection against the Tamil diaspora. While doing so it had admitted that there was a violent prison raid where STF commandos were deployed and that the prisoners were transferred. The SL defence establishment alleged that the prisoners were being ‘guided’ over satellite phone by the ‘LTTE diaspora’.

There was no update on the situation of those numbering around 100, who were allegedly being detained in Anuradhapura prison.

சென்னை, ஏப்.15- தமிழக மீனவர்கள் இலங்கை கடற்படையினரால் கொல்லப்படுவது தொடர்ந்தால், கடும் போராட்டத்தை நடத்துவோம் என்று மதிமுக பொதுச்செயலர் வைகோ கூறியுள்ளார்.இதுகுறித்து மதிமுக இன்று வெளியிட்டுள்ள அறிக்கையில் கூறியிருப்பதாவது:கடந்த 2.4.2011 அன்று ராமேஸ்வரம் பகுதியில் இருந்து, மீன்பிடிக்கச் சென்ற விக்டஸ், அந்தோணி, ஜான் பால், மாரிமுத்து ஆகிய நான்கு மீனவர்கள் காணாமல் போயினர். இத்தகவலை அறிந்த வைகோ, கடந்த 5.4.2011 அன்று, வெளியுறவுத்துறை அமைச்சருக்குத் தகவல் தெரிவித்து மீனவர்களைக் காப்பாற்றிடக் கோரிக்கை விடுத்து இருந்தார். இந்நிலையில், தமிழக மீனவர்கள் நால்வரும், இலங்கை கடற்படையால் நடுக்கடலில் வழிமறிக்கப்பட்டு கொல்லப்பட்டுள்ளனர். விக்டஸ் என்பவரது சடலம் மட்டும் யாழ்ப்பாணத்தில் அடக்கம் செய்யப்பட்டுவிட்டது. எஞ்சிய இரு மீனவர்களின் சடலங்கள், தொண்டி அருகே, இலங்கைக் கடற்படையால் கடலில் இருந்து மீட்கப்பட்டு உள்ளது. மற்றொருவர் குறித்துத் தகவல் இல்லை. இறந்த மீனவர் ஒருவரின் கை, வெட்டித் துண்டிக்கப்பட்டுள்ளது. தகவல் அறிந்த வைகோ, இன்று ராமேஸ்வரம் சென்று, கொடூரமாகக் கொலை செய்யப்பட்டு இறந்த நான்கு மீனவர்களின் குடும்பத்தினரையும் நேரில் சந்தித்தார். வைகோவைப் பார்த்த மாத்திரத்தில் அவர்கள் கதறி அழுதனர். வைகோ குழந்தைகளை ஆற்றுப்படுத்தியதுடன், குடும்பத்தினருக்கு ஆறுதல் தெரிவித்தார். "உங்களின் தாங்க முடியாத துக்கத்திலும், கண்ணீரிலும் பங்கு கொள்வதற்காகவே நான் வந்துள்ளேன். நான்கு மீனவர்களைக் கொன்றது, இலங்கைக் கடற்படையினர் தான். உயிர் இழந்தவர்களின் குடும்பத்துக்கு உதவித் தொகை வழங்குவதுடன், தங்கள் கடமை முடிந்துவிட்டதாகக் மத்திய-மாநில அரசுகள் கருதுகின்றன. மீனவர் படுகொலை தொடருமானால், இளைஞர்களைத் திரட்டி, கடுமையான போராட்டத்தை நடத்த நேரிடும் என எச்சரிக்கிறேன்," என அவர்களிடம் வைகோ கூறினார்.மேலும், இறந்த மீனவர்களின் குடும்பத்தினருக்கு, மதிமுக சார்பில் தலா ரூ. 25,000 உதவித்தொகை வழங்கினார்.இவ்வாறு அந்த அறிக்கையில் தெரிவிக்கப்பட்டுள்ளது.

இதென்ன கோமாளித்தனம்? சட்ட சபையிலும் பாராளுமன்றத்திலும் நடத்த வேண்டிய நிஜ யுத்தத்தை, வெறும் பொம்மலாட்டப் போராட்டமாக்கப் பார்க்கிறாரே? இலங்க்கைச் சகோதரர்களின் நலனையோ மீனவர்களின் நலனையோ தொலை நோக்குப்பார்வையில் பார்க்காமல் வரட்டுக் கவுரவத்தில் சட்ட சபைத்தேர்தலில் இருந்து ஒதுங்கிக்கொண்டாரே? தமிழன் கண்கலங்குகிறான், வைகோ அவர்களே-இருந்த ஒரு போர் வாளும் கூர் மலுங்கிற்றே என்று!

