NCET expects Norway to approach Eezham Tamils with fresh attitudes, personalities

Peace comes from absence of fear, violence and social confrontations. Reconciliation comes from justice and parity between the parties. Development of a people comes from their right to conceive it and own it. How could Norway expect Eezham Tamils in Norway to contribute to peace, reconciliation and development within the Sri Lankan frame, amidst militarisation, colonisation, subordination, denial of justice and denial of ownership to development, asked Norwegian Council of Eezham Tamils (NCET) in a document it presented at a foreign-ministry-funded seminar in Oslo on Sunday. In its peace facilitation, Norway fielding fresh personalities with attitudinal change would immensely help to build its credibility, the document said. The seminar will be addressed by Norway’s development Minister, Mr. Erik Solhiem, when it continues for the third day on Monday.

The themes of the Friday to Monday seminar are “What can be done to strengthen integration in Norway? How Tamils in Norway could contribute to peace, reconciliation and development in Sri Lanka?”

Sometimes back, the NCET, a democratically elected body of Eezham Tamils in Norway, requested the Norwegian Foreign Ministry and the Ministry for Children, Equality and Social Inclusion for a meeting to discuss the affairs of Eezham Tamils.

The foreign ministry in response funded and entrusted the responsibility to Nansen Centre for Peace and Dialogue (NCPD) to conduct a seminar on the above themes for the representatives of the NCET along with some other Norway Tamils chosen by the organisers.

The focus and specialisation of the NCPD is in conducting seminars to “open possibilities for institutional change, where the situation is no longer seen through ethnic lenses.”

The NCET document, signed by its president Mr. Panchakulasingham Kandiah, said that they participate in the seminar seeking discussion and solutions while registering their rejection of the phrasing of the second topic of the seminar.

Pointing out the inner contradictions between Norway’s stand and the expectations of the seminar, NCET asked that if Norway wants domestic solutions in the island then why it is interested in peace, reconciliation and development going from outside from Norway Tamils?

NCET cited Norway’s report on the failed peace process that had criticized Norway for not withdrawing from the peace process when such an act could have told the realities of the war to the world. NCET also cited the report indirectly accepting the genocidal nature of the war.

When such is the responsibility, Norway disowning it and leaving solutions to internal efforts is one-sidedly favouring the stand of the Sri Lankan state and its regime, the NCET accused.

The wards of the Chaavakachcheari hospital, renovated with help from Red Cross societies from Finland and Ireland at different stages and that were already declared open, were declared once again opened by SL president Mahinda Rajapaksa on Monday. The ‘hijack’ move projected as a part of ‘grand opening’ under Rajapaksa's Vadakkin Vasantham (the spring of the North), was exposed by the local journalists, who discovered that the initial inaugural plaques with the names of foreign donors were hastily removed Sunday night and new plaques were installed. As the local journalists in Jaffna began questioning the episode, the SL establishment blocked the journalists from covering the visit of Mr. Rajapaksa to Jaffna Secretariat where he was scheduled to discuss his ‘development’ of North.

During his visit, Mr. Rajapaksa and his son Namal Rajapaksa also declared open a swimming pool at Jaffna Central College. The swimming pool project, initially launched by the ‘Blue Brigade’ of Namal Rajapaksa five years ago, was completed at last by diverting the funds allocated to reconstruct the schools in Vanni this year, civil sources in Jaffna complained.

At the hospital re-opening, Mr. Rajapaksa condemned media for functioning as they did during the times of the war. He said journalists were creating ‘ethnic divisions’.

Sri Lanka Army shelling and SLAF bombardment destroyed Chavakachcheari hospital in year 2000. After 11 years, basic facilities and various sections of the hospital have been reconstructed with the help of foreign donors. Japan had also shown interest in reconstructing the hospital, but the authorities in Colombo had dropped the move.

The completion of the much publicized swimming pool project at the Jaffna Central College had been struck by corruption and was dragged on for five years by Namal Rajapaksa who didn't manage to complete it. The project was completed after diverting five million rupees of funds allocated to reconstruct the schools in Vanni by the Northern provincial ministry of education. The schools in Vanni are languishing without proper shelter and teachers.

During his address at the opening ceremony of the swimming pool at Jaffna Central College, Mr. Rajapaksa warned Tamil students not to get distracted by the elusive forces [from South] that seek to divert their attention from studies [to anti-government activities]. He insisted that Tamil students should learn Sinhala language in addition to English and said all in the island should learn the three languages.

Mr. Rajapaksa attempted to address the students briefly in Tamil. When the SL president was making a lot of pronunciation errors, the students started shouting.

As part of its ongoing structural genocide being committed on Eezham Tamils, the Sri Lankan government under Rajapaksa aims to complete the Sinhalicisation of the Tamil country before year 2020.

The reporters of a leading Tamil daily were blocked from covering the swimming pool opening.

