Geneva resolution answerable to arson committed on Tamil press: Jaffna activist

Burning the press of Eezham Tamils in the island has more than three decades of history. The office and machinery of the Jaffna-based Tamil Daily Eezha Naadu was burnt down the very night the Jaffna Public Library was put to ashes in 1981. Arson was once again committed on Eezha Naadu while the IPKF of the New Delhi Establishment was occupying Jaffna. The Washington-New Delhi deception carried out in the name of Geneva resolution, allowing Sri Lanka to escape from genocide indictment and to continue with structural genocide, is answerable to the current attacks and arson committed on the press of Eezham Tamils in the island, said a new generation political activist in Jaffna.

After 2009, capture, or if capture not possible, attack on the press of Eezham Tamils is systematically carried out in Jaffna and Colombo.

Nowadays, not only the genocidal Establishment in Colombo, but also the abetting Establishments in Washington and New Delhi are actively engaged in capturing the media of Eezham Tamils and in buying journalists inside and outside of the island.

Meanwhile, China has agreed to help significantly upgrade Sri Lankan ‘cyber-warfare’ capabilities, The Indian Express reported last month.

The current series of attack and arson on the press of Eezham Tamils that tries to remain independent follows the ‘reconciliation’ preceptor Washington initiating an empty resolution at Geneva and New Delhi watering it down further.

The OHCHR could find itself ‘occupied’ in cataloguing such attacks, as it was destined by the Geneva resolution for the job of only counting ‘the trees’, the political activist in Jaffna said.

TNA MP cautions on PC elections harped on by Geneva resolution

“We are a distinct Nation with historic records in this soil, proving our evolution [as a Nation]. The Sinhala Nation destroyed us. A nation was destroyed by another nation here. But, the international community has handed us over to those who destroyed us to investigate the crimes against us; we have been handed over to those who fired upon us; to those who fired shells on us; to those who fired phosphorus bombs against us; to those who fired cluster munitions on us. How can you expect justice from this country [of the Sinhala Nation],” asked Tamil National Alliance (TNA) parliamentarian Sivagnanam Sritharan, in a press meet in Jaffna on Wednesday. “Therefore, an intervention by the international community is a must and an urgent one,” failing which the existence of the Tamil nation in the island would be wiped out from the maps of the world, he further said.

The TNA parliamentarian also noted that the resolution passed at Geneva was making reference to conduct Provincial Council elections to the Northern Province.

“We find ourselves in a situation where we have to take part in the PC elections. Since we have already taken part in the PC elections in the East, we can’t denounce the PC elections in the North. If we don’t take part, it would be viewed as a wrong thing. Since the recently passed UNHRC resolution, brought out by the USA for the second time, also mentions the elections to Northern Province, taking part in the PC elections has become a necessity as well as a pressure thrust upon us,” he said.

But, the SL government aims at deploying the All Ceylon Muslim Congress led by SL minister Rishard Badurdeen, the EPDP led by Douglas Devananda, the SLFP [in North] led by Geetanjali or Angkayan, the SLMC, various other factions and the so-called independent groups to contest separately in the Northern PC elections, Sritharan said.

“The SL government has schemed a plan to [divide and conquer]. Unlike in Jaffna peninsula, this would have an impact in Vanni – in Ki’linochchi, Mannaar, Vavuniyaa and Mullaiththeevu,” Mr Sritharan said.

Citing that there are only 3 seats in Ki’linochchi district, the grassroots oriented parliamentarian said that even if the TNA polled 40,000 votes, it will only receive one seat under the proportional representation system as all parties that manage to poll more than 5% votes would have a claim for a seat. The exact number of seats from Ki’linochchi is yet to be announced by the SL Department of Elections.

The SL government is now gifting motorbikes to those former LTTE members who are now brought under the so-called Civil Security Division, where they are given monthly wages of 18,000 rupees each. They are held under the grip of the SL government.