திமுக ஆர்ப்பாட்டத்துக்கு எதிரான மனு தள்ளுபடி


மதுரை, ஆக. 3:    திமுக இளைஞர் அணி ஆர்ப்பாட்டத்துக்கு தடை விதிக்கக் கோரி தாக்கல் செய்யப்பட்ட மனுவை, உயர் நீதிமன்ற மதுரைக் கிளை செவ்வாய்க்கிழமை தள்ளுபடி செய்தது.  பழனி ஆயக்குடியைச் சேர்ந்த வழக்கறிஞர் சசிகுமார் தாக்கல் செய்த மனுவில், சொத்துக் குவிப்பு வழக்கில், முன்னாள் முதல்வர் ஜெயலலிதா வாய்தா வாங்கி வழக்கைத் தாமதப்படுத்துவதாகக் கூறி, திமுக இளைஞர் அணியினர் ஆகஸ்ட் 4-ம் தேதி கண்டன ஆர்ப்பாட்டம் நடத்தத் திட்டமிட்டுள்ளனர்.  இது நீதிமன்ற அவமதிப்பாகும். மேலும் நீதிமன்றத்தை வெளியில் இருந்தே எச்சரிப்பதும் ஆகும். எனவே, திமுக இளைஞர் அணி ஆர்ப்பாட்டத்துக்குத் தடை விதிக்க வேண்டும் என மனுவில் குறிப்பிட்டுள்ளார்.  இந்த மனு நீதிபதிகள் கே.சுகுணா, சி.எஸ்.கர்ணன் ஆகியோர் அடங்கிய டிவிஷன் பெஞ்ச் முன் செவ்வாய்க்கிழமை விசாரணைக்கு வந்தது.  அப்போது ஆஜரான அட்வகேட் ஜெனரல் ராமசாமி, இந்த வழக்கு கர்நாடகத்தில் நடைபெறுகிறது. இங்கு நடைபெறும் ஆர்ப்பாட்டம் நீதிமன்றத்துக்கு எதிரானது அல்ல. வழக்கில் வாய்தா வாங்கி தாமதிப்பதை மக்களிடம் விளக்கவே திமுக இளைஞர் அணியினர் ஆர்ப்பாட்டத்தை நடத்துகின்றனர். எனவே, மனுதாரரின் மனுவில் பொதுநலன் எதுவும் இல்லை எனக் குறிப்பிட்டார்.  இதைப் பதிவு செய்துகொண்ட நீதிபதிகள், பொதுநலன் மனு குறித்து உச்ச நீதிமன்றம் சில வழிகாட்டு நெறிகளை வழங்கி உள்ளது. அதற்கு முரணாக இந்த மனு உள்ளது. எனவே, மனுவைத் தள்ளுபடி செய்வதாக டிவிஷன் பெஞ்ச் தீர்ப்பு கூறியது.
கருத்துக்கள்

நீதி மன்றத்திற்குத் துணைநிற்கும் வகையில்தான் கோரிக்கை உள்ளது. எனினும் அதை ஏற்கும் துணிவு நீதி மன்றத்திற்கு இல்லை என்பது வெட்ட வெளிச்சமாகிறது. பேச்சிலும் எழுத்திலும் சுட்டிக்காட்ட வேண்டியவற்றை ஆர்ப்பாட்டம் மூலம் தட்டிக் கேட்பது நாளைக்கு நீதிமன்ற நடவடிக்கைகளை ஆர்ப்பாட்டங்கள் மூலம் திசை திருப்பும் நடைமுறைக்குக் கொண்டு செல்லலாம். நீதி மன்றங்களைக் கட்டுப்படுத்த முடியாத அரசு ஆளுங்கட்சி மூலம் மிரட்டுவதாகவும் அவப் பெயர் ஏற்படும். அரசு என்ன நினைக்கும் எனக் கவலைப்பாடாமல் நீதி என்ன சொல்கிறது என எண்ணி உரைப்பதே நீதிமன்றத்தின் கடமையாகும்.
