Take bearing from PPT verdict in delivering justice to Eezham Tamils: May 17

The recent verdict by the Permanent Peoples’ Tribunal (PPT) on Sri Lanka, which found the Sri Lankan State guilty of genocide, was a landmark decision in the path of justice to Eezham Tamils, say the activists of May 17 Movement from Tamil Nadu, who were present at the session in Bremen as expert witnesses on the genocide against Eezham Tamils. In an interview to TamilNet on Tuesday, Mr Thirumurgan Gandhi and Mr Umar of May 17 stated that the next step in the path of justice to the victims should be legally binding international investigation on genocide – not something that only deals with war crimes – and the parallel delivery of political justice to the victims of genocide. Any intervention or monitoring in the process to ensure this must avoid the forces of the countries that were complicit in the genocide, they said.



Tamils should not demand any investigation other than a legally binding international investigation on genocide. Those who demand investigations on war crimes have a different agenda to gain their interests. They don’t listen to Tamils as a party to the conflict.

It is therefore important to have an interim administration where Eezham Tamils could look after their own recovery and have the freedom to exercise their political aspiration.

The intervention to monitor and conduct the interim administration and the referendum should be executed as a common responsibility of those who were not complicit in the genocide, Thirumurugan and Umar told TamilNet.

For this to happen, the occupying Sri Lankan military must be removed from Tamil Eelam.

The military forces of the countries such as the UK, USA, India, Pakistan and others that will be found complicit in the genocide should be kept away from any intervention, as they are parties of vested interests, the activists of May 17 said.

The judgment delivered at Bremen by the panel of experts of the Peoples Tribunal was an important paradigm-setting event.

The panel in its rulings said it believed the UK, the USA and India being complicit in the genocide, was a significant ruling setting the opinion.

However, the panel of experts withheld their decision of India’s complicity pending examination of further evidence, as there were time constraints as the judges were focusing on the main charge of genocide.

The panel had a clear understanding of the geopolitical intent of the world powers. On India’s complicity, they needed more time to further study the evidences.

“We need to look back at how the panel ruled in 2010, when they said war crimes and crimes against humanity have been committed and that genocide needed further investigation,” Mr Thirumurgan Gandhi said.

“This time, they have done it. They spent a lot of time, almost the first two days in hearing the witnesses on the genocide and the complicity of USA and UK in detail. We were given less time than initially confirmed as allocated to us, due to the time constraints. The panel also had very limited time to study the evidence material presented to them on Indian complicity. The panel has acknowledged that further investigations are necessary on India. They have also clearly stated that they believe India along with USA and UK, is complicit in the genocide,” Mr Thirumurugan said.

This is the first time India is getting accused for complicity in a genocide outside its own territory.

Commenting on Prime Minister Dr Manmohan Singh's statement that India has “long advocated the creation of an environment in Sri Lanka in which all communities, particularly the Sri Lankan Tamils, are masters of their own destiny within the framework of a united Sri Lanka,” Professor Boyle, an expert in International law, said that this was not an appropriate remedy to deal with genocidaires, adding, "It would be like asking the Jews to engage in a Truth and Reconciliation Process with the Nazis. The very idea is absurd and insulting upon its face alone." India's Prime Minister was responding to Chief Minister Jayalalithaa statement urging the Center to ensure that the process of democratic decentralization, integral to the survival of the Tamils in Sri Lanka, should lead to the Tamils realising their legitimate aspirations.


Professor Boyle said, "Most experts in the fields of international human rights law and international criminal law believe that a Truth and Reconciliation Process is not the appropriate remedy to deal with genocidaires and their victims.

"It would be like asking the Jews to engage in a Truth and Reconciliation Process with the Nazis. The very idea is absurd and insulting upon its face alone," Boyle said.

Prof Boyle added, "Rather, the international community set up the Nuremberg Charter, Judgment and Principles as well as the Genocide Convention to deal with the Nazi extermination of the Jews.

"That is why I have proposed that the United Nations General Assembly establish The International Criminal Tribunal for Sri Lanka as a “subsidiary organ” under U.N. Charter Article 22 that would be modeled upon the Statute for the International Criminal Tribunal for Rwanda.

"Justice must be administered to the GOSL genocidaires on the basis of Truth. Therefore, we must have a Truth and Justice Process with respect to the GOSL genocidaires," Boyle said.

“In order to allay Sinhalese apprehensions, iron-clad guarantees should be provided that devolution to provinces should not lead to demand for separation,” writes V. Suryanarayan, in an opinion feature “Ethnic riddle in Sri Lanka,” appeared in The New Indian Express on Wednesday. “The Achenese model should be of relevance because like the Sinhalese, the Javanese are also opposed to federalism. The special autonomy status to Acheh, it must be underlined, is within the constitutional framework of a unitary Indonesia,” he further writes. Whatever that has happened or continue to happen, Eezham Tamils should never get independence and the Sinhalese should be appeased at any cost, even in their opposition to federalism, is the thrust of the opinion, on which the impunity of genocidal Sri Lanka is firmly anchored, responds TamilNet political commentator in Colombo.

Riddles are told when there are no answers or when the questioner already knows a ‘surprising’ answer.

The question in the island is not new to humanity and the righteous answer is obvious in the pages of history, unless academics and media obliged serve and shield the criminality in the course of the Establishments think of transferring their own riddle on to the question.

If it is really a riddle with a ‘surprising’ answer and if what Suryanarayan has written is that answer, then it is neither a riddle nor that answer is surprising, because such a stand of New Delhi and Suryanarayan, denying independence to Eezham Tamils, appeasing with the ‘apprehensions’ and ‘oppositions’ of the genocidal Sinhala State to any extent for returns reaped by Indian imperialism from time to time, and thus setting the course for the annihilation of the nation of Eezham Tamils as the ‘lasting solution’, is well known for decades.

Another one of the ilk, Vivek Katju, a former Indian Ambassador to Afghanistan, was advising the genocide-facing Eezham Tamils in a feature in The Hindu on 3rd July that “On their part, minorities must shun violent approaches and understand the concerns of the majority communities.”

Katju, a former part of the Establishment that never accepts the genocide it partnered in “this digital age,” was ostensibly sounding sane in telling leaders of the digital age controlling destinies of peoples and countries, not to be guided by historical memory and battles lost and won.

“The 13th Amendment is the cornerstone of the position of the overwhelming majority of the Tamil political class,” Katju writing in The Hindu nullified the ballot of Tamils in the last voting free to take up the topic in the island in 1977, referenda in the diaspora in 2009-2010, and has detracted the international responsibility of conducting a referendum, for it will go out of the exclusive hands of his Establishment.

In speaking to Rajapaksa, Katju was looking forward that “the communication channels which have worked successfully to diffuse situations in the past now need to operate urgently.”

Political observers say that five days after The Hindu feature, Shiv Shankar Menon must have achieved it by bartering the current Tamil issues for signing a Maritime Security Pact with Colombo and Male. Perhaps, if the past communication channels like Shiv Shankar Menon and M.K. Narayanan are not enough, Katju could urge Sri Lanka Ratna Ram to take it up, diplomatic circles in Colombo were commenting.