Likewise, there are 67,000 homeless people, 35,000 in Ki’linochchi district and 32,000 in Mullaiththeevu district. Following the resolution passed in Geneva, the SL government is aiming to use these details to obtain further funds from foreign countries as if it is going to help these people and utilize the opportunity to trap the people into its fold till the elections are over.

“This is purely an exercise aimed at the PC elections, the Tamil parliamentarian said adding that the EPDP would also have its arsenal of arms, violence and powers to be deployed for the manipulation of the voting. I don’t need to tell how Rishard Badurdeen would behave under elections, as you are all aware,” Mr Sritharan said. “It is an easy task for these parties to gain 5% voting through manipulations”.

“They will contest the elections separately, but after the elections, the SL government would bring an alliance consisting of them to seize the power of the Provincial Council,” he said adding that similar tactics was used by the SL government in the East.

“We are not prepared to fool our people that this PC system would bring in solutions to our problems. Neither are we prepared to fool our people that a political solution would come through this system. Perhaps, the act of taking part in these elections could set the course for the demise of the TNA. Perhaps, we may get into a situation where we can’t talk anymore about resolving our national question,” he said adding that the TNA has been placed at a situation where it cannot ignore taking part, as those are opposed to the TNA would be filling the seats of the PC. However, he said: “With the backing of our people and using the PC elections, we have to again prove that we are united and remain powerful under the TNA.”

Mr Sritharan also expressed displeasure on the conduct of Ranil Wickramasinghe, who has offered to save the SL State by convening an all-party meeting. Except, Mano Ganeshan, who opposed the proposal, even those whom we go around boasting as ‘progressive forces’ among the Sinhalese wearing red shirts were keeping mum with the UNP, he said.

Coming hard on the SL propaganda being waged by the SL Governor, Major General (retd.) GA Chandrasiri, that the people under the LTTE had no development for 30 years, the TNA parliamentarian said the real development of the people of Vanni was witnessed under the LTTE-run civil administration. This was much more meaningful than what the SL government is bragging as ‘development’ it had brought forward, Sritharan said.

Even, most of the buildings that the SL government has claimed opened for civilians along the A9 road after the war, were in fact buildings that were built by the LTTE for the civilian infrastructure, he said, citing examples and challenging the SL government to disprove his claim.

Sinhala military takes over UN demining following Geneva resolution

One of the immediate results of the US-resolution at Geneva “welcoming and acknowledging the progress” of genocidal Sri Lanka in various avenues, including in demining the country of Tamils, is the UN entirely handing over demining and supervision of demining to the occupying Sinhala military. This will pave way for the genocidal SL military to make money, Sinhalicize even demining and to come out with excuses for years in handing back lands, news sources in Jaffna said. The last international organisation involved in demining the country of Eezham Tamils and has an office in Jaffna, i.e., a UN outfit of Tamil staff that was supervising, monitoring and issuing certificates on demining, will be closed down in June. The work will be handed over to the SL military and its Sinhala staff.

Instead of Sri Lanka receiving the UN agencies, the US resolution has paved way for even the remaining UN agencies, that too involved in demining, to quit and to be replaced by the genocidal Sinhala military, the news sources in Jaffna said, addressing to the ‘lobbyists’ in the diaspora.

The outcome of the US resolution such as this may provide job for the OHCHR to ‘count trees’ for the next year’s session and may provide opportunities of paid tours for diplomats of the West, Australia and Japan to visit the island and give certificates absolving Sri Lanka, but the whole process would only facilitate another irreversible stage in the structural genocide of Eezham Tamils, the news sources said.

The Jaffna news sources made a particular note on the Japanese delegations whose primary aim was ‘patching up’ genocidal Sri Lanka with the West. They unfairly escape the diaspora radar of scrutiny, the news sources said.