Later, Mr. Rajapaksa attended a meeting at Jaffna district secretariat. Tamil journalists, except the EPDP operated media men belonging to Dan TV, Thinamuarsu and EPDP website, were blocked from covering Rajapaksa's ‘development’ meeting at the Jaffna District Secretariat. Tamil journalists who had gathered at the District Secretariat, including those who had come from Colombo, were chased away.

In the meantime journalists in Jaffna blamed that the visiting Sri Lankan President has proclaimed a war against them in Jaffna on Monday.

The SL authorities had instructed administrative officials of the five districts of Northern province to be present at Rajapaksa's meeting at Jaffna Kachcheari. Some of the female officials complained that they were forced to wear blue cloths and carry Sri Lankan lion flag to welcome the SL president.

TNA parliamentarians and the elected TNA representatives of the civic bodies in the North were not present at the ‘development’ meeting.

Suresh Premachandran of the TNA has said that the TNA was systematically excluded and that only a last minute invitation was given making it impossible for TNA to make a proper representation at the meeting.

The SL president, in his address at Chaavakachcheari hospital also claimed that there was no division such as ‘North, East, West, South and Up-country’ in the island. Mr. Rajapaksa further said that he had once asked Mr. Devananda why the Tamil parties and groups had put forward ‘unrealistic’ demands at Thimphu. Rajapaksa said that Devananda had responded by saying that Tamil parties and groups were intentionally putting forward ‘unrealistic’ frameworks to make it impossible for the SL government to agree upon anything.

Without mentioning the name of the TNA, the visiting SL president said the Tamil parties were still coming with ‘unrealistic’ demands as they did in Thimphu in 1985.

MPs, peers from the House of Lords and a cross-party group of politicians endorsed the call for an independent, international investigation into allegations of war crimes in Sri Lanka, at an exhibition organized by the BTF and APPGT held Tuesday at Portcullis House, a parliamentary building in Westminster. The exhibition highlighted the protracted nature of the genocide of the Eezham Tamils through a creative use of artwork, paintings, newspaper clippings, slides and documentaries. The event was widely welcomed by those who attended, including the shadow foreign secretary, Douglas Alexander, Labour MP for Wolverhampton South-East, Pat McFadden, Lord Quirk, Father Emmanuel of Global Tamil Forum (GTF), and Lord Kennedy. "We must stop the genocide of the Tamils. The world must stop the barbarism of the Sri Lankan regimen," Robert Halfon, Conservative MP from Harlow said at the venue.

Focusing on a central gallery of slides highlighting the overwhelming evidence of war crimes, crimes against humanity and genocide, as well as the ongoing militarisation and colonization in Tamil Eelam by the Sri Lankan state, the exhibition also included a short video depicting the testimonies of survivors, as well as art work illustrating the horrors endured by the Tamils in their homeland.

A few key eyewitnesses from the last stages of the war on the Eezham Tamil people were also present at the event.

The visitors were deeply moved by a set of 80 slides titled ‘Annihilation of Tamils and their disappearing land – 60 years on’, sources told TamilNet.

In a strong statement condemning Sri Lanka, Robert Halfon, Conservative MP, Harlow said "We must stop the genocide of the Tamils. The world must stop the barbarism of the Sri Lankan regimen"

"The need for international independent investigation into the crimes and atrocities that have taken place in Sri Lanka is clear from your exhibition and the UK has a responsibility to act to make this happen," said Heidi Alexander, Labour MP Lewisham East.

She was complemented by Adrian Bailey, Labour MP, West Bromwich who opined that “This display illustrates that persecution and injustice still prevail in Sri Lanka. They underline the need for international investigation and action."

The chairman of the APPGT, Lee Scott, Conservative MP for Ilford North, pledged to continue to fight for justice for the Eezham Tamils.

Former UK defence secretary Liam Fox was also present at the venue.

Stressing the need for swift international action, a BTF press release said that “If the international community fails to act now, the Tamil population and their identity would be completely wiped out from Sri Lanka within a short period, completing the structural genocide.”

Organised by the British Tamil Forum (BTF) and the All Party Parliamentary Group for Tamils (APPGT), the event was supported by Tamil youth who guided attendees through the exhibition, including members of the Tamil Youth Organisation (TYO UK) and Tamil youth from Holland.

British Tamils Forum (BTF), Canadian Tamil Congress (CTC), Holland Tamil Forum (HTF), UK Tamils Youth Organisation (TYO-UK) and Tamil Information Centre (TIC) helped in research and fact compilation for this exhibition, the organisers said.

Working in collaboration with Tamil societies at London universities, the TYO-UK designed a creative exhibit detailing the eight stages of the genocide of Eezham Tamils.

In a forceful rebuttal to the U.S. State Department's suggestion of immunity to Sri Lanka President Rajpakse in the war-crimes charges against him in the case filed in District Court in Washington by three Tamil plaintiffs, Bruce Fein, the attorney for the plaintiffs, said, 'the sitting head of state immunity issue pivots solely on an interpretation of the words “an individual” in the Torture Victim Protection Act (TVPA)," "the plain language of the statute makes no exceptions irrespective of the office an individual might occupy or the circumstances of the crimes universally abhorred," but "[t]he Executive Branch insolently maintains that this Court must obey its directive to dismiss this TVPA case that rests upon universally repugnant crimes in violation of the law of nations," and " [t]o bow to that command would be to permit usurpation of the judicial power by the Executive."