Vivek Katju was in the BJP-RSS-Shiv Sena team that recently came to Colombo and Jaffna as guests of Rajapaksa.

Chennai-based V. Suryanarayan, former Professor of South and Southeast Asian Studies, member of New Delhi Establishment’s security advisory council and an active contributor to the research outfits run by intelligence agencies, was listing out the issues of Akalis, Mizos and Nagas, which according to him, respectively found ‘natural death’, resolved through statehood and ‘progressing’ in reducing violence, through direct negotiations.

None of the examples cited by him has faced a genocidal war of international dimensions in which 30 to 40 countries, led by the USA and India participated. If Suryanarayan’s Establishment now wants to keep it in its backyard or resolve it through ‘direct negotiations’ it should have thought of it before partnering and nodding for the internationally staged genocide. It had decades of time, which it missed by following policy lines, which Suryanarayan himself and the ilk of him were advocating.

Besides, in historicity, dimensions, magnitude, and in the nature of the one to one confrontation, the question of Eezham Tamils in the island differing from any of the examples in India couldn’t have gone incomprehensive to the learned professor.

Suryanarayan now sees the Achenese model within the framework of a unitary constitution as solution. Even there he misses the difference why a Catholic East Timor had to be separated. He sees Acheh, but doesn’t see East Timor. This is of course a riddle, and the answer is ‘Nelson’s Eye’– a favourite phrase of Suryanarayan.

Even after seeing the pen and print of decades upholding the integrity of Sri Lanka bringing in genocide, if the mind is not prepared to come out with what is logical and righteous, then citing ‘Lady Macbeth’ to say ‘blood is in the hands of India’ is only shedding crocodile tears.

A South Indian origin former diplomat of Singapore, K. Kesavapany, who a year ago retired as Director of the Institute of Southeast Asian Studies in Singapore, was also harping on the Acheh model at a gathering of ‘Sri Lankan’ Malaysians, five years ago.

Acheh model within a unitary constitution could provide advantage for powers interested in the ethnic military of the genocidal State to keep the military unquestioned in the concerned region forever, and to easily carryout whatever ‘engineering’ they have in their mind. It is a ‘non-descript’ and un-defined model, so easier to manipulate without political debate. In other words, it is the contemporary style of confirming the colonial status of a ‘conquered’ territory.

Active agencies are now working especially in Malaysia, Singapore and in Australia, to campaign among the diaspora Tamils on the ‘virtues’ of the Acheh model.

In a parallel operation, the very same forces that have brought in Mr. Sumanthiran as nominated parliamentarian into the TNA have now brought in the candidature of Justice C.V. Wigneswaran to the Provincial Council, informed circles say.

Eezham Tamils have to accept living with Rajapaksas or any other Paksha’s (sides) brought in through ‘regime change’, accept living with the exclusive Sinhala military, accept that genocide was the right thing in the ‘digital age’, accept seeing the annihilation of their nation and territoriality and accept being ruled through agents of imperialism or agents to agents of imperialism.

There are two forces that are relatively free to make a break through: the diaspora and Tamil Nadu, if the masses there could come out challenging the ‘engineering’ at political level.

Speaking in April, C.V. Wigneswaran detracted diaspora polity and was sceptical in expecting anything positive from the feelings prevailing in Tamil Nadu.

When nearly 600,000 people, especially students took to streets in Tamil Nadu earlier this year without being initiated by political parties, and especially when they started addressing against the US-tabled Geneva resolution, Tamils all over the world saw it as a very significant move in relieving Eezham Tamils from the bondage of geopolitics that was always on the side of genocidal Sri Lanka.

But the mainstream Indian media blacked out the significant dimension of the uprising and twisted it as something that was only urging New Delhi to vote on the side of the USA. Even now the Indian media that is keen in engineering opinion through Dasguptas, Katjus and Suryanarayans, systematically detracts the unprecedented expression of opinion that has come from the uprising of masses in Tamil Nadu. In this respect they behave in the same way they blacked out genocide in the war.

A long noticed lacuna in Tamil Nadu known for its film media, is that Tamils miss news media as well as writers with the calibre of reaching the other parts of India and the outside world, in order to internationally challenge the habitual detractors of righteous Tamil interests.

The impunity of genocide-accused Sudanese President Omar al-Bashir, allegedly responsible for the deaths of over 2.5 million Darfuris, echoes far beyond the borders of Sudan, write Luis Moreno Ocampo, former Chief Prosecutor of the International Criminal Court and Tom H. Andrews, President of United to End Genocide. “As the first sitting president wanted by the ICC, Bashir is a symbol of what could be the destiny of Assad and other leaders. They are committing more atrocities to remain in power,” the authors assert, in an article published on the Huffington Post on Friday, adding that “If Bashir is to be held accountable then the countries that enable his impunity must also be held accountable. And if the UN Security Council and the world's governments will not cry out against such an affront to justice, then it is up to citizens to do so.”

Excerpts from the article titled ‘Sitting President Still Wanted on Charges of Genocide in Darfur’ by Luis Moreno Ocampo and Tom H. Andrews published on Huffington Post follows:

“Three years ago today, an arrest warrant was released by the International Criminal Court for Sudanese President Omar al-Bashir on charges of genocide in Darfur. Yet today Bashir is a fugitive from justice and is the current president of Sudan.”

“The Darfur case was originally referred to the International Criminal Court (ICC) by the United Nations Security Council, implying an obligation for the world to hold those wanted to account. The charges of genocide came on top of previous charges issued for war crimes and crimes against humanity.”

“Even more inauspicious, it was ten years ago that the genocide that led to 300,000 deaths began in Darfur. Bashir's forces learned to use rape and hunger as silent weapons to commit genocide against some 2.5 million Darfuris. They are living in camps for displaced persons at the disposal of Bashir's forces. They are helpless, voiceless and with no hope for the future. Those who have the duty to protect them attack them. Darfuris need international authorities to help end a genocide that should have been stopped years ago.”

“In fact, it is the same individuals wanted by the ICC for crimes in Darfur who are overseeing the attacks in the South, not only Bashir, but also the former Minister of Interior and current Defense Minister, Abdel Raheem Muhammad Hussein, and the former State Minister for the Interior and current Governor of Kordofan Ahmad Harun. Impunity has a cost of millions of new victims.”

“The world once claimed ignorance of the Nazi atrocities. Fifty years later, the world refused to recognize an unfolding genocide in Rwanda. On Darfur, the world is officially on notice.”

“The world will listen. Last year the outcry of activists and some Members in the U.S. Congress helped to bring pressure to bear on Malawi, both diplomatically and in the form of threatened loss of bilateral aid, resulting in a warning that Bashir would be arrested if he were to follow through on a planned visit. Malawi joins South Africa and Zambia as countries that have taken the positive step to commit to upholding justice if Bashir should try to visit. Other countries should do more to stop Bashir.”