The treachery of the UN and agencies like the IOM in the winding up of the IDP camps and the plight of the Keappaa-pulavu people were in the highlight last year, but peruse the net outcome and the statements of the visiting diplomats from the USA, UK, Canada, Australia, India and Japan, the news sources cited.

Unless the ultimate culprit the USA is not addressed against the absurd resolutions it brings out, the genocide of Eezham Tamils could never be stopped, the news sources in Jaffna were telling it as a priority to the activists in the diaspora who see ‘something progressive’ in the US resolution.

The part of the US resolution “Welcoming and acknowledging the progress made by the Government of Sri Lanka in rebuilding infrastructure, demining, resettling the majority of internally displaced persons,” was added in the third draft, perhaps by the prodding of India, but the USA is ultimately responsible for the larger framework and the bandwagon, alternative political activists in Jaffna commented.

Several international agencies were engaged in demining in the country of Eezham Tamils. They all had Tamil staff. All these agencies were winded up in the recent times, replaced by Sri Lanka’s occupying Sinhala military that has taken up the job for itself.

The UN agency is the last of the international agencies that has an office in Jaffna. In the recent months it was engaged only in supervising and monitoring the work and in issuing clearance certificates.

Even this office will be closed in June. The agency will continue for the next six months, until December, at the SL Government Agent’s Office in Jaffna just to handover the work to Sri Lanka’s military.

The local Tamil staff members, who now work with the UN agency, are given with contract only up to December.

The Tamil staff members are now instructed to ‘train’ the occupying Sinhala military or ex-Sinhala military personnel who are recruited to succeed the work of the UN agency.

Most of the Tamil staff has decided to quit the job when the UN leaves, as it would be impossible to work with the succeeding Sinhala military, informed circles told TamilNet.

Already hundreds of Tamil staff members who were earlier working with the other international demining agencies were out of job, as the Sinhala military had taken over the programme.

Demining is a lucrative area to channel international aid to the benefit of the genocidal Sinhala military patronized by criminal Establishments of the world; to give lucrative jobs and to station the Sinhala units in ‘civil’ among the Tamil population, and to manipulate demining to the requirements of the occupying military, alternative Tamil political activists in Vanni told TamilNet.

Demining, denied of authority or participation to the affected people and carried out by the very culprits, is indispensable in shielding the crimes and in passing the blame on the very affected people. Earlier, the staff that found evidence for cluster bombs and revealed that evidence were ‘penalised’ in Ki’linochchi for that ‘crime,’ news sources in Vanni said.

Meanwhile, the occupying Sri Lanka military has already claimed that it would take 10 years to clear the mines in some areas like the High Security Zone, which the military fast converts into Sinhala Military Zone.

The international assessment on the nature and process of demining in the country of Eezham Tamils, appreciation for the genocidal State on the demining and the policy of withdrawing international supervision are fundamentally faulty and scheming, leading to licensing irreversible structural genocide of a people, political activists in Vanni said.

News sources in the North and East of the island, reporting to TamilNet on such issues insist on ‘views’ preceding ‘news,’ challenging the so-called ‘media conventions’.

“Engineering the release of news to time agendas and interpretation of it are only their prerogatives, while the struggling people in the ground should only supply news for their polity – think the masters and their English-speaking followers in the diaspora.”

“Our news is always silenced, manipulated, suppressed and then when needed for their interests, anonymously ‘leaked’ in international reports and media. This is the so-called media convention we experience in practice. That’s why we want our views to be heard first, at least for the attention and edification of our diaspora misled by the forces of imperialism,” commented a veteran journalist in Jaffna.

Tamil National People’s Front rejects Geneva resolution

“The resolution asks that local mechanisms to be put in place in order to carry out the investigations. We find it unacceptable and we reject it completely. […] The second reason why we reject the resolution is that it puts emphasis and a lot of faith in the recommendations of the LLRC report. […] And finally, the third reason, why we distance ourselves from this resolution is, because unlike the first resolution passed in 2012, in this resolution there is a specific mention of the provincial council system. […] Our party’s considered view is that we are not only unable to associate ourselves anywhere close with the resolution, but also that we have come to a difficult decision of rejecting the decision that was passed,” announced Mr Gajendrakumar Ponnambalam, President of the Tamil National People’s Front (TNPF), at The Press Club meet in Jaffna on Friday.