The rebuttal argument was filed with the Court on the 3rd February, and the U.S. State Department is given another 10 days to file a reply to the response.

Mr Fein told TamilNet that the U.S. Justice Department which simply told the judge that suggestion of Immunity is dispositive, ignoring the textual contents of the TVPA, will unlikely put forward any "new" reasoning. "If they do, then he will request the Judge for an opportunity for a "Sur Reply" to respond to any new arguments that Justice Dept. might put forward in the expected 13th February submission," Fein said.


Limits of Executive Power
Fein who routinely gets invited to testify in constitutional questions, drew on his expertise as a Constitutional lawyer to analyze the present case in the context of Justice Robert Jackson view of Executive power in foreign relations in a famous court opinion.mJackson elborated a tripartite analytical scheme for evaluating the President’s claim of constitutional authority in the realm of foreign affairs:
  1. “When the President acts pursuant to an express or implied authorization of Congress, his authority is at its maximum, for it includes all that he possesses in his own right plus all that Congress can delegate.” It is in these circumstances that he can be said to personify federal sovereignty, and his acts would be entitled to the widest latitude of judicial interpretation.
  2. “When the President acts in absence of either a congressional grant or denial authority, he can only rely upon his own independent powers.”
  3. “When the President takes measures incompatible with the expressed or implied will of Congress, his power is at its lowest ebb, for then he can rely only upon his own constitutional powers minus any constitutional powers of Congress over the matter. Courts can sustain exclusive presidential control in such a case only by,disabling the Congress from acting upon the subject. Presidential claim to a power at once so conclusive and preclusive must be scrutinized with caution, for what is at stake is the equilibrium established by our constitutional system.”
Fein argues that the Plaintiffs’ TVPA case falls into Justice Jackson’s category three, where presidential authority is at its nadir.

Fein adds: "Congress declared “an individual” without exception subject to a civil damages remedy for perpetrating despicable crimes in violation of the law of nations. The Executive Branch butts heads with the congressional enactment in this case by demanding an exception for the notorious sitting head of state of Sri Lanka, whose heinous actions epitomize what Congress aimed to deter by enacting the TVPA.

"Unless the TVPA is unconstitutional—which the Executive Branch does not argue—the will of Congress must prevail and the Suggestion of Immunity must be rejected," Fein argues.

Fein concludes his argument asserting that "any system of justice that bestowed immunity on criminally culpable sitting heads of state for the damages inflicted by their crimes of torture or extrajudicial killing in violation of the law of nations would deserve the odium of all civilized peoples," and adding that, "it strains credulity to believe Congress intended to visit such odium on the United States in enacting the TVPA under the banner of human rights."

Occupying Sri Lanka plans to invite China to build an airport of international standard at Poonakari in the north of the country of Eezham Tamils to balance India’s projects centring around KKS harbour and Palaali airport in the northern coast of Jaffna Peninsula, news sources from the island said. Colombo has started confiscating large tracts of lands for this purpose and China has presented models of the airport for approval, revealed TNA parliamentarian Mr. Sritharan. Poonakari is situated in a controlling location linking Vanni with Jaffna Peninsula, with Palk Bay and Jaffna Lagoon on either side. It is also located close to Raameasvaram and Tho’ndi of the Tamil Nadu coast.

Sometimes back, SL military officials in Jaffna were heard bragging about their ‘diplomacy’ of giving the construction of KKS harbour and Palaali airport to India and involving a Chinese government corporate to use the rest of the northern coast of Jaffna in the guise of installing solar panels and windmills.

A feature appeared in SL government-run Daily News in July 2010, cited Sri Lanka’s occupying military commander in Poonakari, Col. Susantha Gunasekara saying that “as per historical records all enemy incursions to Sri Lanka in the past had been done through Pooneryn and before the last victorious military exercise there had been 135 battles to capture and regain Pooneryn [Poonakari].”

The Daily News feature was also then referring to Sri Lanka’s plan to build the third international airport of the island at Ira’nai-madu in Ki’linochchi. The choice must have now fallen on Poonakari and China has been preferred for the task, considering the advantage of the location of Poonakari checking any ‘enemy incursions’ from Tamil Nadu/ India, political observers in Jaffna said.

Poo-nakari means the city of flowers. The suffix Nakari is a variation for Nakar in old Tamil. Identical to place names like Aazhvaar Thiru-nakari in Tamil Nadu on the opposite coast, and connected to Negeri in Malay, Poo-nakari is a name retaining an ancient linguistic strain. It became Pooneryn in the colonial records.

Meanwhile, constructing a tourist resort in the Nedun-theevu(Delft) island off Jaffna and close to Kachcha-theevu and Raameasvaram in the Palk Bay has been given to China, news sources in Jaffna said.

Today, Sri Lanka celebrates the 64th anniversary of its independence. It revels in the splendidness of the occasion of remembering its release from the British yoke.