“If the United States and China, Europe and Russia, the African Union and Arab League reach an agreement, Bashir will go and his criminal policies will end. Efforts like Bashir Watch will make sure that silence is not an acceptable option.”

“Ten years from now, we hope that the lesson before the world will be one of Bashir facing justice, not one of a repeat offender leading a new series of crimes against humanity and genocide. A decade of impunity is already too long.”

Survivors of 1991 Kashmir mass rape case assert struggle for justice

A court in Kupwara district, Kashmir on Tuesday ordered the re-opening of the infamous Kunan Poshpora mass rape case, allegedly committed by Indian military personnel during a cordon and search operation in the Kunan Poshpora village on February 23, 1991. Despite the case gaining international attention and sparking condemnation by human rights bodies like Amnesty and HRW, the Indian government had officially been in a state of denial as regards the incident. In the wake of this court order, an event titled “Kunan-Poshpora mass rape and torture: Case reopening and future struggle for justice” was organized by Jammu and Kashmir Coalition of Civil Society on Saturday in Srinagar in which the rape survivors and their relatives spoke to the public, asserting their struggle for justice.

In the brutal incident at Kunan Poshpora village over 2 decades back, military personnel from the Rajputana Rifles entered the village on the night of 23 February during a cordon and search counterinsurgency operation.

After forcing the Kashmiri men out of their homes at gun point, the Indian military personnel proceeded to sexually assault the women.

Despite the case being heavily condemned by various local and global human rights organizations, the Indian government till now has taken no action whatsoever to bring the perpetrators to justice.

Following the recent Kupwara court order to re-open the case, the event in Srinagar saw the participation of the rape survivors and their relatives, who narrated the terrible violence that they endured, the failure of the Indian justice system to address their grievances and their struggle to get the perpetrators of the mass crime punished.

The news site Kashmirlife.net, citing relatives of the victims, said that allegedly over a hundred women were assaulted in the village and that the victims “were gang-raped without any consideration of their age, married, unmarried, pregnancy etc.” adding that “The victims were ranged in age from 13 to 80.”

GreaterKashmir.com reported, quoting one of the rape survivors, “When a girl was gang-raped in Delhi whole country rose against it. But in our case there was total silence. We don’t want any women to suffer like us. We don’t want money or jobs but justice. We were raped but through our struggle we will expose and dishonor the accused. It is our last wish to get the accused punished.”

India has not recognized the crimes committed by its army during the IPKF occupation of the Eezahm Tamils’ homeland from 1987-90.

The IPKF massacres, including accounts of rape, documented by the NESoHR were brought out in a publication, “In the Name of Peace: IPKF Massacres of Tamils in Sri Lanka”, by Delhi Tamil Students Union in April 2011.

During the 3 years when the IPKF occupied Tamil Eelam, it earned the dubious name of ‘Indian People Killing Force’ and was accused of violent sexual crimes against women, with the age of the victims being no bar. The Indian army has been occupying Kashmir for more than 30 years. One can imagine what horrors it must have subjected the people to,” a Tamil Nadu activist engaged in solidarity work among oppressed nations told TamilNet.

The activist further said that the increased interaction between the Indian army and the Sinhala army, the latter having perfected using rape as a weapon of genocide, must be looked on with serious concern by activists across India.

The Social Democratic Party of India (SDPI), a pan-Indian Muslim political party, protested on Thursday outside the UN office at Delhi demanding justice for the genocide-affected nation of the Eezham Tamils. Stating that there was a “gradual genocide” of the Eezham Tamil nation going on in the occupied homeland of the Eezham Tamils, the protestors placed four principal demands to the UN and India, namely to pass a resolution against the Sri Lankan state recognizing its crime of genocide, to punish the perpetrators of gross human rights violations, to ensure the trial of Sri Lankan war criminals in the International Criminal Court and to punish the perpetrators of sexual violence against Tamil women.

Tamil political observers in Chennai told TamilNet that it was the consistent work by several Tamil Muslim activists from Tamil Nadu that has led to a pan-Indian grassroots Muslim party taking up the issue of the genocide of the Eezham Tamils with the seriousness it deserves.

Stating that only an internationally monitored referendum among Eezham Tamils for an independent state of Tamil Eelam and an independent international investigation into genocidal war crimes of Sri Lanka would provide justice, MDMK leader Vaiko, in a statement on Wednesday asserted that the upcoming US resolution at Geneva falls drastically short of providing any justice to the genocide-affected nation of the Eezham Tamils. In the statement Mr. Vaiko also criticized political parties in India for holding up the US resolution as an appropriate step forward. Separately, protests against Sri Lanka have been intensifying across Tamil Nadu.

Stones were pelted at the Madurai office of Mihin Lanka, a Colombo based airline, the PTI reported on Wednesday.

Earlier this week, the DMK backed TESO staged a protest in Chennai urging India to support the US backed resolution in Geneva.

However, numerous Tamil activists in Tamil Nadu expressed discontent at the politics of this protest, arguing that the DMK should note that the US resolution is only going to give more time to Sri Lanka to complete its structural genocide of the Eezham Tamils through the LLRC, sources from Chennai told TamilNet.

There is also a session scheduled in the Indian Lok Sabha on Thursday to discuss the issue of the Eezham Tamils.

Rajapaksa regime this week has approved new diplomatic appointments to generals conducted the genocidal war in the island. Conspicuously, they will be representing the regime in a new set of Establishments. People are usually named for such assignments not without prior consent by the concerned countries. Sri Lanka’s Major Generals, Shavendra Silva, Jagath Alwis and Kamal Gunaratne are named to go as Deputy Ambassadors respectively to South Africa, Israel and Brazil, media reports from Colombo said. Earlier the UN, some Western countries, Japan and Australia have received war-crimes-accused SL generals as diplomats.

Meanwhile, people connected to the course of the genocidal war in the island are invariably rewarded in some or the other way by certain countries and by the International Community of Establishments (ICE), political observers commented.

They cited MK Narayanan going as governor, Shiv Shankar Menon becoming the NSA, Nirupama Menon Rao going as US ambassador after retirement and above all the former Indian Foreign Minister Pranab Mukherjee who misled the world on the number of people in the killing field becoming the President of India.

The UNSG Ban Ki-Moon received his second term, Robert Blake continued as US Asst. Secretary of State from Bush Administration to Obama Administration, UK’s John Sawers became the head of MI6, and the latest is Erik Solheim getting named to lead development facilitation of a body of 24 leading developed countries, the political observers further cited.

The Rajapaksa regime getting shielded overtly or covertly by everyone, getting pampered diplomatically and getting bestowed with competitive monetary aid from all quarters are no secrets.

“One of the worst atrocity crime stories of recent decades has barely registered in the world’s collective conscience,” lamented ICG’s President Emeritus and Australia’s former foreign minister Gareth Evans, a few days ago.

