Uprooted Maathakal residents file FR petition in SL Supreme Court

Six uprooted residents of Maathakal from the Valikaamam district secretariat division of the Jaffna district have filed a fundamental rights violation petition in the Sri Lankan Supreme Court (SLSC) last week seeking an order that they should be allowed to resettle in their own lands and houses. They have cited the SL Defense Secretary Gotabaya Rajapaksa, Commander of the Sri Lanka Army Lt. Gen. Jagath Jayasuriya, Commander of the Jaffna Security Forces Maj. Gen. Mahinda Hathurusinghe and the Attorney General as respondents.

The petitioners through their counsel Mohan Balendra have stated that they have been uprooted since 1992 as a direct result of the war in the North-East and though the hostilities ended in May 2009, they are unable to return to their properties.

The uprooted Tamils from Maathakal were being prevented from accessing and resettling in their property.

instead, a fence has been erected around a ‘new’ SL High Security Zone in Valikaamam North area and a notice has been put up prohibiting any one from entering the area, the petitioners said in their suit.

They also said in their petition that that there have been no regulation declaring the areas in which their property was situated to be “High Security Zone” and with the lifting of the State of Emergency in August 2011, there were no longer any legal grounds for any area in the island of Sri Lanka to be declared a “High Security Zone”.

The occupying Sri Lankan military in Jaffna has occupied new lands in Maathakal, leaving 279 more families without homes. The latest reports say that the Sri Lankan military is silently evicting people from their homes in areas that are situated outside the former ‘High Security Zone’, civil sources in Valikaamam North said.

While Colombo has declared Thiruvadi-nilai and 200 meters surrounding the coastal spot as a ‘Holy Zone’, the SL Navy has refused entry to people of the area to lands that are situated even beyond the so-called Holy Zone.

Meanwhile, a long coast stretch of land from Maathakal to KKS has been leased out to Malaysia-based corporate of Chinese connections to set up a wind-mill and solar electricity farm.

India is involved in ‘developing’ KKS Harbour and Palaali airport in the SL military ‘High Security Zone’.

The SL military doesn't allow Eezham Tamils to visit Thiruvadi-nilai. Only Sinhala visitors from South are allowed to visit the ‘Holy Zone’, where a Buddhist stupa was put up after the end of war.

In the meantime, Sri Lanka Navy has also occupied lands along the coast, constructing hundreds of houses along the strip for the families of SL Navy sailors. A naval base has also been established, making the area into a military cantonment.

Civilians who used to visit their houses in the areas where land mines were cleared, have been recently threatened by the SL Navy not to enter the area. The SL military has also put up noticeboards warning land mines. The civilians have also complained of witnessing new landmines being planted in their lands.

The latest report of SL military occupying more lands has been reported outside the former HSZ.

The people of Maathakal have been repeatedly protesting against the land grab.

Uprooted Eezham Tamils from Maathakal West in Valikaamam North, who went to check their lands this week, have been chased away from entering the coastal village by the occupying Sinhala Navy, which still regards the area as it's so-called High Security Zone. The uprooted people, who have been periodically inspecting their houses in the border areas of the HSZ, usually escaping the scrutiny of the SL Navy, have now witnessed the SL Navy planting land mines again inside the HSZ where de-mining had been completed earlier. While the uprooted have been continuously staging protests against the genocidal land grab, the entire coastal stretch has been snatched away from the people by the colonial SL military that has fenced the beach for the construction of military cantonment, erecting houses for SL Navy.

Permanent buildings being constructed along the coastal stretch for the occupying SL military forces. Tamil fishermen are barred from fishing in the seas along the coast and the entire stretch is separated by a fence from the land, stealing and sealing off the coast from the people of the Tamil country.

In the meantime, Thiruvadi-nilai, situated in the area, is being showcased as ‘Sacred Zone’ of the Sinhala Buddhists from the South.

At the same time, a 15 km long stretch from this ‘sacred zone’ in the direction of KKS Harbour, consisting private lands, has been illegally ‘leased’ out to a Malaysian corporate of Chinese connections to install windmills and solar panels.

On Monday, when the people of Valikaamam East staged protest at Thellippazhai braving the harassment by Colombo's military, police and its intelligence-operated squads, the uprooted people of Maathakal, went on a protest in front of the office of the SL Government Agent in Jaffna.

Some of the families, who went to see their houses, were forcefully evicted by the SL Navy. The SLN personnel also seized their tools such as mattocks, the civilians from Maathakal West, who have been uprooted from their village since 1992, told TamilNet Thursday.

“We went there after the EPDP told us to go and resettle where de-mining has been completed. But, the Navy has evicted us and has begun mining the area again,” a man in his sixties said.

The SL Navy has also put up placards warning land mines in the area in recent days.

The SLN personnel have camped at the Nu'nasai MV School.

The people, most of whom fishermen deprived of their livelihood for years, have been demanding the SLN to vacate the school and their land, and also demand access to their sea.

The entire coastal stretch along the both sides of the Vanni mainland in the island is being Sinhalicised and now the people in Jaffna are also being deprived of their coast by the genocidal Sinhala military and the establishments that directly and indirectly back Colombo's LLRC blueprint of Tamil genocide, civil society representatives in Jaffna have blamed.