As a nation and a country, the Sri Lanka is entitled to rejoice on this occasion. We, of Tamil Eelam, would go any length to wish the Sinhala nation all resplendence and prosperity on this happy occasion of theirs, if it were only their independence that they are celebrating today.

Unfortunately, that is not the case here. Today, Sri Lanka celebrates its Independence Day also denoting the completion of its subjugation of Tamil Eelam. Therefore, this Independence Day of Sri Lanka is not only a day of mourning for us but also a day of resolve to rededicate ourselves in our struggle for freedom.

There has never been a day in the annals of history when Tamil Eelam was prepared to surrender its sovereignty and independence willingly to Sri Lanka.  There will never be one! The struggle to retrieve our lost sovereignty shall continue to be the incessant task in our hands.

History has already recorded the momentous time when the Tamils of Eelam took hold of the sovereign affairs of their land into their own hands, however briefly, when the “de facto” State of Tamil Eelam was functioning in Vanni under the guidance of our National Leader.

Sri Lanka has managed to trample our sovereignty once more through its military aggression. It was only able to do so by exploitation of the opportunity presented by an international order in which, unfortunately, the sovereign will of the small nations of this world or the principles of justice and fair play have become subordinate to the interests of powerful states today in setting history.

For 64 long years, Sri Lanka has continued to deny to the Tamil Nation its right of self-rule. Instead, it has been executing a carefully planned program of Genocide of the Tamil Nation. From the day the Sinhalese assumed authority for the affairs of the independent island of Ceylon, the pages of its history are replete with horrendous incidents of genocidal activities perpetrated against the Tamils of Eelam.

These actions have been in the form of aggression on the heritage of our lands, disenfranchisement of a sector of our people, exclusion of Tamils from educational and employment opportunities, destruction of our cultural, historical, archaeological heritage sites and a series of pogroms unleashed upon us from time to time. The cruelest form of this aggression that put the entire civilized world to shame was the barbaric and genocidal conduct of the final phase of the war for Vanni. These expressions of the Sinhala nation’s racism conducted with impunity and insouciance for 64 years have hurt generations of Tamils.

Conceited and emboldened by its latest military victories in Tamil Eelam, the Sri Lankan regime has accelerated its activities of aggression and expedited its efforts to liquidate the Tamil people and their land.
It is under these tragic circumstances that we wish to convey one message to the racist regime of Sri Lanka, on this anniversary of their independence. Let us be unmistakably clear; Let us have no ambiguity on this.

The Nation of Tamil Eelam is determined to reassume its lost sovereignty one day. Our struggles will not cease until then.

This is the one message to the hegemonic Sinhala-Buddhist regime of Sri Lanka that we would want to emphasize upon.

Your military aggression and your continuous encroachment may continue to dispossess our people in their own land.  But you will never be able to possess their hearts or minds.
So long as you fail to win the hearts of these people, you remain the aggressors. Being the unwelcome guests, you will have to vacate our lands one day, someday if not today.

Today, while you reflect on the meaning of freedom and independence, while you celebrate encroachment of our land, we call upon you to vacate your armed forces, the symbol of your aggression, from our homeland forthwith.
We also call upon the forward thinking forces of the Sinhala Nation and indeed the entire world to raise their voices in the name of justice for the freedom of the Nation of Tamil Eelam.

Eezham Tamil activists in Norway on Saturday released stamps featuring LTTE leader V. Pirapaharan, the map of Tamil Eelam and some of the LTTE declared national symbols of the de-facto state of Tamil Eelam, including the Tamil Eelam national flag. The stamps were released in front of the Norwegian Parliament by Jeyasri Balasubramaniam, a candidate elected to represent the Eezham Tamils in two elections held in that country. The event coincided with the so-called independence day of Sri Lanka. On 4th February 1948, the British conferred dominion status to the island then called Ceylon and transferred power to a Colombo-centric, ethnic majoritarian and unitary system of government.

The release of the stamps, bearing Norway's postal authority insignia, comes following the release of similar stamps in other countries in Canada and in other countries in Europe.

Tamil activists were seen distributing stamps to Norwegians and Eezham Tamils amidst the cold weather prevailing in the capital of Norway, sources in Oslo said.

If it is, then Britain must be reminded of its moral, legal and ethical obligations, to ‘do the right thing’, by the Tamils even belatedly,” says Dr. Brian Senewiratne in an article he has authored on the so-called independence of Ceylon on 04 February 1948. “It is no exaggeration to say that on 4 February, 1948, ‘Independence’ was granted to the Sinhalese to do what they wanted to the Tamils. Britain could not care less, as long as the military bases were secure and the (British) tea estates remained under Sinhalese capitalist control, to supply tea at absurdly low prices to fill the British cup.”

“The Tamils are not going to get justice, any more than black South Africans were going to get justice from those who ran the apartheid regime. Justice will have to be extracted from a brutal, barbaric, ruthless, totalitarian regime. It cannot be negotiated, as Neville Chamberlain learnt in dealing with Hitler,” he further writes putting forward an action plan on February 04.