“We remember and acknowledge the shame of Cambodia, Rwanda, Bosnia, and Darfur. We agonize about the failure to halt the atrocities being committed almost daily in Syria. But, at least until now, the world has paid almost no attention to war crimes and crimes against humanity comparable in their savagery to any of these: the killing fields of Sri Lanka in 2009,” he further said.

But the Establishments are fully conscious of the global significance of what they have ‘achieved’. Otherwise they would not pay this much of attention in rewarding the players, political observers commented.

Meanwhile, the genocide-affected nation of Eezham Tamils plunges further into structural genocide and into an invisible genocide, i.e., psychological genocide resulting from the denial of justice and commendation of the culprits.

There are no signs at all that it is practical to expect justice to come from the existing nature of the Establishments unless there is a globally coordinated mass struggle and civil society movement.

For those who think ‘collaboration’ is practical, the fate of Pillaiyan, Karuna and the East should be an eye-opener, civil activists in the island commented.

But certain Western diplomatic circles in Colombo are engaged in a campaign nowadays that challenging or creating awareness on the ‘illogical justice’ of the International Community of Establishments is an ‘impractical’ approach on the part of Eezham Tamils, the civil activists further commented.

The second annual conference of the Global Tamil Youth League held on 7th and 8th April in the UK passed resolutions calling for an independent, international accountability mechanism into war crimes and crimes against humanity committed by the Sri Lankan state and to advocate against the genocide of the Eezham Tamil nation. Emphasising that Tamil sovereignty is the only meaningful expression of self-determination for the Tamil nation in their historic homeland and the only guarantee against genocide, Krisna Saravanamuttu of the NCCT, a participant in the conference, told TamilNet "At a time when powers are trying to manipulate the diaspora to arrive at a settlement within a unitary Sri Lanka, the Tamil Sovereignty Cognition declaration provides a principled ideological and conceptual reference point for Eezham Tamil youth across the world in our struggle for national liberation."

Referring to the unanimous adoption of the Tamil Sovereignty Cognition declaration by Tamil youth activists in Canada at the ‘Eelam Tamil Youth Conference – Canada 2012’, Mr. Saravanamuttu encouraged Tamil student activists around the world to take a bold and decisive step by adopting the Tamil Sovereignty Cognition as the ideological basis for their activism.

The GTYL resolution was adopted by member organisations from Canada, Germany, Italy, Norway, Switzerland and the UK and endorsed by organisations from Australia, New Zealand, Sweden and the United States of America.

Whereas the Tamil people have historically inhabited Tamil Eelam, the North-East of the island of Sri Lanka, as their traditional homeland; and

Whereas the Tamil people are distinguished from other people living in the island by their unique language, culture, traditions and history; and

Whereas for over sixty years the Sinhala Buddhist ideology of the Sri Lankan state is destroying the economic existence, the political and social institutions, and the demographic and territorial basis of the Tamil national identity; and

Whereas the Tamil people have been historically marginalised in language, education and citizenship and suffered state-orchestrated pogroms; and

Whereas these practices have been continuing for over sixty years in a systematic, intentional and targeted manner, constituting the genocide of the Tamil nation; and

Whereas the Tamil nation called for an independent and sovereign state of Tamil Eelam in 1977, and reaffirmed this in 2009 and 2010, based on the principles of the Vaddukkoddai Resolution of 1976; and

Whereas the Sri Lankan state cannot provide meaningful accountability or justice into the grave violations of international humanitarian law during the last phase of the armed conflict, through a domestic inquiry; and

Whereas in order to move forward with a meaningful advancement for the Tamil youth it is vital to preserve the Eelam Tamil identity and remember its history; and therefore

Be It Resolved that the Global Tamil Youth League calls for the establishment of an independent, international mechanism to ensure truth, accountability and justice.

Be it Resolved that the Global Tamil Youth League will work to achieve a political solution that recognises the uncompromising, fundamental principles of the Tamil freedom struggle; namely: recognition of the Tamil homeland, the recognition of the Tamil people as a distinct nation; recognition of the right to self determination of the Tamil nation.

Be It Resolved that the Global Tamil Youth League will work to raise awareness about the ongoing multi-faceted genocide unleashed on the Tamil people by the Sri Lankan state.

‘LLRC hollow, India must use pressure to secure justice for Tamils’: Tehelka

While a section of pro-establishment Indian media and journalists have attempted to the shield the Sri Lankan government from an external war crimes enquiry, an article published in Tehelka, an Indian magazine reputed for its investigative journalism, slams the hollowness of the LLRC citing UN panel report and referring to recently emerged images of civilians executed in cold blood when those who bear command responsibility for the atrocities have been given promotions. The article ‘Why are we not looking at these war crimes?’ dated 24 March by Tehelka’s correspondent Sai Manish further adds that future for justice for the Tamils does not lie with the pro-LLRC US resolution but “It depends more on how India can use its power to ensure that the innocent women and children who died don’t just get counted as collateral damage — as Colombo wants to make the world believe.”

“The United Nations has noted that not only did the Sri Lankan forces disobey all rules of war by deliberately forcing fleeing citizens into areas that were being carpet bombed, their blood-thirsty campaign led to crimes that would even put the warring African militias to shame.”

“The government not just shelled three no-fire zones (NFZs) where it was encouraging the concentration of civilians but also subjected the victims and survivors to further suffering as hordes fled the incessant pounding. The UN expert panel report says, “Screening of suspected LTTE cadre from civilians was done without transparency or external scrutiny. Some of those who were separated were summarily executed and women may have been raped.””

“And now with pictures of systematic torture of LTTE cadre coming out in the open, things are becoming clearer. Sri Lanka’s dirty war closet holds untold tales of torture and the insane violence unleashed by soldiers and commanders who were yearning for sadistic pleasures.”

“The UN’s distrust with Sri Lanka’s internal processes have been fuelled partly by the manipulation of the mass media by Rajapaksa to make ordinary Sinhalese believe that their “sovereignty is under threat from the West” and by the fact that the war was run by the Rajapaksa family and all the top commanders who abused civilians are already well cocooned from any domestic or international law.”

“Because if the United Nations findings were anything to go by, the Lankan war room, including military top guns, would be guilty of “murder, extermination, persecution, enforced disappearances and intentional attacks on civilians” — in effect, the entire gamut of violations of Common Article 3 of the Geneva Convention.”

“In the heat of the war, the Lankan army misled people to flee into death traps. Those Tamils who survived these traps were then screened and randomly tortured and executed,” Mr. Manish writes, placing emphasis on India to use its power to secure justice for the Eezham Tamils.

While this opinion of a mainstream Indian journalist is most welcome, whether India which seems to be pro-actively upholding the interests of the unitary Sri Lankan state and endorsing the genocidal solution in the name of ‘friendly relations’ will treat the Eezham Tamils justly without adequate pressure from Tamil Nadu is a question to be considered, a political observer from Colombo told TamilNet.