Full text of the announcement of Mr Gajendrakumar Ponnambalam at press meet in Jaffna:

We wish to unreservedly distance ourselves from that resolution for three reasons:

Firstly, the resolution, like the similar resolution passed last year in March 2012, once again asks the government of Sri Lanka to carry out a so-called independent and credible investigation into breaches of international law.

Even, when the resolution that was passed in 2012, our party expressed our utter disappointment on the basis that no internal investigation can be asked for, since the Sri Lankan state military is in fact an accused party and the State in itself thereby stands as an accused party.

Our view is, that to ask an accused party to carry out an investigation itself is a complete breach of the concept of natural justice; and as a result, such a request for a local investigatory process has to be rejected outright.

The resolution asks that local mechanisms to be put in place in order to carry out the investigations. We find it unacceptable and we reject it completely. We reject it more so because over the last one year, there have been several things that have happened that have made it impossible for there to be any semblance of independence with regards to such a local investigatory process.

In particular, the fact is that there is currently a Chief Justice, who has been appointed, who we all know, has been in Geneva and in many other forums defending the Sri Lanka State to its hilt with regards to allegations of grave human rights abuses and grave breaches of international humanitarian law. Such a person now standing as the head as Chief Justice, makes any domestic accountability process a mockery.

The second reason why we reject the resolution is that it puts emphasis and a lot of faith in the recommendations of the LLRC report.

Now, if you look at the circumstances under which the LLRC commission itself functioned, you would recall that credible human rights organizations throughout the world themselves have rejected the idea of the LLRC.

The reasons given were, firstly the people who were appointed to the LLRC commission were people that were noted for partiality towards the incumbent regime; secondly the mandate of the LLRC itself was very problematic; and thirdly, the very nature and the setting and the background the LLRC was to function and the modalities with which it was to function, essentially did not provide any safe environment for a credible process of investigation and for a credible process for the Commission to function in, and as a result the LLRC was actually rejected and boycotted.

Despite the fact that the government asked organizations such as the Amnesty International Human Rights Watch and several political parties to take part, those organizations boycotted the LLRC from the very inception on the basis that it was not a credible process. And, as a result, parties like ourselves also rejected it.

The Tamil people who are the custodians and who are the reservoir of evidence with regards to all the atrocities that were committed did not take part. So, the ultimate product of the LLRC is a fundamentally flawed process through which a very, very, inadequate document that has been produced.

So, in that backdrop, the fact is that when the resolution for the second time around, like last year, this year too, chooses to emphasis and almost revolve around the LLRC recommendations we find it unacceptable, fundamentally flawed, and as a result it must be rejected outright.

And finally, the third reason, why we distance ourselves from this resolution is, because unlike the first resolution passed in 2012, in this resolution there is a specific mention of the provincial council system where the resolution welcomes the government’s announcement that it will hold provincial council elections for the Northern Province.

It is our belief that the 13th Amendment to the constitution of Sri Lanka, which created the provincial council system, is an unacceptable basis for any solution to the Tamil national question.

The fundamental problem with the 13th Amendment being mentioned was brought on the basis that it would be a starting point for a solution in the 80s. It has been rejected outright by the Tamil people for the last 20 odd years.

We see no credible reason for it to be mentioned in a resolution such as this, which essentially talks of reconciliation and accountability.

Reconciliation means very clearly reconciling with regards to the conflict in the first place.

Therefore, for these important reasons, our party’s considered view is that we are not only unable to associate ourselves anywhere close with the resolution, but also that we have come to a difficult decision of rejecting the decision that was passed.