The British irresponsibility

Of all the irresponsible acts of the colonial British in Sri Lanka, by far the most serious was leaving the country in the hands of the Sinhalese majority. If Britain was the cause of the problem, then it has to be part of the solution. To support the blatantly anti-Tamil Sri Lankan government, is to compound the problem, not to resolve it.

It is absurd to claim that the British were unaware of the anti-Tamil stance of the Sinhalese ‘leaders’ such as D.S. Senanayake, leader of the United National Party (UNP), who took over from the British. Senanayake’s anti-Tamil stance (and actions) was clearly evident. This included altering the demography of the Tamil East by relocating Sinhalese from the South to make places like Amparai, a Tamil area, into a Sinhalese area.

Sinhalese leaders have never been inspired by any desire to create a common nationalism out of ethno-religious diversity. They peddled the Sinhala-Buddhist jingoism of blatant anti-Tamil propagandists such as Anagarika Dharmapala, based on an exaggerated vision of the Sinhalese past.

It is important to focus on this ethnic intolerance since this is what is happening today more so than it ever has, and has to be addressed.

Anagarika Dharmapala was a confused, quixotic Buddhist with a crusading missionary zeal. He even renamed himself for the purpose. Originally Don David Hewawitarne, he took on the name “Anagarika” (in Pali “the homeless one’), “Dhamapala’ (guardian of the doctrine). His propaganda was based on distortions, half-truths and blatant lies, peddled as historical evidence of the glories of the ancient Sinhalese.

A single example will suffice. In 1911, Dharmapala proclaimed “The Country of the Sinhalese should be governed by the Sinhalese”. In his view, the Tamils and others had no place in Sri Lanka. Every Sinhalese leader has peddled this ethnic chauvinism with increasing virulence, to get the electoral support of the Sinhalese majority (74% of the population). The British were well aware of this. Indeed concerns about the plight of the minorities were raised, not once but twice, by those in the British Colonial Office before Independence was given.

All that Britain did was to insert just one ‘safe-guard’ clause, Section 29 (2) (b) and (c), that no law shall impose any disabilities, or confer any advantage, on members of any one community. There were no penalties or consequences if this was violated (which it was, in full view of the British Governor of ‘Independent’ Ceylon).

Within a year of Independence (1948), legislation was passed to disenfranchise and decitizenise a million Plantation Tamils, a seventh of the population at the time, in one of the worst acts of political vandalism in the world. What did Britain do? Nothing.

In 1956, systematic discrimination against the ethnic Tamils started (and progressed).

As pogrom after pogrom against the Tamils continued, ending in the genocidal killing of the Tamils in the North and East in 2009, what did Britain do? Support the murderous Sri Lankan Government, even supplying the necessary weapons and expertise.

Now with the ‘slow extermination’ of the Tamils in the North and East, what is Britain (and the USA) doing? Taking part in the fire-sale of the Tamil areas and attempting to exclude China’s increasing foothold in Sri Lanka, so essential for the control of the economically crucial Indian Ocean.

It was an Englishman, George Turnour who in 1826 had a manuscript delivered to his office in the Sinhala South. This was The Mahavamsa , which he had translated into English and widely distributed. Regarded as a major historical discovery, it is, in fact, what I have called ‘The textbook of Sinhala supremacy”. To be fair by the author, a Buddhist monk, it was written “for the serene joy of the pious’, not as a record of history. It glorifies the Sinhalese as protectors of Buddhism and saviours of the nation, and derides the Tamils as invaders, vandals, marauders and heathens. It is this ‘Mahavamsa mind-set’ of the Sinhalese that has prevented any form of justice for the Tamil people. Immeasurable damage has been done by this single document to ethnic relations in Sri Lanka.

Anagarika Dharmapala’s ethnic chauvinism of 1900 (“the Country of the Sinhalese should be governed by the Sinhalese”), was faithfully reproduced a century later. Army Commander Sarath Fonseka in an interview to the National Post newspaper in Canada on 23 September 2008, said, “I strongly believe that this country belongs to the Sinhalese. We being the majority, will neve give in. They (the minorities) can live in this country with us. But must not try to under the pretext of being a minority, demand undue things”

Fonseka does not need to give ‘permission’ for the Tamils to live in Sri Lanka. They are there because they were born there and have a right to be there.. They do not need to pretend to be a minority, they are a minority. What are the ‘undue things’ they demand? To have their basic human rights protected, not to be discriminated against, not to be raped, tortured, or ‘disappear’, and not to be non-people whose very existence is in doubt.

All this is well-known. If it is not, a comprehensive Report has just been tabled in the Sri Lankan Parliament Situation Report: North and East on 21 October 2011, which sets out what the Rajapaksa junta is doing to the Tamils.

Britain’s only concern is, and has always been the geopolitical, strategic and economic gains, not human rights. It is not widely known that on the eve of transfer of power, the British and the Sri Lanka (Ceylonese) governments signed a “Defence and External Affairs” agreement of serious importance. In exchange for ‘Independence’, Britain would give military assistance to Sri Lanka, and would be permitted to station and have bases for its army, navy and air force in Trincomalee, Colombo and Katunayake.