Peace academic denounces US-LLRC formula, urges alternative mechanism for justice

“The US support given to UNHRC’s proposal for an accountability mechanism for Sri Lanka would not go beyond requesting GoSL to implement LLRC recommendation which legitimised war to protect the state and reduced human rights violations to the ‘misbehaviour ‘of individual soldiers,” writes Jude Lal Fernando, academic of the Trinity College, Dublin. Establishing what took place was not mere war crimes or crimes against humanity but was intended genocide by Sri Lankan state, and arguing why justice will not come from the powers that conceal the truth and stifle justice and recovery, the academic who was earlier involved in the Dublin Tribunal urges alternative international community to pursue an international independent accountability mechanism.

In a paper sent to TamilNet this week, which is a modified version of his presentation at the 9th Biennial Conference of International Network of Genocide Scholars (INGS) in Argentina last July, Dr. Jude Lal Fernando theoretically and historically establishes why the discourse on Sri Lanka should be orientated on a genocide paradigm and not be confined to mere war crimes or crimes against humanity.

Jude Fernando is a lecturer and a post-doctoral researcher in peace studies at Trinity College, Dublin.

In his paper, he identifies the ideological markers of the UN panel report, thinking in the US/UK/EU and the orientation of the international human rights organisations such as the Human Rights Watch and International Crisis Group as limited, and observes that the scope for justice coming from them would also be limited.

Pointing out that there is not much difference between the rationale behind the findings and recommendations of the LLRC and the ideological markers of the forces mentioned above, Dr Fernando observes that war crime paradigm lacking historical perspective would only lead to not addressing the root cause of the conflict, to reduce the truth about mass atrocity into a mere breakdown of law and order, and to confine recovery of the victims to undefined political solution under the existing unitary state structure.

In recovering truth about mass atrocity in Sri Lanka it is of paramount importance to go beyond a single state-lens, he observes.

Asking a question, whether it is the specific intent of the GoSL or the strategic interests of global powers that dismantled the parity of esteem between the parties, and indicting SL government for the Tamil genocide and the IC for the complicity, Jude Fernando says that there is a deliberate attempt by the powers who are culpable for crimes against peace to conceal the truth and stifle justice and recovery.

He cited the recent statement of visiting US official Otero in Colombo that had softened and twisted even the phrase war crimes into ‘wartime abuses’.

Commenting on Jude Fernando’s paper, a new generation Eezham Tamil politician said: “In war and postwar the partners have the same aim. Only the tactics of deception differs. But the irony is that when a Sinhala academic like Jude Fernando, seeing the deception in the so-called international community, calls for alternative action to get justice, the Tamil National Alliance wants the Eezham Tamils not to do anything, but to remain calm.”

“Jude Fernando’s detailed discussions establishing theoretical and historical perspectives of genocide in the island are a must to be read by everyone involved in the discourse on the conflict in the island. The paper especially enlightens Tamil polity of the demands it should make, directions it should take and against which forces its struggle should be waged, the new generation Tamil politician further said.

Indo-US competition deprives justice to Eezham Tamils

A historical perusal of the long plight of Eezham Tamils would show that a subtle cold war between India and the USA, played over the national question in the island, and their competition to have the dominant nation of Sinhalese on their side, denied justice to the nation of Eezham Tamils at every stage. After leading the matter into an open genocide and on-going structural genocide, the relationship of Tamils with New Delhi or Washington could never be the same again, unless both come to a consensus of delivering justice to Eezham Tamils. Both the powers now pay for their long injustice, as China’s confident entry into Indian Ocean is directly connected to their failure and loss of credibility in the Eezham war. If Tamils siding with India or the USA is vain without delivery of justice, better to collectively opt non-cooperation against both, writes TamilNet political commentator.

Indo-US competition reflecting on Tamil affairs is as old as the independence of Ceylon in 1948.

India sacrificed Tamil interests by accepting the citizenship act of 1949 and by signing Nehru-Kotalawela Pact, in order to woo the pro-US Sinhala leaders of the UNP towards India’s Non-Alignment agenda. The first pawns of the power competition were the Tamils of Indian origin.

After 1956, SWRD Bandaranayake’s ‘Sinhala Only’, the subsequent pogrom against Tamils in 1958, Srimao’s political oppressions of early 1960s and the Republican constitution of 1972 declaring Sri Lanka a Sinhala-Buddhist country, were all tolerated by India’s ‘anti-imperialist’ or ‘non-alignment’ paradigm that was essentially directed against the USA.

The pre-emptions attempted through Banda-Chelva pact and later by US backed Dudley government’s district councils were alternately thwarted by the opposition friendly to one or the other power.

Pro-US, JR government coming to power in 1977 and its ‘out of the region’ economic policies made Indira Gandhi’s India to support the Tamil cause for the first time. The US-backed pre-emption of the district councils in 1981 failed due to its pathetic inadequacy and rising Tamil militancy.

The two pogroms of the US-backed UNP government in 1977 and 1983, and its policy of addressing the national question with a ‘terrorism’ paradigm, were used by India to design a controlled militant strategy in the name of Eezham Tamils.

Indira Gandhi’s assassination, and the changed global balance of power in 1985, abruptly ended the original Indian design.

The US-USSR Cold War ended, but the Indo-US competition exploiting the national question in the island of Sri Lanka continued in subtle ways.

Despite a favourable military situation to India, the USA encouraging JR to play the card of giving Trincomalee to it, made Rajiv’s India to stop at the half-baked 13th Amendment in 1987. The anger of Tamils turned against India with the subsequent development of India militarily imposing the hoodwink solution.

The US-backed Norwegian peace process failed by its inherent non-genuineness, but according to what was implied in Norway’s evaluation of the peace process last month, India was decisively responsible for the ‘Asian Model’ that ended the war in genocide.

According to WikiLeaks documents, the USA initiated the gang-up of countries, including India, against the LTTE, but India vetoed a joint demarche with the US on any model of post-war settlement.

Speaking in Chennai during the war, the then US Ambassador in Colombo, Robert Blake wanted a ‘strategic partnership’ with India. But a few days before the genocidal end of the war, the US Pacific Commander returning from a visit to New Delhi, said that there wouldn’t be any more impediments for India and China to conduct joint naval exercises in the Indian Ocean. The sarcasm in the statement was evident later.

After the war, when the US-led countries initiated the war crimes paradigm to patch up their failure and crimes, India repeatedly aligned with China, Russia and Pakistan to defeat the move in all international forums. Despite a resolution in the Tamil Nadu State assembly, India openly shielded Colombo’s war crimes in the Commonwealth.

In July this year, the retiring Indian foreign secretary and ambassador-designate to the USA, Nirupama Menon Rao, categorically said that India had to be directly involved in resolving the situation in the island, and it should be within the region, avoiding any third party’s involvement.

Writing in The Hindu, October this year, former US ambassadors Teresita and Howard Schaffer, said, “The U.S. and India have always had a harder time working together in the multilateral arena than they do bilaterally and the United Nations has been especially tough.”

India and the US have worked most closely together on thematic issues, but “when it comes to country-specific issues, however, US-India interaction at the UN is more difficult.” The former US ambassadors said in the article “India & U.S. at U.N.: a complicated dance.”

“How do things look nine months after India joined the Security Council for a two-year term? Finding ways to work together has been a challenge for both countries,” they commented on the current Indo-US relationship.

The ambassadors didn’t touch the point on Eezham Tamils and Sri Lanka, but were referring to Syria, Libya and Palestine.

“India has decades of practice in building support in the Non-Aligned Movement […] Working in coalition with the U.S. is a more unfamiliar pursuit,” they further observed.

Meanwhile, reading a paper in April 2006, at a seminar at Zurich, organized by Western donor-oriented Tamil outfit Centre for Just Peace and Democracy and Europe-based Burghof Foundation, Dr Karen Parker said that in her view “the U.S. interests in Sri Lanka pose the most serious barrier to the establishing of a just peace in Sri Lanka.”

“The U.S. substantial interests in Sri Lanka result from its plans greatly to expand its role and power in Asia. First of all Sri Lanka has airfields, such as in Palaly, that could provide highly useful bases for the U.S. airpower. In addition, Sri Lanka has several deep-water ports that would be very useful for basing U.S. naval forces,” she said.

“U.S. interest in Trincomalee harbor, for example, was a major factor in the direct involvement of India in Sri Lanka beginning in 1987, as is apparent by the letter of annexure to the Indo-Sri Lanka accord of that year in which the Prime Minister of India stated that no action would take place in Trincomalee that was against the interests of India,” Karen Parker observed.

“Current discussions of widening the Palk Straights to allow large vessels to pass through are disturbing in light of U.S. interests. Other U.S. interests in Sri Lanka are its natural resources, such as titanium, and the potential for the exploitation of natural gas and petroleum. Most of the land and resources coveted by the U.S. lie in the traditional Tamil areas,” she further observed.

From the sequence of events from 1948 to 2011, any one could see how the Indo-US competition was the real bedrock-impediment for any righteous and lasting solution to the national question in the island.

The competition not only reflected in the two Sinhala political parties that alternately stood in the way of any solutions, but also within the Tamil politics as well. Tamils should not think that examples were confined to Varatharaja Perumal or Amirthalingam in one shade and AJ Wilson, Neelan Thiruchelvam and Lakshman Kadirgamar in the other shade. The Indo-US competition existed within the Tamil militancy from its inception. It also operated within the monolithic LTTE, even though Pirapaharan’s LTTE tried its best to uphold the Tamil national cause above the power interests.

If competing India and the US have any consensus over the island, that exists only in saving the Sri Lankan state, whatever oppressive or genocidal it is, because both want an agent state and want to eat the cake in full. The consensus reflected in both saving the state from the Sinhala insurgency of the JVP too, whether during the SLFP regime or UNP regime.

In the past, after every pogrom against Tamils in the island, from the section of the Sinhala elite that backed the pogrom to the street hawkers in Colombo used to call the Tamils to come back without fear, saying everything is now OK. No wonder it is repeated from the side of the Sinhala elite, but now we have the international street hawkers, New Delhi and Washington, calling Tamils to come forward with ‘reconciliation’ to save the genocidal state.

Apart from this ‘consensus’, Indo-US competition continues unabated both within Sinhala as well as Tamil polity in the post-war scenario.

Even after contributing to the genocide, both the powers, showing all kinds of intimidations or lures, expect the Tamil polity to take their respective sides. They don’t want Tamils to talk about genocide, not that seeing the truth will affect reconciliation between Tamils and Sinhalese but it will affect the reconciliation between them and Tamils.

Any astute Tamil political observer, who could keep the eyes open around him or her, could see how frantically both the competing powers try to perceptibly and imperceptibly gang-up Tamil polity through long-operating intelligence outfits, foundations, funds and ‘silent’ working groups. Who is who and where is one are immaterial here. The individuals involved are not important, but grasping the dangerous phenomenon is more important.

The deviating tactics of the competing powers once again deceive Tamils, their fighting spirit is blunted, they do not know against which impediment they should actually wage their struggle, and they run after the mirages set by the powers.

The past record should tell us that siding with one of the competing powers or opposing one at the instance of the other is not going to bring in lasting solutions. Tamils should realise that the forces in question would have operated in the same way even if Tamils had achieved independence in the war. Whether in success or in failure, intelligent political preparedness of the nation is of utmost importance.

Grasping the unending competition of India and the USA, the Sinhala polity for long was grooming the China card.

However, the China card shown by India or the USA to Tamils as an excuse in the past was not real. It was a smokescreen to their competition. But China in reality has now come into the region, as a direct consequence of the failure of India and the USA in resolving the national question dodged by their competition.

If not for the war that had put the credibility of India and the USA to shambles, China wouldn’t have had the confidence and space to come into this part of the Indian Ocean.

Both the Sinhala polity and Eezham Tamil polity, in their own ways, have taken their revenge on long-blighting India and the USA.

The Eezham war and the entry of China has its telling effects on many others in the Asia Pacific region too, who either tagged behind the USA or India, blindly supported genocidal Sri Lanka.

An Indian military commander swore a couple of days back that India would build a base in South China Sea in retaliation of China’s base in Seychelles.

The USA this week has taken efforts to strengthen its base in Singapore and Philippines, apart from its military presence in Darwin in Australia and around 70,000 US troupes in Japan.

The Establishments in Australia, Japan and in the South China Sea countries, Vietnam, Philippines, Malaysia and Singapore were blindly supporting Colombo’s war that has brought in the Chinese to the scene.

Not only the Establishments in the Asia-Pacific, but some Islamic countries also supported the anti-humanity war of Colombo, thinking that they contribute to anti-US polity. They had their turn of seeing Sri Lankan-model-inspired action.

As China’s entry into the region has become a reality, Tamils should seriously consider the positive aspects of the phenomenon. They should explore avenues – if needed even effective non-cooperation – in persuading India and the USA to deliver the righteous political justice long due to the nation of Eezham Tamils.

There is an inherent lacuna in Tamil polity compared to the Sinhala polity that was using all avenues.

The Sinhalese elite may brag about the success of their international ‘diplomacy’ that was always preoccupied with the Tamil question ever since independence or even before that. But they paid for it by getting a military regime.

If unchecked, the option that would be preferred by the powers in competition is obvious: The SL military will be competitively nurtured forever by the powers to shield their crimes, to facilitate their entry into the island, and to serve as a security service to their interests.

All the while, the existence of such a military will be justified to the dominant Sinhala nation, by continuing the Tamil question unresolved on one hand, and by tacitly approving the genocidal orientation of the ethnically Sinhalese military on the other hand.

The way out for the Sinhala nation is to concede the independence of the nation of Eezham Tamils and then to work for a genuine reconciliation, getting rid of the military and the preying powers.

Genuine reconciliation comes from peoples of parity. Sinhalese settling in the North and East or building Buddhist stupas there won’t be issues at all, when nations in the island have sovereignty in their countries.