The situation is no different now except that the international players and their ruthlessness have increased markedly. I refer in particular, to China, which is making Sri Lanka into a Chinese colony.

In the dozen dvds I have recorded and distributed worldwide, I have said that there are two ’wars’ going in Sri Lanka. One between the Sri Lankan (Sinhala) government against the Tamil people to force them to accept Sri Lanka as a Sinhala-Buddhist nation. The other, at a different level, between China, India and the USA for a foothold in Sri Lanka for the control of the Indian Ocean. Instead of China, can be inserted China, Korea, Japan. Instead of India, it is India and Pakistan. Instead of USA, it is USA and UK.

The Tamil political leadership are no less to blame. Had they not joined hands with a blatantly anti-Tamil Sinhalese leadership to present a ‘common front’ to the colonial British, there would have been no Independence. The Tamil political leadership continues to be a problem rather than the solution.

The same goes on today. The longer the Tamil politicians (the Tamil National Alliance) engage in futile non-productive and meaningless talks with the Sri Lankan regime, more will be the damage done to the Tamil people. These endless talks only allow the Sri Lankan regime to claim that it is ‘negotiating’ with the elected representatives of the Tamil people. It is doing nothing of the sort. Nor has it since day one. These are only ‘pretence’ talks to keep the international community, in particular, the ‘aid-givers’, happy.

It is no exaggeration to say that on 4 February, 1948, ‘Independence’ was granted to the Sinhalese to do what they wanted to the Tamils. Britain could not care less, as long as the military bases were secure and the (British) tea estates remained under Sinhalese capitalist control, to supply tea at absurdly low prices to fill the British cup.

The very least that the departing British could have done was to leave a Federal set-up, or even what existed for centuries before their disastrous 1833 Colebrooke-Cameron ‘Reforms’ that unified what was divided, and centralised power in the Sinhala South. However, as has been stressed, the British could not care less about what happened to the minorities under Sinhalese majoritarian rule. They were only concerned about holding on to military bases and a guaranteed supply of tea.

The betrayal of the Tamils by the British cannot be ignored. If it is, then Britain must be reminded of its moral, legal and ethical obligations, to ‘do the right thing’, by the Tamils even belatedly.

Action

As I have said, this is not the time to ‘express regret’ at what has happened to the Tamils in 1948, but a time for positive action.

Tamils, and those of us, non-Tamils, who support the right of the Tamil people to live with equality, dignity, safety, and now to live at all, must draw up an action plan. One thing is certain – to negotiate with the Rajapaksa regime for an acceptable deal for the Tamils is impossible.. Those who believe otherwise, are not living in the real world.

The Tamils are not going to get justice, any more than black South Africans were going to get justice from those who ran the apartheid regime. Justice will have to be extracted from a brutal, barbaric, ruthless, totalitarian regime. It cannot be negotiated, as Neville Chamberlain learnt in dealing with Hitler.

I will set out an ‘Action Plan’. This is not an attempt to reinvent the wheel but to set out what has been done (successfully) in handling other barbaric regimes, such as the one in Apartheid South Africa. When I use this analogy it is pointed out that the situation in South Africa was different, in that a small minority of whites were oppressing a vast number of blacks. I stand by my comparison in the Sri Lankan setting. It is a tiny number of Sinhalese (the ruling Rakapaksa junta) that is oppressing the vast number of Sri Lankans, be they Tamil, Sinhalese or Muslims. So the comparison is perfectly valid.

  1. Isolate the Sri Lankan regime until it delivers an acceptable solution. This is exactly what was done in South Africa.
  2. Organise and conduct a total boycott of all goods and services in and out of Sri Lanka. This must be comprehensive, with no exceptions. Tourism, sport, investment, loans, and support in every area must be targeted. I am not claiming that this will be easy. Any more than it was in dealing with the much more powerful South Africa. In fact it is much simpler since we are dealing with a regime on the verge if bankruptcy which relies on regular bail-outs for survival.
  3. Trade Unions across the world will have to be informed of the brutality that is being unleashed on the Tamil people, and to urge them not to load or off load goods to or from Sri Lanka.
  4. Tourist companies must be approached and urged to take Sri Lanka off the tourist destinations, and that there are other better, cheaper, and even safer, places to spend a holiday, than the blood drenched beaches of Sri Lanka. Every tourist dollar goes to supporting a brutal totalitarian regime that is guilty of horrendous atrocities and a gross violation of basic human rights.
  5. Make it impossible for the members of this regime to visit countries without a massive protest. The British Tamils showed what can be achieved when President Rajapaksa tried to visit Oxford University in November 2010. Not only did the Oxford Union withdraw the invitation, but Rajapaksa and his goons had to flee the country before they were charged. Rajapaksa should only be able to visit China and Russia.
  6. File legal action against the perpetrators of crimes against humanity and take them to the International Criminal Court. Can this be done? Yes it can. Already there are charges filed in the US and in Europe. More must follow. Some of these criminals are now Sri Lankan Ambassadors. They must be sent back as was so successfully done to the Sri Lankan Ambassador to Germany, Switzerland and the Vatican, Jagath Dias, in 2011.
  7. Stop hallucinating that the United Nations or even the UN Human Rights Council will act. They will not, they never have. The UN is a talk-shop, it is and has always been a talk-shop. The UN Secretary General Ban ki-Moon has his own agenda. Justice to the Tamil people is not on his agenda. What is going on in Sri Lanka is our problem. To expect the UN to deal with it is totally unrealistic. It will not happen. Despite the most damning Report by Ban ki-Moon’s Panel of Experts, he has done nothing, and will not do so.
  8. Insist on a Referendum in the Tamil area to see what the Tamil people want. This was done in East Timor. There is no reason why it cannot be done in Sri Lanka.
  9. Target the Plantation Tamils in Sri Lanka. If they down their tools, the Sri Lankan regime will collapse in a month.
  10. Target the Sinhalese people (members of my community) in the South and point out the problems and hazards of living under a totalitarian regime. The guns that were turned on the Tamils, will now be turned on the Sinhalese. That is what Totalitarian regimes do. It is critical to realise that the Tamils in Sri Lanka can achieve nothing without the help of the Sinhalese. Will the Sinhalese act? Yes they will, not because of any love for the Tamil people but for their own survival. As the International Monetary Fund turns the screws, it is the working people who always pay the price. This is already happening to the Sinhalese..
  11. Amnesty International, Human Rights Watch and the International Crisis Group must be supported. They are groups with the necessary ability and experience to take on brutal regimes. They have done it before, and have succeeded. Their unrestricted admission to all parts of Sri Lanka, not just the Tamil areas, must be a non-negotiable demand. Until that is done, the sanctions should go on.
  12. The R2P (Responsibility to Protect) will have to be applied, since the people of Sri Lanka, the Tamils in the North and East in particular, are not being protected by a ruthless government. R2P allows for armed intervention, if necessary. Words must mean something, and if R2P is to have any meaning, it has to be applied. If it is not, it will lose credibility.
  13. Some international power has to take on the Sri Lankan regime. Canada already has. Britain must be forced to, if only because of the betrayal of the Tamil people by the colonial power which I have already set out.


To look at what is going on in Sri Lanka as a fight between the Sinhala government and the Tamil people will have to change. It is a fight between all the people of Sri Lanka (irrespective of ethnicity) and a totalitarian regime whose entire objective is to remain in power and to rob and rape the country, and do as it wants to whoever they want, with no accountability, or a price to pay. Unless this critical concept is transmitted to the Sinhalese people, however difficult this might be in practice, this murderous, corrupt and incompetent regime will go on for the foreseeable future, with appalling damage done, not only to the Tamil, Sinhalese and Muslim people, but to the country as a whole which is fast heading to be a Failed State,

There is a serious lack of leadership, both in Sri Lanka and among the expatriate community. Where the Sinhalese in Sri Lanka are concerned, there have been no leaders. As I have said earlier, Sinhalese politicians have developed the ability to peddle Sinhala-Buddhist jingoism rather than to lead a nation. This has steadily and dramatically got worse. It is not something that is likely to change. Over the years they have produced a large number of politicians but not statesmen. At the moment, the Sinhalese can barely find a politician to lead the Opposition, as a result of which President Rajapaksa and his cronies can do what they want.

Just four days before the 2010 General Election, an editorial in a leading Sri Lankan newspaper, set out the options facing Sri Lankan voters. In one of the most accurate descriptions of the vast majority of Sri Lankan politicians, the editorial was blunt:-

“None of the individual contenders, political parties or opportunistic coalitions are worthy of our respect or our vote. Together they comprise the most mind-boggling array of crooks, thugs, conmen, hypocrites, unprincipled racists, rapists, drug dealers, money launderers, and general all-round scum that is without parallel elsewhere in the world. Other nations have their share of such undesirables, no doubt, but among them are a handful of honest, sincere, principled folk who have distanced themselves from the corrupt majority. Not so in miserable Sri Lanka.”

These are the leaders in Sri Lanka.

The Tamils are no better. Their leadership has been abysmally poor. Their politics have consisted of making fiery speeches in parliament (which no one listens to), followed by a drink at the local watering hole where they socialised with their Sinhalese counterparts. Not surprisingly, the Tamil people have had a raw deal.

The expatriate community are no better. I can speak only of the expatriate Tamil community with whom I have worked for some four decades. There are simply no leaders who are worth talking about, and the situation is becoming worse.

There most certainly is not going to be a Mahatma Gandhi, in Sri Lanka or abroad, to rescue the people from tyranny and injustice.

If there are no leaders, and none that are likely to appear, it is going to be left to us (;us’ meaning the Tamils and those who support their cause), as was the situation in Gadaffi’s Libya and the other countries in the Middle East ‘Spring’. The people will have to rise.