The ‘reconciliation’ that comes from the USA and India and chanted by the militarised state in the island is only ‘reconciliation’ of the oppressed with the oppressors.

If the ruling elements of the Sinhala nation is continued to be incapable of conceiving what is reconciliation, and if the competition of the powers also is continued to be deceitful in delivering justice, then the democratic and mass struggle of the Tamils may have to be widened to include the Tamils of Tamil Nadu too, against the military-colonial state in the island and its competing god fathers outside. Such a struggle should be in partnership with the Sinhalese, aiming for their liberation too from the militarised state.

The capacity development of the grassroot in Tamil Nadu in coming out of the shackles of the elite sitting on it and the Eezham Tamil diaspora coming out of its subservience in political thinking are crucial in this respect.

Genuine voices have started coming from the Eezham Tamils in the island facing untold suffering and suffocation. The diaspora and Tamil Nadu should get the cue.

Mobilising a concerted and genuine people’s struggle against the real impediment ie., convincing the competing powers to acknowledge the self-determination of the genocide affected Eezham Tamils, is more important than chasing a mirage in Geneva in next March.

சென்னை, டிச.11: முல்லைப் பெரியாறு விவகாரம் தொடர்பாக உச்சநீதிமன்ற முன்னாள் நீதிபதி வி.ஆர்.கிருஷ்ண ஐயருக்கு மதிமுக பொதுச்செயலாளர் வைகோ கடிதம் எழுதியுள்ளார். இதுகுறித்து மதிமுக வெளியிட்ட செய்திக் குறிப்பில் அந்தக் கடிதம் குறித்து தெரிவிக்கப்பட்டுள்ளது:கடித நகல்:மதிப்பிற்குரிய உயர் கிருஷ்ண அய்யர் அவர்களுக்கு,வணக்கம். தங்கள் நலமே விழைகின்றேன். கீழ்காணும் சில செய்திகளைத் தங்கள் கவனத்துக்குக் கொண்டு வர விழைகின்றேன்.நான் தங்கள் மீது மிகுந்த அன்பும், மரியாதையும் கொண்டு உள்ளேன். தாங்கள் அளித்துள்ள சிறந்த பல தீர்ப்புகளை, மேடைகளில் மேற்கோள் காட்டிப் பேசி வருகின்றேன். இந்த டிசம்பர் பத்தாம் நாள், 1948 ஆம் ஆண்டு, மனித உரிமைகள் பிரகடனம் வெளியிடப்பட்ட, வரலாற்றுச் சிறப்புக்கு உரிய நாள்.நீங்கள் ஒரு மனித உரிமைப் போராளி. இனப்படுகொலைக்கு உள்ளாகி இருக்கின்ற ஈழத்தமிழர்களின்பால் தாங்கள் கொண்டு உள்ள பரிவுக்காக, தமிழர்களாகிய நாங்கள் நன்றிக்கடன்பட்டு உள்ளோம்.1988 ஆம் ஆண்டு மே மாதம் முதல் நாள், லண்டன் நகரில் நடைபெற்ற, ஈழத்தமிழர்கள் குறித்த கருத்து அரங்கில், நான் தங்களுடன் பங்கு ஏற்றேன். என்னுடைய வேண்டுகோளை ஏற்று, 1996 ஆம் ஆண்டு 15 ஆம் நாள், சென்னையில் மறுமலர்ச்சி திராவிட முன்னேற்றக் கழகம் நடத்திய மாநில சுயாட்சிக் கருத்து அரங்கில் பங்கு ஏற்று உரையாற்றிச் சிறப்பித்தீர்கள். அன்று தாங்கள் என்னிடம், 1957 ஆம் ஆண்டு கேரள அரசில் தாங்கள் அமைச்சராக இருந்தபோது, கேரளத்துக்கு அரிசி, காய்கறிகள், பழங்கள், பால் தருகின்ற தமிழகத்துக்குத் தேவையான தண்ணீரைத் தர வேண்டும் என வலியுறுத்தியதாகக் குறிப்பிட்டீர்கள். தங்களுடைய தொலைநோக்குப் பார்வையை எண்ணி நான் மகிழ்ந்தேன்.ஆனால், முல்லைப்பெரியாறு அணையை உடைக்க வேண்டும் என்பதை வலியுறுத்தி நடைபெற்ற மனிதச் சங்கிலியில்,  அச்சுதானந்தன் அவர்களோடு தாங்கள் கைகோர்த்து நின்ற செய்தியை அறிந்தபோது, நான் மிகுந்த அதிர்ச்சி அடைந்தேன். அறிவும் ஆற்றலும் நிறைந்த பெருந்தகையாகிய தாங்கள், முல்லைப்பெரியாறு அணைப் பிரச்சினையின் உண்மை நிலையை ஆராய்ந்து, உணர்ந்து இருக்க வேண்டும்.  மிட்டல் மற்றும்  பிரார் ஆகியோர் தலைமையில், உச்சநீதிமன்றம் அமைத்த வல்லுநர் குழுக்கள், முல்லைப்பெரியாறு அணையின் உறுதித்தன்மையை, ஆய்வுகள் நடத்திச் சோதித்து அறிந்து, பென்னி குக் கட்டிய அந்த அணை, 1979 ஆம் ஆண்டுக்கு முன்பே வலுவாகத்தான் இருக்கின்றது என்பதை உறுதிசெய்து அறிவித்து உள்ளது. அதற்கு மேலும், கடந்த முப்பது ஆண்டுகளாக, தமிழக அரசு, பல புதிய தொழில்நுட்பங்களைக் கொண்டு, முல்லைப்பெரியாறு அணையை வலுப்படுத்துகின்ற பணிகளைச் செய்து இருக்கின்றது. எனவே, 7 ரிக்டர் அளவுக்கு நில நடுக்கம் ஏற்பட்டாலும், முல்லைப்பெரியாறு அணை அதைத் தாங்கி நிற்கும்.முல்லைப்பெரியாறு வழக்கில், இருதரப்பினரின் வாதங்களையும் கேட்டு அறிந்தபிறகு, 2006 ஆம் ஆண்டு, பிப்ரவரி மாதம் 27 ஆம் நாள், உச்சநீதிமன்றத்தின் மூன்று நீதிபதிகள் அமர்வு அளித்த தீர்ப்பில், முல்லைப்பெரியாறு அணையின் நீர்மட்டத்தை 142 அடியாக உயர்த்தவும், மத்திய நீர்வள ஆணையத்தின் பரிந்துரையின்படி, அணையை மேலும் வலுப்படுத்தும் பணிகளைத் தமிழக அரசு மேற்கொள்வதற்கும் தீர்ப்பு அளித்து உள்ளது. அந்தப் பணிகளை நிறைவேற்ற, கேரள அரசு எவ்வித முட்டுக்கட்டையும் போடக்கூடாது எனவும் அறிவுறுத்தி உள்ளது. அணையைப் பலப்படுத்தும் பணிகள் முழுமையாக நிறைவு பெற்ற பின்னர், அதை வல்லுநர்கள் ஆராயவும், அதற்குப்பின்னர், அணையின் நீர்மட்டத்தை 152 அடிக்கு உயர்த்திக் கொள்ளலாம் எனவும் உச்சநீதிமன்றம் தீர்ப்பு அளித்து உள்ளது. ஆனால், இந்தத் தீர்ப்பைப் குப்பைக்கூடையில் தூக்கி எறிந்து விட்டு, கேரள அரசு சட்டமன்றத்தில் ஒரு சட்டத்தை இயற்றி உள்ளது. அதன்படி, கேரளாவில் உள்ள அணைகளைப் பராமரிக்க மட்டும் அன்றி, வலு இழக்கச் செய்யவும், கேரள நதிநீர் ஆணையத்துக்கு உரிமை உண்டு எனவும், முல்லைப்பெரியாறு அணையின் நீர்மட்டம் 136 அடி எனவும் குறிப்பிட்டு உள்ளது. கேரள மக்களின் உயிர்களைப் பலியிட்டாவது தண்ணீரைப் பெற வேண்டும் என்று தமிழகம் ஒருபோதும் கருதியது இல்லை. ஆனால், கேரளத்தில் அக்கறையுள்ள சில அரசியல் சக்திகள், தவறான பொய்ப்  பிரச்சாரத்தை மேற்கொண்டு, கேரள மக்களிடம் அச்சத்தை ஏற்படுத்தி உள்ளனர்; முல்லைப்பெரியாறு அணையை உடைத்து நொறுக்கவும் தூண்டி விட்டு உள்ளனர். ஒரு வாதத்துக்காக அணை உடைவதாக வைத்துக்கொண்டாலும், அதில் இருந்து வெளியேறுகின்ற தண்ணீர், 70 டி.எம்.சி கொள்ளளவுத் திறன் கொண்ட இடுக்கி அணைக்குத்தான் நேராகச் செல்லுமே அன்றி, அதனால், கேரள மக்களின் உயிருக்கு எவ்வித அச்சுறுத்தலும் இல்லை.நாங்கள், கேரள மாநிலத்தோடு நட்பு உறவையே விரும்புகிறோம். ஆனால், தங்களைப் போன்ற மதிப்பிற்கு உரியவர்கள், முறையற்ற ஒரு போராட்டத்தில் பங்கு ஏற்றதை அறிந்து வருந்துகிறோம். ஒரு நீதிபதியாகிய தாங்கள், இரண்டு மாநிலத்துக்கும் பொதுவாகவே நடந்துகொள்ள வேண்டும் என எதிர்பார்க்கின்றோம்.2011 டிசம்பர் 10 ஆம் நாள், தமிழக அரசு செய்தித்தாள்களில் வெளியிட்டு உள்ள விவரமான விளக்க அறிக்கையையும், தமிழக அரசு பொதுப்பணித்துறையின் முன்னாள் தலைமைப் பொறியாளர்  ஆர்.வி.எஸ். விஜயகுமார் அவர்கள் எழுதி உள்ள விளக்கக் கடிதத்தையும், இத்துடன் தங்களுக்கு இணைத்து அனுப்பி உள்ளேன். வைகோ

இது தொடர்​பாக மதுரை கீரைத்​து​றை​யைச் சேர்ந்த அட்​டாக் பாண்டி,​​ திருச்​செல்​வம்,​​ பிரபு,​​ சர​வ​ண​முத்து,​​ முரு​கன்,​​ விஜ​ய​பாண்டி,​​ கந்​த​சாமி,​​ ரமேஷ்​பாண்டி,​​ ராமை​யா​பாண்டி,​​ வழி​விட்​டான்,​​ தாழ​முத்து,​​ சுதா​கர்,​​ ரமேஷ்​கு​மார்,​​ திரு​மு​ரு​கன்,​​ ரூபன்,​​ மாலிக்​பாஷா ஆகிய 16 பேர் மீது வழக்கு பதிவு செய்​யப்​பட்​டது.​
பின்​னர்,​​ இந்த வழக்கை 19.5.2007 முதல் சிபிஐ விசா​ரித்​தது.​ அப்​போது ஊமச்​சி​கு​ளம் டி.எஸ்.பி.யாக இருந்த ராஜா​ராம் 17}வது குற்​ற​வா​ளி​யாக வழக்​கில் சேர்க்​கப்​பட்​டார்.​ அவர் பணி​யில் கவ​னக்​கு​றை​வாக இருந்​த​தா​க​வும் சம்​ப​வத்​தைத் தடுக்​கத் தவ​றி​விட்​ட​தா​க​வும் குற்​றஞ்​சாட்​டப்​பட்​டது.​
இந்த வழக்​கில் 32 பக்க குற்​றப்​பத்​தி​ரிகை தாக்​கல் செய்​யப்​பட்​டது.​ 85 சாட்​சி​க​ளி​டம் விசா​ரணை மேற்​கொள்​ளப்​பட்​டது.​

மதுரையில் 'தினகரன்' அலுவலகம் அடித்து நொறுக்கப்பட்டு தீ வைக்கப்பட்டது உண்மையா? அதில் மூன்று உயிர்கள் பலியானது உண்மையா? இது உள் குடும்பப் பிரச்சினையின் காரணமாக நடந்ததா? இதில் உயிர் இழந்த மூவரும் கூலிக்காக உழைப்பை நல்கியவர்களா? இந்த அராஜக நிகழ்ச்சி எல்லா ஊடகங்களிலும் புகைப்படத்துடனும், படக்காட்சியுடனும் வெளியிடப்பட்டதா? அப்படியொரு சம்பவம் அங்கு நடந்தது உண்மையா? அதில் குற்றவாளிகள் யார்? சட்டம் ஒழுங்கு இவற்றின் அடிப்படையில் நடக்கும் ஒரு அரசாங்கத்தால் குற்றவாளிகளுக்குத் தண்டனை வாங்கித் தரும்படி வழக்கை நடத்த முடியாதா? பொய் சாட்சி சொன்னால் தண்டனை இல்லையா? குஜராத்தில் பொய் சாட்சி சொன்ன ஒரு பெண்மணிக்கு தண்டனை கொடுத்தது உண்டா இல்லையா? இந்த நாட்டில் அதே குடும்பத்தினருக்கே பாதுகாப்பு இல்லாதபோது சாதாரண பாமரனுக்கு என்ன பாதுகாப்பு? உயிரிழந்தோருக்காக பழிவாங்க பாடுபடுவேன் என்று சூளுரைத்த அந்தப் பத்திரிக்கை முதலாளி என்ன சொல்கிறார்? இவற்றுக்கு பதில் மக்களுக்குத் தெரிய வேண்டும்.

We should immagine how the family members of these deceased persons will curse our police, courts, administration and specifically Karuna Nithi and his family members. It is similar to Pandiayan murder case at Madurai. God will definitely punish the culprits .