We in the outside world can only assist and support such action. That violence will be unleashed by those in power is a certainty. That is what totalitarian regimes do. They are politically and administratively bankrupt, and have only violence as an answer to all problems.

The ultimate responsibility falls on us – not on the Tamil people in Sri Lanka, who have no voice or power. If we do not act, the blood of the Tamil people will be on our hands – whether we are Tamils, Sinhalese, or non-Sri Lankans. This is not an ‘internal affair’ of Sri Lanka, anymore than Apartheid was an internal affair of South Africa. If we do not act, the Tamil people in the North and East will be extinct, the end of a ‘slow genocide’ from hunger, starvation, lack of medical care and suicide.

The British are to blame for part of this mess, but Sri Lankans have had more than six decades to sort out what they want their country to be. If they want to make it a country run by thugs, crooks and murderers, where only the ruling elite survive and all the rest are ‘disposable’, that is their choice.

I recently lauched a book, Black July ’83: Indictment by I.T. Sampanthan (London). In one of the articles, Professor Kopan Mahadeva wrote “President Mahinda Rajapaksa alone holds the key to lasting peace”. I would have put it differently, “President Rajapaksa and his junta holds the key to Tamil Eelam and have more than justified the absolute need for this”.

As a 10 year old schoolboy, I had just studied the Colebrooke-Cameron ‘Reforms’ introduced by the British in 1933 for their administrative ease. I had no idea what the practical consequences were to the country. I doubt if my history teacher did either. I was about to find out. My parents decided to drive up to Jaffna in 1942, taking me with them. We drove North past Vavuniya, heading for Jaffna.for the first time in our lives..

I was devastated by what I saw.- the sheer underdevelopment and neglect of the area was staggering, in striking contrast to Colombo which I had just left., I told my parents, one of them the first cousin of S.W.R.D.Bandaranaike, that until this area is separated from the Sinhala South, this area will never develop or be allowed to make the obvious contribution that a hardworking people could make to the economy of the country. Now some 70 years later, I am even more convinced that what that 10 year old Sinhalese boy said in 1972 was absolutely correct. As an 80 year old, I am absolutely convinced that until these two nations are separated, and the damage done by the colonial British is reversed, there will neither be peace nor prosperity in Sri Lanka.

Keeping genocide-afflicted Eezham Tamils in sheds and shelters, occupying Sri Lanka plans to build massive ‘tourist’ hotels in Jaffna with Sinhala investment and management, eventually to create Sinhala business enclaves and colonies, news sources in Jaffna said. SL presidential sibling Basil Rajapaksa laid foundation for a 14-storey tourist hotel in the heart of Jaffna city on Friday. Mr. Milinda Moragoda, opposition leader, Colombo municipal council, is said to be closely associated with the investment carried out by a tourism corporate named Jetwing-Yarl. Mr. Moragoda was bracketed with Norwegian development minister Mr. Erik Solheim in luring the LTTE to the peace process in 2001. Meanwhile, Norway conducts a seminar to select participants this weekend, on Norway Tamils contributing to peace, reconciliation and development of Sri Lanka that will be addressed by Mr. Erik Solheim.

From the money Norway spent on the island during the peace process years, Mr. Moragoda’s institution received the single largest monetary assistance meant for any NGO.

Mr. Morogoda attended the foundation-laying ceremony in Jaffna on Friday, along with Basil Rajapaksa and SL prime minister D.M. Jayaratne.

The function was presided over by Mr. Rajan Asirvatham, who once participated in Chandrika Kumaratunga's talks with the LTTE.

Construction of the hotel complex at Clock Tower Road in Jaffna city will be complete within 18 months, speakers at the function said. There was no discussion on whether the 14-storey building is suitable to the limestone terrain of Jaffna and to its fragile groundwater conditions.

Swift economic integration of Jaffna by Sinhala capital and management has been conceived as an alternative to political solution and to complete the structural genocide and annihilation of the identity of the nation of Eezham Tamils. This is carried out with the full blessings of international forces that continue experimenting a vicious paradigm with the national question of Eezham Tamils, while sitting on political and penal justice, political observers in Jaffna said.

The model of bringing in Sinhala capital and management to Jaffna with military protection, while denying Eezham Tamils the political right to conceive their development and investment in their own land and confining whatever capital they have to Colombo under subordinate conditions, will lock even the influential Tamil elite from seeking independence, the political observers said.

Meanwhile, the Sinhala investment on tourist hotels in Jaffna is said to be to cater to the needs of the diaspora Tamils who visit Jaffna.

Similar hotels are also planned in Pa'n'nai in Jaffna city; Nedun-theevu (Delft), Chaaddi, Chi'ruth-theevu and Ma'ndai-theevu in the islands off the Jaffna Peninsula, and in selected locations in Vanni. Lands are taken over in large scale for this purpose and are given to prospective people from the south.

The tourist resort at Nedun-theevu, an island located at a closest distance from Tamil Nadu, India, will be built with Chinese assistance, news sources in Jaffna said.
